The purpose is to site grade within the Regulated Area of the Humber River Watershed to facilitate topsoil stripping, underground servicing and a temporary sediment control pond associated with a residential draft plan of subdivision. 41

    EX10.8 REGIONAL MUNICIPALITY OF PEELTo construct, reconstruct, erect or place a building or structure, site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Old Church Road from Marilyn Street to 680m east of Innis Lake Road, in the Town of Caledon, Humber River Watershed as located on the property owned by Regional Municipality of Peel. The purpose is to reconstruct Old Church Road from Marilyn Street to approximately 680 metres east of Innis Lake Road Intersection in the Town of Caledon. The Redside Dace fisheries timing window will be applied to this project unless otherwise specified in writing by the Ministry of Natural Resources (MNR). Through review of the information provided and identified in the Summary of Plans section, TRCA is of the opinion that the project and implementation as proposed will not cause serious harm to fish. 43

    TOWN OF WHITCHURCH-STOUFFVILLE

    EX10.9 1589212 ONTARIO INC.To construct, reconstruct, erect or place a building or structure, site grade and temporarily or permanently place, dump or remove any material, originating on the site or elsewhere on Part Lot 11, Concession 8, (13876 Ninth Line), in the Town of Whitchurch-Stouffville, Duffins Creek Watershed as located on the property owned by 1589212 Ontario Inc. The purpose is to allow development within a Regulated Area of the Duffins Creek Watershed to facilitate the development of a residential estate lot subdivision at 13876 Ninth Line, in the Town of Whitchurch-Stouffville. 45

    EX10.10 STANDARD DELEGATED PERMITS 47

    Standard Permits are implemented by Planning and Development Division staff and are received monthly by the Executive Committee. Standard permits are subject to the authorization of designated staff appointed as Enforcement Officers, as per Authority Res.#A199/13. Standard permits are non-complex permissions consistent with TRCA approved policies and procedures and issued for a time period of two years or less.

    ____________________________________________________________________________KEY ISSUEAcquisition of property located south of Queen Street East and west of the Don River in the City of Toronto, under the "Greenlands Acquisition Project for 2011-2015", Flood Plain and Conservation Component, Don River watershed.

    RECOMMENDATION

    THE EXECUTIVE COMMITTEE RECOMMENDS THAT 3.2 hectares (8.0 acres), more or less, of land including the flood protection landform, located to the south of Queen Street East and west of the Don River in the City of Toronto, said land being parts of Block 7, 8, and 9 on Registered Plan 66M-2473, designated as Parts 1 to 7, 9 to 19, and 23 on draft R-Plan from Holding Jones Vanderveen Inc., dated as October 14, 2014 and referenced as Job No:. 05-1670- REF23, be purchased from Infrastructure Ontario;

    THAT the purchase price be $2.00;

    THAT TRCA receive conveyance of the land free from encumbrance, subject to existing service easements;

    THAT the firm of Gardiner Roberts LLP, Barristers & Solicitors, be instructed to complete the transaction at the earliest possible date. All reasonable expenses incurred incidental to the closing for land transfer tax, legal costs and disbursements are to be paid;

    AND FURTHER THAT authorized TRCA officials be directed to take the necessary actionto finalize the transaction including obtaining any necessary approvals and signing and execution of documents.

    BACKGROUNDResolution #A94/10 at Authority Meeting #5/10, held on June 25, 2010, approved the Greenlands Acquisition Project for 2011-2015.

    In 2003 TRCA initiated the "Lower Don River West Remedial Flood Protection Project" Class Environmental Assessment (EA) and it was successfully completed in September 2005. The Class EA included the creation of a Flood Protection Landform (FPL) on the west side of the Don River between Queen Street and the Canadian National and GO Transit rail lines.

    In 2007 construction began on the 8-hectare FPL. Infrastructure Ontario has led the development and construction of the FPL to standards identified by TRCA. The FPL has been incorporated into the design of Athlete's Village venue for the 2015 Pan Am / Para Pan Am Games. Also the unique topography of the FPL has been utilized to build Corktown Common Park, which is a signature piece of the community.

    The FPL and Corktown Common Park are organized into two distinct halves. The west, or 'dry' side, of the FPL will provide urban park recreational opportunities and park amenities such as trails, benches and a pavilion. The eastern half, or 'wet' side, of the FPL is defined by sloped topography that will see the creation of an urban prairie which includes an upland meadow on the upper slope, and a lowland wet meadow at the base.

    The subject lands are to be transferred to TRCA from Infrastructure Ontario (IO) on terms and conditions which are satisfactory to TRCA staff and its solicitor and are defined as the easterly side, or ‘wet' side, of the FPL.

    Following transfer of the subject lands to TRCA, permanent easements on other lands currently owned by, or to be acquired by, the City of Toronto would be negotiated and registered. These include portions of certain roadways and the westerly side, or 'dry' side, of Corktown Common Park. The proposed easements would allow TRCA access to the City-owned lands for the purpose of inspecting, repairing, servicing and maintaining the landform and would be the subject of a further staff report to the Authority.

    DETAILS OF WORK TO BE DONEDetails of the work to be done involving the subject lands include:

    Obtaining as-built drawings of the flood protection landform.Satisfaction of the environmental condition of lands. Registration of easements across City of Toronto lands.

    Negotiations have been conducted with Mr. Chris Farquhar, Project Manager, Major Projects Division of Infrastructure Ontario.

    Attached is a plan showing the location of the subject lands.

    RATIONALEThe subject property falls within TRCA's approved master plan for acquisition for the Don River watershed as outlined in the approved Greenlands Acquisition Project for 2011-2015.

    The lands to be acquired from IO would be parts of Blocks 7, 8, and 9 on Registered Plan 66M -2473 and include the flood protection landform work with associated grading and meadow landscaping.

    TAXES AND MAINTENANCEIt is proposed that the lands be turned over to the City of Toronto under the terms of the existing management agreement.

    FINANCIAL DETAILSFunds for the costs related to this purchase are available in the TRCA land acquisition capital account.

    ____________________________________________________________________________KEY ISSUEProposal to lease Toronto and Region Conservation Authority-owned land located in the vicinity of Bolton Heights Drive and Queen Street North, Town of Caledon, Regional Municipality of Peel, Humber River watershed, to construct and operate a cellular phone tower and associated equipment.

    RECOMMENDATION

    THE EXECUTIVE COMMITTEE RECOMMENDS THAT WHEREAS Toronto and Region Conservation Authority (TRCA) has been requested by Rogers Communications Inc. to enter into a lease arrangement for lands located at Bolton Heights Drive and Queen Street North, Town of Caledon, Regional Municipality of Peel;

    WHEREAS it is in the opinion of TRCA that it is in the best interest of TRCA in furthering its objectives, as set out in Section 20 of the Conservation Authorities Act, to cooperate with Rogers Communications Inc. in this instance;

    THEREFORE LET IT BE RESOLVED THAT TRCA enter into a lease with Rogers Communications Inc. of 0.008 hectares (0.020 acres), more or less, together with the use of a 0.020 hectare (0.051 acre) parcel of land for access and utilities for the construction and operation of a cellular phone tower and associated equipment, said land being Part of Lot 11, Concession 6, Town of Caledon, Regional Municipality of Peel;

    THAT the lease with Rogers Communications Inc. be premised on the following:

    (i) the initial term of the lease will be for five years, with three renewal options for successive five year periods subject to the concurrence of TRCA to the renewals;

    (ii) the lease rate is to be $16,830.00 per annum;

    (iii) Rogers Communications Inc. is to be responsible for all approvals required for construction of a cellular phone tower and associated equipment;

    (iv) Rogers Communications Inc. shall be solely responsible for all costs associated with the construction of a cellular phone tower and associated equipment;

    (v) any other terms and conditions deemed appropriate by the TRCA's solicitor;

    THAT an archaeological review is to be completed at the expense of Rogers Communications Inc. with any mitigative measures being carried out to the satisfaction of TRCA;

    AND FURTHER THAT the authorized TRCA officials be directed to take the necessary action required to implement the lease, including obtaining any necessary approvals and signing and execution of documents.

    BACKGROUND TRCA has been approached by Rogers Communications Inc. to utilize this site to locate their cell phone tower and associated equipment. The subject site is currently vacant the proposed installation is approximately 270 metres from the nearest residence.

    Town of Caledon Council approved on March 24, 2015 the construction and operation of the cellular phone tower and associated equipment site location.

    Rogers Communications Inc. equipment requirement for this proposal includes a tower not to exceed 40 metres in height together with an equipment cabinet within a 10 metre by 8 metre housed fence compound. The access right-of-way will be approximately 4.5 metres in width which may include connection to existing utilities. Rogers Communications Inc.’s proposed installation is a 30 metre flagpole tower which provides for a minimum visual profile.

    Lease Agreement The area subject to this lease consists of 0.008 hectares (0.020 acres), more or less, together with the use of a 0.020 hectare (0.051 acre) parcel of land for access for the construction and operation of a cellular phone tower and associated equipment, all of which are located on tableland. A sketch showing the subject land is attached.

    The following are the key terms of the proposed lease arrangement:

    1. Lease Payment: $16,830.00 plus HST per annum to be increased by 2% per year;

    2. Initial Term: five years;

    3. Renewals: three successive five year renewal periods subject to TRCA concurrence;

    4. Access: Rogers Communications Inc. will be provided with unobstructed access to the tower and equipment cabinet at all times;

    5. Insurance: Rogers Communications Inc. will provide $5,000,000 in commercial general liability insurance;

    6. Realty Taxes: Rogers Communications Inc. will pay all taxes levied against the subject property;

    7. Hydro: Rogers Communications Inc. will be responsible for electrical connections and charges relating to this use;

    8. Approvals: Rogers Communications Inc. will comply with all required laws, directions, rules and regulations;

    9. Equipment Removal: Rogers Communications Inc. will remove all equipment and restore the site to the satisfaction of TRCA within 120 days of termination of the lease.

    DETAILS OF WORK TO BE DONE Upon TRCA approval, the necessary other approvals required to bring the lease into effect will be pursued.

    FINANCIAL DETAILS The $16,830 per year in revenues generated from this lease will be used for TRCA purposes.

    RE: SAN ROMANOWAY COMMUNITY GARDEN CONSTRUCTION____________________________________________________________________________KEY ISSUEAward of contract to supply materials and construct a community vegetable garden as part of the Black Creek Sustainable Neighbourhood Retrofit Action Plan.

    RECOMMENDATION

    THAT the contract to undertake the construction of raised wooden planter boxes, related soft paving, fencing and related garden structures be awarded to Elephant Landscape Ltd. at a total cost not to exceed $98,597.11, plus HST, it being the lowest bid meeting Toronto and Region Conservation Authority (TRCA) specifications;

    THAT a 20% contingency allowance be approved to cover any additional unforeseen expenses as authorized by TRCA;

    AND FURTHER THAT authorized officials be directed to take the action necessary to implement the contract, including obtaining any approvals and the signing and execution of documents.

    BACKGROUNDTRCA is working in partnership with multiple partners to revitalize through sustainable design, construction and maintenance the grounds of the San Romanoway towers - an affordable housing complex consisting of three multi-unit buildings at the corner of Jane Street and Finch Avenue in Toronto. Partners include the building owners, property managers, residents, numerous community organizations and the City of Toronto.

    The San Romanoway Revival project is an innovative project of the Black Creek Sustainable Neighbourhood Retrofit Action Plan (SNAP). Implemented at the neighbourhood scale, the Black Creek SNAP entails an integrated, one-window approach to urban retrofits and renewal in older communities. The Action Plan addresses a broad range of objectives to improve the local environment with measureable results and build resiliency against climate change by greening local infrastructure and encouraging positive behavior changes among residents and landowners. Most importantly, the Black Creek SNAP achieves these objectives while addressing key socio-economic objectives of the Jane and Finch community.

    The San Romanoway Revival project specifically addresses food security, employment, water conservation, stormwater management, beautification, and tree, shrub and flower planting, while giving special attention to community cohesion and cultural pride. It is a high profile demonstration project that could serve as an urban renewal precedent for the hundreds of apartment complexes built in the Toronto region in the 1960s and 1970s.

    One of the diverse components of the San Romanoway Revival project is the design and construction of a large community garden, the tender for the construction of which is the issue of this report. TRCA’s Restoration and Infrastructure staff was asked to assist the Black Creek SNAP project lead to help develop a workable master plan for the site and to oversee the detailed design, tendering and construction of the community garden.

    RATIONALEThe work outlined in the Request for Tender (RFT) is to:

    construct the community vegetable garden (including excavation, supplying timber and soil for all planters and garden beds);supply and install metal perimeter fencing;supply and install pollinator garden bed site preparation;install shed from “Shed Man”; andsupply and install a trellis, accessible garden, shredded bark mulch, limestone screening and decorative wooden landscape features.

    A list of contractors was compiled, based on their previous involvement with similar projects and their expertise in this field. The RFT was sent to the following four landscape construction firms:

    Elephant Landscape Ltd;The Beach Gardener;Griffith Property Services Ltd.; andHank Deenan Landscaping.

    The proposals were submitted and reviewed by TRCA staff (Vince D’Elia, Chris Ulcar and Mark Lowe) with the following results:

    RECOMMENDATION

    THAT the contract for website design, development and ongoing maintenance services for Toronto and Region Conservation Authority's (TRCA) website be awarded to Similam Media Inc. at a total cost not to exceed $123,500.00 plus 10% contingency to be expended as authorized by TRCA staff, plus HST, it being the proposal that best meets TRCA specifications and is the lowest bid.

    BACKGROUNDThe TRCA web presence has evolved dramatically from its starting point as a static one way communication tool, originally developed 16 years ago, into an dynamic and interactive relationship system. Today the TRCA web platform plays a critical role in how the public interacts with and perceives TRCA, but the current website remains essentially the same as it was when the content management system was launched in 2009.

    Starting in 2008, the current TRCA website required a large one-time investment in a content management software system called dotCMS. TRCA now hosts and supports more than 50 websites and web applications that vary in size and complexity, 30 of which utilize this platform and will be rolled over to the new platform. While the dotCMS platform has served TRCA well, it has officially reached its end of life and is no longer supported by the software vendor.

    With the need to replace TRCA's website content management system, and TRCA's website traffic quickly moving from traditional computers to a wide variety of mobile devices such as tablets and smartphones, TRCA is looking to build a new and modern website software platform that will allow for ongoing development, feedback and iteration to ensure TRCA continues to evolve to the ever changing internet landscape.

    This approach will not only improve the customer experience but also provide TRCA with a new set of interaction metrics, allowing for a real-time feedback loop for monitoring audience engagement and content trends. This feedback will provide insights into our audience demographic and will ensure that our website is optimized and tuned, on an ongoing basis, to the needs of our various end users.

    RATIONALEWhile TRCA’s web traffic has seen continued growth since its launch in 2009, the software platform that is used to power the content management capabilities has not been able to evolve adequately with the changes in the internet landscape. We have seen a very dramatic move to mobile devices over the past few years and are already seeing a need to build more dynamic, user centric websites that can conform to TRCA's varied audience segments and provide a more tailored experience for each visitor. With this in mind, staff is looking to replace the current content management system with a new platform that will allow for ongoing development, user feedback and software iteration to ensure TRCA can continue to grow its web presence over the coming years.

    In order to minimize time requirements on staff and on potential proponents, the procurement process was broken down into two stages:

    An open online Expression of Interest (EOI) was issued via the Biddingo Tendering Service 1.and submissions were evaluated based on organizational capabilities, suggested approach and methodology, past success with similar project and the vendor’s involvement in the open source software community. The document was requested by 53 vendors and of those, 10 submissions were received 2.and five were invited to present their approach in person and respond to a Request for Proposal RFP# 201501W0010.

    Four proposals were submitted and evaluated by a review committee composed of TRCA staff (Chris Moore, Jung-Hee Ban, David Todd and Jason Tam) based on the following criteria and weights:

    approach and methodology (40%); credentials and references (20%); prior success with similar projects (25%); andpricing (15%).

    Staff recommend that Simalam Media Inc. be awarded the contract for TRCA website redevelopment and web application support. Not only did Simalam’s proposal outperform other submissions with a very comprehensive approach, but the vendor was also the lowest bidder.

    The team was particularly pleased with Simalam’s ’Agile' web development approach and their in-depth understanding of user tracking and website statistical analysis while demonstrating a high level understanding of TRCA’s mission and objectives.

    FINANCIAL DETAILSThe budgeted cost for this project is $123,500.00, plus 10% contingency, plus HST. Funds for the contract are identified in TRCA's 2015 Website Redevelopment Budget for Corporate Communications: Multimedia/Web, account number 042-16, $100,000 is from the reserves and $23,500, plus the 10% contingency, from the operating levy.

    RECOMMENDATION

    THAT Contract #10000364 for the supply and delivery of approximately 1,700 tonnes of 2 - 4 tonne uniform stackable armourstone to the Wilket Creek Rehabilitation Project - Site 3, Phase 2, in the City of Toronto, be awarded to Cut Above Natural Stone Ltd. for a total unit price of $57.68 per tonne and a total cost not to exceed $98,056.00, plus a contingency amount of 10% to be expended as authorized by TRCA staff, plus HST, it being the lowest bid meeting TRCA specifications;

    THAT should staff be unable to achieve an acceptable contract with the awarded supplier, staff be authorized to enter into and conclude contract negotiations with the other suppliers that submitted tenders, beginning with the next lowest bidder meeting TRCA specifications;

    BACKGROUND Watercourses and adjacent park areas within the City of Toronto sustained a significant amount of damage as the result of the August 19, 2005 storm event. In response to the damage caused, City of Toronto Parks Forestry and Recreation (PF&R) entered into an agreement with TRCA in February of 2007 to complete the repairs required to return the damaged areas to a state of good repair in order to ensure protection of life and property within the City of Toronto parks systems while funding for long term rehabilitation of key sites was sought.

    The Wilket Creek tributary of the East Don River was one of the watercourses that suffered a significant amount of damage as the result of the August 19, 2005 storm event. In 2007/8 TRCA staff undertook large scale restoration works within Edwards Gardens, and a series of 10 state of good repair projects within Wilket Creek Park, as part of the aforementioned agreement entered into by the City of Toronto and TRCA in February of 2007.

    Following the completion of the State of Good Repairs work, TRCA entered into a multi-year agreement with Toronto Water and PF&R of the City of Toronto to undertake the completion of additional repair works within Wilket Creek Park, and a Geomorphic Systems Master Plan for the entire Wilket Creek subwatershed.

    To date works have been completed at Sites 6, 7 (2011/12) and Site 3 Phase 1(2012/2013). The restoration work at Site 3, Phase 2 commenced in 2015 and includes the protection of at-risk sanitary sewer infrastructure and associated channel stabilization works.

    The estimated 1,700 tonnes of 2 – 4 tonne uniform stackable armourstone is required as part of the sanitary sewer protection.

    RATIONALERequest for Quotation (RFQ) packages were also sent to eight suppliers as follows:

    RECOMMENDATION

    THAT Toronto and Region Conservation Authority (TRCA) staff be directed to enter into negotiations with the National Wildlife Centre for a potential lease of land from TRCA in the Glen Haffy Conservation Area;

    AND FURTHER THAT staff report back to the Executive Committee at a future date.

    BACKGROUND At TRCA Authority Meeting #8/12, held on October 12, 2012 Resolution #B148/12 was approved, in part, as follows:

    ...AND FURTHER THAT TRCA create a steering committee to address future wildlife rehabilitation needs in the Greater Toronto Area.

    TRCA Conservation Lands Planning Committee took on the role of a steering committee to assess the future wildlife rehabilitation needs within the TRCA jurisdiction. Based on the initial review, there appears to exist a need for at least an additional facility in the western area of TRCA's jurisdiction.

    TRCA has been approached by National Wildlife Centre (NWC), who is currently operating in partnership with the University of Guelph, using a mobile veterinary clinic to attend to the needs of their current catchment area being the western Toronto region. NWC has expressed an interest in leasing for a 20 year period with options to renew, lands from TRCA located on Glen Haffy Conservation Area, as outlined in Attachment 1. NWC is currently looking for lands within the Town of Caledon that are suitable for the phased development and operation of a wildlife centre to service the western Toronto region.

    Representatives from the Town of Caledon Planning Department and TRCA’s Parks and Culture division have been involved in preliminary discussions with NWC regarding this proposed use and are in support of moving forward with discussions and negotiations.

    DETAILS OF WORK TO BE DONE

    NWC to demonstrate financial capacity.TRCA staff and NWC to continue discussions with the Town of Caledon Planning Staff.

    RATIONALE

    NWC is a registered charity that provides wildlife clinical research, wildlife medicine, training and education. Their aim is to act as a platform for training future wildlife custodians, responders, conservation and wildlife biologists, rescue staff and veterinarians in native wildlife issues; as a resource for wildlife emergency prevention, preparedness and response planning in Canada. NWC has been able to provide an important community service since 2014. NWC is funded primarily by donations and by like minded organizations and foundations. As there appears to be a desire for this type of service within the western Toronto region, it would be beneficial for TRCA to consider making this land available for their use.

    RATIONALEThe application was reviewed by staff on the basis of the following information:

    Proposal:The City of Toronto is preparing to undertake repair of a damaged storm sewer in North Park, located on the east side of Keele Street, north of Lawrence Avenue West. This repair is being necessitated due to a large sinkhole that has developed over the sewer, located at the north end of the park, south of Rustic Road. Works will involve excavating the soils around the damaged sewer to expose the existing, sound pipe ends. New segments of storm sewer will be installed to connect the upper and lower ends of existing pipe. The excavated area will be backfilled with native material, and existing asphalt surfaces restored.

    Access shall be obtained from the north, directly from the asphalt park roadway connecting to Rustic Road. All staging will occur within the access routes or grassed areas. Silt fencing is to be established for erosion and sediment control. No vegetation removals are associated with this project. The area disturbed by construction will be restored to prior conditions using topsoil and sod. Construction will occur in April 2015.

    This application seeks to formalize works that have already been approved through the emergency works process. These works were classified as emergency works because the erosion issues and damaged storm sewer infrastructure in North Park presented an immediate hazard to public safety, and as such, represents a threat of injury to persons, loss of life, or loss of property (Conservation Authorities Act ).

    Control of Flooding:The proposed works are not located within the Regional storm flood plain and are not anticipated to impact flooding, flood storage or conveyance of flood waters. All grades will be maintained or matched.

    Pollution:Erosion and sediment control measures (silt fence) will be installed prior to construction and maintained for its duration. These measures are being implemented to prevent the release of construction generated sediment into Black Creek, a tributary of the Humber River. Erosion and sediment control measures have been provided in accordance with the TRCA Erosion and Sediment Control Guideline for Urban Construction (2006).

    Dynamic Beaches:The proposal will not have any implications to dynamic beaches.

    Erosion:There are no impacts identified to slope stability or erosion as a result of these works.

    Conservation of Land:No in-water works are within the scope of this project.

    PlantingsNo vegetation removals are associated with this project. All disturbed areas will be restored to pre-construction conditions, or better, upon completion of work.

    Policy Guidelines:This proposal complies with Section 7.4.4, Infrastructure; and Section 8.9, Infrastructure Policies, of The Living City Policies for Planning and Development in the Watersheds of the Toronto and Region Conservation Authority.

The purpose is to allow development, interference with a wetland and alteration of a watercourse within a Regulated Area of the Humber River Watershed to facilitate topsoil stripping and pre-grading activities, restoration works and the installation of sediment and erosion control measures in a draft approved plan of subdivision (19T-13V009) within Block 55 East, west of Kipling Avenue and south of Kirby Road, in the City of Vaughan.

    The permit will be issued for the period of May 1, 2015 to April 30, 2017 in accordance with the following documents and plans which form part of this permit:

    Letter of Undertaking dated April 20, 2015 prepared by Monarch Castlepoint Kipling North Development Ltd., indicating the Owner agrees to provide any and all minor revisions to the plans to the satisfaction of TRCA prior to the release of the permit, received by TRCA on April 20, 2015.

    RATIONALEThe application was reviewed by staff on the basis of the following information:

    Proposal:The purpose is to allow development, interference with a wetland and alteration of a watercourse within a Regulated Area of the Humber River Watershed to facilitate various works in a draft approved plan of subdivision (19T-13V009) within Block 55 East, west of Kipling Avenue and south of Kirby Road, in the City of Vaughan.

    There are three valley/stream corridors on the Monarch Castlepoint Kipling North Development Ltd. property: the East Humber River valley corridor traverses the western portion of the site, a tributary of Purpleville Creek is found in the northeast corner of the property (Tributary 'A') and a second tributary of Purpleville Creek traverses the central portion of the site (Tributary 'B'). There are several other natural features on and immediately adjacent to the subject site, including two Provincially Significant Wetlands (PSWs) and an Area of Natural and Scientific Interest (ANSI).

    In general, this permit will facilitate:Topsoil stripping and pre-grading activities within the developable portion of the site, including the creation of side slopes along Tributary 'B'. Tributary 'B' is currently in a degraded state and will be restored and enhanced to a valley corridor. The side slopes will be created and stabilized with seed through this permit. The full planting of the slopes will follow at a later date once the edge management plan for the entire site is approved by TRCA and the City of Vaughan.The installation of various erosion and sediment control measures on the site. All natural features will be isolated from the earthworks by sediment control or tree protection fencing. Other sediment and erosion control measures will also be employed including, but not limited to, temporary sediment ponds, temporary swales, check dams and sediment traps. The site works will also be phased to limit the area exposed at any one time.

    It should be noted that only a portion of the site is regulated by TRCA. The applicant requires approval from the City of Vaughan for those portions of the site not within TRCA's Regulated Area.

    Conditional Approval:TRCA staff recommends that this permit be approved with conditions, which will be outlined on the permit once they have been agreed to by the owner.

    Control of Flooding:There will be no impact on the storage or conveyance of floodwaters.

    Pollution:Sediment and erosion control measures will be installed and maintained throughout development to prevent sediment from entering the adjacent natural features.

    Dynamic Beaches:Not applicable.

    Erosion:There are no geotechnical/slope stability issues associated with the proposed development. In addition, the implementation of the aforementioned sediment and erosion control measures will minimize erosion on the site.

    Conservation of Land:All natural features on the site will be protected during the topsoil stripping and pre-grading activities.

    PlantingsA planting plan has not been submitted with the current proposal, but the applicant is required to provide extensive plantings to satisfy TRCA's conditions of draft plan approval. Some of these plantings will be provided with future TRCA permit applications on this site (e.g., trail works).

    As part of the current proposal, seeding of the disturbed areas will be utilized as a means of erosion control.

    Policy Guidelines:This proposal complies with Section 8.4 General Regulation Policies of the The Living City Policies for Planning and Development in the Watersheds of the Toronto and Region Conservation Authority.

    The amphibian pond will be created within the valley corridor associated with Tributary 'B' and will form part of a future natural linkage between the Tributary 'B' and East Humber River valley corridors. The surface area of the pond will measure approximately 0.12 hectares (0.30 acres). The areas in and adjacent to the pond will be planted with native trees, shrubs, aquatic plants and seed.

    The amphibian pond is being provided by Monarch Castlepoint Kipling North Development Ltd. to mitigate for the loss of a farm pond on the tableland portion of the draft approved plan of subdivision to the south (19T-13V008). This tableland farm pond is not connected to the natural system, but provides amphibian habitat. The farm pond will be protected from topsoil stripping and pre-grading activities until the new amphibian pond is created and the existing wildlife has been successfully relocated (see CFN 52133 - Application #1000/14/VAUG).

    Monitoring and adaptive management, if necessary, for the amphibian pond are required as a condition of draft plan approval.

    Control of Flooding:There will be no impact on the storage or conveyance of floodwaters.

    Pollution:Sediment and erosion control measures will be installed and maintained throughout construction to prevent sediment from entering the adjacent natural features.

    Dynamic Beaches:Not applicable.

    There are three valley/stream corridors on the Monarch Castlepoint Kipling South Development Ltd. property: the East Humber River valley corridor traverses the western portion of the site, a tributary of Purpleville Creek is found along the northern limits of the property (Tributary 'B') and a tributary of the East Humber River traverses the southeast corner of the site (Tributary 'C'). There are several other natural features on and immediately adjacent to the subject site, including five Provincially Significant Wetlands (PSWs) and an Area of Natural and Scientific Interest (ANSI).

    In general, this permit will facilitate:Topsoil stripping and pre-grading activities within the developable portion of the site, including the creation of side slopes along Tributary 'B' to the north. Tributary 'B' is currently in a degraded state and will be restored and enhanced to a valley corridor. The side slopes will be created and stabilized with seed through this permit. The habitat elements and full planting of the corridor will require separate permit approval from the Executive Committee, which will follow at a later date.

    The placement of excess topsoil within two blocks at the southern limits of the site. This topsoil placement is intended for restoration purposes on lands that will ultimately be dedicated into public ownership. These lands are currently used for agricultural purposes. 500mm of topsoil will be placed in these blocks, maintaining the existing drainage patterns on the site. These areas will be stabilized with a seed mix. Restoration plantings will occur in these areas and all other buffers within the draft plan area once the edge management plan for the entire site is approved by TRCA and the City of Vaughan. The installation of a temporary culvert crossing of Tributary 'B'. This temporary crossing will be in place for the topsoil stripping works and will remain in place until the ultimate crossing is approved by TRCA. A separate permit will be required for the ultimate crossing. A permit report for this purpose will be brought forward to the Executive Committee at a later date.The installation of various erosion and sediment control measures on the site. All natural features will be isolated from the earthworks by sediment control or tree protection fencing. Other sediment and erosion control measures will also be employed including, but not limited to, temporary sediment ponds, temporary swales, check dams and sediment traps. The site works will also be phased to limit the area exposed at any one time.The protection of an existing farm pond from topsoil stripping and pre-grading activities until a new amphibian pond is created elsewhere within the block plan area and the existing wildlife within the farm pond has been successfully relocated. This tableland farm pond is not connected to the natural system, but provides amphibian habitat. The new amphibian pond will re-create and improve this habitat function.     It should be noted that only a portion of the site is regulated by TRCA. The applicant requires approval from the City of Vaughan for those portions of the site not within TRCA's Regulated Area.

    Conditional Approval:TRCA staff recommends that this permit be approved with conditions, which will be outlined on the permit once they have been agreed to by the owner.

These lands will be planted in the future and dedicated into public ownership, creating a linkage along the southern portion of the site between the East Humber River valley corridor, the Tributary 'C' stream corridor and the PSWs associated with each corridor.

    PlantingsA planting plan has not been submitted with the current proposal, but the applicant is required to provide extensive plantings to satisfy TRCA's conditions of draft plan approval.     Proposal:The proposal is to conduct site grading in order to facilitate the development and construction of a phased mixed-use development, located within the Carrville District Centre, in Planning Block 11, in the City of Vaughan. The subject property is located northeast of Dufferin Street and Rutherford Road and is approximately 17.8 ha in size. The site is currently vacant and contains several natural heritage features including a tableland forest and valleyland associated within the Don River. The limits of these features were previously established and an appropriate 10 metre buffer established as part of the associated Draft Plan of Subdivision application process (19T-12V009).

    The subject property is located in Block 11, which has an approved Master Environmental Servicing Plan in place. The proposed development conforms to the approved Block 11 MESP along with the Carrville District Centre Secondary Plan. The subject proposal is to conduct works in a phased approach: the first, being topsoil stripping of the site, followed by the installation of servicing infrastructure. The last phase includes the development of the proposed mixed use development itself which consists of townhomes, and multi-storey condominium buildings.

    Control of Flooding:The subject lands are located outside of the Regional Storm Flood Plain associated with the Don River. As such, the storage and/or conveyance of flood waters will not be impacted by then proposal.

    Pollution:Erosion and sediment control measures including sediment fencing will be erected around the work site to ensure sediment is not transported into the adjacent natural systems.

    RATIONALEThe application was reviewed by staff on the basis of the following information:

    Proposal:The subject lands are located within the Bolton Rural Settlement Area boundary, and are generally surrounded by industrial and commercial uses to the north, west and south; and agricultural uses to the east. Robinson Creek, a tributary of the West Humber River, traverses a portion of the property to the north-west and south-west. There are also small local riverine wetlands associated with the creek on the subject lands. Draft Plan Approval was granted for the Plan of Subdivision by the Town of Caledon on September 25, 2014, for which TRCA reviewed and approved several technical studies in support of the application (i.e. Functional Servicing and Stormwater Management Report, Environmental Impact Study, Flood Study and Water Balance Report). The Draft Plan comprises a total of 180 residential units; 158 townhouses, and 22 single-family residential lots. The Plan also includes a park block, protected open space and a Stormwater Management (SWM) block, all within an area of 9.52 ha (23 ac).

    Three TRCA permits will be required to facilitate the phased development of the proposed residential subdivision. The subject permit will facilitate the topsoil stripping outside of the environment protection areas and buffers, underground servicing and the construction of a temporary sediment control pond. The second permit will permit the construction of the SWM pond and outfall, and allow for cut and fill balance works within Robinson Creek. The final permit will facilitate the final site grading, and restoration works within the environmental buffers. The second and third permits will be brought forward to the Executive Committee at later dates.

    Control of Flooding:A Flood Study was completed by the applicant for the proposed development and delineates the existing and proposed Regulatory Floodplain within the subject lands. A modest cut and fill balance is being proposed to improve a flood spill condition on the property. A restoration plan for the stream corridor and associated buffers are also proposed to enhance this stretch of Robinson Creek. TRCA staff are satisfied that the results of the Flood Study meet TRCA and provincial standards and requirements. The subject permit for topsoil stripping, underground servicing and the construction of the temporary sediment control pond will not impact to the storage and/or conveyance of flood waters.

    Pollution:Appropriate sediment and erosion controls will be installed and maintained on the subject property during all phases of construction.

    Dynamic Beaches:Not applicable.

    Erosion:There are no geotechnical and/or slope stability concerns anticipated with this project.

    Conservation of Land:No significant vegetation will be removed as part of this permit.

    RATIONALEThe application was reviewed by staff on the basis of the following information:

    Proposal:The Region of Peel has proposed the reconstruction of Old Church Road from Marilyn Street to approximately 680 metres east of Innis Lake Road intersection in the Town of Caledon. It is proposed to widen Old Church Road from two lanes to four lanes and provide on-street parking. These works will provide connectivity to the new subdivision to the north of Old Church Road as well as many other future and existing facilities. The proposed reconstruction will also include the installation of new storm sewers, boulevards and sidewalks, street lighting and traffic signals. One deteriorated corrugated steel pipe (CSP) culvert within the project area is proposed to be replaced with a new CSP culvert of the same diameter. No work on the other two culture with the work are required. In addition, storm sewer outlets have also been proposed at three different locations along the alignment. All storm sewer outlets have been designed to dissipate energy and mitigate erosion.

    Control of Flooding:The proposed project is not anticipated to impact flooding, conveyance or storage of floodwaters.

    Pollution:Erosion and sediment control measures including heavy duty silt fence, rock check dams, erosion control blankets, silt socks and catch basin inlet covers will be installed prior to construction and maintained for the duration of construction, and until the site is stabilized and restored in order to prevent construction generated sediments from entering the watercourse. These measures have been provided in accordance with the TRCA Erosion and Sediment Control Guideline for Urban Construction (2006).

    Dynamic Beaches:Not applicable

    Erosion:No geotechnical/slope stability issues have been identified.

    Conservation of Land:The Redside Dace Fisheries timing window of July 1 to September 15 will be applied to this project unless otherwise specified in writing by the Ministry of Natural Resources and Forestry (MNRF).     Proposal:The purpose of this application is to permit site grading, servicing and landscape works to facilitate the development of a 15 lot estate residential subdivision, within a Regulated Area of the Duffins Creek Watershed. The Draft Plan of Subdivision (19T(W)-14.001) was approved with conditions by the Town of Whitchurch-Stouffville in September of 2014. The subject property is located north of Bloomington Road, west of Ninth Line. An unevaluated wetland is located at the south eastern portion of the property, which feeds into a tributary of Stouffville Creek. This wetland did not qualify as a significant feature. Furthermore, a table land wood lot is located along the western property limits.

    The proposed works consist of lot grading, servicing and home construction. The site will be accessed from Castle Gate with a second east-west road being constructed within the middle of the lot. Servicing will include the construction of a stormwater management pond, which will encroach slightly into the wetland feature. This will ensure that the feature continues to be supplied with adequate surface water under post-development conditions. Two new ponds are to be constructed long the eastern limits of the existing feature with planting taking place around the existing cell and the two new ponds. An ecological evaluation of the existing wetland feature indicates the it provides limited ecological function and that the proposed enhancements would improve the overall ecological function of the feature. Additional plantings will be implemented around the table land wood lot further providing a net ecological gain across the site.

    Control of Flooding:Impacts to the control of flooding, conveyance or storage of flood waters is not anticipated as a result of the proposed works.

    Pollution:Standard erosion and sediment control measures, including silt/sediment fencing, rock check dams and filter sox, will be implemented prior to construction and maintained for the duration of works, and until the site is stabilized and restored, in order to prevent construction generated sediments from entering any watercourse or wetland. Erosion and sediment control measures have been provided in accordance with the TRCA Erosion and Sediment Control Guideline for Urban Construction.

    Dynamic Beaches:Not applicable

    Erosion:Impacts to slope stability and erosion are not anticipated as a result of the proposed works.

    Conservation of Land:No in-water works are associated with this proposal. Enhancements to the existing wetland feature will include the construction of two new pools in conjunction with enhancement plantings. One pool will be approximately 22m by 14m while the other will be approximately 28m by 8m. These features will provide an enhancement to the existing wetland prior to its release into the adjacent tributary of Stouffville Creek.
