    The procedures to follow if you address the Council are : Council requests that you express your ideas in fiveminutes or less and refrain from any personal attacks or derogatory statements about any City employee, a fellow

    citizen, or anyone else, whether in the audience or not. The Mayor will limit discussion whenever he deems suchan action appropriate to the proper conduct of the meeting. At the conclusion of an open call to the public,individual members of the Council may respond to criticism made by those who have addressed the Council, mayask Staff to review a matter, or may ask that a matter be put on a future agenda. However, members of theCouncil shall not discuss or take legal action on any matters during an open call to the public unless the mattersare properly noticed for discussion and legal action.

    6.0 Minutes6.1 Approval of Minutes from the April 20, 2010 City of Maricopa City Council Work Session.6.2 Approval of Minutes from the April 20, 2010 City of Maricopa City Council Regular Meeting.

    7.0 Public Hearings7.1 The Mayor and City Council shall hear public comment regarding text amendment TXT10-01 a text

    amendment to the City of Maricopa Zoning Ordinance Article 16-2 Planning and Zoning Commission,as recommended by the Planning and Zoning Commission.

    7.2 The Mayor and City Council shall hear public comment regarding text amendment TXT10-02 a textamendment to the City of Maricopa Zoning Ordinance Article 16-5 Board of Adjustment, asrecommended by the Planning and Zoning Commission.

    8.0 Consent AgendaAll items on the Consent Agenda are considered to be routine matters and will be enacted by

    one motion of the Council. There will be no separate discussion of these items unless a

    Councilmember or member of the public so requests, in which event the item will be removedfrom the Consent Agenda and considered in its normal sequence on the agenda

    8.1 Budgetary Transfer. The Mayor and City Council shall discuss and possibly take action on approvinga request by Acting Fire Chief Wade Brannon to approve a budgetary transfer of $20,000 from Citycontingency fund line item 100-49500-350 to Fire Department Support Services 100-42230-430 for therepair of two (2) Fire Apparatus. Discussion and Action.

    8.2 Grant Acceptance. The Mayor and City Council shall discuss and possibly take action on approving arequest by Grants Manager Mary Witkofski to accept a grant award and sign a contract from the ArizonaDepartment of Homeland Security in the amount of $11,357 under the State Homeland Security Grant,Law Enforcement Terrorism Prevention Program for 800MHz Radios for the Police Department.Discussion and Action.

    8.3 Resolution 10-16. A Resolution of the Mayor and City Council of the City of Maricopa, Arizona,accepting public improvements and maintenance responsibility for Continental Blvd within theHoneycutt Business Park. Discussion and Action.

    8.4 Resolution 10-17. A Resolution of the Mayor and City Council of the City of Maricopa, Arizona,accepting public improvements and maintenance responsibility for a the eastern portion of HathawayAvenue adjacent to phase 1 of the Sonoran Creek commercial development. Discussion and Action.

    9.0 Regular AgendaItems on the agenda are open for citizen input. Please fill out a card and present it to the City

    Clerk before the meeting begins. The mayor will call upon you for your comments.

    9.1 Off-Track Betting. The Mayor and City Council shall discuss and possibly take action on establishinga policy for Off-Track Betting. Discussion and Action.

    9.2 Ordinance 10-04. An Ordinance of the Mayor and City Council of the City of Maricopa, Arizona,adopting Article 16-2 Planning and Zoning Commission by reference as sections 16-2-1 through 16-2-7of the Maricopa City Code and providing for severability and the effective date thereof. Discussionand Action.

    9.3 Resolution 10-18. A Resolution of the Mayor and City Council of the City of Maricopa, Arizona,declaring as a public record that certain document filed with the City Clerk and entitled Article 16-2Planning and Zoning Commission relating to the establishment and procedures of the Planning andZoning Commission. Discussion and Action.

    9.4 Ordinance 10-05. An Ordinance of the Mayor and City Council of the City of Maricopa, Arizona,adopting Article 16-5 Board of Adjustment by reference as sections 16-5-1 through 16-5-14 of theMaricopa City Code and repealing Article 24 of Chapter 16 of the Maricopa City Code and providing forseverability and the effective date thereof. Discussion and Action.

    9.5 Resolution 10-19. A Resolution of the Mayor and City Council of the City of Maricopa, Arizona,declaring as a public record that certain document filed with the City Clerk and entitled Article 16-5Board of Adjustment relating to the establishment and procedures of the Board of Adjustment.Discussion and Action.

    9.6 IGA Amendment. The Mayor and City Council shall discuss and possibly take action on approving arequest by Development Services Director Brent Billingsley to amend the Intergovernmental Agreement(IGA) between Pinal County and the City of Maricopa to define responsibilities for roadwayimprovements on Farrell Road and Hidden Valley Road. Discussion and Action.

    Tentative Budget. The Mayor and City Council shall discuss and possibly take action on a request byFinancial Services Director Cynthia Sneed to adopt the tentative operating budget for fiscal years 2010-2011. Discussion and Action.

    9.8 Employee Benefits Package. The Mayor and City Council will discuss and possibly take action on arequest by Support Services Director Karen Shaffer to approve an employee benefits package fundinglevel for an amount not to exceed $2,350,000 for fiscal year 2010-2011 with Health Net, AmeritasVision, Ameritas Dental, Fort Dearborn Life and Lincoln Financial and to authorize the City Manager toexecute applicable contracts once drawn. Funding to be appropriated within the fiscal year 2010-2011budget. Discussion and Action.

    9.9 Strategic Plan. The Mayor and City Council shall hear an update on staff progress toward StrategicPlan goals and objectives by Assistant to the City Manager Nicole Dailey. Discussion.

    9.10 Purchase Agreement. The Mayor and City Council shall discuss and possibly take action on arequest by Assistant City Manager Kolman to enter into a purchase agreement with Investment GradeLoans, Inc. to acquire approximately 140.84 acres of real property generally located at the southeastcorner of SR347 and Bowlin Road for $6,748,489.40 plus ordinary closing and research costs and toamend the 2009/2010 operating budget transferring budgetary authority of $6,900,000 to the ParksBond Fund, Facilities, Land (330-41940-710) from the Grants Fund, Police Admin, Buildings (220-42100-720)($4,608,000) and Grants Fund, Police Admin, Non-Capital Equipment (220-42100-690)($2,292,000) to fund said purchase and authorizing the City Manager or designee to execute alldocuments related to the purchase. Discussion and Action.

    9.11 Summer Meeting Break. The Mayor and City Council shall discuss and possibly take action onscheduling a Summer City Council Meeting Break. Discussion and Action.

    10.0 Executive Session10.1 The Maricopa City Council may go into executive session for purpose of obtaining legal advice from the

    Citys Attorney on any of the above agenda items pursuant to A.R.S. 38-431.03 (A)(3).

    10.2 The Maricopa City Council may go into executive session for purpose of obtaining legal advice from theCitys attorney and to consider its position and instruct representatives regarding negotiations for thepurchase, sale or lease of real property pursuant to A.R.S. 38-431.03 (A)(3) and (A)(7).

    11.0 AdjournmentNote: This meeting is open to the public. All interested persons are welcome to attend. Supporting

    documents and staff reports, which were furnished to the Council with this Agenda, are available forreview on our website, www.maricopa-az.gov.
