The rule 2E ofthe CCS $,eave) Rules, 1972which came into effect from 1.9.2008regulates the grant of Earned Leave forpersons serving in the VacationDepartment. The said rule provides f,cr asfollows:-

(l) (a) A Govemment servant(other than amilitary offrcer) serving in a VacationDepartment shall not be entilled to anyeamed leave in.respect of dutyperformed inany year in which he avails himself of thefull vacation.(b) [n respect of any year in which aGovemment servant avails himself of aportion of the vacation, he shall be entitledto.earned leave in such proportion of 30days, as the number ofdays ofvacation nottaken bears to the full vacation:Provided that no such leave shall beadmissible to a Government servant not inpermanent employ or quasi-permanentemploy in respect of the first year.of hisservice.

{c) Ii in any year, the Government servantdoes not avail himself of any vacation,eamed leave shall be admissible to him inrespect ofthat year under rule 26.

. For the puryose of this rule, the term'year' shall be construed not as

meaning a calendar Year induty is performed but as meaningfwelve months of actual dutY in a

Vacation Department.

A Government servant entitled tovacation shall be considered to have

availed himself of a vacation or aportion of a vacation unless he has

been required by general or special

order of a higher authority to forgo

sueh vacation or Portion of a

vacation:Provided that if he has been

prevented by such order fromenjoying more than fifteen daYs of.the vacation, he shall be consideredrto have availed himself of no

portion of the vacation.

When a Govemment servant servingin a Vacation Department Proceedson leave before comPleting a fullyear of dutY, the eamed leave

admissible to him shall be calculated

not with reference to the vacations

whieh fall during the period of actual

duty rendered before proceeding on

leave but with reference to the

vacation that falls during the year

commencing from the date on whichhe compleled the Previous Year ofduty'As per Rule 29{1) the half PaY leave

aocount of every Governmentservant (other than a military officershall be credited with half pay leave

in advance, in two instalments of ten

I Whether encashment of leaveis allowed after LTC is

availed?

Sanction of leave encashment should, as apractice, be done in advance, at the time ofsanctioning the LTC. However, ex-post-facto sanction of leave encashment on LTCmay be considered by the sanctioningauthority as an exception in deserving cases

within the time limit prescribed forsubmission of claims for LTC.

2. Whether enoashment of leavewith LTC can be availed at thetime when the LTC is availedby the Government servantonly or can leave be encashedat the time when LTC is

availed bv familv rnembers?

Yes. A Govt. servant can be permitted toencash eamed leave upto l0 days eithe.r atthe time of availing LTC for himself orwhen his family avails it provided otherconditions are satisfied.

J, Whether leave encashmentshould be revised onretrospective revision ofpay/D.A7

ln terms of 38-A of CCS(Leave) Rules,encashment of EL alongrvith LTC is to be

caleulated on pay admissibie on the date ofavailing LTC and DA admissible on thatdate. If pay or DA admissible has been

revised with retrospective effec1 going'bythe rule the Govt. servant would be entitledto encashment of Leave on the revised rates.

+. Whether encashment ofEarned Leave and Half PayLeave is admissible toindustrial employees?

The industrial employees, other than thoseunder the cadre control of the Ministry ofRailways, are entitled to encash both EarnedLeave and Half Pay lrave, subject to overalllimit of 300. The cash equivalent of HalfPay Leave shall be equal to leave salaryadmissible for Half Pay Leave plus Dearness

Allowance admissible on the leave salarywithout any reduction being made onaccount of pension and pension equivalentof other retirement benefits payable. But nocommutation of Half Pay kave shall be
