(May 6, 2013 – Hamilton, Ontario) The REALTORS® Association of Hamilton-Burlington (RAHB) reported sales, listings and the average sale price for all propertytypes listed through the RAHB Multiple Listing Service® (MLS®) in April showedincreases over the same month last year.

There were 2,202 properties listed in April, a 6.5 per cent increase over April of lastyear. All property sales numbered 1,521, representing a 5.5 per cent increase over thesame month last year. The average sale price of $382,682 was an increase of 1.8 percent from the previous April.

“Spring has arrived for the resale real estate market,” said RAHB CEO RossGodsoe. “We started seeing more listings and sales come through the MLS® systemfirst thing in April. All property sales are not only higher than last year, but are the sec-ond highest in an April for the last 20 years.”

Seasonally adjusted* sales of residential properties were 4.5 per cent lower than thesame month last year, with the average sale price up 2.4 per cent for the month.Seasonally adjusted numbers of new listings were 2.2 per cent lower than the samemonth last year.

Actual overall residential sales were 5.1 per cent higher than the previous year atthe same time. Residential freehold sales were five per cent higher than last year whilethe condominium market saw an increase in sales of 5.6 per cent. The average sale price

of freehold properties showed an increase of 1.9 per centover the same month last year; the condominium market,however, saw a decrease of 8.6 per cent when compared to the same period last year.

The average sale price is based on the total dollar volume of all residential proper-ties sold. Average sale price information can be useful in establishing long term trends,but should not be used as an indicator that specific properties have increased ordecreased in value.

The average days on market increased from 38 days to 40 days in the freehold mar-ket and from 41 days to 42 for condominiums.

“Listings are up from last year, but there are still fewer listings on the market thanthere were a year ago,” noted Godsoe, “and the number of listings is still below the aver-age for the last ten years. The seller’s market which has existed in our market area con-tinues, even though we saw some signs of a more balanced market at the end of the firstquarter.”

Year to date, listings are down 2.9 per cent compared to the same period last year,while sales are seven per cent lower. The average sale price for the first four months ofthe year is 5.7 per cent higher than the same period last year.

The generalization about life insur-ance is that it’s only good at death. Andthen it’s too late to enjoy the game. Notso with critical illness insurance. Peopleare living longer, and medical technolo-gy now provides the potential for some-one who would have died only 30 yearsago from a critical illness such as a heartattack or stroke, to survive.

According to the Heart and StrokeFoundation, in Canada more than 75,000people have a heart attack each year, butwell over 80% survive the attack. Thesame applies to 70% of the 50,000 whohave strokes. The Canadian CancerSociety states that the death rate fromcancer has fallen to only 1 in every3,000 cases. Many survivors return towork, but not necessarily the same joband sometimes earning less money.

Critical Illness Insurance is thefinancial safety net should you sufferfrom a critical illness. Critical illnesscoverage provides benefits that are paidupon the diagnosis of a critical illnesssuch as cancer, heart attack, stroke,Alzheimer’s disease and others. In otherwords, critical illness coverage providesa living benefit that pays-directly to thepolicyholder-when they have a criticalillness. For example, if someone with$100,000 of critical illness coveragewere suddenly stricken with malignantcancer, he or she would receive a$100,000 payment.

The attractiveness of this product is

no surprise when one considers what itoffers the potential buyer. A lump sum ofnon-taxable cash, while the insured isliving, upon the diagnosis of a coveredcondition, thus alleviating the additionalstress which financial pressure wouldbring. Particularly since the critical ill-ness survivor would then be able toafford the medical treatment and otherexpenses not covered by his or her pri-vate or provincial medical plans. Theycould then afford to continue to pay themortgage or other bills in the event theywere without income for any length oftime. CI coverage effectively addressesthese and many other financial issues.

While fairly new to Canada, criticalillness insurance is one of the mostwidely sold insurance products. Since itsintroduction in Canada in 1994, CI cov-erage has rapidly grown to a $200 mil-lion dollar market. This is evidence ofthe consumer need for critical illnessinsurance and the need for financialsecurity in life as well as death. As Dr.Barnard says, “Critical Illness insurancegives you financial independence whenyou need it most. You need insurancenot only because you are going to diebut because you are going to live.” Thisis a product designed to give youCHOICES...

to consider:Who is going on title?If it is your first investment, I

suggest that all partners be on title tothe property, in their personal names,as opposed to a corporation. A lenderwill want all the partners to sign per-sonally for the mortgage, so there islittle advantage to spending the extramoney to incorporate, with additionalbookkeeping fees and tax returns.You can always get insurance to pro-tect against claims related to liability.

How are decisions going to bemade?

Key decisions include who toaccept as a tenant and which renova-tions to undertake. Most of themshould have majority approval, but insome cases, you may require deci-sions to be unanimous, to protect all

of the partners.Who signs the cheques?Signing authority and how distri-

butions are made to the partners isalso a concern. I suggest that chequesup $1,000 or $2,000 can have one sig-nature, but anything more needs atleast two. There should be a separateaccount devoted to the investment, sothere is no confusion about personalcheques being used to pay bills.

When is reporting to be done?The partner who is managing the

property should be required to submitmonthly reports to the partners aboutthe rents received and the expensespaid each month. There should be anannual report as well. This way eachpartner can make the appropriateincome and expense reporting to theCanada Revenue Agency when filingseparate tax returns.

How are disputes settled?If things go to court, only lawyers

win. Agree on a detailed and expedit-ed arbitration process. That way thearbitrator’s decision is final, with noright to go to court, where it willinevitably get delayed and becomeexpensive.

What if one partner dies?There should be a process where

the property is appraised and the part-ner who survives has to buy out theestate of the deceased partner at fairmarket value.

What if one partner wants to selland the other partners do not?

There should be a similar processwhere the partners who do not wish tosell have to buy out the partner whowants to sell at fair market value, tobe determined by an appraisal.

What if one partner doesn’t paytheir share of expenses?

If one partner is not paying theirshare, then they should lose their rightto make any decisions about the prop-erty. There should also be a formulaso that the non-defaulting partnerscan buy out the share at a reducedvalue.

It is hoped that every real estateinvestment will lead to a profitableresult and that no one will have theneed to look at a partnership agree-ment. However, if things do not workout, it is good to know that the answercan be quickly found, without havingto resort to costly legal or accountingprocedures. By having the right legaland accounting advice before enter-ing into a real estate investment withpartners, you can ensure peace ofmind for all partners involved.

If you suspect someone who iselderly, or otherwise unable to takecare of themselves, is being takenadvantage of in their financial affairs,you should encourage them to getlegal advice.

Here’s an example of what canhappen.

In 2006, Gary Shular inheritedhis mother’s home on Jacobs Ave., inSt. Catharines. Shular had a history ofmental illness and suffered bouts ofdepression and lived in the house fortwo years with his partner. After theysplit up, Shular moved to an apart-ment on Parliament St. in Toronto andthe St. Catharines property was neg-lected.

In Toronto, he renewed hisacquaintance with an old friend,Michelle Ferraton, whom he’d knownfor years. She suggested that she andher common law spouse could helphim fix the St. Catharines propertyand sell it. In exchange, she wantedhalf the sale price. Shular agreed andsigned a sales agreement prepared byFerraton to give her half the money.

A court later heard that Ferratonput $2,115 into the property and thenconvinced Shular to give her a powerof attorney so that she could list andsell it. In 2008, she signed an agree-ment to sell it for $156,000. Shularstill had to sign the closing papers.

After deducting fees and expenses,Shular received $140,000. Ferratonexpected to get $70,000.

Shular had a change of heart andrefused to pay the $70,000, but didgive Ferraton $2,115, plus $20,000for helping him out.

Ferraton sued for the remainder.At trial in November 2012, Shular’sex-partner testified that Shular had ahistory of mental illness. He also toldthe court Shular was vulnerable toexploitation. Shular confirmed to thecourt that he was very depressed inthe summer of 2008.

Ferraton confirmed in court sheknew Shular’s vulnerabilities whichwas why she had helped him withfinancial matters when he couldn’tearn a living or take care of himself.

By the time of the trial, Shularwas on welfare, and he told court allthe money from the property sale wasgone.

In a decision of the OntarioSuperior Court of Justice datedNovember 26, 2012, Judge J. Wilsondecided that the contract was uncon-scionable and unenforceable. He saidan agreement giving Ferraton 50 percent of the sale was unfair and sinceshe was not a real estate agent, shecould not be paid for services relatedto selling the house. Since Shular hadinsisted at the trial that Ferraton be

paid for her help, he upheld the totalpayment of $22,115.

Here is what the judge said:“Ms. Ferraton was well aware of

Mr. Shular’s emotional frailties andhistory, and took advantage of hispassivity and listless attitude towardsthe property during a period of deepdepression. What appears to havebegun as an act of friendship, maturedinto a plan to profit from the situationand to take advantage of Mr. Shular’s

emotional state and apathy.”Do not give out a power of attor-

ney or sign any other legal documentover any of your property withoutfirst obtaining legal or other profes-sional advice. There may not beenough time to get to court to fix itlater.
