200 Commerce Avenue, Williston Environmental Disclosure The property is within a neighborhood that has experienced chemical contamination and has been designated as a superfund site by the U.S. Environmental Protection Agency. The contamination dates back to the 1960’s and the source of the contamination is believed to be the property formerly leased to Mitec Systems to the north of the subject property. Identified groundwater contaminates include tetrachloroethylene (PCE), trichloroethylene (TCE) and dichloroethylene (DCE) compounds. Multiple test wells are located throughout the neighborhood and periodic testing is performed to track the status of the underground plume.

The EPA recently conducted a remedial investigation of the area to determine if changes have occurred in the concentration and location of the plume. The investigation involved vertical profiling in which groundwater was tested at various depths. So far, results of this testing have not been produced. Per the project manager, the timing for publicly available information is one to two years.

The contamination is present within groundwater that ranges between approximately 35 and 40 feet beneath the earth surface. If used as a potable water supply, the groundwater would constitute a health risk through ingestion, dermal contact or inhalation. Since the neighborhood is served with municipal water, direct contact is not likely given the depth of the groundwater. One potential area of concern would be vapors emitted through the soils between the groundwater and the earth surface. The subject property is built upon a slab rather than an excavated basement, which limits the potential for vapor collection. If there were a concern of vapor emission, a passive ventilation system could be developed to provide an acceptable solution at a reasonable expense. The exact cost of such a system is not known without specific contractor quotes, but is estimated between $5,000 and $10,000. The necessity for such a system I not known and cannot be determined without further information.

Karen Lumino, Remedial Project Manager for the U.S. Environmental Protection Agency, indicated that the data available does not give reason to believe that the subject property is the source of the contamination. The past and present uses of the subject property also suggest a low likelihood of liability. Further, Mrs. Lumino stated that a property owner would not be held liable so long as the owner has not caused or contributed to the contamination. Further, a potential buyer for the property would be able to apply for liability limitation through the “bona fide purchaser exemption”. Mrs. Lumino indicated that it is uncertain if contamination exists within the subject property and that the presence of contamination would not likely imply financial liability on the part of the current or a future owner.
