    1. What is the importance of mediation?The Court of Justice is in charge of the administration of 

     justice for the people. Its primary goal is to have disputes settledwith convenience, speediness and fairness. In addition to having

    disputes settled by means of hearing and rendering judgment,mediation is a method to resolve disputes which is commonly adoptedby courts of many countries. Mediation is a dispute resolutionmechanism that can enable a convenient, speedy and efficientsettlement. In mediation, the disputing parties may achieve amutually satisfactory settlement in which there is no loser or winner from the outcome. In mediation, both parties can emerge as thewinners with a win-win solution that can preserve their long-termrelationship. Last but by no means, the least, settlement of disputeby mediation also can lead to a more peaceful and harmony society,reduce the number of cases going through the trial process, andprovide a chance for people participation in the dispute settlementprocess.

    2. Court-annexed mediation is the mediation conductedwhile the cases are still pending in court. A mediation may bearranged by the court to seek for a mutually acceptable solution for the pending cases. If parties can reach an agreement as a result of the mediation, the parties may then withdraw the plaint or enter intoa compromise agreement. Such agreement may be proffered to the

     judges responsible for the relevant case; the judges then may render a judgment on agreed-terms. In the case that the parties can settleonly some of the issues in dispute, the court will conduct theproceeding for the remaining issues.

    7. What is the mediation process?

    1. To enter into an out-of-court mediation, the parties tothe dispute may appoint a neutral third person to facilitate themin finding a mutually acceptable resolution for the dispute. In theappointment of the neutral third person, the parties may consult eachother and agree as to the person to be appointed, or may request anorganization to arrange the mediation for them.     If the dispute referred to mediation is not settled, thedisputing parties where required to appear before the Court have tostrictly comply with the summons and the defendant still has tofile a written answer where such prescribed period has not expired.

    However, the parties may file a motion requesting to extend theprescribed period, or adjourn the date of proceeding on the groundthat their dispute is under the mediation process.

    20. Is there any difference between in-court and out-of-court settlement? If so, what is the difference?

    Out-of-court settlement is the settlement that the partiesreach in their negotiation and reduce the terms of settlement into awritten instrument called ça compromise agreementé which willafterwards represent the new rights and obligations to be compliedby the parties. If any party fails to comply with such agreement, itwill be a basis for enforcement procedure against such party.

    In-court settlement is the settlement that the parties reachin course of or during court proceedings by entering into acompromise agreement. The parties may then request the court torender a judgment on agreed-terms. Such agreement incorporatedin the judgment may be enforced without initiation of the newlawsuit if a party fails to comply with the terms of the settlement.

    Where a plaint has been withdrawn, the Court may order to

    partially refund the Court fees to the parties, without ordering to paythe lawyer fees.Where the parties come to a compromise, the Court may
