Herat, Afghanistan SUBJECT: Letter of Concern, Contract Number W5KA4N-12-C-0062, Farah Dorms 1. Heram Engineering and Design has failed to comply with the terms and conditions specified in Contract No W5KA4N-12-C-0062. Please provide the Contracting Officer, MAJ Jose Crespo, a plan to remedy the deficiencies contained in the beow list of Non-Compliance items NLT Tuesday, 1200 local time, 14 Nov 2012. - Site Work: Section 3.1 of SOW 3.1.2 The Contractor shall Grade the site to ensure there is no ponding of surface water. The site shall be sloped to insure all surface water runs away from the site, prior to placing/grading of gravel material. - not started. 3.1.5 The contractor shall provide, install, and compact 5cm (2in) or smaller gravel at 1.5 meters (5 feet) in distance around all facilities once complete. The Contractor shall not place gravel until all construction on site is completed and given permission by the RSCW Engineer COR. - not started. - ECP Improvements: Section 3.2 of SOW - Sliding Gate not installed for Female Barrack compound - " 3.2.2 Contractor shall supply and install welded steel anti‐personnel spikes to the top of the sliding gate. Design shall be similar to Figure 4 with spikes being a minimum of 10cm (4”). Spike strip shall be integral with the gate and not obstruct opening and closing." - no spikes on gates. - Roof Drains: Section 3.4.8 of SOW -"3.4.8.1 The contractor shall provide a 10 cm (4 inch) diameter galvanized steel or schedule 40 PVC down spouts." - appears to be aluminum. - Electrical: Section 3.4.13 of SOW - electrical still not complete - Stoves: Section 3.4.14 of SOW - Stoves have not been provided or installed by the contractor. - " 3.4.14 Stoves. The Contractor shall provide and install wood/coal burning stoves. The Contractor shall run the smoke stacks through the exterior wall and the height of the smoke stack shall exceed the height of the parapet wall by 45cm (18”). The stoves and their installation shall comply with Engineering Specifications – Stoves. Holes for the stove pipes were put in the ceiling in every room, not through the wall as the SOW states. - Fire Extinguisher: Section 3.4.17 of SOW

3.4.17 Fire Extinguisher. The Contractor shall provide and install one (1) A‐B‐C 6 Kilogram fire extinguisher for every 100 SM of floor space in each building. 3.4.17.1 The fire extinguishers shall be installed within three feet (3’) of each corresponding exterior doors and shall not be installed higher than four feet (4’) above the finished foundation. - not installed. - Electrical: Section 3.4.13 of SOW " 3.4.13.3 Contractor shall provide and install an appropriately sized, commercially manufactured main distribution panel (MDP) for calculated building load and a main circuit breaker appropriately sized for calculated building load." - not installed. - Exit Signs: Section 3.4.18 of SOW 3.4.18 Exit Signs. The Contractor shall provide and install one (1) exit sign above each exterior doors. 3.4.18.1 The exit signs shall be wired to dedicated electrical circuits with independent battery backups. The exit signs shall consist of both English and Dari. - not installed. - Electric Hot Water Heater: Section 3.4.19.4 of SOW "3.4.19.4 The Contractor shall provide and install one (1) electric hot water heater to serve both the kitchen and bathroom. The minimum size of the hot water heater shall be 400 liters (100 gallons)." - not installed - Kitchen: Section 3.4.20 of SOW - nothing is installed in the kitchen. - Bathroom: Section 3.4.21 of SOW 3.4.21.1 - Laundry deep sink is not installed. 3.4.21.4 - Washer/Dryer does not exist. - Floodlights: Section 3.5 of SOW - not installed. - Guard Tower: Section 3.6.4 of SOW Per Two Connex Guard Tower Spec: "7. Handrail: The handrail will be 3.8cm (1.5”) diameter steel railing supported by 3.8cm (1.5”) diameter steel rail posts. See drawing for locations." - missing handrail section on top platform. "9. Electrical: According to Specifications PART 11 Electrical."- not started. "13. Sandbags: The contractor shall also furnish and install 2 rows of filled sandbags stacked the entire height of the walls on all four sides for the bottom two CONNEX units."- not started. - 20' Connex Bunker: Section 3.6.3 of SOW - "3.6.3.2 After construction of the bunker, the contractor shall cover the exterior surface of the HESCOs with a 2cm (3/4”) thick layer of concrete plaster." - not complete Per 20ft Connex Bunker Spec: "6. HESCO Container Cover: Mil5B HESCO container will be used on top of the container, as shown in the drawings. Six (6) units will be used to create an enclosed area that the contractor can then fill in with dirt to the same level as the HESCO. The outer walls will be made of two (2) units of Mil 1B HESCO stacked on top of each other. The HESCO will be tied together when stacked using wire. The contractor shall furnish, install, erect, and fill HESCOs as directed in Specification PART 13. Fill material shall be furnished by the Contractor, according to Specification PART 13."

"7. Sand Bag: When container bunkers are placed adjacent to existing perimeter wall, voids between the top of perimeter wall and bunker cover shall be filled with sand bags. The Contractor shall furnish all sandbags and fill material for the sand bags." - refer to drawings in Spec, for bunker coverage. - Water Storage: Section 9 of SOW 3.9.3 - Booster Pump Station - not started 3.9.3.1 - Booster Pump - not started 3.9.4.3 - Roof - not started 3.9.4.4 - Doors and Windows - not started - Generator Power Plant: Section 3.8 of SOW -Reference CJTF-Phoenix Engineering Power Plant designs and specs. "4.2. The Contractor will install an exhaust pipe for each generator. The exhaust pipes will exhaust through the roof. The pipes will exhaust 45 cm above the roof and then turn 90 degrees. The open end of the pipes will face down wind. The contractor will seal the opening around the exhaust pipe and the roof with high heat sealant to ensure that it is a water tight seal. See drawings for more details." - no exhaust pipes. "6. Afghan Generators Sites: The contractor will enclose both the generators and fuel tank with a 240cm (8 ft) high chain link fence. Concertina wire be placed 30 cm high on top of the fence. The fence will be installed 30 cm (12 in) away from the foundation of both the generator and the fuel tank or per the COR’s direction. Fence posts will be buried and encased with concrete 30 cm wide X 30 cm deep (12 in wide x 12 in deep). The fence will have a 120 cm (4 ft) wide gate." - gates not installed on either generator. 2. Your immediate attention is required. Failure to comply and/or submit a plan that is accepted by the contracting officer will result in a “Show Cause” notice to be adminstered and Termination actions will be considered. 3.
