    Agenda Item: Street Renaming Update

    CMO (City Managers Office) Recommendation: Discussion of proposed street namechanges.

    Background: Staff is recommending renaming several streets in the City. Theproposed street name changes have been reviewed by the Public Works Department,Police Department, Fire-Rescue Department and 911. Meetings were also held withCity Councilmembers.

    Discussion: Staff is seeking input from the Mayor and City Council before meeting withneighborhoods and property owners.

    Background

    The Public Works Department is proposing to rename several streets in the City. As

    part of the street renaming process, the following communications plan was adopted:

    Step 1 Brief CouncilmembersStep 2 Meet with key neighborhood/business representativesStep 3 Send letter to residents/businesses that will be effected and post signsStep 4 City Council Adoption

    Discussion

    Some of the streets recommended for renaming are similarly named and could causeconfusion for public safety. A meeting was held with the Police Department, Fire

    Rescue Department, Public Works Department and Noah Reiter (representing 911) togather their feedback.

    The following recommendations were made:

    Council District One

    Spindle Court/Spindale CourtRecommendation: Rename Spindale Court to Nesbit Creek Court.

    Landowne Drive/Lansdowne Court

    Recommendation: Rename Landowne Drive to Nesbit Creek Drive.

    Roberts DriveRecommendation: Although there are two Roberts Drive segments, do notrename road since it does not pose an emergency response problem.

    Council District Two Brandon Mill Road

    Recommendation: Rename northern segment to Grogans Mill Drive.

    Council District Three

    Heards DriveRecommendation: Rename southern segment to Heards Creek Drive or RaidersDrive. Note: Riverwood High School recently requested paperwork from the Cityto initiate a street name change on the south segment of Heards Ferry Drive toRaiders Drive. The change will require approval of all of the effected propertyowners, including Fire Station #3. To date, Riverwood High School has notsubmitted the required paperwork to rename Heards Drive.

    Agenda Item:

    Proposed Ordinance to amend Chapter 54, Article III, Section 54-51 to add a

    subsection (c) setting forth the deduction allowed the collector of the hotel-motel tax

    City Attorneys Recommendation:

    That the proposed ordinance amendment, which is attached, be approved so as to providenotice of the deduction available to those required to comply with Chapter 54, Article III on the

    Hotel-Motel Tax and to clarify the circumstances under which this deduction is allowed to betaken.

    Background:O.C.G.A. Section 48-13-50, et seq. authorizes each county and municipality in the State

    of Georgia to levy certain excise taxes on rooms, lodgings, and accommodations as provided

    thereafter in that article.Pursuant to O.C.G.A. Section 48-13-51(a)(5), the City is authorized to impose, assess,

    and levy an excise tax of 7% of the rent for every occupancy of a guestroom in a hotel, as

    defined by the ordinance. Hotel is defined in Section 54-50 of the ordinance as a structure orany portion of a structure, including, but not limited to, rooming or lodging houses, inns, motels,

    motor hotels and courts, hotels, cabins, public or private clubs, and tourist camps, which contain

    guestrooms which are regularly furnished for value to the public.

    O.C.G.A. Section 48-13-52 provides that when this tax is paid when due, the collector ofthe tax is allowed a reimbursement in the sum of three percent in the form of a deduction, but

    only if the amount due was not delinquent at the time of payment.

    Discussion:Payment of this tax to Sandy Springs is made on a monthly basis, and although the form

    used by the City references the deduction, the deduction is not, but should be, set forth in the

    ordinance. Since the ordinance provides in subsection (b) of Section 54-51 the tax shall notapply to charges or transactions excluded or exempted from the tax by state law, it appears that

    what should be subsection (c) was either overlooked or inadvertently omitted.

    Alternatives:To do nothing and leave as is, would leave in question whether the ordinance as currently

    stated adequately complies with state law authorizing the imposition of this tax according to the

    guidelines set forth in the applicable state statutes.

    STATE OF GEORGIACOUNTY OF FULTON

    AN ORDINANCE TO AMEND CHAPTER 54, ARTICLE III, SECTION 54-51 TO

    ADD A SUBSECTION (C) SETTING FORTH THE DEDUCTION ALLOWEDTHE COLLECTOR OF THE HOTEL-MOTEL TAX AND THE CIRCUMSTANCESIN WHICH ALLOWED

    WHEREAS, the City of Sandy Springs (the City) previously enacted an ordinance, asauthorized by O.C.G.A. Section 48-13-50, et seq., imposing an excise tax on rooms, lodgings,and accommodations, effective January 3, 2006; and

    WHEREAS, O.C.G.A. Section 48-13-52 provides for the collector of the tax to beallowed a reimbursement in the form of a deduction of the amount due, but only if the amountdue is not delinquent at the time of payment; and

    WHEREAS, although the form supplied by the City, and completed on a monthly basisby the collectors of this tax, references the deduction, it appears that the language regardingthis deduction was either overlooked or inadvertently omitted when the original ordinance wasenacted; and

    WHEREAS, adding a subsection (c) to Section 54-51 would inform of the deduction andthe circumstances under which the deduction is allowed to be taken;

    NOW, THEREFORE, in order to accomplish the foregoing, the Mayor and City Councilof the City, pursuant to their authority, do hereby amend Chapter 54, Article III, Section 54-51 ofthe Citys Code of Ordinances by adopting the following subsection, to be known as Section 54-51(c):

    (c) Operators collecting the hotel-motel tax imposed by this articleshall be allowed a reimbursement, in the form of a deduction, forcollecting, submitting, reporting, and paying the amount due. Therate of the deduction shall be three percent of the amount due, butonly if the amount due is not delinquent at the time of payment.

    ITEM: Consideration of Approval of the Intergovernmental Agreement (IGA)For the MARTA Funded Projects Currently Programmed in the TransportationImprovement Plan (TIP)

    Public Works Departments Recommendation:

    The Staff recommends that the Mayor and City Council consent to the partnership agreementbetween the City of Sandy Springs and MARTA and that the City Council authorize the Mayor tosign the Intergovernmental Agreement (IGA).

    Background:

    In September 2009, staff reported to Mayor and City Council a potential additional fundingsource for transit related transportation projects due to American Recovery and ReinvestmentAct (ARRA) funding from the Atlanta Regional Commission (ARC) to MARTA for operations. Inreturn for the ARCs allocation of $25 million in Metropolitan Planning Organization (MPO)ARRA Flexible STP Highway Program Funds, MARTA has given program authority for $25million in MARTA capital funds. While these funds have no specific obligation deadline or other

    timing restrictions, they are subject to other legal restrictions such as the MARTA Act of 1965 asamended and the Rapid Transit Contract and Assistance Agreement (RTCAA) of 1971. Staffmet with ARC and MARTA staff on July 16, 2009 to discuss the potential funding. Theproposed breakdown of the $25 million at this meeting was based on sales tax generation andwas as follows:

    North Fulton $6.25 million,South Fulton $2 million,City of Atlanta $8.5 million, andDeKalb County $8.25 million.

    Discussion:

    The $6.25 million allocation for North Fulton County was divided among the five northern citiesbased upon the match formula used in the North Fulton Comprehensive Transportation Plan(NFCTP) Memorandum of Agreement (MOA). The City of Sandy Springs will receiveapproximately 28% or $1.75 million for transit related projects.

    The guidance given to staff in September resulted in the following project categories:

    Transit sidewalk connectivity and safety upgrades ($1.2 million),

    Bus shelter replacements at 18 different locations ($360,000),Illuminated overhead signage at rail stations ($25,000), andA midblock crossing at MARTA stop location along Roswell Road (SR 9) near LongIsland Drive ($150,000).

    These project amounts were added to ARCs Transportation Improvement Plan (TIP) by

    Administrative Modification on March 5, 2010.

    The City intends to enter into a project Intergovernmental Agreement (IGA) with MARTA toaccess the $1.74 million in funding and formalize the agreement between the two entities. Thedraft IGA is attached in Exhibit A as the Intergovernmental Agreement (IGA).

    Alternatives:

    If the City chooses not to execute an IGA with MARTA, there will be no formal frameworkbetween the entities to direct the completion of these projects, and the funding would likely bedivided among the remaining four North Fulton County cities.

    Financial Impact:

    This funding would not require any type of local match. Also, the funds could be used as a localmatch for a federally funded project if the project can be shown to have nexus to transit.

    ARC-MARTA OFFSET FUNDS

    INTERGOVERNMENTAL AGREEMENT

    THIS INTERGOVERNMENTAL AGREEMENT, (hereinafter referred to asAgreement) entered into as of the _____ day of ___________, 2009, by and

    between the City of Sandy Springs, (hereinafter referred to as the CITY) and theMETROPOLITAN ATLANTA RAPID TRANSIT AUTHORITY, (hereinafterreferred to as MARTA OR the Authority).

    WITNESSETH THAT:

    WHEREAS, by virtue of action taken by the Atlanta Regional Commission(ARC) whereby certain federal funds were transferred to the Authority and, inexchange, the Authority committed to fund qualifying projects contained in theTransportation Improvement Plan (TIP) from the Authoritys capital budget; and

    WHEREAS, the Citys share of funding from the Authority for qualifyingprojects in the TIP is $1,750,469 ; and

    WHEREAS, the City has identified the projects defined herein (theProject) for funding from the Citys share of funding in the amount of$1,750,469 ;

    WHEREAS, the parties desire to define the responsibilities for the design,construction, implementation and payment of costs for the Project as set forthherein;

    NOW THEREFORE, in consideration of the promises and the mutual

    covenants and agreements hereinafter contained, the parties hereto agree asfollows:

    1. Project Defined. The Project is defined as sidewalks, shelter and signageupgrades, and a raised median crosswalkimprovements located at variouslocations in the City, as is more fully shown in the attached Exhibit A (drawing,diagram, etc.).

    2. Duties of City. The City shall be responsible for all work and servicesrequired for the successful completion of the Project, including but not limited to:(a) the design of the Project, (b) the procurement of goods and services related to

    the construction of the Project, (c) the management of the Project and allcontractors performing work thereon, (d) the inspection and final acceptance ofthe Project, and (e) all other acts and obligations consistent with the successfulcompletion of the Project.

    3. Time of Performance. Work and services shall be undertaken and pursuedin such sequence as to assure their expeditious completion. All work and servicesrequired hereunder shall be completed on or before (need date). All invoices to

    be submitted hereunder for reimbursement shall be submitted within 60 days ofcompletion of work.

    4. Reimbursement. The City shall be reimbursed for the costs of the Projectas set forth in Exhibit B, which is attached hereto and made a part hereof.

    5. Formal Communication/Designated Agents. Formal communicationsregarding this Agreement shall include, but not necessarily be limited to,correspondence, progress reports and fiscal reports. The City or its designee shallfurnish progress and fiscal reports to the Authority periodically, as requested bythe Authority. All formal communication regarding this Agreement shall be inwriting and addressed to the Designated Agents of the parties.

    _____________, is designated as the authorized agent of the Authority forpurposes of this Agreement only, except for executing amendments hereto. Allcorrespondence shall be direct to him/her at MARTA, 2424 Piedmont Road,N.E., Atlanta, GA 30324-3330.

    6. Review and Coordination. To ensure adequate assessment of the Projectand proper coordination among the parties, the Authority shall be kept fullyinformed of the progress of the work and services to be performed hereunder.The City may be required to meet with designated representatives of theAuthority from time to time, as reasonably requested, to review the work and

    services performed.

    7. Maintenance of Records. The City shall maintain all books, documents,papers, accounting records and other evidence pertaining to the Project inaccordance with generally accepted accounting principles applicable to the Cityand shall make such material available at all reasonable, times during the term ofthis Agreement for inspection by the Authority or its external auditors. The Cityshall include the provisions of this paragraph in any contract executed inconnection with this Project.

    8. Conflict of Interest. No officer, member or employee of the Authority, andno public official of any local government which is affected in any way by theProject, who exercises any function or responsibilities in the review or approvalof the Project or any component part thereof, shall participate in any decisionrelating to this Agreement which affects his or her personal interests or theinterest of any corporation, partnership or association in which he or she isdirectly interested; nor shall any such officer, member or employee of theAuthority, or public official of any local government affected by the Project, havea direct interest in this Agreement or the proceeds arising therefrom.

    A RESOLUTION TO APPROVE AN INTERGOVERNMENTAL AGREEMENT (IGA)

    BETWEEN THE CITY OF SANDY SPRINGS AND THE METROPOLITAN ATLANTA RAPID

    WHEREAS, it is necessary, from time to time, to establish policies, procedures and guidelines consistent

    with the administration of a municipal government consistent with the US Constitution, Federal Statutes,

    alignment with Federal, Georgias State Constitution, and the Charter for the City of Sandy Springs and

    WHEREAS, by Resolution adopted, the City of Sandy Springs desires to enter into an Intergovernmental

    Agreement (IGA) with the Metropolitan Atlanta Rapid Transit Authority (MARTA) to develop and

    construct transit related infrastructure projects at various locations within the City.

    WHEREAS, upon adoption of this Resolution, the City Sandy Springs Public Works Department staff

    will manage all applicable phases of these projects.

    NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE

    CITY OF SANDY SPRINGS, GEORGIA

    That they receive, accept, and affirm the authorization for the Mayor to execute an Intergovernmental

    Agreement (IGA) with the Metropolitan Atlanta Rapid Transit Authority (MARTA) for the

    implementation of these transit related transportation improvement projects, with funding provided by

    MARTA.

    Public Works Departments Recommendation:

    The staff recommends that the Mayor and City Council accept the construction bids for thestreetscape project located in the current Perimeter Community Improvement District (PCID)construction plans for the ongoing LCI project on Peachtree Dunwoody Road, lying and locatedin Land Lot 18 of the 17th District of Fulton County, Georgia. The project limits are from I-285north along Peachtree Dunwoody Road to Abernathy Road.

    Background:

    This PCID project is designed to construct sidewalks and ADA compliant ramps alongPeachtree Dunwoody Road. It will fill in gaps where no sidewalk currently exists. The projectwas advertised and two bids were received:

    JJE Constructors, Inc. $1,694,059.11Butch Thompson Enterprises, Inc. $1,937,616.38

    Discussion:

    The Georgia Department of Transportation (GDOT) and the Atlanta Regional Commission(ARC) are currently reviewing the bids. If approved by ARC and GDOT, staff recommends thatMayor and City Council approve the award of the contract to JJE Constructors, Inc.

    Alternatives:

    The city can choose not to accept the bids and the project would have to be re-advertisedresulting in delay of the project and potential loss of construction funding.

    Financial Impact:

    None at this time as the project design was funded by PCID. The funding for the construction ofthis project is being supplied by the federal stimulus funds.

    AN ORDINANCE TO PROHIBIT CERTAIN PARKING

    IN THE CITY OF SANDY SPRINGS

    WHEREAS, The City of Sandy Springs is charged with providing for the health, safety

    and welfare of its citizens; and

    WHEREAS, The City has authority to regulate the driving and parking within City

    streets and rights-of-way; and

    WHEREAS, The City has determined that continuous parking of unused and abandoned

    vehicles on the City rights-of-way creates traffic issues, negatively

    impacts properties and property values, and

    WHEREAS, The City finds it necessary, in furtherance of the preservation of health,safety and welfare of its citizens, to prohibit continuous and unabated

    parking of unused and/or abandoned vehicles:

    THEREFORE, The Mayor and Council of the City of Sandy Springs hereby amend the

    City Code as follows:

    Sec. 58-72. Parking or abandonment prohibited.

    Unless specifically authorized by the City and designated by visual reference, it is

    unlawful for any person to park or abandon a motor vehicle of any kind upon the streets or upon

    the rights-of-way of the streets and allow said motor vehicle to remain parked or abandoned for

    more than ___ consecutive hours. This ordinance shall be cumulative with all other parking

    and/or vehicle requirements within the City.
