Jamaluddin is a mechanicalengineer who took to crime tomake easy money.

later parked their car on LodhiKhan Street, near Pondy Ba-zaar.

The Madras High Court di-rected Mahalakshmi CulturalAssociation, T. Nagar on March22 not to allow members orguests to play rummy withstakes and make a profit orgain. The police can take ac-tion if any illegal activity iscarried on in the associationpremises, it said.

A Division Bench compris-ing Justices D. Murugesan andP. P. S. Janarthana Rajapassed the judgment on anappeal by police against asingle judge’s order on Nov. 4last year.

Originally, the Associationfiled a writ petition seeking anorder to forbear the police from

“Do not play rummy for gain”, High Court tells Mahalakshmi Associationinterfering in any manner inthe association’s activities,including playing rummy withor without stakes and also fromharassing its members andguests. As rummy is a game ofskill and not gambling, the as-sociation sought directions inthe writ petition.

The single judge having foundthat rummy is a game of skilland that police could not treatit as an illegal activity, dis-posed of the petition with direc-tions which included that theassociation should not indulgein any illegal activity otherthan playing rummy (13 cards)with stakes by its membersand guests.

Challenging this, the Direc-tor-General of Police and otherpolice authorities filed thepresent appeal.

Modifying the single judge’sorder, the Bench said thatrummy is only a game of skilleven though an element ofchance is also involved. If thegame is played by the mem-bers or guests without stakes,the Chennai City Police Actwill not be attracted.

The Bench said that a find-ing of the Supreme Court thatrummy is a game of skill shouldbe understood in the context itwas rendered in, on the basis ofevidence adduced by prosecu-tion in that case. A reading of

the judgment appeared that inthe event rummy was playedwith stakes the police had theauthority to take action underthe Chennai City Police Acteven though the game involveda skill and in that event, Sec-tion 49 (Saving of games ofskill) could not be pressed intoservice.

Though the provision ex-cluded the provisions of Sec-tions 42 to 48 in the eventrummy which is a game of mereskill was played, nevertheless,the said provision should beunderstood to mean that solong as the game was playedwithout stakes, the penal pro-visions were not applicable.

On the other hand, in thewake of the definition of ‘gam-ing’ in the law, in the eventrummy is played with stakes,it would amount to gambling.In that event Section 49 couldnot be pressed into service.

The Bench said in respect ofthe FIR registered against 56persons and others who weresaid to have indulged in illegalgambling as per a raid in Au-gust 2011, the police could pro-ceed further and it was for theassociation, its members andtheir guests to defend the sameas the criminal action was ini-tiated after a valid raid by thepolice. The police should notdisturb the association fre-

quently under the guise of in-spection without there beingany reliable information re-garding illegal activities of theassociation or its members orguests, the court said. Reportcourtesy The Hindu

ATM booth on Azhagiri Salaiin K. K. Nagar was destroyed ina fire on March 22 but firemenmanaged to retrieve the cashchest containing more then Rs.3 lakhs.

Police suspect a short-cir-cuit in the air-conditioning unitmight have sparked the fire.

Passersby noticed smokecoming from the booth andalerted the Fire Service.

S. Jagadeesh (Station FireOfficer, T. Nagar Fire & Ser-vice Station) said that the callcame at 11.15 a.m but most ofthe interior of the booth hadbeen destroyed by the time theyreached the spot. But firemenmanaged to remove the cashchest. The fire was put out inan hour. He said bank officialswho opened the chest foundthe cash intact.
