The 25th Meeting of the Board of Governors was held on 6th & 7th August, 2013, at 11.00 A.M.
in the Council office at Sector-8, Pocket-14, Dwarka, New Delhi-110077. The following members of the

2.2 Review of Recruitment Rules for the post of Secretary, MCI in the context of PIL filed by Indian Medical Association before the Hon’ble High Court of Delhi : Additional Secretary to make
presentation of the case before the BOG in the meeting on 7.8.2013.
2.3 Consideration of cases for continuation of Recognition of medical colleges, as per UG Committee’s recommendation : The decision taken is as indicated in Annexure-1.
2.4 Recognition of Saraswathi Institute of Medical Sciences, Hapur -consideration of Lucknow Bench of Hon’ Allahabad High Court’s Order dated 24.7.2013 regarding : After discussion, it was
decided to recommend to MoH&FW grant of Recognition to the Medical College.
2.5 Karuna Medical College, Palakkad – Continuance of provisional affiliation for the academic year 2013-14 granted by Kerala University of Health Sciences : After discussion, it was decided that
the Council may write to the Government that in the light of grant of recognition by the University for 50 MBBS
seats, necessary direction be issued.
2.6 Admission of 1st year MBBS students at Adesh Institute of Medical Sciences & Research, Bathinda and Chintpurni Medical college, Pathankot in the academic year 2011-12 : After
discussion, it was decided to issue Show Cause Notice as has been recommended by the Council earlier
regarding discharge of students who do not fulfill minimum eligibility criteria for admission to MBBS
Course.

2.7 Establishment of new medical college at Raipur, Chhattisgarh by Lord Buddha Educational Society, Raipur, Chhattisgarh for the academic year 2013-14 u/s 10A of the IMC Act, 1956 : In the light of Hon’ble Supreme Court’s direction in WP(C) No.468 of 2013 dated 12.7.2013, the
Board of Governors have decided to conduct physical verification of the compliance of deficiencies
submitted by the College authorities vide their letter dated 26.6.2013.
2.8 Mayo Institute of Medical Sciences, Barabanki, U.P. – Renewal of permission for
admission of 2nd batch of 150 MBBS students for the academic year 2013-14 u/s 10A of the IMC Act, 1956 : It was noted that the Council, vide letter dated 19.6.2013, conveyed approval of the Board of
Governors for renewal of permission for admission of 2nd batch of 150 MBBS students at Mayo Institute
of Medical Sciences, Barabanki (U.P.) for the academic year 2013-14, subject to –
(a) Submission of PNDT Certificate & Blood Bank License.
(b) Rectification of the following deficiencies and other deficiencies pointed out in the
Assessors Report :
“1. Resident shortage by 8.53%. The department wise shortage is as under –
(i) General Medicine – 03
(ii) General Surgery – 1
(iii) Rest are JRs”

The College vide letter dated 20.6.2013 submitted the compliance Meanwhile, the Council
received on 1.7.2013 copy of the letter dated 21.6.2013 from Registrar, Dr. Ram Manohar Lohia Awadth
University, Faizabad addressed to the Managing Trustee, Bodhisatva Charitable Trust, Lucknow,
stating therein that the Dr. Ram Manohar Lohia awadh University, Faizabad has not granted affiliation to
the above College for MBBS course. The matter regarding renewal of permission for admission of 2nd
batch of 150 MBBS students at Mayo Institute of Medical Sciences, Barabanki (U.P.) for the academic
year 2013-13 along with the compliance dated 20.6.2013 and letter dated 21.6.2013 received from the
Registrar, Dr. Ram Manohar Lohia awadh University (U.P.) 2nd & 3rd May, 2013) has been considered by
the Board of Governors, at their meeting held on 9.7.2013 and it has been decided as under :
“Disapproved the proposal (The decision communicated to the college on 19.6.2013 is required to
be revoked in view of the withdrawal of Consent of affiliation to the College by the Awadh
University…”
Accordingly, the Council vide letter dated 14.7.2013, revoked the renewal of permission for
admission of 2nd batch of 150 MBBS students at Mayo Institute of Medical Sciences, Barabanki (U.P.) for
the academic year 2013-14, which was granted by the Council vide letter dated 19.6.2013.
In reference to above, the Council has received a letter dated 16.7.2013 from the Director Principal,
Mayo Institute of Medical Sciences, Barabanki (U.P.), In additional to above, the Registrar, Dr. Ram
Manohar Lohia Awadh University, Ghaziabad (U.P.) vide letter dated 16.7.2013 forwarded a copy of
Consent of Affiliation dated 16.7.2013 addressed to the Managing Trustee, Bodhisatva Charitable Trust,
Lucknow, with copy to the Council. In view of above position, it was unanimously decided that the

decision taken earlier may be reiterated as the Consent of Affiliation was actually issued and received
on 16.7.2013, which was beyond the last date for issue of renewal permission.
2.9. Readmission of Sri Tony J. Manual at Jubilee Mission Medical College & Research Institute, Thrissur : The Board of Governors noted that Sri Tony Joseph Manuel had been admitted to
MBBS course during the academic year 2004-05. He had passed his 1st BBS in January, 2006. He
passed Microbiology & Forensic Medicine of the II MBBS in May, 2008 and was absent from 15.9.2008
to 10.1.2012, due to depressive disorder as per the Medical Certificate. The Principal, Jubilee Mission
Medical College & Research Institute, Trissur has permitted him to continue his studies with effect from
9.1.2012 after a leave period of almost 3 ½ years, subject to the approval of the University. The Deputy
Register of University of Calicut, Kerala has now requested for the MCI’s consent on regularization of
readmission of the above candidate. After considering all aspects of the case, the Board of Governors
unanimously decided that the request for regularization of the readmission of the candidate cannot be
agreed to as there has been a wide gap in this case.
2.10 PG Courses - Recognition cases : Recognition of various Postgraduate qualifications and
Issuance of Letter of Permission at Mahatma Gandhi Medical College and Hospital, Jaipur under
Rajasthan University of Health Sciences, Jaipur u/s 11(2) of the IMC Act, 1956. - Pvt. - Rajasthan were
considered and decided as under :
Matter was discussed in Board of Governors Meeting on 06/08/2013. The vigilance section was also
called, and it was conveyed that there is nothing pending by CBI against this

institute. The Postgraduate Meeting made the observation based on comparative analysis of PG assessment
reports of inspections of departments and the UG surprise assessment report and the Board of Governors decided
as under : ‐
1) May be recommended for recognition of 03(Three) seats in MS(OBG) qualification with suggestion to improve the clinical workload (Particularly nos. of major surgeries) and proper maintenance of the admission register and operation register (Deficiency in the nos. of Assistant Prof. (2) during surprise UG visit on 29-30.05.2013 was found corrected on day of examination on 22.06.2013).
2) May be recommended for recognition of MD(Paediatrics) qualification with 02(Two) seats. No deficiency is identified during the surprise assessment for UG course done on 29-30.05.2013.
3) May be recommended for recognition of MS(General Surgery) qualification for 04(Four) seats. the deficiency of SR in the dept. of surgery as pointed by the surprise assessment by UG course on 29-30.05.2013 was corrected during exam on 31.06.2013. No publication from the dept. in any journal since 1992.
4) In the year 2012 no admission took place due to non-availability of the students. May be recommended for recognition of 04(Four) seats in MD(Pharmacology) qualification. (Surprise assessment for UG course on 29-30.05.2013 pointed no deficiency in the faculty strength in the department.)
5) may be recommended for recognition of 01(One) seats in MS(Ophthalmology) qualification.
6) May be recommended for recognition of MD(Anaesthesia) qualification with 05 (Five) seats.

The Board of Governors decided that faculty should complete training in MCI Basic Course Workshop in Medical Education Technologies either, before joining service but after selection, or during the probation period.

Board of Governors decided that twinning of new medical colleges for PG / superspecilatty courses should be on the basis of specialty areas. This would be discussed in the meeting of the Board of Governors to be held after 15th August, 2013. The Chairman, Academic Council or her nominee may be invited to attend the discussion.

2.14 Show Cause Notices due to CBI Report : The case of Vinayaka Mission’s Medical College &
Hospital, Karaikal was discussed in brief. It was observed by the Board of Governors that such individual
case of Colleges may be put up in the respective files with comments of Secretary and Law Officer
mentioning specific Action Points on which approval of the BOGs is required.
2.15 Letter from MoH&FW regarding representation of Shri Pratik Singh for grant of Eligibility Certificate for pursuing medical education : The Board of Governors noted the contents of Ministry
of Health & Family Welfare’s letter dated 27.5.2013 stating, inter alia, that consideration of Shri Prateek
Singh’s case as one-time measure, would lead to penal consequences/contempt of Court in the light of
Supreme Court’s specific directions that future cases (beyond 15.3.2001) shall be governed by the
revised guidelines.
2.16 Hearing to be given to Kushal Education Trust, Jaipur (regarding Kushal Medical College, Jodhpur). on the basis of Court Order : Hearing was given to the Trust/College on 7.8.2013. After
discussion, the Board of Governors decided that the financial documents submitted by the College
authorities be re-examined by the Auditor and thereafter, a speaking order be issued in consultation with
the Law Officer.
2.17 IMA Representation regarding rural posting of Doctors - questions raised about its feasibility : The Board of Governors considered the various suggestions contained in Indian Medical

2.18 Setting up of a Regulatory Commission on the line of HP Private Educational Institution for ensuring appropriate standards of medical education in private higher educational institution: After discussion, the Board of Governors decided to refer the matter for obtaining views of Law Officer
before further consideration. .
2.19 Dr. H.S. Chhabra, Secretary, Association of Spine Surgeons of India’s letter dated 2.8.2013 regarding Orthopaedicians providing spinal care including surgery to patient : After discussion
in detail, the Board of Governors decided that the Orthopaedicians may also provide for spinal care
including surgery to the patients.
2.20 Permission of Supreme Court of India for 4th round of Counseling in All India Quota : The
Board of Governors noted the Order dated 30.7.2013 of the Hon’ble Supreme Court in W.P. © No.433 of
2013 – Dr. Fraz Naseem and Ors. v/s Union of India and that the requisite compliance has to be carried
out by the DGHS

2.21 MCI Participation in 5th Technical Meeting of Medical Councils Networking under the aegis
of WHO in South East Asiasn Region being held at Bangkok in 2nd week of August, 2013 : After
discussion, the Board of Governors felt that the event is an important forum for getting exposure to the
new ideas and benefit of networking of the entire gamut of policy making in the field of medical
education in South East Asian Region. Considering all these advantages, the BOGs have decided to
take part in the event by deputing a three Member team from MCI’s side.
2.22 Furnishing of MCI’s comments on Counsel General of India, Kingdom of Saudi Arabia’s letter regarding problem faced by Indian health professionals in Saudi Arabia pertaining to equivalence of their degrees with health professionals from other countries working in Saudi Arabia : After discussion, the BOGs felt that, in the first instance, it is necessary to look into the
comparative position of the course contents, curriculum, duration, total hours of study (theory &
practical) of the 4 year-post graduation course obtaining in countries like, UK, USA, Saudi Arabia, Egypt
vis-à-vis those included in our 3 Year-post graduation courses in India. Since the PG course contents,
curriculum, duration, total hours of study (theory & practical) in medical education all over the world are
more or less the same, the idea of conducting a comparative study of these aspects is to see whether
our 3 year PG Courses are not really covering all the above aspects during their 3 year PG programme
and if that is so, then there is a strong case for us to argue that the Indian 3 year PG Course should be
equated with that of 4 year PG courses prevalent in other countries. After discussion, it was decided that
our Equivalence Committee should study the comparative picture and submit its recommendation for
further consideration by the BOGs.
