B.F. Fields Moving & Storage is marking a major milestone this year by operating in the Erie area for 110 years. Briefly share with our readers how the company got its start. Benjamin Franklin Fields founded the company in 1905 with a wagon and a team of horses. In those early days, the basic service was moving people’s household goods.

How did the company evolve to where it is today? Until 1947 the company was located at 22nd and Raspberry. We became agents for North American Van Lines in 1947, which allowed us to offer services worldwide, and the company was taken over by Ben’s daughter and son-in-law, Helen and Tony Milano. As the company grew, it needed larger warehousing capacity and, in 1958, the company moved to 848 East 12th Street. In 1972, Helen and Tony retired and the business was then taken over by their son and daughter, Bob Milano and Gerri Hammond, and my father, Richard Squeglia. In 1996, the company was sold to my father and I, and, in 2000, we moved to our current location at 945 Downing Avenue.

Presently, B.F. Fields Moving & Storage coordinates moves for the military, businesses, families and corporate employees originating anywhere in the world. Describe some of the services offered at your offices and warehouse facilities in Erie. Over the years the company expanded into other services including transportation of sensitive electronics, hospital equipment and commercial storage. We also are heavily involved in asset management for hotel renovations, college dorm construction, and new restaurant/business constructions. This entails receiving, warehousing and delivery of all items needed to outfit these institutions. We also provide final mile deliveries of various Internet products throughout the tri-state region. Our trucks can be found making in-home deliveries to locations in New York, Ohio, and into many of the surrounding counties in Pennsylvania.

How many people do you employ and how diverse are their job roles? While our employment levels may vary, we consistently employ a minimum of 13 people. Their tasks vary from sales, accounting, logistics management, packing, loading, and the transportation of residential and business items.

The moving-and-storage business is focused on exceptional customer service. Tell us about how you deliver this experience, including the use of your satellite tracking system in your operations. Gerry Hammond established the foundation for our customer service philosophy, and we have continued to build upon it. We believe that exceptional customer service comes from having a team of employees that enjoy working for your company. I know it may sound like a cliché, but I feel if our employees are happy that extends to the service they provide to the customer. Regarding our satellite tracking system — it allows us to stay in constant touch with our drivers, ensuring the customer is kept up to date on the status of their goods and the timing of their delivery.

Finally, what do you believe is the secret to B.F. Fields’ longevity? The longevity of this company is attributed to my father, Richard Squeglia, and the manner in which he handled the company’s fiscal and operational issues, as well as continuing the company’s philosophy of always putting the customer first; his contributions provided a strong foundation for us to leverage our future growth. To this day, with more than 100 years of combined knowledge in the industry, our employees continually work to find solutions for our customers, whether it is moving household items across town, a piece of machinery across the globe, or providing storage and management for a hotel construction site.

Business BuzzEASTERN ALLIANCE TO ISSUE WORKERS’ COMP DIVIDENDS The Manufacturer & Business Association (MBA) is pleased to announce that 56 eligible member companies participating in its Workers’ Compensation Group Dividend Program through Eastern Alliance Insurance Group (EAIG), will receive a dividend payment. These eligible members were participants during the Program’s 2011-2012 group dividend year and will receive their proportionate share of the $70,000 group dividend payment, based on their audited premiums for that time period. The 2011-2012 group dividend year covers Program policies with effective dates from July 1, 2011 through and including June 30, 2012.

According to the Association, “The group dividend is one of the unique features of our Program and a driving reason why the MBA chose to sponsor it. Through our partnership with EAIG, we are proud to make available to our members, both small and large, the opportunity to earn a dividend on their efforts to maintain a safe work environment.”

Since 2009, the MBA and EAIG have partnered on the workers’ compensation program to provide competitive rates, superior claims and risk management service, with the potential to earn a group dividend. The dividend potential is contingent upon the entire group qualifying from an overall premium standpoint, and the group’s program year loss ratio (in the aggregate) being favorable for that given year.

Legal BriefIs Your Business Fully Prepared for a Fire, Spill or Similar Emergency?

Events such as fires, explosions or major spills can have a sudden and drastic impact on your business. While business owners typically have at least a basic evacuation plan and know to call 911, not all businesses take the additional steps needed to prepare fully their facility personnel and emergency responders.

Significant advance preparation is needed to truly minimize the effects of such a disaster. There have been several local instances where fire departments have delayed entry to a facility on fire because nobody knew exactly what materials were burning and what toxins that fire might be emitting. As a result, firefighting efforts were hampered and delayed, and the value of the property loss and the size of the business interruption grew due to something as simple as a missing material safety data sheet (MSDS).

To the other extreme, there also was a local incident where responders entered a fire scene without fully knowing what was burning, resulting in more than a million dollars in damage to firefighting equipment and numerous firefighters seeking treatment for respiratory problems. In both cases, this is a nightmare scenario for a business owner, and it is the type of event that could challenge the very existence of a business.

Resources Available Fortunately, with a reasonable amount of effort up front, the likelihood of such a scenario playing out at your facility can be greatly reduced. As an initial matter, there are several regulatory programs that require many facilities to have formal plans in

place to deal with such emergencies. The Pennsylvania Department of Environmental Protection has a document on their website entitled “Guidelines for the Development and Implementation of Environmental Emergency Response Plans” to help facilities develop a spill/emergency response plan that will comply with numerous state and federal regulatory requirements. Preparing such a plan and having it available and accessible in an emergency (and not only located inside the facility) is a critical planning step.

In addition, facilities that store in excess of a threshold quantity of any extremely hazardous substance (EHS) are required under federal law to work with the Local Emergency Planning Committee (LEPC) to develop an offsite plan to deal with a chemical spill or release. You might assume that your facility does not have any listed EHS chemicals onsite, and certainly not in excess of a threshold quantity. However, this is a dangerous assumption as planning thresholds can be exceeded by something as seemingly innocuous as several battery powered lift trucks (due to the presence of in excess of 1000 pounds of sulfuric acid in the batteries combined).

All manufacturers and other entities with chemicals stored or used onsite should contact their LEPC to review their need for an offsite plan as well as to understand the additional Tier II reporting requirements that apply to other hazardous substances stored onsite. In Erie County, that contact is made through the Erie County Department of Public Safety. Data

provided to the Erie County LEPC is shared with Erie County’s Hazardous Materials Response Team as well as all local fire departments.

Upcoming Workshop The Erie County LEPC has scheduled a training workshop for facility personnel for the afternoon of February 12, and businesses are encouraged to attend. The workshop will be geared toward working with facility Environmental Health and Safety personnel to evaluate chemical hazards, gather data on chemicals and begin preparing plans for dealing with such hazards. Jim Berlin, founder and CEO of Logistics Plus, started with a vision for his company that has now grown to more than 350 employees and offices around the world.

Expertise and SupportLogistics Plus has certainly evolved since 1996 when Berlin was given a one-year purchase order to manage domestic inbound logistics for GE Transportation Systems, Erie’s largest employer. Today, Logistics Plus has services that are as diverse as its customer base, offering solutions to both large and small businesses looking for a strategic partner to help them with their transportation or logistics needs.

“We’re at our best when we can learn more about our customers’ businesses,” says Berlin, “and then do our thing so that they can focus on their core business.”

At Logistics Plus, the trade compliance function is an essential component of its solutions. Adam Mook, Compliance Department manager, and Gretchen Blough, a Licensed Customs Broker, are part of a global team of 25 professionals who ensure that everything coming into or going out of the country does so legally and in compliance with all of the various international laws and customs regulations that govern the shipment of goods.

“Our main goal is to help our customers understand what those global regulations are,” explains Mook, “and making sure that they are shipping their product in a compliant manner.

“There’s basically two ways to look at it,” he says. “If a U.S. company is exporting its product from here to say, Malaysia, they may be able to handle the function of getting out of the United States, but they often don’t think about all the documentation requirements, packaging or labeling of the products for the import process in the country they’re shipping to. That’s where we come in and help, not just in getting it out of the U.S. side, but we also tell them how to prepare their product in order to get it into the country and to clear customs.”

For example, if a customer has items that require U.S. Government issued licenses to export, Logistics Plus will go to that company’s location to learn about the product, from meeting with engineers who are designing it and what the intended use is, to who it’s sold to and who it’s end users are. This thorough research helps determine classifications and the appropriate export licensing regulations that apply to that specific product.

“We spend a week or two at the company to learn about the products, develop an export or import compliance program, in the form of a written manual, and conduct work-force training explaining the overall process for the company,” notes Mook. “Then, we have services beyond that, which we perform, remotely, after the initial engagement of learning about the products. Ongoing, we classify all of their products for both ECCNs (export control classification number) and HTS

(harmonized tariff schedule) code classifications, and we do that on an annual contract basis.”

The Logistics Plus advantage is providing customers all the support they need for their compliance and logistics needs.

“We add that expertise, and we add the customer service,” notes Blough. “There’s a lot of forwarders that have online sites that you can go to yourself, but you’re not getting a big picture there. You’re not getting someone that’s going the extra mile for you to make sure everything’s covered.”

The GEs of the world have their own teams to do that, where we help the smaller companies that don’t have that kind of expertise to read through the customs regulations and the country of origin requirements to qualify goods.”

recognized standard trade terms are used in sales contracts to make sure buyers and sellers know who is responsible for the cost of transporting the goods, including insurance, taxes and duties, to where the goods should be picked up from and transported to, as well as who is responsible for risk of loss or damage to the goods at each step during transportation.

However, experts say Incoterms® are often the most misunderstood and underrated aspect of an international shipment transaction. “If you’re negotiating with someone who is much more savvy than you, you’re going to end up paying a lot more for your shipment than you originally anticipated,” notes Blough.

Mook, who regularly hosts training seminars to assist businesses with Incoterms®, says he often hears of companies that weren’t prepared for how to maneuver in the international marketplace.

“There was one seminar attendee who had sold a shipment of steel product to Poland. The seller sold on the Incoterms® rule called ‘delivered duty paid,’ where the seller has to pay for all the transportation costs, any duty and taxes in the country of import and also handle import clearance responsibility. The sale was a $400,000 sale, and there was a 15-percent duty rate on that type of product in Poland. In addition to that, there was 17-percent value-added tax, and they had to pay for all the customs fees on top of the freight. They actually lost money on the sale.”

But what’s in store for the future is anybody’s guess.

“I always joke that I don’t know for sure what’s going to happen today, no less a year or two from now, but our overall motto is to grow, and we will continue to do that because of our talent, our energy, our passion and our continued record of success,” says Berlin. “Growth equals opportunity — and more fun — so that is our mantra.”

As far as downtown Erie is concerned, there is also more work to be done.

“When we bought Union Station 10 years ago, we talked about it being the foundation of a renaissance in downtown Erie,” Berlin says. “And, though there have been some missteps I think, I believe that now we are beginning to see a renaissance take hold, and I do predict that a couple of years from now, the Union Station Square neighborhood will be a vibrant community — a long way from where it was when we first got here.”

In many ways, Logistics Plus is a symbol of what’s possible for any business when you have the right vision and the right people working together to make things happen.

The 2014 midterm election represented a major political sea change in Congress, where a larger than expected Republican surge has dramatically changed the political composition of both the Senate and House. While political pundits are correctly cautioning against overly ambitious predictions of policy change as a GOP Congress struggles to legislate in the face of presidential vetoes, political telltales suggest that the congressional gridlock of the past few years may be diminished as new areas for common ground may present themselves.

All eyes are on the Senate, where a potential nine-seat shift to the Republicans has produced the most dramatic ideological shift to the right in memory. The new Republican majority will be constrained by Senate cloture rules, which will require them to collaborate with select Democratic members to achieve by key legislative initiatives.

Equally significant in the political equation is the U.S. House, where Speaker Boehner and his leadership team have received a 15-seat boost — more than was predicted, and in the face of a real financial disadvantage. This new majority is more geographically diverse than that of the last Congress, but also far better constituted to move major legislation.

With this sea of change, the manufacturing community can anticipate that several key issues will be in the forefront:

International Trade To the extent that the Obama administration aspires to lead on trade policy, the new Congress is clearly well positioned to be a strategic partner. The election has produced what will likely be the most pro-trade Congress in recent memory, with the leverage of protectionist forces like the AFL-CIO and the environmental movement drastically reduced. The United States Trade Representative has prioritized completion of a Trans-Pacific Partnership (TPP) in coming months as a centerpiece for the administration’s “pivot to Asia,” with a number of contentious issues still in play. Also in the negotiation process are new trade agreements that are likely to dramatically impact the global trading system: the Transatlantic Trade and Investment Partnership (TTIP), an integrated US-EU Free Trade Agreement that could break new ground on regulatory cooperation and market integration; and a Trade in Services Agreement (TISA) to lower non-tariff barriers to the free international flow of services. Hopes are high that TPP will receive a favorable response from Congress if completed in coming months. However, the Obama administration has never aggressively pursued Trade Promotion

Authority (TPA), a process that authorizes the Executive Branch to negotiate complicated and balanced trade pacts and present them to Congress for a single vote.

Tax Policy The demand for tax reform is enormous, but the majority in Congress and the Obama administration see the issue differently. Republicans would like to make the tax code more competitive by simplifying the system and lowering rates to stimulate economic growth. The Obama Treasury is focused on eliminating tax preferences to generate greater revenue, with sympathy for some rate reduction. Tax reform will catch fire in this Congress despite the ideological differences, with the possibility of some limited reforms becoming law. Key players in the debate will be Chairman Orrin Hatch and Ranking Member Ron Wyden of the Senate Finance Committee and Chairman Paul Ryan of the House Ways and Means Committee; local voices will include Senators Casey and Toomey and Congressman Kelly, all key votes on the tax writing committee.

Health Care No, Virginia, they won’t repeal ObamaCare, but they sure will try. After facing a presidential veto, the legislative calendars will be filled with the narrow changes in the more unpopular components in the law as a strategy for highlighting its weaknesses and undermining its delicate architecture. Expect limited bills to repeal business and personal mandates, the unpopular medical device tax, and the Cadillac tax on premium health plans, among others. The final fate of the Affordable Care Act is unlikely to be decided until after the 2016 election.

Energy and the Environment The new Congress will move quickly to propose a pro-market energy initiative linking increased energy production to energy innovation and economic growth. Expect a battle royale over tax and regulatory incentives for renewable energy and offshore oil and gas development. I also anticipate a serious debate in Congress over the new EPA clean air rule and the U.S.-China agreement to limit greenhouse gas emissions. The forecast: a generally pro-production agenda with a continuing path to national energy independence.

Bottom Line In general, citizens can expect a more deliberate, aggressive and active Congress, with its productivity a matter of partisan speculation. Republicans will get what they sought: responsibility, an opportunity to guide legislative policy — and ultimately blame.

HR ConnectionFAMILY BUSINESS SURVEY SHOWS NEED TO `PROFESSIONALIZE’ Family businesses must adapt faster, innovate sooner and become more professional in the way they run their operations if they are to remain suc-cessful. These are just some of the findings of the latest PwC survey of 2,378 family business executives in more than 40 countries worldwide.

The report — “Up Close and Professional: The Family Factor” — is PwC’s seventh survey of family businesses globally, covering more companies and markets than ever before.

Overall, the survey indicates that — despite a tough economic environment, with pressures around skills shortages, innovation and governance — family firms remain dynamic and resilient. Indeed, family businesses account for 70 percent to 90 percent of GDP globally, and are

an effective barometer of the health of the economy.

One eye-catching finding from this year’s survey is that the need to professionalize the business is gaining ground as a key concern for family firms, driven by an almost perfect storm of competitive pressure, rising costs and global megatrends. It scarcely registered in 2012, but now 40 percent of respondents agree this is a key challenge over the next five years. And it must be accompanied by an equally rigorous approach to professionalizing the family.

SURVEY: LARGER LOGISTICS COMPANIES BOOST SALARY OFFERINGS FOR NEW HIRES According to the findings of Logistics Management’s (LM) 30th Annual Salary Survey, young logistics managers are being wooed by competitive offers from large companies that come close to matching those of high-tech, finance

and engineering industries. At the same time, however, median earnings remain in line with those posted in 2013, indicating that veteran logistics managers should not expect the same pay incentives.

The report, conducted by Peerless Research Group (PRG), reconfirms findings from 2013 that young professionals can make the most of their fast track offers by continuing to enhance their career planning.

Management peers will be raising the bar, however, expecting aspiring workers to demonstrate thought leadership when it comes to the introduction of new technologies and strategic human resource initiatives.

Alan Beaulieu, president of ITR, an economic forecasting firm notes that by hiring multi-skilled professionals now, companies can secure a competitive advantage as the global economy stages a fresh rebound in 2015.

Trust is at the core of every successful relationship, both at home and in the workplace. For a leader, estab-lishing trust can be a challenge. One of the most effective ways to establish trust with your staff is to meet with them individually and build a rock solid relationship.

One way to do this is through something called the 5-10 session. Below is an example of how they work:

• Every employee has a weekly or bi-weekly meeting with you at a predetermined time.

• The meeting lasts five to 10 minutes and is held in a quiet, private location.

• The employee determines the subject of the discussion — nothing is off-limits.

• The subject matter can be

personal or professional; it is up to the employee.

• ALL employees participate.

Since, in most cases, this will be radical departure from how you currently communicate, it would be wise to have a general meeting explaining the meaning behind these meetings. If you just spring these on your employees, they will be suspicious of your intent and probably be afraid to speak freely.

It is also important to commit to the process and not stop these sessions after a few months. All indications are that people enjoy them and are upset when they abruptly stop for seemingly no reason.

As leaders, we tend to underestimate the impact we can have on the people we lead. Just five to 10 minutes out of

our week can both build and enhance trust that can immediately translate into more dedicated and productive employees. Give it a try, it is time well spent.

WHICH FORMS DO I USE AND WHERE CAN I GET THEM?You will use the Log of Work-Related Injuries and Illnesses (OSHA Form 300), the Summary of Work-Related Injuries and Illnesses (OSHA Form 300A), and the Injury and Illness Incident Report (OSHA Form 301). You must fill out the Log and the Incident Report only if a recordable work-related injury or illness has occurred. You must fill out and post the Summary annually, even if no recordable work-related injuries or illnesses occurred during the year. You can get the forms from OSHA’s Record-keeping page.

Employers get ready! The U.S. Department of Labor’s Occupational Safety and Health (OSHA) final rule for Occupational Injury and Illness Recording and Reporting Requirements takes effect on January 1, 2015. The final rule makes several changes that significantly expand reporting requirements for all employers.

Previously, employers had to notify OSHA of all work-related fatalities and work-related hospitalizations of three or more employees within eight hours of the incident. Under the new rule, employers are still required to report all work-related fatalities within eight hours, in addition to the following: 1) all work-related inpatient hospitalizations of one or more employees; 2) all work-related amputations; and 3) all work-related losses of an eye.

The new rule imposes a 24-hour reporting window for reporting these incidents. Also, as an added surprise

to employers, OSHA announced that employer reports of illness or injury will now be made public on OSHA’s website, which OSHA believes will act as an incentive for employers to increase safety for their workers.

Additionally, the new rule updates the list of employers partially exempt from OSHA recordkeeping requirements. Under the previous regulations, two classes of employers were partially exempt from routinely keeping records of serious employee injuries and illnesses, including employers with 10 or fewer employees and employers in certain low-hazard industries, as classified by the Standard Industrial Classification system. The new rule keeps the exemption for employers with 10 or fewer employees, but replaces the Standard Industrial Classification system, with the newer North American Industry Classification System. As a result, while some new industries will now be exempt, other employers in

industries previously exempt, must now comply with all OSHA’s recordkeeping requirements.

If you are not sure whether you are still partially exempt, OSHA’s webpage provides a list of the industries previously exempt that now will be required to keep OSHA injury and illness records. The webpage also provides step-by-step instructions to determine whether your company is categorized as an exempt industry under the new rule. All riggers are not created equal. The question is not how long a rigging company has been in business, but how long those running the company have been in the rigging and crane busi-ness. Rigging, by its very nature, is a complex service — not for the novice or faint of heart. No two jobs are ever alike — and even if they involve moving the same kind of machinery, every location has its own unique cir-cumstances, and every machine its own challenges. HARTMAN GROUP WELCOMES ACCOUNT EXECUTIVEThe Hartman Group recently hired John Confer as an account executive.

Confer will be work-ing in the Williamsport office with the personal lines team providing service and value for Hartman Group clients’ individual insur-ance needs.

Confer is a graduate of the Pennsylva-nia College of Technology and holds a degree in business management. He holds PA Insurance licenses in Accident & Health, Casualty and Allied Lines, Life and Fixed Annuities, Property and Allied Lines.

MERRILL LYNCH ADVISER EARNS DAVID BRADY AWARDJohn Masterson, an Erie-based Merrill Lynch adviser, was one of 10 employees recently honored with the 2014 David Brady Award at a ceremony in New York for his outstanding philanthropy, client focus and overall commitment to his company and community.

The award is named for David Brady, a New York-based financial adviser who died in the terrorist attacks of Septem-ber 11, 2001. He was highly respected for putting the client first and giving back to his community. The award that bears his name was created in 2007 and seeks to honor individuals within Bank of America’s Global Wealth and Invest-ment Management division, which includes Merrill Lynch and U.S. Trust. Award recipients were joined by Brady’s family members, senior leaders and past

award recipients to hear the inspired stories of this year’s winners — all nomi-nated by their colleagues.

“David Brady lived the ideal of tirelessly helping clients, his colleagues and com-munity every day of his life. That’s why it is a great honor for me to congratulate those who have the strong dedication to excellence, client service and com-munity that David exemplified, and is embodied in the David Brady Award,” said Dwight Mathias, managing director of the Western Pennsylvania complex of Merrill Lynch.

In 1998, Masterson joined Merrill Lynch as a financial adviser where he provides planning and investment management services to his team’s clients. Masterson, currently serving as the senior resident director of the Erie office, works along with 16 other financial advisers and associates and is proud of his firm’s involvement in the community.

McCARTHY HONORED FOR COMMUNITY SERVICEErie Housing and Development Ser-vices (HANDS) recently honored William F. McCarthy, president and CEO of Stairways Behavioral Health, with the Charles R. and Katherine L. Scalise Community Service award.

The honor is awarded to an individual who has made significant contributions in their advocacy and impact on public social issues regarding at-risk popula-tions and for their leadership in produc-ing work of lasting impact.

HANDS President/CEO Charles G. Scalise introduced McCarthy as the award’s recipient at the organization’s annual Community Celebration at the Erie Art Museum. The award bears the name of Scalise’s parents and HANDS founding board members.

McCarthy is the president and CEO of Stairways, a provider of mental health services to Erie County residents for more than 50 years. He began his Stair-

ways career more than 40 years ago and has served in a variety of positions before becoming the organization’s leader in 1998.

HANDS is a nonprofit organization that provides opportunities for resi-dents, families and senior citizens by developing and managing quality affordable housing. HANDS has been instrumental in the production of more than 1,000 units of affordable housing in nine counties across north-western Pennsylvania.

LANZILLO INSTALLED AS 2015 ERIE COUNTY BAR ASSOCIATION PRESIDENT Richard A. Lanzillo has been installed as the 2015 president of the Erie County Bar Association (ECBA). His presidency, which took effect January 1, 2015, was announced at the ECBA Annual Meeting on Decem-ber 4, 2014 at Lake Shore Country Club.

The Erie County Bar Association serves the lawyers, judges and the public of Erie County, Pennsylvania by assisting members in the practice of law and by engaging in activities that promote the public’s understanding of and respect for the American system of law and justice.

Lanzillo currently serves as the vice president of Knox (since 2007). He has extensive experience in complex com-mercial, employment and civil rights litigation and appellate practice. He has lectured extensively on state and federal trial and appellate practice, as well as municipal, labor and commercial law topics.

Lanzillo is admitted to practice before the state courts of Pennsylvania and several federal courts, including the U.S. Supreme Court and the U.S. Court of Appeals for the Third, Ninth and Federal Circuits. He also regularly serves as a mediator and neutral evaluator in the Alternative Dispute Resolution Program of the United States District Court for the Western District of Pennsylvania.
