Key PointsWhen people make standard Wills they usually leave

everything to the surviving partner and then to their

children. It may, however, come as a surprise to

know that your children could end up with very little,

or even nothing at all. This may happen if one or

both of the parties need residential care.

•If you have total assets, i.e. your home contents,

money, investments et cetera, in excess of £23,500,

you will have to pay for your care costs.

•If your assets total between £14,500 - £23,500 you

will be required to make a contribution from capital

and income.

As a result, your family home may be lost in order to

fund care costs.

How can I secure or protect my property?

Setting up a Protective Property Will or Property

Trust Will is certainly something to consider. Most

couples have their property in joint names and many

with a survivorship destination. This means that if

one dies the property will automatically pass to the

survivor. Should the survivor have to go into care,

the whole of the property may be sold to pay for care

fees.

Our recommendation

•We recommend evacuating the survivorship

destination so that the property is owned in equal

shares. This means that you each own a one half

share in the property.

•You can then enter into a Will so that on first death

your entire Estate does not pass to the survivor, but

you ensure that the one half share of the property

falls to, say, your children, who would normally be

your end beneficiaries.

•They then agree to hold the property in trust during

the surviving parent’s lifetime, and possibly grant a

life rent agreement confirming the position.

•On the death of the second parent, the remaining

one half share falls to the children. This effectively

“ring fences” one half of the value of the house.

•We recommend acting early. To wait and not take

action until just before a person requires care may be

seen as deprivation of assets.

In summary, this simple arrangement means that a

surviving spouse never owns 100% of the property,

but he or she has a life interest to still live in the

property. The local authority will therefore have

difficulty in seizing the property. Accordingly, at

worst only the one half share of the property would

be means tested. It has already been shown in

England that local authorities are reluctant to put a

charge over a one half share of the property, as it is

very difficult to determine the value.

We take the view that this is very effective way of

protecting if not your property, then your parents’

Hello my name is David Watt, probably best known for my mortgage and overseas purchase advice but over the last few years i have had an ever increasing number of clients and friends who have had just no where else to turn as debt has raised its ugly head and life seems to be not the way it should be.

Those clients and friends range from successful business people where the current financial climate has taken its toll to just Mr or Mrs Smith where credit was too readily available and its now caught up.

Please read on and i hope this can be of some assistance to creating a happy future.

Step 1, Acknowledge your debts.

Even something as simple as reading this article is a positive start to dealing with debt.It means you have admitted that you are struggling and started seeking solutions.You have the right attitude and by taking further steps you can climb out of debt.

Step 2, List your income and expenses.

You need to know exactly where you are so list all debts and total income but please do not work on min payments to credit cards as you are only delaying future problem.

Step 3 ,Maximise your income

You may be eligible for government entitlements such as:

Job seekers allowance,child tax credits,Income support,Incapacity or disablement benefits or maybe something as simple as making sure you are paying the correct tax so check your tax code.

Step 4, Make cutbacks to reduce your expenses

Now comes the hard part.Its time to look at your spending and work out where you can make savings. A few small changes can cut your expenses significantly .Here are some ideas,

Transport, take the train or bus when going into town, saves parking ,fuel and wear and tear to

your vehicle,Take a packed lunch to work, its also much healthier,Cook from scratch rather than ready made meals,Switch household utility suppliers if you spend time putting thought into savings you will be amazed on what you come up with.

Step 5, Prioritise your debts.

Once you know where you are financially its time to prioritise your debts, you may now have realised your fighting a loosing battle so some creditors, mortgage etc must be taken care of first the remainder we to list in order of interest rate charged and pay most to the most expensive.

Step 6, Contact your creditors

By this stage you should have your financial statement and your list of priority and non priority debts with the amounts you intend to pay. Its time to start negotiating with your creditors.

Start by writing a letter to each creditor that says your finding things tough and giving them reasons why this has came about.

Your creditors will normally respond em pathetically and discuss options with you,

Step 7 , Work out your long term strategy

This is the main area i can help with, i can make arrangements to visit you at home, go through all that you have done up to now and if all the above fails then i will explain what government backed schemes that are in place to help,

It could be Debt Arrangement Schemes where interest is frozen, Trust deeds where one simple payment each month for 3 to 5 yrs means debt free or sequestration, all of the above i will write more about in the next Life In publications.

Soya milk 'protects the liver' from dangerous build-up of fat

A team from the University of Illinois found soy protein, may reduce the build-up of harmful fat in the liver.

Scientists in the US compared the livers of lean and obese rats fed a diet containing either milk or soy protein.

No differences were seen in lean animals. But obese rats fed soy showed a 20 per cent reduction in overall levels of fat accumulation in the liver.

Triglycerides, a type of fat known to be harmful to the heart, were reduced by the same level.

This means soya could protect against 'fatty liver disease', a condition linked to obesity that can lead to liver failure.

The well-known phrase, ‘no pain, no gain’ is more true than we ever thought.

Every year we spend millions of pounds trying to save ourselves from feeling pain, be it a throbbing headache or the excruciating agony of acute illnesses such as heart attacks and angina.

But scientists are realising how the dreaded sensation actually plays a crucial role in keeping us alive, by setting off hidden healing processes when we suffer heart attacks, and preventing chronic diseases such as arthritis breaking out.

British scientists have discovered that the intense pain suffered during a heart attack may actually be helping to save people’s lives. Blocking it with powerful drugs may worsen the victim’s chances of survival, according to the investigators at Bristol University.

They have found that during a heart attack, pain signals from cardiac nerves help to attract stem cells from bone marrow to repair damage, and restore blood flow after a clot has starved the heart of

oxygen-carrying blood. The investigations were first done on mice, and then with human patients.

Experts from Purdue University, Indiana, USA have found a compound in red wine that can help control obesity.

The substance, piceatannol, delays the generation of young fat cells and prevents them from growing into mature ones.

It is also thought to protect the body from heart and neurodegenerative diseases, as well as cancer.

The compound blocks insulin’s ability to activate genes that carry out further stages of fat cell formation.

Eating nuts can help stave off obesity, says study

Dieters often dismiss them because of their high fat content, but research suggests that snacking on nuts can help keep you slim.

A study found that those who consumed varieties such as almonds, cashews and pistachios demonstrated a lower body weight, body mass index (BMI) and waist circumference compared to non-consumers.

They were also at lower risk of developing heart disease, type 2 diabetes and metabolic syndrome.

Experts are now recommending a daily intake of 1.5 ounces, or three tablespoons of nuts as part of a healthy diet.

Lead researcher Carol O'Neil, from Louisiana State University, said: 'One of the more interesting findings was the fact that tree nut consumers had lower body weight, as well as lower body mass index (BMI) and waist circumference compared to non-consumers.

Going to the dentist is a chore, and a necessity if we want to keep our own teeth. But there may be more broad-ranging benefits.

Experts are increasingly discovering links between gum disease – which affects half the population – and dozens of other illnesses.

The British Dental Association’s scientific adviser, Professor Damien Walmsley, says: ‘The good news is that most cases of gum disease are treatable and, more importantly, preventable.’

Good oral hygiene – brushing teeth twice a day with fluoride toothpaste, restricting intake of sugary foods and drinks to mealtimes, stopping smoking and visiting the dentist once every two years (or more often if you have problems) – can boost overall health. Regular check ups, clean teeth and a healthy mouth could increase lifespan and lead to early diagnosis, treatment and prevention of a range of diseases from Anaemia, High blood pressure, Heart problems, Lung disease to Diabetes.

Curry spice 'lowers risk of heart attack after surgery'

The curry spice turmeric may help ward off heart attacks in people who have had recent bypass surgery, according to a study.

Curcimins - the yellow pigment in turmeric - is known for having antioxidant and anti-inflammatory properties.

Bypass surgery is performed to improve the blood supply to the heart muscle. However, during the operation the organ can be damaged by prolonged lack of blood flow, increasing the patient's risk of heart attack.

Patients given an extract from turmeric had a 65% lower risk of heart attack than those given a placebo in a study

The results need to be confirmed in further research, said Wanwarang Wongcharoen from Chiang Mai University in Thailand.

Research has suggested inflammation plays an important role in the development of a range of diseases, including heart disease, and curcumins could have an effect on those pathways, said Bharat Aggarwal, who studies the use of curcumins in cancer therapy at the MD Anderson Cancer Center in Houston, Texas.
