    PlaintiffMan-Q Corp. ( Man-Q ), by and through its attorneys, for its complaint against

    Defendant Conair Corp. ( Conair ) alleges as follows:

    N AT U R E O F T H E A C T I O N

    1. This is a patent infringement action arising under the Patent Laws of the United

    States, Title 35, Section 1, et. seq.

    T H E PA R T I E S

    2. PlaintiffMan-Q is a Taiwanese corporation having its principal place of business

    at 7/F, No. 17, Siping St., Chungshan Dist., Taipei City, Taiwan.

    3. Man-Q was founded by Mr. Kai-Mou Tsai, a prolific innovator and manufacturer

    of hair care products and accessories who is the named inventor of over 50 patents granted by the

    United States Patent and Trademark Office ( USPTO ). Man-Q is the assignee of a number of

    U.S. patents invented by Mr. Tsai as well as Mr. Shih-Ling Hsu, a fellow Taiwanese inventor in

    the hair care product and accessory industry.

    4. Upon information and belief, Defendant Conair is a corporation organized and

    existing under the laws of Delaware, with its principal place of business located at 1 Cummings

    Point Road, Stamford, CT 06902.

    5. Upon information and belief, Conair sells hair accessories under its own name

    and as Scunci,®a division of the Conair Corporation,with sales in the United States, includingin

    th is district .

    J U R I S D I C T I O N A N D V E N U E

    6. This is a patent infringement action arising under the Patent Laws of the United

    States, Title 35, Section 1, et. seq. This court has subject matterjurisdiction under 28 U.S.C. §§

    1331,1332, and 1338(a).

    7. Venue is proper under 28 U.S.C. § 1391(b), 35 U.S.C. § 293, and/or Va. Code

    Ann. § 8.01-328.1.

    8. Venue is proper in this District under 28 U.S.C. § 1391(b) because Defendant

    Conair maintains substantial, continuous and systematic contacts within the Commonwealth of

    Virginia. Conair thus has purposefully availed itself of the privilege of conducting activities in

    this judicial district and division, thereby invoking the benefits and protections of the laws of the

    Commonwealth of Virginia.

    9. Defendant Conair, directly or through intermediaries (including distributors,

    retailers, subsidiaries, affiliates, agents, and others) ships, distributes, offers for sale, sells, and/or

    advertises its products relating to hair accessories in the United States, the State of Virginia, and

    the Eastern District of Virginia. On information and belief, Conair has committed acts of patent

    infringement in Virginia including offering for sale and/or selling infringing hair accessory

    products in Virginia and the Eastern District of Virginia. Conair's products have been sold and

    used in Virginia and the Eastern District of Virginia, and on information and belief, continue to

    be purchased and used by consumers in Virginia and the Eastern District of Virginia. In

    addition, Conair operates a retail website at http://www.conair-store.com where it advertises,

    offers to sell, and sells various Conair products directly to consumers, including those located in

    the Eastern District of Virginia.

    10. Pursuant to 35 U.S.C. § 293, the Eastern District of Virginia has jurisdiction of a

    nonresident patentee such as Man-Q, regarding its U.S. patents or rights thereunder.

    B A C K G R O U N D

    T h e P a t e n t s

    11. U.S. Design Patent No. D391,020 (the '020 patent ), titled Hair Clip, was duly

    issued by the United States Patent and Trademark Office ( USPTO ) on February 17, 1998. Mr.

    Tsai is the sole inventor listed on the face of the '020 patent. Mr. Tsai assigned his rights in the

    '020 patent to Man-Q. Man-Q is the legal owner of the '020 patent and has the entire right, title

    and interest in and to the '020 patent. A true and correct copy of the '020 patent is attached as

    Exhib i t 1.

    12. U.S. Design Patent No. D404,524 (the '524 patent ), titled Hair Clasp, was

    duly issued by the USPTO on January 19,1999. Mr. Tsai is the sole inventor listed on the face

    of the '524 patent. Mr. Tsai assigned his rights in the '524 patent to Man-Q. Man-Q is the legal

    owner of the '524 patent and has the entire right, title and interest in and to the '524 patent. A

    true and correct copy of the '524 patent is attached as Exhibit 2.

    13. U.S. Design Patent No. D627,509 (the '509 patent ), titled Hair Raiser, was

    duly issued by the USPTO on November 16, 2010. Mr. Tsai is the sole inventor listed on the

    face of the '509 patent. Mr. Tsai assigned his rights in the '509 patent to Man-Q. Man-Q is the

    18. On information and belief, during the term of the '524 patent, Conair and its

    Scunci division manufactured, marketed, or sold in the United States, or imported into the United

    States, hair clasps that fall within the scope of the '524 patent, including those made of metal

    wi th a chain- l ink adornmen t .

    19. On information and belief, Conair and its Scunci division manufacture, market, or

    sell in the United States, or import into the United States, hair raisers that fall within the scope of

    the '509 patent, including at least hair raisers having product numbers 20034-W and 55768-P.

    20. On information and belief, Conair and its Scunci division manufacture, market, or

    sell in the United States, or import into the United States, hair retainers that fall within the scope

    of the '296 patent, including at least hair retainers having the product number 39046-A.

    21. On information and belief, Conair and its Scunci division manufacture, market, or

    sell in the United States, or import into the United States, hair bands that fall within the scope of

    the '815 patent, including at least hair bands having product numbers 39202-A, 39445-A, and

    39642-A.

    22. On information and belief, Conair and its Scunci division manufacture, market, or

    sell in the United States, or import into the United States, hair ornaments that fall within the

    scope of the '982 patent, including at least hair ornaments having the product number 38277-A.

    23. On information and belief, the acts of infringement by Defendant Conair and its

    continue to do so unless and until enjoined.

    39. On information and belief, the acts of infringement by Defendant Conair have

    been intentional and willful, making this case exceptional and entitling Man-Q to increased

    damages and other reliefpursuant to 35 U.S.C. §§ 284 and 285.

    infringed and continue to infringe the '982 patent by manufacturing, marketing, and selling in the

    United States, or importing into the United States one or more of the hair ornaments identified in

    this Complaint, which are covered by the '815 design patent.

    46. Defendant Conair's acts of infringement have caused damage to Man-Q and will

    continue to do so unless and until enjoined.

    47. On information and belief, the acts of infringement by Defendant Conair have

    been intentional and willful, making this case exceptional and entitling Man-Q to increased

    damages and other reliefpursuant to 35 U.S.C. §§ 284 and 285.

    E X C E P T I O N A L C A S E

    48. This case is exceptional within the meaning of 35 U.S.C. § 285. PlaintiffMan-Q

    is entitled to an award of its attorneys' fees in connection herewith.

    WHEREFORE, Plaintiff Man-Q prays for a judgment against Defendant Conair, as

    follows:

    a. A judgment that Defendant Conair has infringed the '020, '524,'509, '296, '815,

    and '982 patents, and that such infringement was willful;

    b. An award of damages to Plaintiffagainst Conair for infringement of the '020,

    '524, '509, '296, '815, and '982 patents under 35 U.S.C. § 284 and/or § 289;

    c. In the event Plaintiffelects to recover damages under 35 U.S.C. § 284, an increase

    of the sums awarded to Plaintiff to three times actual damages, according to 35 U.S.C. § 284;

    d. That Conair, its officers, agents, and employees be permanently enjoined from

    infringing the '509, '296, '815, and '982 patents;

    e. A declaration that Plaint iffMan-Q's case against Conair is an exceptional case

    pursuant to 35 U.S.C. § 285 and therefore subject to attorneys' fees;

    f An award of costs and attorneys' fees to Man-Q; and

    g. Such other relief as the Court deems just and reasonable.

    (57) A B S T R A C T

    A hair ornament includes a body having an engagement section to be in contact with hair of a user. The engagementsection includes a row of plates arranged along a lengthdirection of tlie body. Two of the row of plates adjacent tocach other arcconncctcd by a conncctingmember having firstand second ends.The first end of each connecting member ispivotablyconnectedto oneof twoadjacentplates.The secondend of each connecting member is pivotably connected to theother of the two adjacent plates. A spacing between twoadjacent plates is adjustable by pivoting the two adjacentplates to adjust an overall length of the body in the lengthdirection of the body.

    1. Field o f th e Invention

    The present invention relates to a hair ornament and, moreparticularly, to a hair ornament that has an adjustable contacta r ea w i th t h e h a i r o f th e user.

    2. Description of the Related ArtConventional hair ornaments iiave various types and have

    an engagement section for contact with the hair of the user.The engagement section generally includes a couple of platesthat can be in contact with tlie hair by extending tliroughorclamping the hair,allowing the hair ornament tobe positionedo n th e hair.

    FIG. 14 shows a conventional hair ornament including abody 1' having two symmetric clamping portions 11' eachhavingan engagement section 111' at a lowerend thereof.Theengagement section 111' includes a plurality of teeth or plates112' at a bottom end thereof. 'ITieclamping portions 11' arepivoted together.A spring 12' is attached between the clamp

    ingportions11' to bias theclamping portions11'to a positionclamping thehair.The plates 12' areextended through thehairto prevent the body 1' from falling from thehair. However,anoverall width A of theengagement sections 111' of theclampingportions 11'and theextendingarea of theplates 112' in thehairare fixed. Namely,the hair ornamentcan notbe adjustedaccording to differing head sizes and differing hair amountso f d i f l e ren t use r s.

    Thus, a need exists foran adjustable hair ornament that canbe adjusted accordmg to differing head sizes and differinghair amounts o f di ffe ren t use r s .

    BRIEF S U MM A RY O F T H E INVENTION

    The present invention solves this need and other problemsin the field of adjustable hair ornaments by providing, in apreferred form, a hair ornament including a body having anengagement section adapted to be in contact with hair of auser. The engagement section includes a row of platesarranged along a length direction of thebody.Two of the rowof platesadjacent toeach other are connected by a connectingmember having first and second ends. The first end of eachconnecting member is pivotably connected to one of twoadjaccnt plates. Tlic sccond end of each connccting memberis pivotably connected to theother of thetwo adjacent plates.A spacing between two adjacent plates is adjustable by pivoting thetwo adjacent plates to adjust an overall length of thebody in the length direction of tlie body.

    In a preferred form, the body includes first and secondclamping portions that are pivoted together. An elastic element is mounted between the first and second clamping portions. Each of the firstand second clamping portions includesa pressing portion on an end thereof. Each of the first andsecond clamping portions includes the engagement section.Each plate includes firstand second pivotal portions. The firstand second ends of each connecting member include thirdand fourth pivotal portions.The first and second pivotal portions are one of a pin and a hole. The third and fourth pivotalportions are theother of the pin and the hole. The third pivotalportionofcachconnccting memberispivotablycngag^withthe first pivotal portion of one of two adjacent plates. Tliefourthpivotalportion of eachconnecting member ispivotablyengaged with the second pivotal portion of the other of thetwo adjacent plates. Th e pressing portions are provided atcenters of tlie first and second clamping portions. An extension extends from each of two opposite sides of each of tlie

    first and second pressing portions. Each extension includes aguide slot extending in the length direction and slideablyreceiving one of the first and second pivotal portions of atleast one of the plates.

    ond clamping portions pivoted together at first ends thereof.Each of the first and second clamping portions includes anengaging portion ona second endthereof. Each of thefirstandsecond clamping portions ftirther includes the engagement

The engaging portions are releasably engaged witheach other such that the engagement section of each of thefirstandsecond clamping portions clamps thehair of the user.

    15 Each plate includes firstand sccond pivotal portions. The firstand second ends of each connecting member include thirdand fourth pivotal portions. The first and second pivotal portions are one of a pin and a hole. The third and fourth pivotalportionsare the other of thepin and the hole. The thu-dpivotal

    20 portion of each connecting member ispivotably engaged withtlie first pivotal portion of one of two adjacent plates. Tlie

    fourthpivotalportion of eachconnccting member ispivotablyengaged with the second pivotal portion of the other of thetwo adjacent plates. The first end of each of the first and

    25 second clamping portions includes first and second extensions spaced in a direction perpendicularto the length direction. Each engaging portion includes third and fourth extensions spaced in the direction perpendicular to the lengthdirection. The engagement section of the first clamping por-

    In a further preferred form, the body includes first andsccond gripping portions. The engagement scction is intermediate the first and second gripping portions. Each of the

The first and second pivotal portionsare one of a pin and a hole. The third and fourth pivotalportions are theother of thepin and thehole. The thirdpivotal

    45 portion of cach connccting member ispivotably engaged withthe first pivotal portion of one of two adjacent plates. Thefourthpivotalportion of eachconnecting member ispivotablyengaged with the second pivotal portion of the other of thetwo adjacent plates. Each of the first and second gripping

Each of thefirstand second extensions includes a guide slot extending inthe length direction and slideably receiving one of the firstand second pivotal portions of at least one of the plates.

ITie second clamping plate includes firstandsecond ends. The firstend of the secondclamping plate ispivotably connccted to the first clamping plate. Each of tlicfirstandsecondends of thesecond clampingplate includesanextension having a guide slot. Each guide slot extends in thelength direction and slideably receives one of the first andsecond pivotal portions of at least one of the plates.

    extended position (FIG. 11) can be increased by the extensions 45and 46. The hair ornament can easily beextended orcollapsedto a desiredextentaccordingto dilTering headsizesand differing hair amounts of different users. Itcan be appreciated that th e hai romament o f th e fourth embodiment in th ecollapsed state can be utilized as a comb.
