EFSA PROGRESS REPORT

Executive Summary

The present report refers to the period from 1st January to 28th February, 2014.

Highlights:

Reorganisation of the RASA Department;

Public consultation on the second part of the draft opinion on bisphenol A (mid-January – mid-March);

Cumulative risk assessment of pesticides: info-session for stakeholders and media activities;

„EU Summary Report on trends and sources of zoonoses, zoonotic agents and food-borne outbreaks in 2012‟ and „EU Summary Report on Antimicrobial Resistance in 2012‟ in collaboration with the European Centre for Disease Prevention and Control (ECDC);

Urgent request on African swine fever;

Advisory Forum: EU risk assessment agenda, identify and prevent divergent opinions, data collection and data access, food safety research and industry, and nutrivigilance;

Stakeholders: meeting with NGOs on environmental risk assessment and new plant-breeding techniques, and publication of the report of the Stakeholders Consultative Platform discussion group on „Transparency‟;

New Focal point agreements with 30 countries. Science Strategy and Coordination (SCISTRAT):

EFSA adopted the Opinion on the „Use of the qualified presumption (QPS) approach for botanicals and botanical preparations‟. The scientific report on „Indicative timelines for submitting additional or supplementary information to EFSA during the risk assessment process of regulated products‟ and the Technical report on „Systematic procedure for the identification of emerging chemical risks in the food and feed chain‟ were published. The Advisory Forum (AF) met in December and held a joint session with the AF Communications working group (AFCWG). The meeting discussed around the development of a common EU risk assessment agenda along with feedback from the discussion group on further developing scientific cooperation between EFSA and the Member States. Additional discussion took place on the new Commission Framework Programme Horizon 2020, Expert Database (EDB) Survey, Staff Exchange Scheme and Hepatitis A tracing activity. Among others, the agenda of the AF meeting scheduled on 5 and 6 March included the following: Follow up on the discussion on the EU risk assessment agenda; Early means to identify and prevent diverging scientific opinions; Data collection and data access; Food safety research and industry; and Nutrivigilance. Among others, the Focal Point (FP) discussed around the re-evaluation of aspartame, Expert Database survey and priorities for 2014. New FP agreements were signed with 30 countries. EFSA held a meeting with non-governmental organisations (NGOs), where experts exchanged views on protection goals, the impacts on biodiversity of regulated products, endangered species and species recovery, and new plant-breeding techniques. The report of the Stakeholders Consultative Platform Discussion Group on „Transparency‟ was published.

Risk Assessment and Scientific Assistance (RASA): EFSA adopted four opinions in the areas of plant health (Citrus canker Xanthomonas campestris and Citrus black spot Guignardia citricarpa), biological hazards (BSE risk in bovine intestines and mesentery) and contaminants (chromium in foodstuffs). The „EU Summary Report on trends and sources of zoonoses, zoonotic agents and food-borne outbreaks in 2012‟, which was produced in collaboration with the ECDC, was published in February. In addition, EFSA adopted two scientific reports, three technical reports, four external reports and nine internal reports. In the scientific area of animal and plant health, among others EFSA is working on: an urgent request on African swine fever (use of methods to control the wild boar population to control the disease), the update of the 2010 scientific opinion on African swine fever, and the

environmental risk assessment of the apple snail for the EU. In the biological area, among others EFSA will work on the opinion on Salmonella and Norovirus in leafy greens eaten raw as salads. In the area of contaminants EFSA will work on perchlorate in food (in particular fruits and vegetables) and tetrahydrocannabinol (THC) in milk and other food of animal origin. Among others, the DATA Unit will work on updated guidelines for the EU MENU project.

Scientific Evaluation of Regulated Products (REPRO):

EFSA adopted one guidance document related to the format of pesticide monitoring data, 28 opinions, three technical reports and one external report. The public consultation on the second part of the draft opinion on bisphenol A remained open from mid-January to mid-March. The final opinion on bisphenol A is expected to be adopted in May 2014, following a stakeholders‟ meeting aimed at discussing the comments received during the public consultation. In addition, public consultations were launched on the draft opinions on the Dietary Reference Value on „Iodine‟ and „Niacin‟. EFSA also adopted 15 reasoned opinions on MRL and four conclusions on pesticide peer review. The Application Desk received and processed 77 applications and 42 requests for assistance via the web form. The ANS Panel will continue working on the re-evaluation of food additives and will organise a workshop with stakeholders in this area. The re-evaluation of flavouring substances, as well as the evaluations of food contact materials and recycling processes remain among the main tasks of the CEF Panel. The FEEDAP Panel will focus on approximately 70 opinions on feed additives, 60% of which are linked to re-evaluations mainly of amino-acids, colourings, flavourings, preservatives, silage and trace elements. The GMO Panel will continue issuing opinions and guidance documents on applications of GM plants. In the nutrition area, the NDA Panel will work on the assessment of health claims and novel food applications, as well as on dietary reference values for micronutrients. In addition, the NDA Panel will work on the safety assessment of caffeine, health benefits of fish consumption and advice on milk based drinks intended for infants and young children. Among others, the PPR Panel will focus on the opinion on the state of science on risk assessment for non-target terrestrial plants. The PRAS Unit will continue working on MRL applications, as well as the evaluation of pesticide active substances.

Communications (COMMS):

EFSA published seven outputs including press releases, web stories, event stories and feature stories. In terms of multimedia products EFSA produced 4 new videos: 2 for the series Understanding Science, one dedicated on BPA in the context of the launch of the public consultation, and one on EFSA's Grants and Procurements. Media coverage amounted to nearly 1,500 articles and 115 media queries, the majority of which were on topics such as bisphenol A, bee health, GMOs (in particular GM maize 1507), nutrition and health claims (caffeine and infant formula) and the publication of Prof. Séralini‟s new report on pesticides. Two interviews were organised with newswire Reuters (on phosphates) and The Guardian (on apple snails). EFSA‟s twitter account now numbers nearly 5,500 followers. Wide range of communication activities followed the publication of a critical report by NGO PAN Europe on EFSA‟s activities in the area of cumulative risk assessment. In response to the report, a commentary from the Chair of EFSA's Management Board, Sue Davies, was placed in „The Parliament Magazine‟. Two web stories highlighted the feedback to the public consultation on opinion on cumulative assessment groups the other held in the framework of a stakeholders‟ info session.

Institutional relations, Planning, Budget and Human Resources:

EFSA participated in the meetings with the European Parliament ENVI Committee in the framework of the 2012 discharge procedure and to discuss around ways for better transparency and improved dialogue with the European Parliament. EFSA participated to the launch event of the EXPO 2015 in the European Parliament in Brussels. The Authority intends to organise a high level scientific conference. At the meeting of the network of Heads of Agencies EFSA contributed to the discussions around the staff reduction requested to so called “cruising-speed” EU Agencies and the role of the Agencies‟ Management Boards. Meetings with DG SANCO and DG DEVCO were organised to discuss around EFSA‟s multiannual programme on international scientific cooperation 2014-2016.

Since January, the Project Coordination Office (PCO) replaced the Mandate Review Committee (MRC) in the evaluation of the internal mandates requests.

On 28 February 2014, € 17.47 million or 21.94% of the € 79.63 million budget was committed, and € 8.15 million or 10.24% of the € 79.63 million payment appropriations were paid. 443 posts were occupied and one job offer sent to the selected candidates bringing the total to 444 posts filled-in out of the planned 474 posts.

SCIENCE STRATEGY AND COORDINATION (SCISTRAT)

Scientific Committee and Emerging Risks

(SCER)

o Opinion on the „Use of the qualified presumption of safety (QPS) approach for botanicals and botanical preparations‟.

o Publication of the report on „Indicative timelines for submitting additional or supplementary information to EFSA during the risk assessment process of regulated products‟.

o Publication of a technical report presenting a systematic procedure for the identification of emerging chemical risks in the food and feed chain.

Advisory Forum and Scientific Cooperation

(AFSCO)

o The Advisory Forum (AF) meeting of December 2013 included a joint session with the AF Working Group on Communications. Discussion was held on developing a common EU risk assessment agenda along with feedback from the discussion group on further developing scientific cooperation between EFSA and the Member States. Additional discussion took place on the new Commission Framework Programme Horizon 2020, the Expert Database (EDB) Survey, Staff Exchange Scheme and Hepatitis A tracing activity.

o Among others, at the March 2014 meeting the AF further discussed around the EU risk assessment agenda and exchanged views on early means to identify and prevent diverging scientific opinions. Additional discussion took place on data collection and data access, food safety research and industry, and Nutrivigilance.

o The new programme for the European Neighbourhood Policy (ENP) countries started on 1st February 2014 lasting for 2 years.

o Meeting of the FP. Among others, the meeting discussed around the re-evaluation of aspartame, Expert Database survey and priorities for 2014. New FP agreements were signed with 30 countries.

o Teleconference of the FP Discussion Group on „Development of a guideline for coordination of the work of national representatives in EFSA‟s scientific networks‟.

Stakeholders

o Meeting with non-governmental organisations (NGOs): EFSA‟s experts listened to the views and presentations of representatives of NGOs on protection goals, the impacts on biodiversity of regulated products, endangered species and species recovery, and new plant-breeding techniques.

o EFSA met the representatives of a new stakeholder organisation to hear about their work and discuss possible areas of cooperation.

o Publication of the report on the views expressed by the members of the Stakeholder Consultative Platform discussion group on „Transparency‟.

International relations o EFSA welcomed a delegation of the Food Safety Committee of Japan.

o EFSA welcomed the US Food and Drug Administration Liaison Officer to EFSA, Mr Donald Prater.

Animal health and plant health (ALPHA)

o Adoption of opinions on the „Risk to plant health posed by citrus canker Xanthomonas campestris’, and on „Citrus black spot Guignardia citricarpa, all strains pathogenic to Citrus and for the whole EU territory‟.

o Technical report on the public consultation on Xanthomonas campestris.

o External report on data collection to support pest risk assessment of Guignardia citricarpa Kiely: study of splash dispersal of G. citricarpa pycnidiospores from infected citrus.

Biological hazards and contaminants (BIOCONTAM)

o Adoption of opinions on „Bovine spongiform encephalopathy BSE risk in bovine intestines and mesentery‟ an on the „Risks to human health related to the presence of chromium in foodstuffs‟.

o Scientific reports of EFSA on „EU Summary Report on trends and sources of zoonoses, zoonotic agents and food-borne outbreaks in 2012‟ and „EU Summary Report on Antimicrobial Resistance in 2012‟ in collaboration with the ECDC.

o External reports supporting the preparation of the „EU summary report on zoonoses, antimicrobial resistance and food-borne outbreaks‟ and on „TSE infectivity model (TSEi) in animal tissues: Bovine intestines and mesenteries‟.

Assessment and methodological support (AMU)

o Internal reports on: „Model on transmissible spongiform encephalopathies TSE infectivity level in animal tissues‟, „Bisphenol A (BPA) hazard identification, hazard characterisation and risk characterisation for the purpose of the scientific opinion on the risks to public health related to the presence of BPA in foodstuffs‟, „Probability of extreme weather in Europe‟, and „Modelling of release of citrus black spot‟.

o Report of EFSA regarding review of the report on updated technical specifications for harmonised reporting of food-borne outbreaks through the European Union reporting system in accordance with Directive 2003/99/EC.

Evidence management (DATA)

o Technical reports on: „Refined exposure assessment of β-apo-8‟-carotenal (E 160e)‟ and „Transmission of chemical occurrence data from EFSA database into the electronic data submission system of WHO‟

Additives and products or substances used in animal feed (FEEDAP)

o Adoption of eight opinions on authorisation of feed additives: Technological (three), Nutritional (four) and Zootechnical (one). Five of these opinions were re-evaluations of additives already on the market.

Food ingredients and packaging (FIP)

o Public consultation on the second part of the draft opinion on bisphenol A related to human health risks (from mid-January to mid-March).

o Adoption by the CEF Panel of nine opinions related to the safety evaluation of recycling processes (four), active & intelligent packaging (two) and flavouring substances (three).

Genetically modified organisms (GMO)

o Annual report of EFSA‟s Network for risk assessment of GMOs for 2013.

o Two opinions on GM cotton MON 88913.

o Technical report on soybean BPS-CV127-9.

Dietetic products, nutrition and allergies

(NDA)

o Adoption of eight opinions on: Health claims Art. 13.5 (three), Art.14 (two) and Art.19 (one); Dietary Reference Values for Biotin and Pantothenic acid (two).

o Public consultations on Dietary Reference Values for „Iodine‟ and „Niacin‟.

o Two Technical reports on „Transitech‟ and „Biotin & pantothenic acid‟.

Pesticides and plant protection products and their residues

o Adoption of the guidance document related to the format of pesticide monitoring data and the opinion on good modelling practice in the context of mechanistic effect models for risk assessment of plant protection products.

o 15 reasoned opinions on MRL applications and MRL reviews, including three urgent requests.

o Four conclusions on pesticide peer review.

o In occasion of the publication of the opinion on aspartame (December 2013), EFSA organised a press briefing in Brussels. A press release, a video, a revised FAQ and for the first time a layman summary on aspartame was produced.

o The publication of the Annual Summary report on Zoonoses (jointly with the ECDC) was accompanied by a press release and infographics, as well as updated factsheets on listeria and zoonoses.

o Wide range of communication activities followed the publication of a critical report by NGO PAN Europe on EFSA‟s activities in the area of cumulative risk assessment. In response to the report, a commentary from the Chair of EFSA's Management Board, Sue Davies, was placed in „The Parliament Magazine‟.

o Following the external evaluation and the Management Board‟s recommendations, EFSA launched a call for tender on the redesign of its website.

o At the beginning of 2014, the EFSA Journal moved from SCISTRAT Department to COMMS Department to ensure a stronger integration of the EFSA Journal with EFSA‟s overall Communications strategy.

o The Internal Communication work plan for 2014 was endorsed. Among its main objectives it includes „information for action‟ and „engagement for performance‟.

CORPORATE – RESOURCES AND SUPPORT

Planning and Monitoring

o In January the Project Coordination Office (PCO) replaced the Mandate Review Committee (MRC) in the evaluation of the internal mandates requests. At the same time the PCO started mirroring the activities of the MRC for what relates external mandates.

o Variance reporting „actual vs. plan‟ (in terms of budget and FTE consumption) is being tested and will be distributed to project and process managers and sponsors starting from the second quarter of the year to support the improvement of the organisation‟s planning capability.

Institutional relations

o Within the framework of the 2012 discharge procedure, EFSA participated in a hearing with Agencies organised by the European Parliament Budgetary Control Committee (CONT). Among others, discussion focused on financial performance and independence.

o Together with the other EU Agencies which activities fall under the remit of the ENVI Committee, EFSA participated in a meeting with the ENVI Committee Chair, Matthias Groote, and the ENVI Secretariat to discuss around ways for better transparency and improved dialogue with the EP on the brink of a new term of office (2014-2019).

o Meeting of the network of Heads of Agency, with the participation of representatives of the Council secretariat, Commission and EP. Among others, the meeting discussed around human resources and the application of the 5% redeployment pool to so-called “cruising-speed” Agencies and the Commission‟s Roadmap proposal on, among others, the revision of the role of the Agencies Management Boards.

o EFSA participated to the launch event of the EXPO 2015 (European Parliament in Brussels, 29 January). The World Expo 2015 will be held in Milan from the1st of May to the 31st of October 2015. The theme is “Feeding the Planet, Energy for Life”. EFSA intends to organise a high level scientific conference.

o Meeting with DG SANCO and DG DEVCO to discuss EFSA‟s multiannual programme on international scientific cooperation 2014-2016.

Quality

o Quality management System (QMS): The Repository of EFSA Governance Documents has been made available on the portal. The External Review Working Group report was delivered. The corrective actions for Science regarding the 2012 Health Check were completed. The Health Check evaluation for the Departments of RESU and COMMS was completed.

o Document Management System (DMS): An external audit of the implementation of the Policy and file-plan was completed finding that both have been implemented in all units audited. The old LiveLink system has been successfully upgraded to the new version in a test environment.

Data protection

o Notifications were prepared on: EFSA‟s Application Desk stakeholders‟ database, authorisation for staff outside activities, prior information on publications by staff members, staff mission management and experts‟ participation in EFSA meetings and events.

o General review of existing notifications in the area of human resources: staff performance dialogue and staff recruitment process.

Court cases

o EFSA submitted its response to the appeal in Case C-615/13 P ClientEarth & PAN Europe v EFSA & Commission. This Appeal was lodged against the judgement of the General Court in Case T-214/11 ClientEarth & PAN Europe v EFSA concerning an access to documents request to which EFSA replied by disclosing all the documents requested with the exception of the names of the experts when linked to their comments in application of the legislation on the protection of personal data and settled case law on this matter. The European Commission lodged its response in support to EFSA.

Ombudsman o In complaint 1228/2011/MMN concerning the recovery by EFSA of the full installation allowance from a former staff member following the non

confirmation of the employment contract after the end of the probationary period, the Ombudsman notified to EFSA the closure of the case with a critical remark.

IT systems

o Alignment of all IT systems and services to new EFSA organizational structure following RASA reorganization and to the new Staff Regulations.

o Successful technical upgrade and user acceptance of Open Text Document Management System (on time, in full, on budget, with quality).

o Implementation of revised IT governance.

Outreach and support services

o Work has started on a reengineered process to lean the organisation of network meetings. Work is also ongoing concerning the future contract with the shuttle service provider in order to shorten waiting time at airports and improve customer satisfaction.

o A project aiming at centralising the logistical support to institutional meetings has been launched.

Financial management o On 28 Feb. 2014, € 17.47 million or 21.94% of the € 79.63 million budget was committed, and € 8.15 million or 10.24% of the € 79.63 million

Overall, EFSA activities in the first two months of 2014 are on track: 59 scientific outputs and 16 supporting publications have been adopted. At this early moment in the year, there are no evident concerns in relation to the attainment of the yearly targets.

Item 3: 3 scientific report of EFSA adopted ahead of target date. Item 9: At the end of February, EUR 1 million was paid against the EUR 1.22 million expected to be paid (18% below target) Item 13: This result has been largely determined by the late adoption of reasoned opinions on MRLs (14 out of 15 adopted reasoned opinions were late): to be noted that this bulk re-evaluation is a one-off exercise with a very high number of small evaluations of individual MRLs related to pesticide active substances, for which the initial legal deadline set by the Commission has long been recognised as overambitious. An action plan has been developed in order to absorb the backlog by 2015.

Questions in “Clock Stop”: Compared to the data reported to the Management Board in December 2013 (as of end November 2013), the total number of questions in stop-the-clock remains stable, with a reduction in the FEED area and an increase in the FIP area.

Questions “Overdue”: Compared to the data reported to the Management Board in December 2013 (as of end November 2013) there has been a reduction in overdue questions for PRAS (mostly due to the adoption of reasoned opinions/MRL), a slight decrease in the area of FEED (re-evaluation of feed additives) and an increase in the FIP area (flavourings and food colours), for which a new deadline is being agreed with the European Commission.
