LEWISBERRY BOROUGH COUNCIL MEETING MONDAY, OCTOBER 6, 2014 The meeting was called to order by William Thompson, President, leading in the Pledge of Allegiance to the Flag. MEMBERS PRESENT William Thompson, President; Mark Keener, Vice-President; Andrew Purcell, Mayor; Council Members; Robert Smith, Mary Pelton, Patrick Groft and Daniel Soltis. Also Present: Mackensie Greene, Borough Manager; P. Daniel Altland, Solicitor PUBLIC PRESENT *SEE ATTACHED SIGN IN SHEET* RECOGNITION OF PUBLIC Eric Hawkins, Deputy Chief Fairview Township Fire Department: o Mayor Andrew Purcell inquired of the necessity for the Siren. Deputy Hawkins states that the siren does not need to be on, it was enabled at the request of council. o Inquired of the status on the Borough obtaining the Occupancy Permit for the Fire House. Councilman Robert Smith states there are items that need to be completed before the Permit can be obtained. o The Fire Department will do its best to attend Borough events. Timothy Moyer, Red Land Girls Softball Association states the following: o The Association requests permission to replace the backstops at both fields and some of the fencing. A quote has been obtained from R&S Fence Company. Discussion ensued. Robert SMITH made a motion which was seconded by Mary PEL TON to approve replacement of the backstops and fencing. Motion carried, 6-0. o The Association would also like council to consider entering into a Long Term Lease for the use of the softball fields. Discussion ensued. Decision tabled for further investigation. o Rain coming from higher ground is causing damage to field #2. Discussion ensued. William Thompson will speak with Paul Fisher about the possibility of digging a swale. Jim Hamburger, Family First Health Center states the Health Center is running out of space and are currently looking into a grant for expansion. Mr. Hamburger requests councils input and permission to add 8,000 square feet onto the current borough building along with sixty- two (62) parking spaces. Discussion ensued. Daniel SOLTIS made a motion which was seconded by Robert SMITH to deny the request for expansion, siting the lack of space. Sergeant Rocco, Newberry Police Department stated the following: . o There were Thirty-One (31) calls within the Borough for the month of September 2014. o Councilman Robert Smith inquired of Mr. Rocco the intent of the letter received by the York County Quick Response Team; Sargent Rocco stated he is not a part of the team, however, Newberry Police have two officers that are, then proceeded to inform council the purpose of the team. Resident Maureen Bereznak inquired of the date and time planned for Trick or Treat night for the Borough. Halloween will be held Thursday October 30 th from 6-8pm. 1

LEWISBERRY BOROUGH COUNCIL MEETING

MONDAY, OCTOBER 6, 2014

The meeting was called to order by William Thompson, President, leading in the Pledge ofAllegiance to the Flag.

RECOGNITION OF PUBLIC• Eric Hawkins, Deputy Chief Fairview Township Fire Department:

o Mayor Andrew Purcell inquired of the necessity for the Siren. Deputy Hawkinsstates that the siren does not need to be on, it was enabled at the request of council.

o Inquired of the status on the Borough obtaining the Occupancy Permit for the FireHouse. Councilman Robert Smith states there are items that need to be completedbefore the Permit can be obtained.

SOLICITOR'S REPORTSolicitor Altland stated the following:• Correspondence received from York County Solid Waste Authority requests council accept

and adopt an Amendment to the Agreement between the Borough and the Authority datedMarch 5, 2007 for waste management services. Solicitor Altland outlined the details of theagreement. Discussion ensued. Patrick GROFT made a motion which was seconded byMary PELTON to approve the Amendment to the Agreement. Motion carried, 6-0.

APPROVAL OF MINUTESRobert SMITH made a motion which was seconded by Mary PEL TON to approve theSeptember 2014 Meeting Minutes. Motion carried, 6-0.

APPROVAL OF INVOICES AND RECEIPTSPatrick GROFT made a motion which was seconded by Mark KEENER to approve the GeneralFund, Electric Fund, Road Fund and Building Maintenance account invoices for payment.Motion carried, 6-0.

COMMISSION AND REPORTSZoning: No ReportMayor's Report:• Yard of the Month for September was awarded to Dana and Anthony Catania. Will be

discontinuing the Yard of the Month through the winter months.• Would like Council's approval for contacting the main Post Office for Lewisberry regarding

the inconsistencies in the PO Box rental fee. Discussion ensued. Council approves.• Would like to work on a "Welcome to the Neighborhood" hand out for people moving into

the Borough. Discussion ensued. Manager Greene states she has already started workingon this and will forward what she has to Mayor Purcell.

Road Commission: No ReportElectric Commission:• Councilman William Thompson stated the following:

o PMEA Conference will be held in State College on October 15th if anyone would like toattend.

o Kevin Sorenson has replaced the meter on Torn Hetrick's garage.o The Sub-Meter has been installed at the Fire Station.

Anne E. Sterline Library:• Mary Pelton stated the following:

o The Community Fair/Chili Cook-Off was successful.o There will be a Book, Bake and Soup Sale held on October 18the 8-2 at the Park

Building.o Councilman Patrick Groft inquired if council ever obtained the financial report from

the library. President Thompson stated that the Borough has not.Insurance Commission:• The Insurance payment to Mellon Restorations is being withheld until the Occupancy

Permit is obtained and a few other items are completed.Building and Grounds Commission:

Councilman Robert Smith stated the following:• Park Building:

a Restroom partitions have been painted and reinstalled.a Water Filter changed in all three buildings.a Fuel Oil tank Yz.

• Fire Station:a There are items that still need to be taken care of before we can get our occupancy permit

and release funds.a Revisits the previously discussed issue with the frequency in which the fire siren is going

off. Discussion ensued. Council agrees that the siren can be turned off.a The vent pipe for the heat exchanger needs to be replaced. A quote from Tom Dougherty

for this is around $2,020.00. Discussion ensued. Robert SMITH made a motion whichwas seconded by Daniel SOLTIS to approve the replacement of the vent pipe. Motioncarried, 6-0.

a The #1 fuel oil tank is at Y4& the #2 tank is at % full. Town & County Fuel quoted aprice of $2.849 per gallon as long as the Borough gets at least 300 gallons of fuel.Discussion ensued. Robert SMITH made a motion which was seconded by DanielSOL TIS to approve the purchase of fuel oil for both the Park Building and Fire Station.

• Community Building:a Jim Hamburger of the Health Center is requesting two Fire Drills to be performed a year.a Shirley Knight, Annie E. Sterline Librarian states that the carpet needs to be cleaned.

Discussion ensued. Manager Greene will get quotes for carpet cleaning in the Library,hallway, and RedCap. Robert SMITH made a motion which was seconded by MaryPELTON to approve the carpets to be cleaned the cost not to exceed $400.00. Motioncarried, 6-0.

a Borough employee Terence Yinger will be painting from the front door to the archwayin the Library.

OLD BUSINESS• Manager Greene brought forth the previously discussed inquiry from Donald Keener of

Newberry, requesting permission for York Haven to join Newberry's EmergencyManagement Agency (herein after referred to as "EMA"). Discussion ensued. PatrickGROFT made a motion which was seconded by Robert SMITH to approve York Havenjoining Newberry's EMA, as long as there is no cost incurred to Lewisberry Borough.Motion Carried, 6-0.

• President Thompson brought forth the previously discussed correspondence from YorkCounty Quick Response Team asking for a donation. Discussion ensued. Council will notdonate.

NEW BUSINESS• President Thompson appoints himself, Mark Keener and Daniel Soltis to the Budget

Committee, which will meet on October 22nd at 5:00 pm. Discussion ensued. Councilmembers, Robert Smith, Daniel Soltis, Robert Griffith and Mayor Andrew Purcell will bepart of a committee to discuss the income vs. expenses for the Community Building.

• Manager Greene presents the following for approval; the 2015 Animal Control contractsubmitted by Mary Harris, the 2015 West Shore Recreation Commission Membership, andthe 20 15 York County SPCA Housing Agreement. Discussions ensued.

o Decision regarding the Animal Control Contract has been tabled.o Patrick GROFT made a motion which was seconded by Daniel SOLTIS to approve

continued participation in the 2015 West Shore Recreation Commission Membershipat a cost of$905.00 for the year. Motion carried, 6-0.

oMary PEL TON made a motion which was seconded by Robert SMITH to approvethe 20 15 York County SPCA Housing Agreement, at a cost of $181.00 for the year.Motion carried, 6-0.

• Manager Greene states the following:o Correspondence from York County inquired of the Borough's desire to participate in

a joint bid for various fuel bought in bulk. Discussion ensued. Council declinesparticipation.

o The 2014 Foreign Fire Insurance in the amount of$2,144.68 has been received andwill be distributed to the Fairview Township Fireman's Relief Association.

• Councilman Robert Smith inquired of the status of the resident complaint for the barkingdog. Discussion ensued. Mayor Purcell will call and speak with Peter Schilling ofCommonwealth Code in reference to Ordinance Violations.

• Councilman Patrick Groft inquired of the Financial Statements that the Borough has yet toreceive from the Annie E. Sterline Library. Discussion ensued. Councilwoman MaryPelton will inquire of the financials at the next Library Board Meeting.
