NO HOLDS BARREDBy M. A. SADANAND

‘India Today’ of June 20 had two ugly faces on the coverwhich could have given a good hearted chap like me a dozennightmares had I followed the newly sprung saviours ofIndia - the twin hazards named Ramdev and Anna, theauthor of the men’s style of skip-a-day stubble.

I skipped the entire cover story and had a brush withimmortality when old friend M. F. Husain welcomed mewith a bear hug.

“Hello friend, where have you been?”I liked the reference to the pussy cat rote and told him,

“I have been to London to see the Queen”. We, the ordinary passing clouds over the rain-washed

skies, feel a camaraderie in the unpolluted vacuum of theworld so high, unriven by anything negative. He repeatedthe hug and I felt that some people express their feelingsmore deeply by gestures than words.

I got a shot of pain thinking about this gesture.Jayalalitha’s first cabinet had K. A. Krishnaswamy asLaw Minister. Circumstances so coalesced that I wasappointed Government Pleader from which post, after acouple of years later, a snake in the grass swung its fangsto end the most beautiful period of my professional lifewhen Truth really reigned in my life and the snake did notperhaps like it. You can’t blame the snake for over produc-ing venom, and so Rasputin had the last laugh.

Krishnaswamy could hardly speak on the phone thenext day. One need not be a fictional Perry Mason to fingerthe crook who did it. All of us knew who the viper was.

A few months after the snake-bite, I attended thewedding of a friend’s son when a bear hug enveloped me.Krishnaswamy nearly ckoked me. A hug can dispensejustice while others dispense with justice. He was a goodnon-snake which is why God sent for him to wipe off allvipers from the astral Justice Ministry.

Q & A on Credit Card problems - 2 My credit card outstanding is Rs.1,26,000 and my gross monthly income is Rs.25,000. After meeting myexpenses I do not have enough to make my monthly minimum due payment. What are the implications if I stoppaying the outstandings?

If you default, you will initially be called directly by your lender, or your lender may allocate your account to a collectionagency. These agencies will try to contact you using various communication cha-nnels - telephone calls, letters, email,SMS to remind you to repay the loan outstanding. They may even resort to sending collectors to your home/office totry and collect the dues. After 60 or 90 days of past due, the bank will discontinue your right to use the credit card. Thiswill then be reported to a centralized credit bureau and you will be marked as someone who has delayed repayment. This will, in turn, negatively impact your ability to avail loans in the future. I have not been able to make any repayments on my credit card outstanding on account of being hospi-talizedfor the past 6 months. As part of my severance package I had received a lump sum payment from my last employerand had used this to make a payment on my credit card outstanding. I received a letter from the bank confirmingthat, against a balance of Rs. 2 lakhs outstanding, they had agreed to accept Rs.1.2 lakhs as a negot-iated finalsettlement of all claims. I made the payment and was under the assumption that there was no further paymentdue. I have more recently applied for a housing loan that got rejected. I have been told by the financial institutionthat my CIBIL report is showing me in an adverse status, and that they could not lend to me. Despite making afinal settlement payment, why am I being rejected in the CIBIL report?

Please be aware that whenever you negotiate with your banker for a reduced payment of total dues, or if a collectionagency offers you a lower negotiated final settlement payment, as is your case, this reduction from the original termsof the payment agreement is reported by your banker to CIBIL. This renegotiated repayment will remain on your CIBILreport for 7 years and is likely to impact your ability to avail loans in the future. I feel that my CIBIL report is incorrectly showing that one of my past loans is in write-off status. How can Icorrect an error showing up in my CIBIL report?

The moment you find out that you have a write-off account in your credit report, you must immediately contact yourlender. Your lender will surely help you if you show interest in making the payment and will work with you to rectifythe situation. Get the total amount due on your card calculated with the help of your lender. You may be required topresent the last monthly bill statement received and some other details of your credit card. Your bank will give the exactfigure of amount that you owe them. If you find this to be correct, pay this amou-nt and get a ‘no due’ certificate orpayment receipt from your lender. The process will not be over yet. You will now have to call up your bank again andrequest them to update the credit bureau. Your bank will update the CIBIL reco-rds within a span of 40 days, the writeoff will get cleared, and the account will be shown as a normal closed account.

You can also contact CIBIL directly if your bank does not co-operate in updating the status to CIBIL and tell themabout your settlement by showing the payment receipt. After some clarifications and enquiries from the lender, thecredit bureau will update the same in your report and your report will be clean.
