11. Amendment to Rule 635, Appointments from Eligibility Lists, and Rule 804, Industrial Accident or

Industrial Illness Leave. Final Approval recommended, effective August 29, 2016. (Case 11094)

Purpose: Existing law authorizes a school district that has adopted the merit system to fill all

vacancies in the classified service from applicants in the first three ranks of the eligibility list who

are ready and willing to accept the positions except AB2125 (Hall) in 2012 allows exceptions for

school districts with a pupil population over 400,000 for named classes which require specialized

licenses, certifications, knowledge, or ability that cannot reasonably be acquired during the probation

period; or gender. AB 1339 (Santiago), as of September 2, 2016, extends these provisions for all

except for the information technology solution technician classification until December 31, 2020.

Existing law requires an employee receiving leave benefits pursuant to the provisions of Ed Code

45192 to remain within California during periods of injury or illness, unless the governing board

authorizes travel outside the state. The Education Code and the Labor Code each have a special

workers’ compensation-like statutory benefit for certain employees, but only the Education Code

limits out-of-state travel for those employees while they are receiving the benefit. Assembly Bill

915 (Holden) effective January 1, 2016 aligns the laws governing industrial accident or illness leaves

by removing the travel restrictions on an employee receiving these benefits.

Management – Unit J SENIOR FACILITIES PROJECT MANAGER DEFINITION

Manages and coordinates the efforts of District staff and outside contractors and consultants in the planning, design process, fund application, Division of State Architect approval, implementation, construction progress review, and problem solving for school construction, modernization, or maintenance projects.

TYPICAL DUTIES Provides management and direction of architectural and design processes, including defining solutions to the more technically complex issues, to several project teams that: Develop, analyze, and direct school design and construction, or direct work pertaining to the planning, implementation, and project activities with other Facilities Services Division personnel, administrators, community representatives, and other involved participants.

Manage and coordinate Board-approved projects and land acquisition activities and analyze the impact on major maintenance programs, equipment needs, project design, contract solicitation, and project inspection, and coordinate these activities with other District offices including Maintenance and Operations, Asset Management, Project Execution, Real Estate, Office of Environmental Health and Safety, and other related organizational units. Determine which projects require review or approval from the Board of Education, Division of State Architect, Office of Public School Construction, State Allocation Board, California Department of Education, or others. Prepare or coordinate applications for projects and submit project information for review and

approval. Prepare and provide program strategies, project descriptions, definitions, and specifications for contract architects or other contractors and District architectural, engineering, or maintenance personnel. Gather and analyze data to prepare project budgets and maintain responsibility for fiscal Controls, grant and rebate funding mechanisms and cost management. Analyze and evaluate requests for specialized modernization or deferred maintenance projects and develop a master project plan that includes health and safety concerns, the effects of the interruption on the education process, and cost effectiveness. Prepare, review, and evaluate project schedules, scope, and budgets, and determine the action

necessary to resolve problems and staffing. Supervise and participate in the use of data systems, data entry, and development of management reports related to District and Board approved projects, utilizing computerized reporting systems. Make presentations to governmental agencies to clarify and justify project fund requirements. Provide written and oral reports to higher-level administrators regarding project status relating to scope, schedule, and budgets.

Assigns staff and projects, supervises staff activities, and evaluates performance. Plans, directs, reviews, and participates in training for staff and others affected by the services of the organization.

Assists in developing or reviewing personnel management policies and procedures within the organization and assures that personnel programs and transactions conform to regulations and District policies.

May provide constructability review of construction contract documents such as architectural, engineering, utility, and shop drawings and specifications.

May review change orders, requests for clarification, inspection reports, punch lists, non conformance reports, fire alarm systems, permits, establishes scope changes, DSA reviews, and determines any deficiencies in project design or construction.

Performs related duties as assigned. DISTINGUISHING CHARACTERISTICS AMONG RELATED CLASSES

A Senior Facilities Project Manager provides direction and oversees all activities of several assigned Facilities Project Managers, level I and II, and Assistant Project Managers, and assists in the administration of a Branch or Region.

A Facilities Project Manager II directs the activities concerning the study, planning, design, construction and/or modernization of several school facilities; coordinates related land acquisition and implementation with various State, District, and local personnel; and prepares project applications and secures project funds.

Branch or Regional Directors are the administrative heads of large, multi-section organizational units with multiple functions that usually are interrelated.

SUPERVISION

A Senior Facilities Project Manager receives general direction from a higher-level administrator. General supervision is exercised over Facilities Project Managers II, Facilities Project Managers I, and other lower-level technical and clerical personnel.

CLASS QUALIFICATIONS

ENTRANCE QUALIFICATIONS

Education:

Graduation from a recognized college or university with a bachelor’s degree in architecture, engineering, construction management, or a related field. Possession of a valid Certified Construction Manager (CCM) credential issued by the Construction Manager Certification Institute (CMCI) may be substituted for the required education.

Experience:

Six years of experience as a project manager in the planning, design, modernization, and construction of facilities, two of which may be at the level of an assistant project manager or higher. Experience with educational facilities is preferred.

Special Physical Requirement:

Ability to climb ladders, walk on roofs, and move safely in partially completed buildings and crawl spaces

III) As an employee in good standing, the administration is recommending that incumbent J. Cantu (EN 276523) be star-rated at the salary of $147,033.96 in accordance to Personnel Commission Rule 591.

BACKGROUND: The District is currently reviewing certificated positions in an effort to align certificated staffing levels with the State requirement R2 ratio levels. The Human Resources Division has requested the assistance of the Personnel Commission staff in evaluating certificated positions identified by the Division to determine whether or not the duties assigned to the position meet the provisions of Education Code 44065. BASIS OF RECOMMENDATIONS: Staff studied the Temporary Advisor – MST – Confidential (0514) position with the working title, “Director of Student Safety Investigation (SSI)” and found that the duties and responsibilities do not meet the provisions of Education Code 44065. Based on staff’s analysis, the duties assigned to J. Cantu include directing, planning, and coordinating employee misconduct investigations involving violations of District policies; ensuring that the investigations are thorough, timely, and conducted with the highest level of integrity and discretion; directing and overseeing the establishment and effectiveness of policies, guidelines, requirements, and strategies for employee misconduct investigations; analyzing and reviewing all preliminary and final investigative reports, summaries, and statements to ensure compliance with investigative protocols, standards, and guidelines; and directing the department in analyzing cases, establishing timelines, gathering and examining evidence, interviewing witnesses or person(s) of interest, and accurately writing the reports. An external salary survey of public agencies was conducted, but no comparable classifications were found. Therefore, the proposed salary is based on internal alignment. The level of responsibility and scope are evaluated to be similar to that of the Deputy Inspector General, Investigations at $9,844.62 - $12,240.65 per month or $118,135.44 - $146,887.80/year. The scope and responsibility are similar in that both classifications direct and plan investigative functions and activities. Therefore, the salary range of $9,844.62 - $12,240.65 per month or $118,135.44 - $146,887.80/year is appropriate. STATUS OF INCUMBENT: Incumbent J. Cantu (EN 276523) may be appointed to the reclassified position in accordance with the provisions of Education Code 45271 and Personnel Commission Rule 715, Transfer and Change of Location. The conversion of the subject position from certificated service to the classified service will have no effect on the status or seniority of the incumbent in accordance with the provisions of Education Code 45271. The recommended salary for the proposed classification is based on internal alignment with other existing senior management executive classifications that have similar scope and level of responsibility and are responsible for providing executive leadership to multiple divisions. Therefore, the proposed allocation of the class to the salary range of $14,090.29 - $17,403.46/month is appropriate.

EXPLANATION:

Existing law authorizes a school district that has adopted the merit system to fill all vacancies in the classified

service from applicants in the first three ranks of the eligibility list who are ready and willing to accept the positions

except AB2125 (Hall) in 2012 allows exceptions for school districts with a pupil population over 400,000 for named

classes which require specialized licenses, certifications, knowledge, or ability that cannot reasonably be acquired

during the probation period; or gender. AB 1339 (Santiago), as of September 2, 2016, extends these provisions

for all except for the information technology solution technician classification until December 31, 2020.

Existing law requires an employee receiving leave benefits pursuant to the provisions of Ed Code 45192 to remain

within California during periods of injury or illness, unless the governing board authorizes travel outside the state.

The Education Code and the Labor Code each have a special workers’ compensation-like statutory benefit for

certain employees, but only the Education Code limits out-of-state travel for those employees while they are

receiving the benefit. Assembly Bill 915 (Holden) effective January 1, 2016 aligns the laws governing industrial

accident or illness leaves by removing the travel restrictions on an employee receiving these benefits

It is recommended that final approval be given to the amendment of Rules 635 and 804 effective August 29, 2016.

AMENDMENTS:

635 APPOINTMENTS FROM ELIGIBILITY LISTS Education Code 45272 All vacancies in the classified services shall be filled pursuant to this article and the rules of the commission, from applicants on eligibility lists… The commission shall place applicants on the eligibility lists in the order of their relative merit as determined by competitive examinations. The final scores of candidates shall be rounded to the nearest whole percent for all eligibles. All eligibles with the same percentage score will be considered as having the same rank. Appointments shall be made from the eligibles having the first three ranks on the list who are ready and willing to accept the position.

Education Code 45277

Appointments may be made from other than the first three ranks of applicants on the eligibility list when the ability to speak, read, or write a language in addition to English or possession of a valid driver’s license is a requirement of the position to be filled. The recruitment bulletin announcing the examination shall indicate the special requirements which may be necessary for filling one or more of the positions in the class. Where such a position is to be filled, using the authority of this section, the appointment shall be made from among the highest three ranks of applicants on the appropriate eligibility list who meet the special requirements and who are ready and willing to accept the position.

If there are insufficient applicants who meet the special requirements, an employee who meets the

special requirements may receive provisional appointments which may accumulate to a total of 90 working days. Successive provisional appointments of 90 working days or less each may be made in the absence of an appropriate eligibility lists containing applicants who meet the special requirements if the personnel commission finds that the requirements of subdivisions (a) and (b) of Section 45288 have been met. These appointments may continue for the period of the provisional appointment, but may not be additionally extended if certification can later be made from an appropriate eligibility list

Education Code 45277.5

Notwithstanding Section 45277, in a school district with a pupil population over 400,000, the following shall apply:

(a) An appointment may be made from other than the first three ranks of eligible applicants on the eligibility list if one or more of the following are required for successful job performance of a position to be filled: (1) The ability to speak, read, or write a language in addition to English.

(4) A specific gender, if it is a bona fide occupational qualification. (b) The recruitment bulletin announcing the examination shall indicate the special requirements that may be necessary for filling one or more of the positions in the classification. If a position is to be filled using the authority of this section, the appointment shall be made from among the highest three ranks of eligible

candidates on the appropriate eligibility list who meet the special requirements of the position and who are ready and willing to accept the position.

(c) If there are insufficient applicants who meet the special requirements, an employee who meets the

(d) This section applies only to the following classifications: (1) Principal financial analyst. (2) Principal administrative analyst. (3) Senior administrative analyst. (4) Senior administrative assistant. (5) Senior financial analyst. (6) Information technology electronic communications technician. (7) Information technology solution technician. (87) Senior human resources specialist. (98) Any classifications that have been designated as management or confidential.

(e) A school district that makes an appointment pursuant to this section shally study the effectiveness of the selection method, the vacancy rates for each class, and the length of time to hire for each class, and submit a report on its findings to any affected labor union.

(f) This section shall remain in effect only until December 31, 20152020, and as of that date is repealed,

unless a later enacted statute, that is enacted before December 31, 20152020, deletes or extends thate date.

A. Employment of personnel from eligibility and other employment lists is subject to action by the Board of

Education based upon the recommendations of the Superintendent of Schools and the Superintendent's designees. Official offers of employment shall be made by staff of the Personnel Commission’s Classified Employment Transaction Services Branch or other administrative personnel designated by the Personnel Director of the Personnel Commission.

B. An eligible on a list for an executive/administrative, supervisory, or technical class shall be considered "ready and willing" if the eligible is

1. willing and able to appear for an interview within 14 days from the date the availability letter is sent or the availability telephone contact is made, and is 2. willing and able to report for work within one month from the date the eligible is selected for the job. C. Except as provided in Paragraph D, below, an eligible for any other class shall be considered "ready and willing" if the eligible is 1. willing and able, to appear for an interview by the second working day after an availability telephone contact is made. 2. willing and able to appear for an interview by the second working day after an electronic mail or

For certification to vacancies of 79 hours a pay period or less, the Personnel Commission’s Classified

Employment Transaction Services Branch shall make a minimum of two telephone calls at least six hours apart in efforts to contact the eligible in regard to availability. If the eligible cannot be contacted, the person shall be considered unavailable for that vacancy. The eligible must contact the Personnel Commission’s Classified Employment Transaction Services Branch to make themselves available again.

E. An eligible or a person on a reemployment list may refuse two offers of interview or regular appointment within his/her scope of availability. After the third refusal, no additional offer is required. All offers and refusals shall be noted on the eligibility list record. If such a person fails to respond to a communication about certification or appointment, his/her name may be passed over until an acceptable explanation has been received by the Personnel Commission’s Classified Employment Transaction Services Branch. The provisions of this Paragraph apply only to possible regular appointment; refusal of a limited-term assignment shall not affect eligibility for regular appointment. F. When an examination has been administered, the final scores of all candidates shall be rounded to the nearest whole percent. All eligibles with the same percentage score after rounding will be considered as having the same rank. Except as provided in Paragraph G, all eligibles in the highest three ranks, as well as all candidates for transfer and change of location, who have been determined to be available in accordance with Paragraph B or C, shall be certified from the eligibility list. G. When a Division Head, Administrator of Operations, or head of an independent branch determines that

the possession of a valid California Driver License, or when a site administrator or supervisor determines

that the ability to speak, read, or write a language in addition to English; specialized licenses, certifications, knowledge, or ability that cannot reasonably be acquired during the probationary period; and/or specific gender if it a bona fide occupiational qualification, is a requirement of a position, to be filled, as listed in Education Code 45277.5, he/she shall indicate in writing to the offices of the Personnel Commission the specific requirement or requirements desired. If the request is approved after a determination that it complies with all relevant laws, rules, procedures, and policy, or if Commission staff determines that special qualifications are required for successful job performance, the special requirements shall be announced in the appropriate examination bulletin, and the Commission staff shall certify the eligibles within the three highest ranks on the eligibility list and all candidates for transfer and change of location who possess such qualifications and who have been determined to be available in accordance with Paragraph B or C and, when bilingual skill, knowledge, or ability is the requirement, have passed the appropriate test or test part. When there are fewer than three ranks of eligibles who possess the special qualifications, a person who possesses the special qualification may be given a provisional assignment in accordance with Education Code Section 45277.5. The provisional assignment is subject to all rule provisions regarding such assignments.

H. A person who is appointed under the provisions of Paragraph G for bilingual skill need not be retested for language ability in order to qualify for a language differential as provided for in Rule 588. Such differential shall be automatically established, based upon the approved request for selective certification as required in Paragraph G. The language differential may be terminated in accordance with Rule 588. I. When a position previously determined to require the special qualifications becomes vacant, the division

head, Administrator of Operations, or head of an independent branch shall indicate in the request for personnel action whether the special requirement is to be continued, subject to review and approval by Commission staff. If the special requirement is continued, the position shall be filled in accordance with Paragraph G above.

J. If a position being filled by an appointment from an eligibility list is occupied by a provisional employee whose name is not included in the names certified, the continuation of the provisional employee beyond the 15-day period after the eligibility list is established is authorized under the following circumstances: 1. At least one of the eligibles certified is not a District employee. 2. The limitation of 90 working days or 126 working days for provisional assignments provided by the Education Code is observed. 3. The applicable limitation prescribed in Paragraph B or Paragraph C, within which the selected eligible is "ready and willing" to accept the position is observed. 4. The applicable limitations prescribed in the Education Code Section 45288 have been met.

804 INDUSTRIAL ACCIDENT OR INDUSTRIAL ILLNESS LEAVE

Education Code 44043

Any school employee of a school district who is absent because of injury or illness which arose ourt

of and in the course of the person's employment, and for which the person is receiving temporary disability benefits under the worker's compensation laws of this state, shall not be entitled to receive wages or salary from the district which, when added to the temporary disability benefits, will exceed a full day's wages or salary.

During such periods of temporary disability so long as the employee has available for the employee's

use sick leave, vacation, compensating time off or other paid leave of absence, the district shall require that temporary disability checks be endorsed payable to the district. The district shall then cause the employee to receive the person's normal wage or salary less appropriate deductions including but not limited to employee retirement contributions.

When sick leave, vacation, compensating time off or other available paid leave is used in conjunction

with temporary disability benefits derived from worker's compensation, as provided in this section, it shall be reduced only in that amount necessary to provide a full day's wage or salary when added to the temporary disability benefits.

Education Code 44044

Notwithstanding the provisions of Sections 44043, 44984, and 45192, a school district may waive the

requirement that temporary disability checks be endorsed payable the district, and may in lieu thereof, permit the employee to retain his temporary disability check, providing that notice be given to the district that such check has been delivered to the employee. In such cases, the district shall then cause the employee to receive his normal wage or salary less appropriate deductions, including, but not limited to, employee retirement contributions, and an amount equivalent to the face amount of the temporary disability check, which the employee has been permitted to retain. In all cases, employee benefits are to be computed on the basis of the employee's regular wage or salary prior to the deduction of any amounts for temporary disability payments.

Nothing contained herein shall be deemed to in any way diminish those rights and benefits which are

granted to a school employee pursuant to the provisions of Sections 44043, 44984 and 45192.

Education Code 45192

(a) The governing board Governing boards of a school district shall provide by rules and regulations

for industrial accident or illness leaves of absence for employees who are a part of the classified service…

(a)(1) Allowable leave shall not be for less than 60 working days in any one fiscal year for the same accident.

(b)(2) Allowable leave shall not be accumulated from year to year.

(c)(3) Industrial accident or illness leave will commence on the first day of absence.

(d)(4) Payment for wages lost on any day shall not, when added to an award granted the employee

under the workers' compensation laws of this state, exceed the normal wage for the day.

(e)(5) Industrial accident leave will be reduced by one day for each day of authorized absence regardless of a compensation award made under worker's compensation.

(f)(6) When an industrial accident or illness occurs at a time when the full 60 days will overlap into

the next fiscal year, the employee shall be entitled to only that amount remaining at the end of the fiscal year in which the injury or illness occurred, for the same illness or injury.

(c) The industrial accident or illness leave of absence is to be used in lieu of entitlement acquired

under Section 45191. When entitlement to industrial accident or illness leave has been exhausted, entitlement to other sick leave will then be used; but if an employee is receiving workers' compensation the personemployee shall be entitled to use only so much of the person'shis or her accumulated or available sick leave, accumulated compensating time, vacation or other available leave whichthat, when added to the worker's compensation award, provide for a full day's wage or salary.

(d) The governing board of a district may, by rule or regulation, provide for as much additional leave

of absence, paid or unpaid, as it deems appropriate and during this leave the employee may return to the person'shis or her position without suffering any loss of status or benefits. The employee shall be notified, in writing, that available paid leave has been exhausted, and shall be offered an opportunity to request additional unpaid leave.

(e) A Period Periods of leave of absence, paid or unpaid, shall not be considered to be a break in

service of the employee.

(f) During all a paid leave leaves of absence, whether industrial accident leave as provided in this section, sick leave, vacation, compensated time off or other available leave provided by law or the action of a governing board of a district, the employee shall endorse to the district wage loss benefit checks received under the workers' compensation laws of this state. The district, in turn shall issue the employee appropriate warrants for payments of wages or salary and shall deduct normal retirement and other authorized contributions. Reduction of entitlement to leave shall be made only in accordance with this section.

(g) When all available leaves of absence, paid or unpaid, have been exhausted and if the

employee is not medically able to assume the duties of the person's his or her position, the

person employee shall, if not placed in another position, be placed on a reemployment list for a period of 39 months. When available, during the 39-month period, the personemployee shall be employed in a vacant position in the class of the person'semployee’s previous assignment over all other available candidates except for a reemployment list established because of lack of work or lack of funds, in which case the personemployee shall be listed in accordance with appropriate seniority regulations.

(h) The governing board of a district may require that an employee serve or have served

continuously a specified period of time with the district before the benefits provided by this section are made available to the personemployee provided that such this period shall not exceed three years and that all service of anthe employee prior to the effective date of this section shall be credited in determining compliance with the requirement.

Any employee receiving benefits as a result of this section shall, during periods of injury or illness,

remain within the State of California unless the governing board authorizes travel outside the state.

(i) In the absence of rules and regulations adopted by the governing board of a district, pursuant to this section, an employee shall be entitled to industrial accident and or illness leave as provided in this section but without limitation as to the number of days of this leave and without any requirement of a specified period of service.

(j) An employee who has been placed on a reemployment list, as provided hereinin this section,

who has been medically released for return to duty and who fails to accept an appropriate assignment shall be dismissed.

(k) This section shall apply to districts that have adopted the merit system in the same manner and

effect as if it were a part of Article 6 (commencing with Section 45240) of this chapter. A. Leaves resulting from industrial accidents or industrial illnesses shall be granted in accordance with

Education Code Sections 44043 and 45192 and this Rule. B. A regular classified employee who is absent from duty because of an industrial accident or industrial

illness, as defined in the Worker's Compensation Insurance Law, shall be granted paid leave for each accident or illness while receiving temporary disability benefits known as worker's compensation.

1. In order to be eligible for paid leave, a nonregular employee must have completed at least 130 working

days of paid service in any status during each of the three years immediately preceding the beginning of the leave. A day of paid service shall be defined as any day for which pay is received.

2. When a certificated employee is granted an industrial accident/illness leave from the certificated

assignment, paid leave from a classified assignment, if any, shall be granted if the employee is eligible therefor, in accordance with preceding provisions of this Rule.

C. Paid industrial accident/illness leave shall be granted, in accordance with the employee's assignment, from

the first day of absence to and including the last day of absence resulting from each separate industrial

illness or industrial injury. A paid industrial accident/illness leave granted under Paragraph B, above, shall be for not more than 60 working days for regular employees and not more than 60 working days of based on the average of daily hours worked by nonregular employees.

D. Paid industrial accident/illness leave shall be reduced by one day for each day of authorized absence

regardless of the temporary disability allowance made under workers' compensation. Days absent while on paid industrial accident/illness leave shall not be deducted from paid illness leave to which the employee may be entitled pursuant to Rule 808.

E. A retired person employed in accordance with Rule 763 shall be granted a paid industrial accident/illness

leave if the employee qualifies in accordance with Paragraph B.1, above. The paid industrial/illness leave shall extend only to the last day to the employee's current assignment or to 60 working days whichever occurs first.

F. Any classified employee may be granted paid leave because of an injury resulting from an act of violence

that occurred during the choice of the employee’s duty. Determination that the injury was the result of an act of violence shall be made by the employee’s site supervisor.

Paid special physical injury leave shall be granted from the first day of absence for not more than 60 working days, except that:

1. Upon request for additional leave, the Human Resources Division or Personnel Commission may

approve successive 60-day extensions up to a maximum of one year.

2. Approval of a leave beyond one year may be obtained from the Superintendent or his designated representative.

G. If an employee is unable to return to duty after exhausting paid industrial accident/illness leave, the employee, if eligible therefor, shall be placed on illness leave in accordance with Rule 808. Accumulated illness leave will be reduced only in the amount necessary to provide a full day's wages or salary, as indicated in the employee's assignment, when added to compensation without penalties from the Worker's Compensation Insurance Fund. Accumulated half-pay illness leave shall be reduced no more thatn eight hours for any one day or no more than the employee's basic daily assignment.

H. If an employee continues to receive a temporary disability allowance after all paid illness leave has been

exhausted following a paid industrial accident/illness leave, the employee shall receive pay from accrued vacation to the extent necessary to make up the employee's regular salary.

I. After the expiration of all paid leave benefits, the employee shall be notified in writing and, if he/she is a

regular employee, shall be offered the opportunity to request an extension of the leave as an unpaid leave. Vacancies caused by such unpaid leave may be filled by regular appointment. The total time of all leave benefits provided under this Rule, including unpaid accident leave, shall not exceed 36 months for any one industrial accident or industrial illness.

J. Upon return to service from industrial accident/illness leave, a regular employee shall be assigned to a

vacant position in the employee's class. If no vacancy exists, the employee may displace the recently appointed employee in the class with less seniority. If placement cannot be effected, the employee shall be treated as if laid off from the class, in accordance with Rule 740. An employee returning from industrial accident/illness leave shall not have any loss or gain is status or benefits other than that specifically provided in the Education Code and Personnel Commission rules. An employee shall continue to receive seniority credit for all purposes while on such paid or unpaid leave of absence.

K. When all paid or unpaid leave of absence have been exhausted following an industrial accident or

industrial illness, an employee shall be terminated and be placed on the reemployment list for the class from which leave was granted for a period not to exceed 39 months. An employee who fails to accept an appropriate assignment after being medically approved shall be removed from the reemployment list. Appropriate assignment is defined as an assignment to the employee's former class at the time of layoff, in former status and time basis, and in assignment areas in which the employee was available. Employees removed from a reemployment list under this Rule may appeal the removal using the procedure indicated in Rule 600 for appeals of rejection of applicants, candidates, and eligibles except that an appeal of an administrative review decision relating to medical matters shall not be made to the Personnel Commission but shall be to such authorities as the Board of Education may designate.

L. While an employee is on any paid leave resulting from industrial accident or industrial illness, the employee's salary paid by the District shall not, when added to a normal temporary disability allowance award without penalties granted the employee under the State Worker's Compensation Insurance law, exceed the employee's regular salary. A permanent employee's regular salary is computed on the basis of number of hours and days in the employee's basic daily assignment. Regular salary of an employee who is not permanent shall be computed on the basis of the average number of hours worked each pay period in which the employee was in paid status during the preceding 12 months13 pay periods. Long-term differentials, as defined in Rule 500, shall be considered as part of the employee's regular rate for the purpose of this Rule and shall be continued during paid industrial/illness leave. (For determination of whether a particular differential is considered a long-term or a short-term differential, refer to the pertinent rule.)

Final allowances for permanent industrial disability settlements are not subject to remittance to the District.
