NATURAL RESOURCE AND CULTURAL FEATURES:

The majority of the site is impervious. There are no known significant natural resources or cultural features associated with this site.

COMPREHENSIVE PLAN: This site is located within the Pembroke SGA, Central Village District. Mixed use residential/business. The Pembroke plan does not get to the specifics of access for individual parcels. However, the Special Area Development Guidelines, Urban Areas, calls for sites to minimize or eliminate curb cuts by sharing vehicular access.

MASTER TRANSPORTATION PLAN (MTP) / CAPITAL IMPROVEMENT PROGRAM (CIP): Virginia Beach Blvd. in the vicinity of this application is considered an eight-lane divided major urban arterial. The Master Transportation Plan proposes an eight-lane facility within a 155 foot right-of-way. Currently, this segment of roadway is functioning at capacity at a LOS D. Rose Marie Avenue in the vicinity of this application is considered a two-lane undivided collector street. It is not included on the Master Transportation Plan A roadway Capital Improvement Program project is slated for this area. The Pembroke Area Transportation Improvements (CIP 2-109) will develop short-term, mid-term, and long-term alternatives for transportation needs in the Central Business District surrounding the Town Center. The project will be phased based on funding.

The City of Virginia Beach Public Works Specifications and Standards allow for one curb cut on each street for a corner site. However, the following condition must be satisfied:

One existing curb cut from Virginia Beach Boulevard and one existing curb cut from Rose Marie Avenue must be removed to satisfy the Public Works Specifications and Standards.

WATER: This site is connected to City water. The existing meter (City ID #95020889), and the existing fire meter (City ID #95020889) may be used or upgraded to accommodate the proposed development. There is a 16-inch City water main in Virginia Beach Boulevard. There is a 20-inch City water main in Virginia Broad Street. There is an 8-inch City water main in Rose Marie Avenue.

SEWER: This site is connected to City sanitary sewer. Pump station #353 the receiving pump station for this site, has capacity issues and may require system modification. An engineering hydraulic analysis of Pump Station #353 and the sanitary sewer collection system is required to ensure future flows can be accommodated. There is an 8 -inch City sanitary sewer gravity main in Lavender Lane. There is an 8 -inch City sanitary sewer gravity main Rose Marie Avenue. There is an 8 -inch out of service sanitary sewer line Rose Marie Avenue.

STORMWATER: No comments at this time.

FIRE: No comments at this time. A complete review will be done during the DSC process. DSC - LANDSCAPING: Street frontage landscaping is to be installed where possible. (i.e. landscaping in the entrance to be removed along Virginia Beach Boulevard)

The applicant has requested a modification to allow use of one of the two curb cuts on Rose Marie rather than exclusively off Virginia Beach Boulevard. The applicant has agreed to remove two curbs cuts, one on Virginia Beach Boulevard and one on Rose Marie Avenue. Removal of the curb cuts should be done in conjunction with providing a continuous sidewalk meeting ADA standards. This is consistent with the

Pembroke SGA plan for new sidewalks in redevelopment areas, as well the access and circulation component of the Urban Area Special Area Development Guidelines. Upon a visit to the site and review of the plans, it was found that a few objects were located within City right-of-way. A propane tank and bollards as well as a row of parking along Rose Marie Avenue were located within the right-of -way. The applicant intends to relocate the propane tank and bollards as well as the parking spaces onto their property. The location of the propane tank will need to be done in conjunction with International Fire Code requirements thus no plans for the relocation are shown with this application. Also noted was that the existing freestanding sign located along Virginia Beach Boulevard is significantly taller than the current sign standards. The applicant was asked to reduce the height of this sign to be in compliance with current sign regulations. The applicant has indicated that this reduction in height would create a hardship. The sign has been in place for over 35 years. The applicant has concern that the sign would not be visible above the parked trucks if the sign height were lowered. Staff points out that there would be ample indications of this business located on the site. Staff recommends approval of this requested modification with additional conditions in accordance with code requirements as listed below.

1. All conditions with the exception of Number 6 attached to the Conditional Use Permit granted by the

City Council on November 10, 1993 remain in effect. 2. Condition Number 6 of the November 10, 1993 Conditional Use Permit is deleted and replaced with

the following:

The vehicular driveway entrances on the southwest corner of the site, closet to the intersection of Virginia Beach Boulevard and Rose Marie Avenue, with one on each roadway, shall be closed within 90 days of City Council approval. Street frontage as well as the closed areas shall be landscaped in accordance with the Site Plan Ordinance, Section 5A, Landscape requirements.

3. The propane tank and bollards shall be relocated in accordance with City codes and the International Fire Code requirements from the Right-of-Way of Rose Marie Avenue within 90 days of City Council approval.

4. The parking spaces shall be relocated in accordance with City codes from the Right-of-Way of Rose Marie Avenue within 90 days of City Council approval.

5. The freestanding sign shall be modified to conform to the City Zoning Ordinance or be removed within 90 days of City Council approval. If a new free-standing sign is installed, it shall be a monument –style sign, no more than 12 feet in height with a brick base of at least two feet in height.

NOTE: Further conditions may be required during the administration of applicable City Ordinances and Standards. Any site plan submitted with this application may require revision during detailed site plan review to meet all applicable City Codes and Standards. All applicable permits required by the City Code, including those administered by the Department of Planning / Development Services Center and Department of Planning / Permits and Inspections Division, and the issuance of a Certificate of Occupancy, are required before any uses allowed by this Use Permit are valid. The applicant is encouraged to contact and work with the Crime Prevention Office within the Police Department for crime prevention techniques and Crime Prevention Through Environmental Design (CPTED) concepts and strategies as they pertain to this site.
