That said, the economic turmoil and resultant financial hardship has forced hundreds to abandon Marbella, countless more, again for financial reasons are desperate sell. The property crisis has created a unique opportunity. Real estate assets can be acquired for exceptionally low prices, and activity in the market shows that a number of shrewd investors have already realised that there are significant profits are to be made. The latest boost that Marbella received was the announcement of the finalisation of the multi million Euro Port Al Thani project, to

The development is part funded by a massive €400M investment by Qatari Royal family member, Sheikh Abdullah Bin Nassar Al Thani, who in June 2010 reportedly purchased the football club Malaga CF for €36M. Over the next 4 years and will completely transform the approach to Marbella, generating and attracting significant income in the town.

Marbella Property Auctions The auctions are held every month in Marbella. There are a variety of reasons why a property ends up at these auctions, for example embargoes for unpaid taxes or other unpaid debts, and all arrive at auction as the creditors follow the legal process to recover monies. The vast majority of properties arrive at auction as a result of defaulted mortgage loans and the auction is part of the procedure for the lender to recover the debt prior to forced repossession, i.e. bank foreclosure. Properties often sell at these auctions for less than 50% of the current market value; however the auctions operate behind closed

doors, with the most outstanding deals normally being acquired by a select group of ‘connected’ individuals and their associates. The Club has formal direct representation at every auction and can therefore able offer its member’s access to the 80 -100 property deals that pass through the property court auctions each month. The objective of the Club, in regard to these auctions, is to establish a long term and mutually beneficial working relationship with select private individuals and a small group of investors, or investment fund, to benefit and profit from the opportunity that the auctions present due to tremendous discount on market value.

Court auction properties can only be bought with cash, and are only available to purchase in a short window. Past auction properties are made available in the member’s area of our website, demonstrating the fantastic opportunities that exist. We also provide our members who are ready to buy with up to date schedules of properties due at auction. The property auctions are conducted in court, and presided over by a Judge appointed by the Marbella Judiciary. The actual properties due at auction are published in the auction rooms usually just a week or so prior to the auction. This doesn’t leave a lot of time for someone planning to buy, so when an auction list is confirmed the buyer needs to be ready and able to purchase immediately.

Property & Bidding Our team of experts carry out due diligence includes full check of deeds and title, analysis of the encumbrance in relation to last sale / purchase price as well as previous and current market valuations and recent sale price of comparables. Whilst in many cases it may not be possible to inspect the property internally, in most cases an external inspection will be carried out and a view of the interior gained. Being able to view from the outside or through a window isn’t sufficient for us to categorically state the condition of the inside. We therefore build into our evaluation and assessment, an expectation that every property will require some work, whether that is straight forward redecoration or more extensive refurbishment. In each case our assessment will be reflected in the amount we recommend as a prepared bid.

Whilst we will make recommendations regarding bidding, we do not act in any capacity as property investment advisers. We provide our member with all the information and consultation required, to make an educated decision on the final amount of maximum bid. Our recommendations for private purchasers and investors may vary, as someone wishing to purchase for personal has more leeway to bid higher than an investor purchasing to resell for a profit.

‘The List’ As auction lists are revealed at short notice, we track properties direct from the banks and non-publicised court information. This way we become aware of properties that are due at auction, as much as 6 months in advance and can therefore give our members an advantage and more time to plan and make decisions. Although the fact remains, the buyer must always expect to have no more than 2 week’s notice of the date of the auction of the property that they intend to buy. Our foreclosure specialists have been tracking Marbella auction property in this way for the last two years, and have recorded every

auction property since August 2009. This gives us a wealth of information and we therefore have an exceptional insight, knowledge and understanding of this unique purchase method.

As and when we receive new information, usually on a weekly basis, we compile a shortlist of exceptional opportunities, having analysed the full list of all available auction properties. Our team of real estate experts, financial consultants and legal advisers carry out research and due diligence in order to make sure only the best purchase opportunities make ‘The List’. ‘The List’ provides full ‘land registry’ details of each property and any additional information that our research team have been able to obtain. It gives a guide price for each property, which is typically 50% of the last valuation and also details the amount of funds (deposit) that must be lodged in the courts bank account for each respective auction property. This amount is 30% of the given guide price of the auction property.

Marbella Property Club members can view the most up to date lists in the members area of the Marbella Property Club website Non members can view an example list compiled from properties from past auctions. This list also states the actual auction sale price where known. Successful bidders have approximately one week to complete the purchase. If the bid is not successful the deposit payment is refunded immediately. We do not handle this money; it is deposited directly into a designated court controlled account set up specifically for purpose This whole process is taken care of by the lawyers acting on behalf of the buyer. The purchaser can use our lawyers, use an alternative firm recommended by us, or have legal representation of their own choice.

Purchase Fee When a member enlists our services to buy an auction property, we require a €1000 commitment fee & proof of funds. This fee is offset against the purchase fee. The fee is applicable for a successful purchase at auction and is a fixed fee plus a percentage of the purchase price. Note: Some third parties may charge their own fees – we have no control over any fees levied by introducers who use our services.

The fee does not include the legal fees to complete the transaction, the government transfer tax of 8%, the land registry notary fees or legal and conveyance costs. We can recommend a lawyer or you may appoint your own lawyer. When you instruct us to bid on your behalf, we require a purchase fee deposit of the fixed fee; this is fully refundable in the event that your bid is unsuccessful.

The commitment fee can only be deducted from the purchase fee and is therefore non-refundable.

Auctions are not for everyone, the majority of buyers need to see, touch, and experience what they are buying. Investors, who are familiar with the dynamics of the real estate market, will understand that, as long as the right property, is acquired at the right price, they will be able to turn in a profit, even if it does require, redecoration, renovation or complete reform. Our experience and the research that we carry out, means we have a good understanding of the prices of property in given areas and can therefore determine a maximum bid recommendation that will allow sufficient margin to fit a resale strategy. Typically the properties that we present to our investor members can be acquired for between 30 and 50% of their current market value, ample margin to cover purchase costs and carry out works to add value to the property and turn it into a product that can be sold at a market price discount to the ‘touchy feely’ buyer. We seek properties which in the current market can expect to resell within 1 year, although in some highly sought after locations this timescale can be significantly lower. Such sought after hotspots

have a constant demand for properties from the mid price brackets upwards. Places like The Golden Mile, areas to the east of Marbella, beachside, golf locations and those with sea views always sell before similar properties that don’t have these features. As we will share in the profit from the resale we have a vested interest in achieving resale, and we have an advantage in the market in that we are able to offer your resale auction properties below the current market asking price. We only market, promote and sell our clients and members property and we do this via an extensive network of professionals, which includes 1000’s of IFA’s, private clients and real estate agencies in various locations though out Spain, and worldwide.
