MARION COUNTY COMMISSION COUNTY COURT JANUARY 9, 2013 The Marion County Commission sat in regular session pursuant to its adjournment on Wednesday, December 19 th , 2012. Present were Commissioner Elliott, Commissioner VanGilder and President Tennant. The proceedings of Wednesday, December 19 th , 2012, together with those had and done under the supervision of Janice Cosco, Clerk and Recorder for the Marion County Commission on December 20 th , 21 st , 26 th , 27 th , 28 th , 2012 and January 2 nd , 3 rd , 4 th , 7 th and 8 th , 2013 were approved as submitted and signed. D. D. Meighen led the Court with a prayer. Tony Michalski, Director of MCPARC led the Court with the Pledge of Allegiance. President Tennant called the meeting to order. Commissioner Elliott moved to dispense with the reading of the minutes of Wednesday, December 19 th, 2012 and accept them as presented. Commissioner VanGilder seconded. President Tennant concurred. The Commission presented the Election of the President and President Pro Tem of the Marion County Commission for 2013. Commissioner Tennant moved that Randy Elliott be appointed President of the Marion County Commission. Commissioner VanGilder seconded. President Randy Elliott concurred. President Elliott moved that Butch Tennant be appointed President Pro Tempore. Commissioner VanGilder seconded. President Pro Tempore Tennant concurred. President Elliott thanked Butch Tennant for all of his service to the County as President of the Commission these past two years. President Elliott made the following comments: that he is honored to serve once again as the President of the Commission and thanked both Commissioners for their confidence in him to serve as President of the Commission. He continued that when you hold a position of authority you must have a vision for the future. He added that some of his major goals for the upcoming year are to add to Marion County’s financial strength through contribution to our Stabilization Fund. President Elliott stated that the primary role of the Commission in to be fiscally responsible to the Citizens of Marion County in managing the County’s Budget. President Elliott stated that the second major goal is economic development for the County. He added that through the Marion County Development Authority and its new Economic Director Charlie Reese there are currently eighteen loans out at this time. President Elliott added that we will continue to aggressively seek opportunities for economic development on the I-79 Corridor, which we are the center piece of that table. Thirdly, He continued to secure the Courthouse and the J. Harper Meredith Building and that we will continue to monitor all the measures put in place for the protection of our employees and the citizens of Marion County. He also added that we now have five full time deputy sheriffs on patrol within the buildings. He continued that we are willing to add any additional measures that are necessary.

PAGE 2 President Elliott continued that our most important asset we have in the County are our employees and that we have provided funding to our Elected Officials for eight consecutive years to have a raise. He added that the greatest thing we as a Commission can do for the County is to work TOGETHER as a team. He added that we are going to do this to accomplish our goals and solve the County’s problems. Finally, we are here to serve the people, because as elected officials they have put their trust in us. The County is entitled to be served by us to the best of our abilities and with a positive attitude. He continued that we have much to accomplish here in Marion County. President Elliott stated that we want to make Marion County a better place to live as a result of not only the efforts of this County Commission but all the Elected Officials and all of the Agencies of the County. President Elliott then stated that he wanted to thank all of the Citizens of Marion for their belief in the Commissioners to accomplish these goals. For the record, note James Priester, Assessor presented to the County Commission the following Exonerations for approval.

Dated January 9, 2013 Nos. #2013-1 through #2013-27

Pursuant to the recommendation of James Priester, Assessor and approval of Patrick Wilson, Prosecuting Attorney; Commissioner Elliott moved that the President to sign Nos. #2013-1 through #2013-27. Commissioner VanGilder seconded. President Tennant concurred. The Commission received the Order Confirming and Ratifying Fiduciary Supervisor’s Report of Claims and Settlement Reports, Order #333. At a Regular Session of the County Commission of Marion County, West Virginia, continued and held for this County at their offices in the J. Harper Meredith Building on the 9th, day of January, 2013. This day came David A. Glance, Fiduciary Supervisor for Marion County, West Virginia, and presented to the Commission his Report of Claims and First and Final Settlement Reports for the following estates which reports he has filed in the Office of the Clerk of the County Commission, pending confirmation. There being no objections received to these reports and no errors appearing, the Report of Claims and First and Final Settlement Reports are hereby ratified, confirmed and approved.

Commissioner Tennant moved that the Commission approved these dates for our night meetings. Commissioner VanGilder seconded. President Elliott concurred. The Commission received a request for reimbursement from West Virginia Division of Justice and Community Services to cover expenditures from January 1, 2013 to January 31, 2013, in the amount of $2,396.00 for our VOCA Grant program.

Commissioner Tennant moved that the President sign as required. Commissioner VanGilder seconded. President Elliott concurred. The Commission received a request for advice and consent of the County Commission to hire Brian Scott Speakman as Deputy Sheriff, effective December 13, 2012, starting salary of $32,956.91, with benefits.

Commissioner Tennant moved that the Commission hire Brian Scott Speakman as Deputy Sheriff, effective December 13, 2012, starting salary of $32,956.91, with benefits. Commissioner VanGilder seconded. President Elliott concurred. The Commission received a request for advice and consent of the County Commission to reinstate Christopher Erdie as Deputy Sheriff, effective December 26, 2012, starting salary of $32,956.91, with benefits.

Commissioner Tennant moved that the Commission reinstate Christopher Erdie as Deputy Sheriff, effective December 26, 2012, starting salary of $32,956.91, with benefits. Commissioner VanGilder seconded. President Elliott concurred. The Commission received a request for advice and consent to accept the resignation of Bob Schmidt from the Kingmill Valley PSD Board. PAGE 8 The Commission received a request from the Monumental PSD for financial assistance with the purchase of a generator for the Levi Lane pump station. Eugene Chipps was present to answer any questions the Commission could have on their request. He stated that this request for funds has changed a little since we have submitted this request, in that we have purchased the generator. What we are presenting today is that the Commission assists us with the funding of two switches that will be at the two pumps stations. We are going in this direction to make it a simple hookup so that there will be no issue if this is required when the power is down. The mobile generator will be able to be moved to the pumps stations if needed. Mr. Chipps stated that we need $5,396.50 for the two switches.

Commissioner Tennant moved that the Commission contribute $4,500.00 towards the purchase of the two switches for the Monumental Public Service District and that those funds be appropriated from the Coal Severance Fund. Commissioner VanGilder seconded. President Elliott concurred.

PAGE 9 For the record, note the Commission received from Professional Service Industries, Inc., acting on behalf of Cellco Partnerships, working with Verizon Wireless, is submitting notice of their intent to construct a cellular communication tower in Paw Paw District, Baxter, Marion County; PSI Project #08161225. President Elliott added for the record that we should inform Chris McIntire that this is occurring and to see if he can work out a deal in which we could attach to the tower a unit that would increase the emergency services ability to obtain better communications in that area of the County.

For the record, note the Commission received the Reconciliation Summary from Valley Falls Public Service District, for period ending 11/30/2012. Commissioner Tennant added for the record that the County received from the Governor’s Office in the amount of $280,000.00 for the Rails for Trails Project. Tony Michalski, Director of MCPARC stated that this was a grant from the State where the Former County Planner Richard Walton was assisted by Tony. He continued that this was for Phase I development of the trails between Farmington and Mannington. We are still awaiting the transfer of the property from CSX at this time. Tony continued that the funds will be utilized for environmental study. If added that if we accomplish that this year we will be able to begin the construction phase in 2014. Commissioner Tennant stated that this was the largest grans issued this year for the Rails for Trails projects in the State of West Virginia.

PAGE 16 Janice Cosco the County Clerk wanted to thank the Commission and the Maintenance staff for removing of the wall on the second floor near Judge Aloi Office. It opened up the view and has made it appear as it did in the past. There being no further business to come before the County Commission, it is ordered that this Commission do now recess until, Wednesday, January 16th, 2013 at 10:00 a.m. for the next scheduled County Commission Meeting. _________________________________
