The procedures to follow if you address the Council are: Council requests that you express your ideas in fiveminutes or less and refrain from any personal attacks or derogatory statements about any City employee, a fellowcitizen, or anyone else, whether in the audience or not. The Mayor will limit discussion whenever he deems suchan action appropriate to the proper conduct of the meeting. At the conclusion of an open call to the public,individual members of the Council may respond to criticism made by those who have addressed the Council, mayask Staff to review a matter, or may ask that a matter be put on a future agenda. However, members of the

Council shall not discuss or take legal action on any matters during an open call to the public unless the mattersare properly noticed for discussion and legal action.

8.1 Resolution 10-43. A Resolution of the Mayor and City Council of the City of Maricopa, Arizona,appointing a Judge Pro Tempore for the City of Maricopa Municipal Court, setting his compensationand providing a commencement date therefore. Discussion and Action.

8.2 Special Event Liquor Licen se. The Mayor and City Council shall discuss and possibly take action onrecommending approval to the Arizona Department of Liquor License and Control for a Special EventLiquor License application submitted by the Maricopa Chamber of Commerce for a special event knownas Stagecoach Days to be held on Saturday, October 9, 2010 at Pacana Park located at 19000 N. PorterRoad, Maricopa, AZ 85138. Discussion and Action.

8.3 SPR10-05 . The Mayor and City Council shall discuss and possibly take action on approving a request by Planning Manager Kazi Haque to approve a request made by Jackie Guthrie, agent, on behalf ofAgainst Abuse, Inc. and Ms. Patricia Griffen, property owner, who are requesting review and approval ofa site plan, landscape and elevations plans for a group home to assist and provide needy residents withsocial and behavioral health services. Discussion and Action.

8.4 Consent to Apply for Grant. The Mayor and City Council shall discuss and possibly take action onapproving a request by Grants Manager Mary Witkofski for Council to direct staff to apply for theArizona Governors Office, Office of Economic Recovery for the Public Safety Stabilization Program forthe Fire and Police Department in an amount not to exceed $99,999.00 for backfill costs and overtimefor the fire department and overtime from drug interdiction activities with the police department anddesignate City Manager Kevin Evans to execute all necessary documents to complete that applicationprocess. Discussion and Action.

9.1 Heritage District Committee. Councilmembers Julia Gusse and Alan Marchione shall each possiblyappoint a member to the Heritage (Redevelopment) District Citizens Advisory Committee. Discussionand Action.

9.2 Solar Rebate Program . The Mayor and City Council shall discuss and possibly take action onapproving a request by Assistant Planner Rodolfo Lopez to review and approve the Solar RebateProgram guidelines. Discussion and Action.

9.3 Intergovernmental Agreement. The Mayor and City Council shall discuss and possibly take actionon approving a request by Development Services Director Brent Billingsley to approve an

Intergovernmental Agreement between the City of Maricopa, the Arizona Department of Transportation(ADOT) and the Union Pacific Railroad (UPRR) with regard to the State Route 347 grade separationproject. Discussion and Action.

9.4 Award of Contract. The Mayor and City Council shall discuss and possibly take action on a requestby Development Services Director Brent Billingsley to approve an Award of Contract to Abacus ProjectManagement Inc. to provide professional program/construction management and design services forfuture City facilities. This Award of Contract, in an amount not to exceed $521,207.00, will be fundedfrom budget line item General Fund, Non-Departmental, Professional Services (100-49500-320)through a budgetary transfer of $521,207.00 from budget line item General Fund, Non-Departmental,Contingency (100-49500-350), and is in compliance with City of Maricopa Purchasing Code, Section 3-4-6. Discussion and Action.

10.0 Executive Session10.1 The Maricopa City Council may go into executive session for purpose of obtaining legal advice from theCitys Attorney on any of the above agenda items pursuant to A.R.S. 38-431.03 (A)(3).10.2 The Maricopa City Council may go into executive session for purpose of obtaining legal advice from the

Citys attorney and to consider its position and instruct representatives regarding negotiations for thepurchase, sale or lease of real property pursuant to A.R.S. 38-431.03 (A)(3) and (A)(7).
