    By virtue of all powers in that behalf vested in tiletrustees of time Mount Marshall Public Cemetery, thesaid trustees make time following by-laws:-

    All fees and charges payable to time trustees, asset forth, in Schedule A hereto shall be paid at thetimes amid maimer therein mentioned, unless otherwiseo rderecl.

    The ''superintendent,'' as referred to in theseby-laws menus the person for the time being employedby the trustees as time superimstendemit of the Cemetery,and such person shall, subject to the trustees, havecharge of the general care of time Cenmetery, and super-yision of the erection or placing of monumental work

    All applications for interusent shall be made attile offices of tile trustees in such time as to allow atleast five working hours' notice being givell to thesuperintendent at the Cemetery prior to the time fixedfor burial, otherwise als extra charge shall be made.

    Tile trustees shall cause all graves to be dugand vaults, brick graves, or graves to be re-opeuedas and when required.

    Every coffin shall have upon the lid all approvedmetal plate beariisg the name of the deceased stampedor otherwise iudchbiy inscribed in legible cisaracterstilereon. Assy coffin ilot complying with this by-lawwill not be admitted to or be interrecI lii tile cemetery.

Should the grantee be lIllable to produce the''Grant of Right of Burial'' on making applicationfor a grave to be re-opened, for the purpose of inter-ment, through having lost same the said granteeshall mssakc a- sworn declaration to tills effect, andshall pay tile fee for a copy of such ''Grant of Rightof Burial,'' as prescribed in Selledule A hereto, beforethe interment taices place.

    Every funeral shall enter by the principalentrance, and iso vehicle, except the Ilearse and mourn-issg coaches, shall he permitted to enter tile Cemetery,or stand opposite the entrance gates. Vehicles shallot be allowed to proceed fastç tbag five miles per

    hour within the Cemetery, assd sIsall proceed at and-by such roads as directed by the superintendent orother officer of the trustees from time to time. Anydriver or other person failing or neglecting to observesuds directions may be forthwith expelled from theCemetery. No bicycle shall be ridden witisin theCe isle terv.

    No catacomb shall be allowed.Monumental masons shall not be permitted to

    carry on work within tile Cemetery during other thanthe hours specified for the opening and closing of thegates on week days, Saturday and Sunday excepted,when no work is to be done from noon Saturday tothe opening of gates on the Monday niorning, withoutthe written permission of tile trustees.

    Subject to tile approval of the trustees, eachapplicant for an ''Order for Burial'' shall, withinthree months from date of the application, enclosethe grave mentioned in such application with a kerb-ing of tiles, slate, or stone and shall cause to beplaced thereon a number plate beariug the number ofthe grave or vault. The kerbing enclosing a graveshall Ilave engraved thereon in figures not less thantwo niches in height, the number of tIle grave soenclosed. Every grave, vault, monument, tombstone,kerbisig, or any other erection shall be maintainedand kept 111 thorough repair and proper condition by,and at tile expense of tile grantee. Should thegrantee's residence not be known or he out of theState, the trustees to have power to do the work andkeep an account against the gralstee. No moundsshall be allowed.

    No wooden fence, railing, cross or other woodenerection shall be allowed on or around any grave orvault.

    No trees or shrubs shall be planted on anygrave except such as shall be approved by the superin-ten dent.

    All workmen, whether eulployed by the trusteesor by any other person, shall at all times whilst witlunthe boundaries of the Cemetery, be subject to tilesupervisiois of the superintendent, and silall obey suchdirections as that officer may find it necessary to give;and any workmen committing any breach of theseregulations amid by-laws, or refusing or neglecting tocomply with any directions of the said superintendent,silali be removed from the Cemetery.

    Licenses for grave dressing or decorating maybe issued by the trustees, such licenses to be renewedannually in the month of July.

    Ally person taking part in dressing or attend-ing to any grave shall comply with the followingrnles:(a) No rubbish, soil, sand, or other materialremoved ill dressing a grave shall be placed on anyother grave, and if placed in any adjoining groundshall be removed immediately the work is completed.(b) No sand, soil, or loam silall be taken from anyportion of the Cemetery for the purpose of dressingany grave, except with the permission of tile superin-tendent. (c) The dressing of all graves, and Wileelilsgand carting of any material silall he snl).lect to thesnpervision of the superintendent. (ci) Work in alleases to be carried on witil due dispateil, and onlyduring regulation hours.

    Prior to conducting any interment within theCemetery or making use of tile Cemetery for any pur-pose connected with intermnents every undertaker shallpay to the trustees an annual fee as prescribed inSchedule A hereto and slIall at tile tilne of makingsllCll payment of the fee macic, seceive a''Permit,'' to hold good during good behaviour anduntil the first day of July following, and unless in thepossession of such a ''Permit'' no undertaker shallbe allowed to engage in or carry out any duty or workwithin the Cemetery.

    Tile trustees may decorate graves frons time totime, when desired by the grantee to do so. If thegrantees do not desire the trustees to carry out thiswork, the grantees may either do it themselves oremploy any person licensed by the trustees for thatpurpose.

    No person, except the relatives of the deceased,the trustees, or those licensed by tile trustees, shallbe perinitted to decorate ally grave.

    If for the purpose of re-opening a grave thetrustees find it necessary to remove tue edging tiles,plants, shrubs, etc. from off the grave, the person soordering the re-opening shall pay to the trustees thecharges laid down in Schseclule A hereto.

    Notwithstanding anything contained in theexisting by-laws to tile contrary, permission may begloated to the Defence Department of the Common-wealth to erect headstones on the graves of deceasedsoldiers without payment of any fee.

    Free ground may he granted if it is proved tothe satisfaction of the trustees: (a) That the deceased

    was a returned soldier, anfi that he died as the resultof injuries received in war; and (b) that tile relativesof the deceased are in neeessitous circumstances; pro-vided tilat such grant shall be made subject to thecondition that only the remains of deceased soldiersshall be interred in the grave.

    Any pelsOa violating tile rules of proprietyammd decorum; of coinniitting any nuisance or trespass,or injuring any tree, shs-ub, flower, border, grave omany erection, or ill any way inflinging tilese by-laws,shall be expelled from the Cemetery.

    Any person committing any breach of any by-law or regulation, oi- of any other rules, regulations orby-laws lawfully macic under the authority of any Actrelating to cemeteries, shall for every such offence beliable to a penalty not exceeding five pounds, and inease of a continuing bmeachi a fnmtiier sum not exceed-ing one pound for every day during which such breachcontinues.

    Any person committing a hi-each of any by-lawlii tile Cenictei'y shall in addition to being liable to apenalty undei any by-law be liable to be forthwithremoved from the Cemetery by tile trustees or thesuperintendent or oGiem- employee of tile tmnstees or byany police constable. If such pci-son resists removal,or if and as often as such person so rellloved shall,unless with the consent of the superintendent, againenter tile Ccinetes-y within 24 hours of his removaltherefm-oln, lie shall be liable to a penalty not exceed-ing five pounds.

    The fosegoing by-laws, with tile accompanyingSchedules, were duly framed and presented to a meet-ing of the Board of Trustees of the Mount MarsilallPublic Censetery held at Bencubbin on the 24th dayof Marchi, 1949, and adopted.

    (1) All applications for land within the State made under the provisionsof the Land Act, 1933-1948, shall be lodged, with prescribed deposits, at the Depart-ment of Lands and Surveys, Perth, except however in regard to applications forland within the townsites of Kalgoorlie and Boulder which applications, with pres-cribed deposits, shall be lodged at the office of the Government Land Agent atKalgoorlie.

    SURVEY FEES.

    5. (1) The cost of survey of land shall be payable in accordance with theFirst Schedule to this regulation, provided that in special cases approved by theMinister the cost of survey shall be charged at the actual cost incurred in surveyas certified in writing by the Surveyor General, and shall be payable accordingly.

    (2) In respect of selections under Part V. :-

    Where the cost of survey is charged in accordance with the FirstSchedule hereto and is included in the price of the land or, in thecase of a free homestead farm otherwise required to be paid, thensuch cost of survey, with interest, shall be payable in regard tothe individual type of holding by the particular method set outin the respective schedule to this regulation applicable thereto asreferred to in the following table

    Where in any case the Minister directs under the proviso to sub-regulation (1) of this regulation that the cost of survey to be chargedshall be the actual cost, the latter shall be payable, with interest,by instalments over the period mentioned in the respective scheduleapplicable to the type of holding as referred to in the foregoingtable, but in such instalments as the Minister shall direct.

    (3) (a) Except as hereafter provided no application for land under Part V.of the Land Act, 1933-1948, shall be approved, if such land is not surveyedbefore selection, until the land applied for has been surveyed, classified, and priced.

    After such survey, classification and pricing, and of approval to the appli-cation the applicant will be duly notified.

    The Minister may, in his discretion, approve of applications before surveyin special cases where the delay otherwise through the isolation of the land appliedfor, or other sufilcient reason, would cause hardship or inconvenience to the applicant.

    Where land is applied for under the provisions of Section 47, 49 or 65,and such land is unsurveyed at the time of selection then the applicant shall, unlessotherwise required by the Minister in any particular case, lodge with his applicationin addition to any other prescribed fees, an amount equal to one-quarter of the costof survey and shall pay the balance of the cost of survey, with interest, over thefirst five years of the term of the lease in the manner prescribed in the Third Scheduleto this regulation.

    Whether the land is surveyed or unsurveyed at the time of selection, noapplicant shall be entitled to a refund of any portion of the money he has paidwith his application, should the approval notice have been issued, or the land havebeen surveyed as a result of his application prior to issue of the approval notice.

    (4) Notwithstanding anything in these Regulations to the contrary, the Ministermay in his discretion in any particular case refuse to effect the survey of any landfor an applicant or lessee unless the applicant or lessee shall pay, or agree to pay,as the case may require, the full cost of the survey in such amounts, in such manner,and at such times as the Minister shall in writing direct.

    (5) Where a lease is surrendered or forfeited, the Minister may direct thatthe cost of the survey, or the unpaid balance thereof, shall be paid to the Ministerforthwith by the person in whom the lease was vested at the date of the surrenderor forfeiture.

    (6) Survey fees as set out in the Seventh Schedule hereto shall be payable inrespect of land granted by the Crown whether for an estate in leasehold or freehold,under the provisions of Section 33 of the Land Act, 1933-1948, and such surveyfee shall be payable with the application.

    INTEREST.

    7. The interest payable on value of improvements under Sections 47 (2b)and 75 shall be at the rate of 5 per cent, per annum, and where interest is payableon survey fees under Sections 47 (4b 1) and 51, such interest shall be at the rateof 5 per cent. per annum Provided that this clause shall not apply to land acquiredunder " The Agricultural Lands Purchase Act, 1909," or Part VIII. of " The LandAct, 1933-1948."
