Membership and Account Agreement Please note that this Agreement applies to consumer accounts established primarily for personal, family, or household purposes. Members 1st Federal Credit Union offers member accounts maintained for business purposes, which are subject to separate agreements and disclosures. Anyfinancialserviceorproductofferedbyusmaybeusedforanypurposepermittedbylaw.Youagreethatillegaluseofanyfinancialservicewillbedeemedanactionofdefaultorbreachofcontract.Useofanyfinancialproductorserviceinamannernotpermittedbylawmaycausethatserviceorrelatedservicestobeterminatedatourdiscretion.Wereservetherighttodeclineanytransactionthatweconsider fraudulent, suspicious or illegal.| As used in this Agreement, the words “we” “our” and “us” means Members 1st Federal Credit Union (also referred to as the “Credit Union”), and the words “you” and “your” mean you, the account owner(s) (also referred to as “owner(s)”, and includes personsorentities,user(s)ofaservice,andany“signer”)or“agent”appointedbyoron behalf of you to sign on the account and to conduct transactions or use a Credit Unionserviceinarepresentativecapacity.Thewords“youraccount”refertoeachandeveryoneofyouraccountsattheCreditUnion. YOU UNDERSTAND THAT THIS AGREEMENT CONTAINS AN AGREEMENT BY BOTH PARTIES TO RESOLVE DISPUTES THAT ARISE BY AN INDIVIDUAL ARBITRATION PROCEEDING HELD IN ACCORDANCE WITH THE PROVISIONS OF SECTIONS 27 AND 28, AND THAT THE PARTIES HAVE AGREED NOT TO RESOLVE SUCH DISPUTES AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION PROCEEDING. “Account”meansanysavingsshare,checkingsharedraft,orcertificateshareaccount that you own at the Credit Union. “Agent” means a person or entity who is not an owner of the account, but who hasbeendulyauthorized,orwereasonablybelievetobedulyauthorized,bytheowner or owners to conduct transactions on the account. “Agreement” means this Membership and Account Agreement, the Disclosures andtheSignatureCard.TheDisclosuresandtheSignatureCardareincorporatedintothis Agreement by this reference to them and all references to the term “Agreement” is intended to include the Signature Card and Disclosures. “Business day” means Monday through Friday, excluding federal holidays as designatedbytheFederalReserve. “Disclosures” means any agreements or disclosures with respect to your account ortheservicesinconnectionwiththeaccount,whichshallbemadeavailabletoyouatanyCreditUnionbranchoffice,andarealsoavailableathttp://www.members1st.org,whichmayinclude,butshallnotnecessarilybelimitedto,theFundsAvailabilityPolicy,theSubstituteCheckPolicy,theElectronicFundsTransfersAgreementandDisclosures,thePrivacyPolicy,theTruthinSavingsandRateandFeeDisclosures,andtheMobileDepositServiceDisclosure. “Entity”meansacorporation,partnership,association,business,society,charity,trust, club, or similar organization or group. “Member in Good Standing” means a member who (1) maintains a minimum of $5.00inthemember’sprimarysavingsshareaccount(knownasparvalue);(2)hasnonegativeoroverdrawnsavingsbalancesforaperiodofmorethan30days;(3)ifthememberhasloansoutstanding,allsuchloansarecurrentbytheirterms;(4)complies with all rules of membership set forth in the Credit Union’s Bylaws and in thisAgreement;and(5)hasnotcausedtheCreditUniontosufferaloss. “Notice to the Credit Union” means contacting the Credit Union by one of the followingmethods(unlesstheparticularcontextrequiresamorespecificmethodofnotice):(a)bywritingtousat5000LouiseDrive,P.O.Box40,Mechanicsburg,PA17055;(b)bycallingourCustomerServiceTeamat(800)237-7288;or(c)byvisitingusinpersonatoneofourbranchlocations.IfNoticetotheCreditUnionisprovidedviatelephoneorinperson,theCreditUnion’srecordsshallbethesoleconclusiveevidenceastowhetherandwhensuchnoticewasreceivedbytheCreditUnion. “Person” means a natural person. “Signer”meansanypersonwhohastheauthoritytomakewithdrawalsfrom,writechecksonandobtaininformationaboutanaccount. “Transaction”meansanyaction,instruction,order,orrequestthatwouldincreaseor decrease the balance in an account or would impose a lien or security interest on fundsintheaccount,andanyotherrequestforservicesorinformationinconnectionwith the account.

1. AGREEMENT BETWEEN YOU AND THE CREDIT UNION. You understand that in executing the Signature Card in connection with your account, which incorporates this Agreement, you are entering into a legally binding contract with us, and the specificterms,responsibilities,andliabilitiesofmembership,accountownership,andrelatedserviceswithusaresetforthinthisAgreement.Eachofyou(a)applyingformembership, (b) signing the signature card for an account, (c) using an account, or (d) requestingorlateraddingproductsand/orservicesconnectedtoanaccountacknowl-edges receipt of this Agreement and agrees to the terms set forth in the Agreement, asamendedfromtimetotime.ThecurrentversionofthisAgreementsupersedesallpriorversions,discussionsandagreementsandcontainsthetermsgoverningyourac-count(s)withtheCreditUnion.ThisAgreementcannotbemodifiedorally.IfthereisaconflictbetweenthisAgreementandsomethingsaidbyanemployee,officer,oragentoftheCreditUnion,theprovisionsofthisAgreementwillbefollowed.PleasereadandkeepthisAgreementsothatyoucanrefertoitwhenyouhaveaquestionaboutyourmembership,account(s)orservice(s).YouunderstandandacknowledgethatyoucanalsoaccesstheeffectiveversionofthisAgreementanytimeonourwebsiteathttp://www.members1st.org.ShouldyouhaveanyquestionsaboutamatteraddressedinthisAgreement,pleasecontactusat(800)237-7288orvisitusatyourlocalbranch.

2. INCORPORATION OF DISCLOSURES.TheDisclosuresareimportantdocuments about your account and all parties’ rights and obligations in connection with your ac-count(s).TheseDisclosureswillbeprovidedtoyouupontheopeningofyouraccountandareavailableatanyCreditUnionbranchoffice,andarealsoavailableathttp://www.members1st.org. We may change or modify the content of these Disclosures atourdiscretionandinaccordancewithapplicablelaw,andwewillprovidenoticeofthesechangesormodificationstoyouonlyasrequiredbyapplicablelaw.Suchchangesandmodificationswillbebindingonyou,effectiveasofthetimethechangeormodificationismadebyus.AllchangesandmodificationswillbeavailableatanyCreditUnionbranchoffice,andarealsoavailableathttp://www.members1st.org,andatanytime,itisthemostrecentversionoftheDisclosuresthatisincorporatedintothisAgreement,withoutregardtowhatversionwaseffectivewhenyouenteredintothis Agreement.

3. MEMBERSHIP AT THE CREDIT UNION. TojointheCreditUnion,youmustmeet the membership requirements, including the purchase and maintenance of the minimumrequiredshares(parvalue),assetforthintheCreditUnion’sbylaws.Youauthorizeustocheckyouraccount,creditandemploymenthistory,andobtainreportsfromthirdparties,includingcreditreportingagencies,toverifyyoureligibilityfortheaccountsandtheservicesthatyourequest.Youspecificallyacknowledgethatyouruseoftheaccount(s)andanyrelatedservicespursuanttothisAgreementconstitutesa permissible purpose for the Credit Union to obtain your credit report, without any fur-ther authorization from you. During the course of your membership, you must remain a Member in Good Standing. If you cease to be a Member in Good Standing, your membershipprivilegesmayberevokedbytheCreditUnion.

4. OPENING AN ACCOUNT. a. Identification –Tohelpthegovernmentfightthefundingofterrorismandmoneylaunderingactivities,federallawrequiresallfinancialinstitutionstoobtain,verifyandrecordinformationthatidentifieseachpersonwhoopensanaccount.Asaresult,whenyouopenanaccount,wewillaskforyourname,streetaddress,dateofbirth and other information that will allow us to identify you for this purpose. We may alsoasktoseeandcopyyourdriver’slicenseorotheridentifyingdocuments. b. Federal Identification Number – Federal law requires U.S. persons to provideaFederalTaxIdentificationNumber(TIN)atthetimeofaccountopening.UnlesswereceiveyourcertifiedTIN,wereservetherighttorefusetoacceptyourinitialdeposit,pay interest on the balance or permit withdrawals. Interest paid prior to receipt of your certifiedTINwillbesubjecttobackupwithholdingunderIRSregulations.YoumustcertifythattheTINyouhaveprovidediscorrectandthatyouarenotsubjecttobackupwithholding.Foraforeignperson(s),documentation,includingaW-8form,isrequired.Ifyouhavequestionsregardingyourtaxstatus,consultyourtaxadvisororlegalcounsel.

5. ACCOUNT TYPES. You may open an account either by yourself, referred to as an “individualaccount,”orwithoneormorepersonsasa“jointaccount.”

a. Individual Account –Anindividualaccountisanaccountownedbyyoualone,whichyouastheaccountowneruseduringyourlifetime.Generally,intheeventofyour death, the funds in your account will go to your estate, subject to the terms of this Agreement and applicable law. Subject to the terms of applicable law and this Agreement,youcanspecificallydesignateaperson,personsorentityasabeneficiaryoftheaccount,knownasapayableondeath(POD)orTottenTrustaccount.Insuchcase,uponproofofdeathandthepayee’sproperidentificationincompliancewiththeterms of this Agreement and the Credit Union’s policies and procedures, the funds in youraccountshalltransfertoyournamedbeneficiaryinaccordancewiththeappli-cablelawsgoverningPODandTottenTrustaccounts.Ifyoudesignatemorethanonebeneficiaryontheaccount,eachwillbeentitledtohisorherproportionateshareofthefundsintheaccount(whichwillbedeterminedbydividingtheamountofthefundsintheaccountbythenumberofbeneficiariesdesignatedontheaccount),andwillownthosefundswithoutarightofsurvivorship.Ifabeneficiarypredeceasesyou,itisyourresponsibilitytonotifyusandmakeanychangestotheaccount.ThisproceduredoesnotapplytoIndividualRetirementAccounts,whichhaveseparatebeneficiarydesignations. b. Joint Account – A joint account is an account owned by two or more persons. i. Unless otherwise stated on the Signature Card you executed, a joint account includestherightofsurvivorship.Arightofsurvivorshipmeansthatwhenoneownerdies,allsumsintheaccountwillpasstothesurvivingowners.Asurvivingowner’sinterest is subject to the Credit Union’s statutory, contractual and common law lien for the deceased owner’s obligations, and to any security interest or pledge granted by a deceasedowner,evenifasurvivingownerdidnotspecificallyconsenttoit.Whenonlyonesurvivingownerremainsonajointaccountsubjecttotherightofsurvivorship,thataccountisdesignatedasanindividualaccount,subjecttothetermsofthisAgreementandapplicablelawwithrespecttoindividualaccounts.Forajointaccountwithoutarightofsurvivorship,thedeceasedowner’sinterestpassestohisorherestate in accordance with applicable law. ii. Any owner is authorized and deemed to act for any other owner and may instruct us regarding transactions and other account matters, including the request of futureservicesinconnectionwiththeaccount.Eachownerguaranteesthesignatureof any other owner. Any owner may withdraw or transfer funds, including all funds on deposit, pledge to us all or any part of the shares, or stop payment on items without the consent of any other owner, without regard to the proportionate share of the funds ondepositattributabletosuchowner.Whileanyindividualaccountownermaychangeorcloseanyaccountactingaloneexcepttheprimarysavingsshare,wemayrequireallaccountownerstoconsentinwritingtotheadditionorremovalofanyownerontheaccount,andwereservetherighttorequirewrittenconsentofallownersforanychangetoorterminationofanaccount.Wehavenodutytonotifyanyowneraboutanytransaction,orchangestoorclosureoftheaccount.IfwereceiveNoticetotheCredit Union of a dispute between owners or inconsistent instructions from them, we may suspend or terminate the account and require a court order or written consent fromallownersinordertopermitthewithdrawaloffundsfromtheaccountortotakeanyotheractions.Noticeprovidedbyustoanyonejointownershallbeconsiderednotice to all joint owners. iii. Allaccountowners,bothaloneandtogether,arejointlyandseverallyliablefor all transactions on, changes to, and closure of the account and for any charges, fees, losses, or liabilities incurred with respect to any transaction on, changes to, or closureoftheaccountregardlessofwhichownerconductedorbenefittedfromthetransaction, change or closure. You agree that if any account owner owes us money for any reason, we may enforce our rights against all funds in any account in which that account owner is an owner, including joint accounts, regardless of which owner deposited the funds in the account.

c. Trust Account–Toestablishadepositaccountforatrust,youmustprovideusacopyofthedocumentgoverningthetrustoraCertificateofTrustifcompliantwith and permitted by applicable law. Such trust instrument must be in writing and approvedbytheCreditUnion.Sharesmaybeissuedtoeitherarevocableorirrevo-cabletrust,subjecttothefollowing:(a)whensharesareissuedinarevocabletrust,thesettlormustbeamemberoftheCreditUnioninhisorherindividualcapacity;or(b)whensharesareissuedinanirrevocabletrust,eitherthesettlororthebeneficiarymustbeamemberoftheCreditUnioninhisorherindividualcapacity.Thenameofthebeneficiarymustbestatedinbotharevocableandirrevocabletrust.Thegrantor,trustee,andallbeneficiariesmustallbeeligibleformembershipintheCreditUnion.

Thepersonwhoopensatrustaccountwillbedesignatedthetrusteeandistheonlyperson who may access the account and the only person who signs a Signature Card. Atrustaccountwillbeadministeredinaccordancewiththetermsofitsgoverningtrustinstrument.YouacknowledgethattheCreditUnionmayrequestanopinionofyour legal counsel should it be necessary, in the sole discretion of the Credit Union, for the Credit Union to maintain a trust account. If we request a legal opinion, you will provideoneatyourexpense.Forpurposesofthissection,sharesissuedpursuanttoapensionplanauthorizedbytherulesandregulationswillbetreatedasanirrevocabletrust unless otherwise indicated in the rules and regulations.

d. Minor’s Account –Anypersonundertheageof18mayopenandownanaccount with us and may conduct transactions on the account, subject to the terms, responsibilities, liabilities, and conditions of this Agreement. We may require any accountestablishedbyapersonundertheageof18tobeajointaccountwithanownertheageof18orolderwhoshallbejointlyandseverallyliabletousforanyreturneditem,overdraft,orunpaidchargesoramountsonsuchaccount.Wemaypayfundsdirectlytothepersonundertheageof18withoutregardtohisorherage.Unlessaguardianorparentisanaccountowner,theguardianorparentshallnothaveanyaccountaccessrights.Wehavenodutytoinquireabouttheuseorpurposeofanytransaction. We will not change the account status when the person reaches the age of18orolderunlessthechangeisauthorizedinwritingbyallaccountowners.

e. PUTMA Account – As a member, you may open and own an account to hold the fundsofaminorunderthePennsylvaniaUniformTransferstoMinorsAct(“PUTMA”).UnderPUTMA,apersonundertheageof21isaminor.Thisaccountmustbedesig-natedandtitledinaccordancewithPUTMA,inwhichyouasthecustodianholdfundsfortheexclusiverightandbenefitoftheminor,subjecttotherequirementsofPUTMA.As the custodian, you are the only person who is entitled to conduct transactions on theaccount,change,and/orclosetheaccount.Whentheminorreachestheageof21,itisyoursoleresponsibilitytopaythefundsintheaccounttotheminor.Ifyoudie,wemaysuspendtheaccountuntilwereceiveinstructionsfromanypersonauthorizedby law to withdraw funds or a court order authorizing withdrawals. As the custodian, you agree to indemnify and hold us harmless from and against any and all loss, costs, damage, liability, or exposure, including reasonable attorney’s fees, which we may sufferorincurarisingoutofanyactionorclaimbyanybeneficiaryorothercustodianwith respect to your actions in handling or dealing with the account.

f. Representative Payee Account–ArepresentativepayeeisanindividualappointedbytheSocialSecurityAdministrationtoreceiveSocialSecuritybenefitsforsomeone who cannot manage or direct someone else to manage his or her money. A representativepayeeaccountisanaccountmaintainedbytherepresentativepayeeonbehalfofandforthebenefitofsuchindividual.TherepresentativepayeewillbepersonallyliabletousforanydeficiencyoramountowedinconnectionwithsuchAccount.Therepresentativepayeeagreesandacknowledgesthatthisliabilitytouswillsubjectaccountsoftherepresentativepayeeheldinhisorherindividualcapacityto our lien rights and rights of setoff contained in this Agreement.

g. Accounts subject to a Power of Attorney–Thepersonexecutingapowerofattorney will be referred to as the “principal” and the person acting for the principal as the “agent.” An agent has no ownership interest in the account(s) or Credit Union votingrights.Wemayrefusetocomplywithapowerofattorney,andsuchrefusalwillbewithoutanyliabilitytoyou,evenapowerofattorneythathasbeenpreviouslypresentedtotheCreditUnionandhonoredforreasonablecause,untilwereceiveanaffidavitfromtheagentstatingthattothebestoftheagent’sknowledge,theprincipalisaliveandthattherelevantpowersoftheagenthavenotbeenalteredorterminated.An agent’s power will cease to exist upon the principal’s time of death, or otherwise asprovidedforbyapplicablelaw.Youagreetoindemnifyandholdusharmlessforhonoring any power of attorney, or copy thereof, that we accept in good faith and believevalidandauthorizedbyyou.Youagreethatwehavenoobligationtomonitoranagent’stransactionsontheaccount.Theagentunderanypowerofattorneyinconnection with your Account shall be subject to the terms and conditions of this Agreement.

h. Agents appointed to Joint Accounts–Eachjointaccountholdermayappointhisorherownagentorattorney-in-facttotransactbusinessonthejointaccount,withouttheknowledgeorconsentoftheotherjointaccountholder(s).

i. Fiduciary Accounts – When you open an account to hold the funds of an es-tate,atrust,aguardianship,conservatorship,courtorderedarrangement,oranyotherlegalorfiduciaryrelationship(collectively,“FiduciaryRelationship”),youunderstandandacknowledgethatweareonlyprovidingyou,asthefiduciary,withanaccounttoholdfundsforthatFiduciaryRelationship,andthatwehavenofiduciarydutytoanypartywithrespecttosuchaccount.Youfurtherunderstandandacknowledgethatyouasthefiduciaryarecompletelyresponsibleforfulfillingthedutiesandresponsi-bilities of that Fiduciary Relationship, and we need only rely on and adhere to terms, responsibilities and obligations of this Agreement. Furthermore, you and all persons associated in any way with the Fiduciary Relationship agree to indemnify, defend, and hold us harmless for any loss damage, claim or liability asserted against us for our actionstakenpursuanttothisAgreementthatoccursasaresultofopening,usingandclosingtheaccount.Wereservetherighttorequiresuchdocumentsandauthorizationas we may deem necessary or appropriate to satisfy us that you or any other person requestingordirectingthewithdrawaloffundsheldintheaccounthavetheauthorityto withdraw funds. We may require you to substantiate your authority to negotiate a checknotspecificallymadepayabletoyoubeforeacceptingitfordeposit,andmayrequireyoutodepositthecheckintoanaccounttitledinthenameofthepayee.Notwithstandingtheforegoing,inoursolediscretion,wemayrefusetotakeanyactionyourequestwithrespecttotheaccountifweknoworbelieveingoodfaiththatyouarebreachingorotherwiseviolatingyourfiduciarydutywithrespecttotheaccount,althoughwehavenoobligationwhatsoevertoindependentlyinvestigatewhetheryouarecomplyingwithyourfiduciarydutiesrelatedtotheaccount.

j. Certificate Accounts –Anytimedeposit,termshare,sharecertificate,orcertificateaccountwhichweofferissubjecttothetermsofthisAgreement,theDisclosures,andthedocumentgoverningthetermsofsuchcertificateaccount,whichis incorporated in this Agreement by reference.

6. ACCOUNT ACCESS AND TRANSACTIONS. a. Authorized Signatures – Your signature on a Signature Card or electronic authentication authorizes your account access. Any person who signs the Signature Card as an account owner, signer or agent may conduct transactions on the account oruseorrequestservicesinconnectionwiththeaccount.Wemayrequireyoutoprovideuswithyoursignatureandcurrentgovernment-issuedpictureidentificationtoconductatransaction.Wewillnotbeliableforrefusingtohonoranycheck,draft,order,itemorinstructionifwebelievethesignatureisnotgenuineoraltered.Wewillnotberesponsibleforreviewingsignaturesoncheckspresentedforpayment.Ifyouhaveauthorizedtheuseofafacsimilesignature,wemayhonoranycheckordraftthatappearstobearyourfacsimilesignature,evenifitwasmadebyanunauthorizedperson. You authorize us to honor transactions initiated by a third person to whom you havegivenyouraccountnumber,accountinformation,accountaccesscode(includ-ing,butnotlimitedtoPersonalIdentificationNumbers),evenifyoudonotauthorizeany particular transaction by that person or any particular transaction by that person is notforyourbenefitoraccordingtoyourinstructions.Youagreethatwemaydisregardallinformationonacheck,includingnotes,andlegendsexceptforyoursignature,theamountofthecheckandtheinformationcontainedintheMagneticInkCharacterRecognitionlineatthebottomofthecheck,whichcontainsyouraccountnumberandchecknumber.

b. Unauthorized Endorsements – If you suspect or become aware of an unau-thorized,missingorforgedendorsementonacheck,draftorotheritemdrawnonyouraccount,orthatthepayeedidnototherwisereceivethefundsrepresentedbysaidcheck,draftorotheritem,youagreetoprovideNoticetotheCreditUnionimmediately.IfyoufailtoprovideNoticetotheCreditUnionwithinthirty(30)daysofsuchtimethatyoukneworshouldhaveknownoftheunauthorized,missingorforgedendorsementandsuchfailureresultsinourinabilitytorecoveronthecheck,draftorotheritem,wewillnotbeliabletoyou,andwillhavenoobligationtore-credityouraccount,forsuchcheck,draftorotheritem.Youfurtheragreetocooperatewithourinvestigationandtoprovideuswithanyinformationwerequireatourdiscretionaspartofourinvestigation.Suchinformationmayincludeanaffidavitfromthepayeeregardingtheallegations.Inanycase,wewillnotbeobligatedtoreimburseyouforthecheck,draftorotheritemorcredityouraccountuntilourinvestigationisconcludedandwehavedetermined such reimbursement or credit is appropriate. If you reimburse the payee of theitempriortotheconclusionofourinvestigationandwedeterminethatyouwere

notlegallyobligatedtodoso,wewillnotbeliabletoyouforthecheck,draftorotheritem. You further agree to notify law enforcement authorities of any criminal act, or anyactreasonablybelievedtobecriminal,relatedtotheclaim.Youagreethatyouwillnotwaiveanyrightsyouhavetorecoveryourlossagainstanyonewhoisobligatedtorepay, insure or otherwise reimburse you for your loss. You will pursue your rights, or atouroption,assignthemtoussothatwemaypursuethem.Innoeventwillwebeli-ableforanyspecialorconsequentialdamages,includinglossofprofitsoropportunity,or attorneys’ fees incurred by you, and our liability will be reduced by the amount you recoverorareentitledtorecoverfromothersources.

c. Access Options – You may withdraw or transfer funds from your account in anymannerwepermit,whichmayinclude,forexample,checks,AutomaticTellerMachines(“ATMs”),inperson,bymail,bytelephone,automatictransfer,internet,ormobiledevicesasapplicable.Wemayreturnasunpaidanycheckordraftdrawnonaformwedonotprovide,andyouareresponsibleforanylossweincurhandlingsuchcheckordraft.Ifwerequireyoutouseaspecificformtoconductorcompleteatrans-action, and you fail to use that form, you agree that we may refuse to honor, execute or complete the transaction. Whether a transaction is honored, executed or completed, you are responsible for any loss or liability incurred by us as a result of your failure to use a required form or adhering to the terms and responsibilities of this Agreement.

d. Electronic Transfers – We offer wire transfers or automatic clearing house (ACH)transfersthatallowyoutosendorreceivedebitsorcreditstoorfromyouraccount.ShouldyouutilizetheseservicesandreceivefundseitherbywireorACHtransfer,youagreetoverifythetransfersbyreviewingyourperiodicstatementandagreethatwehavenodutytonotifyyouwhenthefundsarereceived.Inadditiontoreviewingyourstatement,youmaycontactustodeterminewhetherapaymenthasbeenreceived. i. WireTransfers–ExceptasamendedbythisAgreement,wiretransferswepermitwillbesubjecttoapplicableFederalandPennsylvanialawsandregulations.When you order a wire transfer, we will debit your account for the amount of the payment order and will charge your account for any fees related to the transfer. We reservetherighttorefusetoexecuteanywiretransfertoorfromyouraccount.Weare not obligated to execute any payment order to transfer funds out of your account if theamountoftherequestedtransferplusapplicablefeesexceedstheavailablefundsin your account. We are not liable for errors, delays, interruptions, or transmission failures caused by third parties or circumstances beyond our control, including me-chanical, electronic or equipment failure. Payment orders we accept will be executed within a reasonable time of receipt but may not necessarily be executed on the date theyarereceived.Cutofftimesmayapplytothereceipt,executionandprocessofa fund transfer, payment order, cancellation, or amendment. If a request for a fund transfer,paymentorder,cancellation,oramendmentisreceivedafteracutofftime,itmaybetreatedashavingbeenreceivedonthenextbusinessday.Pleasecontactusto inquire about cutoff times. From time to time, we may need to suspend processing ofatransactionforgreaterscrutinyorverificationinaccordancewithapplicablelaw,inoursolediscretion,andthisactionmayaffectsettlementoravailabilityofthetransaction. When you institute a wire transfer, we may require that you identify the recipient,therecipient’saddress,anyfinancialinstitutionbynameandbyaccountoridentifyingnumber,andpurposeofthewire.TheCreditUnionandanyotherfinancialinstitutions facilitating the transfer may rely strictly on the account or identifying number,evenifthenumberidentifiesadifferentpersonorfinancialinstitution.Anyaccountownermayamendorcancelapaymentorder,evenifthatpersondidnotinitiate the order. We may refuse any request to amend or cancel a payment order that webelievewillexposetheCreditUniontoliabilityorloss.Anyrequestthatweacceptto amend or cancel a payment order will be processed within a reasonable time after itisreceived.Youagreetoholdusharmlessfromandindemnifyusforalllossesandexpenses, including attorneys’ fees, resulting from any actual or attempted amended or canceled payment order. We may require you to follow a security procedure to execute a payment order or certain electronic fund transfer transactions. We will notify you of any such security procedures, and you agree that our security procedures are commercially reasonable. You further understand and agree that if the Credit Union verifiesyourwiretransferorderpursuanttothesesecurityprocedures,thenyouwillbe liable for any wire transfers made from your account, whether or not you authorized them. ii. ACHTransfers–ExceptasamendedbythisAgreement,ACHtransfers

wepermitwillbesubjecttotheElectronicFundsTransferActanditsimplementingregulations and the National Automated Clearing House Association (“NACHA”) Rules, which are incorporated in this Agreement. While we may temporarily credit your accountforanACHtransfer,ifwedonotreceivefinalsettlementforthetransferwemayreversethecredittoyouraccountwithnoliabilitytoyouforsuchaction.Inthealternative,youagreetoreimburseusfortheamountofthereversedtransfer.

iii. ConversionofCheckstoElectronicTransfers–Insomecircumstances,aperson,merchantorotherentitytowhomyouhaveissuedacheckcanconvertyourcheckorcheckinformationtoanelectronicfundstransferanddebityouraccount.ThisconversionofyourchecktoanelectronicfundstransferiscoveredbythisAgree-ment,theNACHARulesandourElectronicFundsTransferAgreementandDisclosures.You authorize us to honor the electronic funds transfer and debit your account just as iftheoriginalcheckwaspresentedforpayment.Youunderstandthatifwedishonorandreturnyourchecktoamerchantforinsufficientfunds,amerchantmayattempttore-presentthecheckelectronicallyasanelectronicfundstransfer,andthatthiselectronicfundstransfer,whichrepresentsthedishonoredcheck,willbetreatedasare-presentedcheckunderthisAgreement.

i.iv. RemotelyCreatedChecks–Aremotelycreatedcheckisacheckordraftcreatedbysomeoneotherthanthepersononwhoseaccountthecheckordraftisdrawn.Aremotelycreatedcheckisgenerallycreatedbyathirdpartypayeeasautho-rizedbytheowneroftheaccountonwhichthecheckordraftisdrawn.Authorizationisusuallymadeonthetelephoneorthroughanonlinecommunication.Theowneroftheaccountdoesnotsignaremotelycreatedcheck.Inplaceoftheowner’ssignature,theremotelycreatedcheckusuallybearsastatementthattheownerauthorizedthecheckorbearstheowner’sprintedortypedname.Ifyouauthorizeathirdpartytodrawaremotelycreatedcheckagainstyouraccount,youmaynotlaterrevokeorchangeyourauthorization.Itisyourresponsibilitytoresolveanyauthorizationissuesdirectly with the third party. We are not required to credit your account and may chargeagainstyouraccountanyremotelycreatedcheckforwhichthethirdpartyhasproof of your authorization.

v. OtherTypesofElectronicTransactions–Thetermsofelectronicfundstransfer transactions, including Visa®DebitCardandATMtransactions,inconnectionwithyouraccountaregovernedbytheElectronicFundsTransferAgreementandDisclosures.

e. Withdrawal Restrictions–Wewillpaychecksordrafts,permitwithdrawalsandmaketransfersfromavailablefundsinyouraccount.TheavailabilityoffundsinyouraccountmaybedelayedassetoutmorefullyintheFundsAvailabilityPolicyDis-closure.Youmusthavesufficientfundsavailableinyouraccount,orbeeligibleforandenrolledinoverdraftprotectioninconnectionwithyouraccount,inordertowithdrawfundsfromyouraccount.Ifacheck,draft,item,orothertransferorpaymentorderispresentedagainstinsufficientfunds,weareentitledtodishonorthecheck,draft,item, or other transfer or payment order, unless you are eligible for and enrolled in our overdraftservices,andyouwillbeassessedafeeasspecifiedintheDisclosures.

In addition to the foregoing, there are a number of circumstances in which you may not be able to withdraw funds from your account, including, but not limited tooccasionswhen(1)youattempttowithdrawormakeatransferrequestbyanymethodwedonotpermit;(2)you,asigner,anagent,oranypersonfailstopresentauthoritativedocumentationoridentificationwerequiretoaccesstheaccountormakeawithdrawal;(3)disputesoruncertaintyoccuroverwhoownstheaccountorthefundsheldintheaccount;(4)fundsfromdepositsarenotyetavailableforwithdrawalordepositedcheckshavebeenreturnedunpaidandwehavechargedthembackagainsttheaccount;(5)fundsareheldfordebitcardauthorizationsforpurchasesmadebutnotyetsettled;(6)thefundsintheaccountareheldassecurity(collateral)foranobligationtousortoathirdpartysubjecttoavaliddepositaccountcontrolagreementtowhichweareaparty;(7)thefundsareheldoroffsetunderourconsen-sual security interest, statutory lien rights, common law lien rights, or contractual lien rightsprovidedforinthisAgreementbecauseyouoranotherownerowesmoneytous;(8)wehavebeenservedwithagarnishment,levyorothersimilarlegalprocessornoticeaffectingtheaccount;or(9)wereasonablybelievesuchwithdrawallimitationsmaybenecessarytopreventalosstous.

Additionally,wemayrequireyoutoprovidewrittenNoticetotheCreditUnionofyourintenttomakeawithdrawalfromyouraccountatleastseven(7)daysanduptosixty(60)dayspriortothetimethatyouwouldliketomakethewithdrawal.

f. Transfer Limitations – We may limit the dollar amount or the number of transfers from your account. Please consult your Disclosures. Additionally, we may limittheamountofcashwithdrawalsatourATMs.OurcurrentlimitationsonATMcashwithdrawals are set forth in your Disclosures.

g. Postdated and Stale Dated Checks –Youagreenottoissueanycheckthatispayableonafuturedate(thatis,postdated).Ifyoudoissueacheckthatispostdated,andwepayitbeforethatdate,youagreethatweshallhavenoliabilitytoyouforsuchpayment,andsuchcheckisnotproperlypayableagainstyouraccount.Youagreenottodepositchecks,draftsorotheritemsbeforetheyareproperlypayable.Wearenotobligatedtopayanycheckdrawnonyouraccountthatispresentedmorethansix(6)months past its date.

h. Order of Payments–Checksandotheritemsmaynotbeprocessedintheorderthatyoumakethemorintheorderthatwereceivethem.Wemay,atourdis-cretion,andinaccordancewithapplicablelaw,payacheckoritemandexecuteothertransactionsonyouraccountinanyorderwechoose.Theorderinwhichweprocesschecksoritemsandexecuteothertransactionsonyouraccountmayaffectthetotalamountofoverdraftfeesthatmaybechargedtoyouraccount.Pleasecontactusifyouhavequestionsabouthowwepaychecksandprocesstransfersandwithdrawals.

i. Right to Refuse Payment–Youagreethatwewillhavenoliabilitytoyouforrefusingtohonoranycheck,item,order,orinstructionifwebelieveingoodfaiththatanysignature,instruction,provision,term,ortheformitselfisnotgenuineorisalteredandthatsuchnonpaymentornon-actionisnotwrongful.

j. Non-member presenting your check – You understand that we may require anynon-memberaskingustocashyourchecktoprovidethatperson’scurrentgov-ernment-issuedpictureidentification.Youagreethatifanon-memberpresentingyourcheckfailstocomplywiththesepresentmentrequirements,wewillhavenoliabilitywhatsoeverforrefusingtopaythecheckandthatsuchnonpaymentisnotwrongful.Additionally,wemayrefusetoacceptanycheckdrawnonyouraccountthatispresented for payment in person. Such refusal shall not constitute a wrongful dishonor ofthecheck,andweshallhavenoliabilityforrefusingpayment.

7. DEPOSITS TO YOUR ACCOUNT. Funds may be deposited into your account by anymeanswepermit,whichmayinclude,forexample,checks,ATMs,inperson,bymail,bytelephone,automatictransfer,internet,ormobiledevicesasapplicableandinaccordance with the terms of the Disclosures. We are not responsible for any deposit whichwedonotreceive,andourrecordswillbethesoleconclusiveproofofreceiptornon-receiptofadeposit.Depositsmadebymail,atnightdepositories,oratunstaffedfacilities(includingATMs)arenotourresponsibilityuntilwereceivesuchdeposit.Wereservetherighttorefuseanydeposit.

a. Availability of Deposits–Theavailabilityoffundsinyouraccountinconnec-tionwithadepositmaybedelayedassetoutmorefullyintheFundsAvailabilityPolicyDisclosure.

b. Endorsements–Wemayaccepttransfers,checks,draftsandotheritemsfordeposit into any of your accounts if they are made payable to, or to the order of, one (1)ormoreaccountowners,eventhoughsuchtransfer,check,draftandotheritemisnotendorsedbyallpayees.Eachpartytoamultiple-partyaccountauthorizeseveryother party to endorse and to deposit to the account any item payable to one, both or all of them, and authorizes us to accept for deposit any item payable to one, both or allofthemwithorwithoutendorsement.Ifacheck,draftoritemthatispayabletotwo(2)ormorepersonsisambiguousastowhetheritispayabletoeitherorboth,asdeterminedinoursolediscretion,wemayprocessthecheck,draft,oritemasthoughitispayabletoeitherperson.Notwithstandingtheforegoing,ifaninsurance,govern-mentorothercheckordraftrequiresanendorsement,wemayrequireanendorse-ment as set forth in the item without limiting our rights set out in this subjection. Youagreenottoknowinglydepositanytransfers,checks,draftsandotheritemsintoyouraccountthatdonothaveeitheratrueoriginalsignatureofthepersononwhose account it is drawn or an authorized mechanical reproduction of that person’s signature.Youagreenottodepositanytransfers,checks,draftsandotheritemsinto your account that are missing any required endorsement or that contain an unauthorizedorforgedendorsement.Wemayrequireyoutoverifyanendorsement

onanytransfers,checks,draftsandotheritemsthroughtheappearanceinpersonoftheendorserwithproperidentificationandbyprovidinguswithanendorsementguarantee. Allendorsementsmustappearonthebackofthechecksorotheritemwithinthefirst1½inchesfromtheleftsideofthecheckorotheritem.Youarealsoresponsibletomakesureatthetimeyouissueanycheckthattheformatissuchthattherewillbenowritingwhatsoeveronthereversesideofthecheckplacedbeyondanarealocated1½inchesfromtheleftedgeofthecheckwhenlookingatitfromthefront.Itisyourresponsibility to ensure that these requirements are met and you are responsible for any loss incurred by us for failure of an endorsement to meet this requirement. Whilewemayatourdiscretionacceptnon-conformingendorsements,youwillberesponsible for any loss incurred by us due to the delay in processing or returning the checkorotheritemforpayment.Checksdepositedbymobiledepositmustincludetherestrictiveendorsement“ForMobileDepositOnlyatMembers1stFederalCreditUnion” in addition to your endorsement.

c. Restrictive Legends–Wearenotrequiredtohonoranyrestrictivelegendsorany language on an item that purports to place restrictions, limits or conditions on the paymentornegotiationofsuchitem.Examplesoflegendsare“mustbepresentedwithinninety(90)days”or“notvalidformorethan$1,000.00”or“twoormoresig-naturesrequired”.Wemaypayoracceptchecksandotheritemsbearingrestrictionsornotations(e.g.,“VoidAfter90Days,”“WithoutRecourse,”“PaidinFull,”“VoidOver$100”),whetheronthefrontorback,inanyformorformat.Wemaydisregardanyinformationonacheckordraftotherthanthesignatureofthedrawer,theamount,andanymagneticencoding.Suchnotationsshallhavenoeffectonus,andyouagree(1)thatwedonotfailtoexerciseordinarycareinpayingachecksolelybecauseourproceduresdonotprovideforasightexaminationoftheseitems,and(2)toassumeallrisksandlossesresultingfromouracceptanceorpaymentofchecksoritemsthatmaynotconformtothepurportedlyrestrictivelanguage.Youagreetoindemnify,defendandholdusharmlessforouracceptanceorpaymentofsuchchecksoritems.

d. Collection of Items – We only act as your agent and we are not responsible for handling items for deposit or collection beyond the exercise of ordinary care. We arenotliableforthenegligenceofanycorrespondent(orotherthirdpartyprovidingservicesonourbehalf)orlossintransit,andeachcorrespondentorotherthirdpartyprovidingservicesonorbehalfwillonlybeliableforitsownnegligence.Wemaysendanyitemforcollection.Youwaiveanynoticeofnonpayment,dishonororprotestregardingitemswepurchaseorreceiveforcreditorcollectiontoyouraccount.Wereservetherighttopursuecollectionofpreviouslydishonoreditemsatanytime,includinggivingapayorfinancialinstitutionextratimebeyondanymidnightdeadlinelimitsimposedbyapplicablelaw.Wereservetherighttorefuseorreturnanycheck,draft,item,orfundstransfertakenfordeposit,toplaceareasonableholdonthecheck,draft,oritemortosendthecheck,draft,oritemforcollection.Wealsoreservetherighttochargeyouraccountforanycheck,draft,oritemtakenfordepositintheeventitbecomeslostinthecollectionsprocess.

e. Direct Deposit – We may offer preauthorized deposits (for example, payroll checks,SocialSecurityorretirementchecks,orothergovernmentchecks)orpreauthorized transfers from other accounts. You must authorize direct deposits or preauthorized transfers by enrolling with the initiator of the deposit. You must notify usatleastthirty(30)daysinadvancetocancelorchangeadirectdepositortransferoption.Ifyouraccountisoverdrawn,youauthorizeustodeducttheamountyouraccountisoverdrawnfromanydeposit,includingdepositsofgovernmentpaymentsorbenefits.Uponabankruptcyfiling(eitherbyyouorbyanypayeeofapreauthorizedtransfer), unless you cancel the authorization, we will continue applying payments fromdirectdepositsinaccordancewithyourauthorizationonfilewithus.InadditiontoanyotherrightswehaveunderthisAgreement,ifwearerequiredtoreimburseanyfederalorstategovernmentanyportionofabenefitpaymentdepositedintoyouraccount,youagreethatwemaydeducttheamountreturnedtothegovernmentfromthataccountoranyotheraccountyouhavewithuswithoutpriornoticetoyou,unlesssuch deduction is prohibited by law.

f. Time of Deposits–Depositsmadeorreceivedbyusafter11:00p.m.EasternTimeanddepositsmadeonanydaysotherthanourbusinessdayswillbeconsideredtohavebeendepositedonournextbusinessday.DepositsmadeatnightdepositoriesoratATMsthatarenotlocatedatoneofourbranchesshallbeconsideredtohave

beendepositedwhenweretrievethedeposit.Credittoyouraccountforfundsdeposit-ed,whetherviacheck,draft,item,orothertransfer,isprovisionaluntilwereceivefinalsettlementfortheitem.Ifafinancialinstitutionobligatedtopayanitemdishonorsanyitemwhichyouhavedeposited,wemaychargeyouraccountfortheamountofsuchcheck,draft,item,orothertransferandimposeareturnchargeonyouraccountasspecifiedintheDisclosures.Anycollectionfeesweincurmaybechargedtoyouraccount(s).

g. Deposit Errors–Ifwemistakenlycredityouraccount(s)forfundstowhichyouarenottherightfulowner,evenifsuchmistakeissolelyattributabletoouractions,wewilldeductthosefundsfromyouraccount(s),evenifthiscausesyouraccount(s)tobeoverdrawn.Inthealternative,inordertorecoversuchfunds,wemayexerciseour right of setoff against any other account owned solely or jointly by you under our statutorylienrights,commonlawlienrights,orcontractuallienrightsprovidedforherein.

h. Limitation on Deposits–Wemaylimitthenumberofitemsdepositedand/orthefrequencyofdepositsandothertransactionsthatyoucanmakeeachday.Thedateweusetodeterminethefrequencyoftransactionsisthedateatransac-tion is completed by us rather than the date you initiate the transaction. Should the transactions on your account exceed the limitations we established, we may limit your accounttransactionactivity,imposeafeeasspecifiedintheDisclosures,orcloseyouraccount.

8. ADVERSE CLAIMS.Ifwereceiveconflictinginstructionswithrespecttoyouraccount,ornoticeofanadverseclaimofownership,righttocontrol,oraccessfundsinyouraccount,ornoticethatthefundsinyouraccountmayhavebeenobtainedthrough fraudulent or criminal acts, you agree that we may place a hold on the funds in the account, until all appropriate parties (as determined in our sole discretion) provideuswithjointwritteninstructionswithrespecttodispositionofthefunds.Weare not required to determine if the dispute has merit. Additionally,ifwereceiveNoticetotheCreditUnionindicatingadisputebetweentwo or more joint account owners, we may require the signature of all joint account ownersforalltransactionsuntilthedisputeisresolvedtooursatisfaction. Additionally,weshallhavetherighttoclosetheaccountanddepositthefundsheld in the account into the registry of a court of proper jurisdiction, where the appro-priatepartiesshallbeinterpleadedorjoinedtotheactionforpurposesofresolvingthedispute regarding the funds. IfweelecttotakeanyactiondescribedinthisAgreementoravailabletousunderapplicablelaw,youagreethatweshallnotbeliabletoyoufordamagesofanykind,and you agree to pay and reimburse us for our reasonable costs and expenses includ-ing, without limitation, attorneys’ fees and court costs from the funds in any account of yours prior to any distribution. Ifyouaskustofollowinstructionsthatwebelieve,inoursolediscretion,mightexpose us to any claim, liability or damages, we may refuse to follow your instructions or may require a bond or other protection, including your agreement to indemnify us. You agree to be liable to us, to the extent permitted by law, for any loss, costs, attor-ney fees or expenses that we may incur as a result of any dispute or legal proceeding involvingyouraccountorourrelationshipwithyou.Youauthorizeustodeductanysuch loss, cost, attorney fees or expense from your account(s) pursuant to our statu-tory, common law or contractual right of setoff without prior notice to you or to bill you separately.Thisliabilityincludes,butisnotlimitedto,disputesinvolvingsituationsinwhichtherearedisputesbetweenyou,anyagentyouhaveauthorized,ajointowneror third party claiming an interest in your account. It also includes, but is not limited to, situationswhereanyactiontakenonyouraccountbyyou,youragent,ajointowner,orathirdpartycausesustoseektheadviceofanattorney,whetherornotweactuallybecomeinvolvedinadispute.Anyactionbyusforreimbursementfromyouforanycosts, attorney fees or expenses may also be brought against your estate, heirs and legalrepresentatives,whowillbeliableforanyclaimsmadeagainstandexpensesincurred by us.

9. DIVIDENDS, INTEREST AND FEES.Wepayaccountearningsdividends(interest), and assess fees against your account as set forth in the Disclosures. We maychangeanyoftheDisclosuresatanytimeandmakeourratesavailableviaourwebsite or by contacting us. We will notify you when fees change in accordance with the terms hereof and the requirements of applicable law.

10. STOP PAYMENT ORDERS. a. Stop Payment Order Request–AnyownermaystoppaymentofanycheckdrawnorACHdebitdrawnontheowner’saccount.Tobebinding,astoppaymentordermustaccuratelydescribethecheck,ortransaction,includingtheexactaccountnumber,thecheckordraftnumber,andtheexactamountofthecheck.Ifwereceiveincorrect or incomplete information, we will not be responsible for failing to stop paymentonthecheck.Inaddition,youmustprovidesufficientadvanceNoticetotheCredit Union for a stop payment order to allow us a reasonable opportunity to act on it. Ifwere-credityouraccountafterpayingacheckoveravalidandtimelystoppaymentorder, you agree to sign a statement describing the dispute with the payee, to assign usallofyourrightsagainstthepayeeorotherholdersofthecheck,andtoassignusany legal action.

b. Duration of Order –Oralstoppaymentorderswilllapsewithin14calendardaysunlessconfirmedinwritingwithinthattime.Writtenstoppaymentorderswillbeeffectiveforsix(6)monthsandmayberenewedforadditionalsix(6)monthperiodsbyrequesting in writing that the stop payment order be renewed within a period during which the stop payment order is still in effect. We are not required to notify you when a stop payment order expires.

c. Credit Union Checks–Youmaynotstoppaymentonanycertifiedcheck,cashier’scheck,teller’scheck,moneyorder,oranyothercheck,draftorpaymentguaranteedbyusthatyouhaverequestedorisassociatedwithlegalprocessinconnectionwithyouraccount.Ifsuchacheckinyourpossessionislost,stolenordestroyed,youagreetoprovideuswithasigneddeclarationoflossandindemnityagreement.Atouroption,wemaywaittorepayorreissuethecheckaminimumofthirty(30)daysandamaximumofninety(90)daysafteritwasoriginallyissued.Iftheoriginalcheckisproperlypresentedbeforetheninety(90)dayperiodexpires,regard-lessofwhetheryouhaveprovideduswithasignedindemnityagreement,wewillpaythecheck,andifwehaverepaidtheamountofthechecktoyou,youwillbeliabletous for the amount so paid.

d. Liability – Fees for stop payment orders are set out in the Disclosures. Although payment of an item may be stopped, you may remain liable to any item holder, in-cluding us. You agree to indemnify and hold the Credit Union harmless from all costs, including attorneys’ fees, damages or claims related to our refusing payment on an item, including claims of any joint account owner, payee, or endorser in failing to stop paymentonanitemasaresultofincorrectinformationprovidedbyyou.

11. ACCOUNT INSURANCE COVERAGE. Your account is insured up to the limit established by the National Credit Union Share Insurance Fund (“NCUSIF”).

12. ACCOUNT SECURITY AND YOUR OBLIGATIONS. In addition to obligations contained elsewhere in this Agreement, or incorporated herein, including, but not limit-edto,theElectronicFundsTransferDisclosures,youshouldatalltimes(a)safeguardaccountmaterialsandinformationsuchasaccountnumbers,checkbooks,electronicaccessdevices,passwords,andidentificationnumbers;(b)reviewcarefullyallaccountmaterialsincludingchecks,checkbooks,checkstock,statementsande-statementsforunauthorizedactivity;(c)maintaincontroloverfacsimilesignaturesande-signa-tures;(d)bevigilantwithregardstoreleasingaccountinformationtounknownparties;and(e)issuechecksorotherfundstransferswithcaretoavoidalterationsandforgeries.Youareresponsibleforsecuringanycomputerandnetworkusedtoaccessyour online account against intrusion or manipulation. YoumustprovideNoticetotheCreditUnionimmediatelywheneveryoubecomeawarethatanyofyourchecksordebitcardsarelostorstolenorofanyunauthorizeduse of your account. If you fail to immediately notify us of such situations, it may limit ourabilitytopreventaloss,whichwillresultinyoubeingsolelyliableforanyandallloss suffered in connection with such theft or unauthorized use of your account. If you claim a credit or refund because of forgery, alteration or any unauthorized activity,youmustcooperatewithusintheinvestigationoftheloss,includinggivingusanaffidavitcontainingstatementsthatwillenableustopursuelegalprosecutiontopreventorrecoveranyloss.Wewillhaveareasonableperiodoftimetoinvestigatethefacts and circumstances surrounding any claim of loss. Wemayrequirethatyounotifylawenforcementauthoritiesandaidintheinves-tigation and prosecution of any criminal act related to your account. We may deny a claimofmonetarylossduetoforged,alteredorunauthorizedchecksifyoudidnot

maintainpropercontroloveryouraccount.Wemayalsorequireabondofindemnityinan amount satisfactory to us against all claims and expenses we may incur. Youagreethatyouwillnotwaiveanyrightsyouhavetorecoveryourlossagainstanyone who is obligated to repay, insure or otherwise reimburse you for your loss. You will pursue your rights, or at our option, assign them to us so that we may pursue them.Innoeventwillwebeliableforanyspecialorconsequentialdamages,includinglossofprofitsoropportunity,orattorneys’feesincurredbyyou,andourliabilitywillbereducedbytheamountyourecoverorareentitledtorecoverfromothersources. UseofthePIN(PersonalIdentificationNumber),cardPIN(s),and/oronlinebankingpasswordaretheagreedsecuritymethodstoaccessyouraccount(s).WewillrelyoninstructionsreceivedunderyourPINorpassword.Youagreethattheuseofthesesecuritymethodswillhavethesameeffectasyoursignatureinauthorizinganytransaction.YouareresponsibleforkeepingyourPIN,password,accountnumberandotheraccountdataconfidential. WhereyouhaveauthorizedanyotherpersontouseyourPIN(s)orpasswordinany manner, your authorization is considered by us to be unlimited in amount and du-rationofeffectiveness.GrantinganotherpersonaccesstoyouraccountviathePIN(s)orpasswordwillmakeyoufinanciallyliableforanylossincurredormisuseoftheaccount.Yourauthorizationwillbeeffectiveuntil(1)youhaveprovidedwrittenNoticetotheCreditUnionthatyouhaverevokedtheauthorization;(2)youhavechangedyourPIN(s)orpasswordviathetelephoneoronlineaccountaccess;and(3)wehavehadareasonable opportunity to act upon a request to change your PIN or password. Tomaintainsecurecommunicationsandreducefraud,youagreetoprotectthesecurityofyouraccountnumber(s),PIN(s)andpassword.Wereservetherighttoblockaccesstoyouraccount(s)andservicesifwebelieveingoodfaithyourPINorpassword has been or is being used by an unauthorized person.

13. MEMBERSHIP, ACCOUNT, SERVICE AND TRANSACTION INFORMATION. We arededicatedtoprotectingtheprivacyofyourpersonalinformation.Assuch,onlyanaccountowner,signer,oragentspecificallynamedonanaccountisentitledandcanhaveaccesstoinformationconcerningmembership,theaccount,aservice,ora transaction related to the account. If there are multiple account owners, signers, or agents on an account, you agree that any owner, signer, or agent may obtain all information about the entire membership relationship, including any and all accounts, services,ortransactions.WeagreenottodiscloseaccountinformationtothirdpartiesexceptasstatedinthePrivacyPolicyDisclosure.Uponrequest,wewillgiveyouthename and address of each agency from which we obtain a credit report regarding your account.

14. CREDIT UNION LIABILITY. We exercise ordinary care if our actions or inactions areconsistentwithapplicablestatelaw,FederalReserveregulationsandoperatingcirculars,clearinghouserules,andgeneralfinancialinstitutionpracticesfollowedintheareathatweserve.Yougrantustheright,inmakingpaymentsofdepositedfunds,torelyexclusivelyonthetypeoftheaccount,thetitlingoftheaccount,andthetermsoftheAgreement.Exceptasotherwiseexpresslyprovidedbyapplicablelaw,ruleorregulation,youagreethatneitherwenoranyentityorpersonwhoprovidesservicesorproductstous(“ServiceProviders”)willbeliableforanyloss,injuryordamage,including,butnotlimitedto,indirect,incidental,special,consequentialorpunitivedamages, whether under contract, tort or any other theory of liability, arising out of or relating to any failure of performance, error, omission, interruption, defect, delay in operationortransmission,computervirus,linefailureorunauthorizedinterceptionoraccesstoyourcommunicationswithus,evenifweortheServiceProvidersareawareofthepossibilityofsuchevents.Totheextentanylaw,ruleorregulationprovidesfor us to be liable for any such loss, injury or damage, but permits our liability to be limited or eliminated by agreement, this paragraph limits or eliminates our liability to the fullest extent permitted.

15. NO LIABILITY FOR SYSTEMS. We will not be responsible for indirect losses resulting from your inability to access our computer systems data. We will also not be responsible for direct, special, indirect or consequential damages or losses attributable toorarisingoutof(a)anactofnature;(b)physicaldamagetoordestructionoftangi-bleproperty,includinglossofusethereof;(c)anunexplainedorindeterminablefailure,malfunction or slowdown of the computer system, including electronic data, and the inabilitytoaccessorproperlymanipulatetheelectronicdata;(d)aninterruptioninnormalcomputerfunctionornetworkserviceorfunctionduetoinsufficientcapacitytoprocesstransactionsorduetoanoverloadofactivityonthecomputersystemor

network;(e)acomplete,substantialormaterialfailure,disablementorshutdownoftheInternet,regardlessofthecause;(f)thereductioninorsurgeofpower;(g)themalfunctionorfailureofanysatellite;or(h)anyactionbyagovernmentalorqua-si-governmentalauthorityoragency,includingtheseizureordestructionofpropertyby order of such authority or agency.

16. TRANSFERS AND ASSIGNMENTS. You cannot assign or transfer an interest in your account unless we agree in writing. Your successors and assigns are bound by this Agreement. Any actual or purported assignments of the account remain subject to oursecurityinterestandrightofsetoff.Wemustapproveanypledgeofyouraccountas security for a debt, and any pledge remains subject to our security interest and rightofsetoff,unlesswespecificallyagreeotherwise,inwriting.WemayassignthisAgreement in connection with a merger, consolidation, or a sale of all or substantially all of our assets.

17. NOTICE.Writtennoticethatweprovidetoyouiseffectiveatthetimeofmailingtoyou,firstclassmail,postedprepaid,atthecurrentrecordaddresswehaveforyou.Noticetoanyaccountowneriseffectivenoticeastoallaccountowners.YouareresponsibleforprovidingNoticetotheCreditUnionofanynameoraddresschange,andwemayrequireyoutoprovidesuchnoticeinwriting,tobeeffective.Inthealter-native,ifyouhaveconsentedtoreceivenoticeselectronically,noticetoyoushallbeeffectivewhenwehaveprovidedelectronicnoticeinaccordancewithourestablishedprocedures.AnyNoticetotheCreditUnioniseffectivewhenwereceiveit.TheCreditUnion’srecordsshallbethesoleconclusiveevidenceastowhetherandwhensuchnoticewasreceivedbytheCreditUnion.

18. ACCOUNT STATEMENTS. a. Contents–Ifweprovideaperiodicstatementforyouraccount,youwillreceiveaperiodicstatementoftransactionsandactivityonyouraccountduringthestatementperiodasrequiredbyapplicablelaw.Ifaperiodicstatementisprovided,youagreethat only one (1) statement is necessary for joint accounts, mailed or emailed to theaddressofrecordprovidedforinconnectionwiththeaccount.Forsharedraftorcheckingaccounts,youunderstandandagreethatyouroriginalcheckordraft,when paid, becomes the property of the Credit Union and may not be returned to you,butcopiesofthecheckordraftmayberetainedasrequiredbylawbyusorbypayable-throughfinancialinstitutionsandmaybemadeavailableuponyourrequestfor a fee as set forth in the Disclosures. You understand and agree that statements aremadeavailabletoyouonthedatetheyaresenttoyou,whetherbymailorbyelectronicnoticethatstatementsareavailableforviewing.Youalsounderstandandagreethatchecks,drafts,orcopiesthereofaremadeavailabletoyou,eventhoughthechecksordraftsdonotaccompanythestatement.

b. Examination – You are responsible for examining each statement immediately upon receipt, and reporting any irregularities to us. If we suffer a loss because of yourfailuretopromptlyreportanyunauthorizedsignatureonoralterationofacheckto us, you are precluded from asserting any claim against us for that unauthorized signatureoralteration.Youwillalsobeprecludedfrommakingaclaimagainstusforany unauthorized signature or alteration by the same wrongdoer if you do not report thefirstunauthorizedsignatureoralterationbythatwrongdoerwithinareasonableperiodoftime,nottoexceedsixty(60)days,fromthedatewhenwemadeavailabletoyouthestatementshowingthewrongdoer’sfirstunauthorizedsignatureoralteration.If you fail to report any irregularities such as forged, altered, unauthorized, unsigned, counterfeit,erroneousorotherwisefraudulentchecks,drafts,items,paymentsortransactionsdrawnonyouraccountorotherdiscrepanciesreflectedonyourstate-ment(each,an“Irregularity”)withinsixty(60)daysofthedatewemadethestatementavailabletoyou,wewillnotberesponsibleforyourlossinconnectionwithsuchIrregularityreflectedonyourstatementandwillhavenoobligationtore-credityouraccount for the amount of the Irregularity. We also will not be liable for any items that are forged or altered in a manner not detectable by a reasonable person, including the unauthorized use of a facsimile signature machine. You agree not to institute any legal proceedingoractionagainstusforanyclaimwhichyoumayhaveregardinganysuchirregularitiesunless(1)youhavegivenuswrittenNoticetotheCreditUnionoftheirregularitywithinthetimeframedescribedabove,and(2)suchlegalproceedingoraction has been commenced within one (1) year after the date when such statement oradvicewasmailedormadeavailabletoyou.ThetermsofourElectronicFundsTransferAgreementandDisclosureswillcontroltheprocessandtimeframefor

reporting unauthorized or erroneous electronic funds transfers.

c. Statement Concerns –YouagreethattheCreditUnion’sretentionofchecksordraftsdoesnotalterorwaiveyourresponsibilitytoexamineyourstatementsorthetimelimitfornotifyingusofanyirregularity.Thestatementwillbeconsideredcorrectfor all purposes, and we will not be liable for any payment made or charged to your accountunlessyouprovideNoticetotheCreditUnioninwritingwithinthetimelimitprovidedforinthisAgreementfornotifyingusofanyirregularities.Ifyoufailtoreceiveaperiodicstatement,youagreetoprovideNoticetotheCreditUnionwithin14daysofthetimeyouregularlyreceiveastatement.Ifyoudonotreceiveastatementfromusbecauseyouhavenotsupplieduswithacorrectaddress,wemaystopsendingyourstatementsuntilyousupplyuswithaproperaddress,andwewillhavenoliabilitytoyouforsuchfailuretoprovideastatement.

19. MODIFICATION OF THIS AGREEMENT. We may change the terms of this Agreementfromtimetotime,andwewillnotifyyouofanychangeswemaketothisAgreementortheDisclosuresthataffectyouraccounts,services,andifapplicable,loans, in accordance with the requirements of applicable law and the notice require-mentsinthisAgreement.Youagreethatunlessapplicablelawprovidesotherwise,wemaynotifyyouofachange,amendmentormodificationtothisAgreementortheDisclosuresbysuchnoticeofthechange,amendmentormodificationaswedeter-mine is appropriate, such as by statement message or enclosure. You agree that such noticewillbesufficientandeffective,andyourcontinueduseofanyaccountshallconstituteyourconsenttosuchchange,amendmentormodification.Thesechangesmay include, but are not necessarily limited to a change or supplement to, or deletion of,existingprovisionsandtheadditionofnewprovisions,whetherornotthesubjectoftheamendmentwasaddressedinpreviousversionsofthisAgreementorotheragreementsgoverningyouraccount.Unlessalongerperiodisrequiredbyapplicablelaw,suchchangeshallbeimmediatelyeffectiveuponnoticetoyou.Atanytime,itisthemostrecentversionoftheAgreementthatisineffect,withoutregardtowhatversionwaseffectivewhenyouenteredintothisAgreement.YoumayonlychangethetermsofthisAgreementbymodifyingtheinformationprovidedforintheSignatureCard,withourexpresswrittenconsent,subjecttofulfillingourinformationrequestsinconnection with such requests, and obtaining the signatures of any other joint owners of the account, if necessary in our sole discretion.

20. SECURITY INTEREST/RIGHT OF SETOFF. Unless prohibited by law, you pledge andgranttousalienandconsensualsecurityinterestandagreeandacknowledgethatweshallhaveacontractualrightofsetoffinallshares,dividends,depositsandinterest,ifany,inallaccountsyouhavewithusnowandinthefuture(whethersuchaccountsarejointlyownedormultiple-partyaccounts)foranyandallobligations,liabilityordebtowedbyyoutous,whetherjointorindividual,whetherdirectorcontingent,whethernoworhereafterexisting,andwhetherarisingfromoverdrafts,guarantees,loans,attachments,garnishments,levies,orattorney’sfees.Iftheaccountisajointormultiple-partyaccount,eachaccountownerauthorizesustoexercisethe lien rights or rights of setoff granted in this Section against the full amount of the funds deposited into the account for any and all obligations owed to us by any individualaccountowner.Thisapplieseveniftheobligationisnotjointbetweentheowners of the account, and without regard to the proportion to the net contributions by each account owner to the sum on deposit. We may exercise the rights granted under thisSectionwithoutliabilitytoyou,evenifitresultsinaninterestpenaltyordishonorofsubsequentchecks,drafts,transfersandotheritemswithrespecttoyouraccount.Excepttotheextentprohibitedbylaw,thisrightappliestoallfundsondepositinanyaccountyouhavewithus,regardlessofitssource,including,forexample,butnotlimitedto,federalorstatebenefitpayments. Ifyoupledgeaspecificdollaramountinyouraccountforaloan,wewillfreezethe funds in your account to the extent of the outstanding balance of the loan, or, if greater,theamountofthepledgeiftheloanisarevolvingloan.Otherwise,fundsinany pledged account may be withdrawn unless you are in default. Inadditiontothepledgecontainedherein,applicablelawgivesusalienonallsharesanddividendsandalldepositsofinterest,ifany,inaccountsyouhavewithusnowandinthefuture.Exceptaslimitedbyapplicablelaw,thestatutoryandcommonlawliengivesustherighttoapplythebalanceofallyouraccountstoanyobligationon which you are in default. After you are in default, we may exercise our statutory and common law lien rights without further notice to you.

If we do not apply the funds in your account to satisfy your obligations, liabilities ordebtsowedtous,wemayplaceanadministrativefreezeonyouraccountinorderto protect our statutory and common law lien rights and may apply the funds in your accounttotheamountyouoweusatalatertime.Thestatutoryandcommonlawlienand pledge do not apply to IRA accounts or any other account that is prohibited by applicable law from the right of setoff. By not enforcing our rights to apply funds in your account to your obligations, liabilities or debts owed to us that are in default, we donotwaiveourrightstoenforcetheserightsatalatertime.

21. FULL PAYMENT CHECKS.Ifyouarerepayingormakingapaymentonaloanor other obligation that you owe us, please direct such payment according to the documentsevidencingyourloanortothepersonattheCreditUnionwhocontactedyou about the obligation. You agree that if you attempt to write or negotiate with a “full payment” legend (such as “paid in full” or “without recourse”) or other language intended to repay in full any of your outstanding obligations to us, that such legend aloneshallnotbeeffectivetoconstituterepaymentoftheobligationinfullandwemayacceptsuchcheckwithoutconsentingtotherepaymentoftheobligationinfull.

22. GARNISHMENTS, ATTACHMENTS AND LEVIES. If your account is attached, garnished,orotherwisesubjecttolevyorseizure,inwholeorinpart,bylegalaction,we shall not be liable to you for any sums we may be required to pay from your accountbecauseofsuchattachment,garnishment,levyorseizure,evenifpayingthemoneyfromyouraccountleavesinsufficientfundstopayacheckyouhavewritten.You hereby authorize us to comply with any legal process. We may accept and act onanylegalprocessthatwebelievetobevalidwithoutanyliabilitytoyou,whetherservedinperson,bymailorbyfacsimiletransmissionatanyofouroffices.“Legalprocess” includes a subpoena, restraining order, injunction, writ of attachment or execution,levy,garnishment,taxwithholdingorder,searchwarrant,forfeitureorothersimilarcourtoradministrativelaworderrelatingtoyouraccount.Wherepermittedbyapplicable law, we may charge your account a legal process fee for each order, which is set forth in the Disclosures. Where permitted by applicable law, any garnishment, attachmentorotherlevyagainstyouraccountissubjecttoourrightofsetoffandanysecurityinterestwehaveintheaccount.Youagreetoreimburseusforanyexpenseswe incur in connection with any legal process related to your account. Such expenses include,withoutlimitation,research,copyingofdocuments,filingfees,administrativeandlegalcosts,andtotheextentnotprohibitedbylaw,outsidecounselandin-housecounsel attorneys’ fees. Any such expenses become immediately due and payable whenincurredandmaybechargedtoorsetoffagainstyouraccounts,asprovidedforinthesectiontitledSecurityInterest/RightofSetoff.Ourrightofsetoffforthestandardfeesforprocessinglegaldocumentsaccruesatthetimeweareservedwithsuchprocess.

23. ENFORCEMENT.Intheeventweincuranyloss,relatedexpenses,fees,attor-neys’fees,charges,and/orliabilityonanaccountorasaresultofanytransaction,dispute, uncertainty, or membership matter concerning you, any owner on the account,yoursigner,oryouragent,youagreethatyouarejointlyandindividuallyliable to us for the full repayment of that loss, related expenses, fees, attorneys’ fees, charges, and liability. You agree that we may deduct any loss, related expenses, fees,attorneys’fees,charges,and/orliabilityfromyouraccountwithoutnoticetoyou. Additionally, you agree to pay any other reasonable charges, fees or expenses wemayincurinconjunctionwithprovidingyoumembership,anaccount,oranytransactionorrelatedservicesthatarenotcoveredbytheAgreement.Intheeventthat the Credit Union is required to initiate legal action to enforce or interpret any of the terms, responsibilities, or liabilities of the Agreement, you agree that the Credit Union, if successful, is entitled to payment by you of its reasonable attorneys’ fees and costs,includingthoseincurredonanyappeal,bankruptcyproceeding,and/orpostjudgment action unless otherwise limited or prohibited by applicable law. You (and you successors and assigns, including, but not limited to your estate) agree to hold us harmless from and agree to indemnify and defend us against any claim or legal action arisingfromtheexerciseofourrighttorecoverforanyloss,relatedexpenses,fees,attorneys’fees,charges,andliabilityweincurasaresultofprovidingyoumember-ship,anaccount,oranytransactionorrelatedservicesthatarenotcoveredbytheAgreement.

24. INACTIVE AND DORMANT ACCOUNTS.IfyouhavenotmadeanytransactionsoveraperiodspecifiedintheDisclosures,wemayclassifyyouraccountasinactive

ordormant.Unlessprohibitedbyapplicablelaw,wemaychargeaservicefee,assetforthintheDisclosures,forprocessingyourinactiveaccount.Ifweimposeafee,wewillnotifyyouasrequiredbyapplicablelaw,atyourlastknownmailingaddressorbyemail, at your last email address of record. You authorize us to transfer funds from any otheraccountofyourstocoveranyservicefees,ifapplicable.Totheextentallowedbyapplicablelaw,wereservetherighttotransfertheaccountfundstoanaccountpayable and to suspend further account statements. If a deposit or withdrawal has not beenmadeontheaccountandwehavenoothersufficientcontactwithyouwithintheperiodspecifiedbyPennsylvaniaorotherapplicablestatelaw,theaccountwillbe presumed to be abandoned. Funds in abandoned accounts will be reported and remittedtotheappropriateCommonwealthorstateagencybasedonthelastknownaddress of the Member in accordance with applicable law. We may charge a fee, as disclosed in the Disclosures, for processing accounts that are subject to unclaimed property.OncefundshavebeenturnedovertotheCommonwealthofPennsylvaniaorapplicablestate,wehavenofurtherliabilitytoyouforsuchfunds,andifyouchoosetoreclaim such funds, you must apply to the appropriate agency.

25. TERMINATION. a. Termination of your Account/Suspension of Services – We may terminate youraccountorsuspendservicesatanytimewithoutnoticetoyouormayrequireyouto close your account and open a new account if (1) there is a change in owners or authorizedsigners;(2)therehasbeenaforgeryorfraudreportedorcommittedinvolv-ingyouraccount;(3)thereisadisputeastotheownershipoftheaccountorofthefundsintheaccount;(4)anychecksarelostorstolen;(5)thereareexcessivereturnunpaidchecks,drafts,itemsortransactions;(6)therehasbeenanymisrepresentationoranyotherabuseofyouraccount;(7)wereasonablydeemitnecessarytopreventalosstous;(8)youhaveengagedinobjectionableconducttowardus,ouremployees,ourmembers,orourvendors,as“objectionable”isdeterminedinoursolediscretion;(9)suspiciousactivityhasoccurredinconnectionwithyouraccount;(10)youhavenotgivenustheinformationwedeemnecessarytoverifyyouridentity;(11)youviolatelaws,rules,regulationsorCreditUnionpolicies,contractsoragreements;(12)youaredelinquentorindefaultofobligationstotheCreditUnion;or(13)anyownerdies.YoumayterminateanindividualaccountbyprovidingNoticetotheCreditUnion;wereservetherighttorequiresuchnoticebeprovidedinwritingorin-personatoursolediscretion.Wereservetheright,butarenotobligated,torequiretheconsentofallownerstoterminateajointaccount.Wearenotresponsibleforpaymentofanycheck,draft,withdrawal,transactionorotheritemafteryouraccountisterminated;however,ifwepayacheck,draft,withdrawal,transactionorotheritemaftertermination,youagree to reimburse us.

b. Termination of your membership – You may terminate your membership byprovidingNoticetotheCreditUnion,orbywithdrawingyourminimumrequiredmembership shares and closing all your accounts. We may unilaterally terminate your membership(andallaccountsandservices)forcausingalosstotheCreditUnion,byviolatingthisAgreement,foranyofthereasonslistedinSubsection(a)ofthisSection,or for any reason as permitted by applicable law.

26. APPLICABLE LAW. Your account, this Agreement and the interpretation of this AgreementaregovernedbyandconstruedpursuanttoourBylaws,applicableFederallaw,regulations,andOperatingCirculars,andthelawsoftheCommonwealthofPenn-sylvania,withoutregardtoPennsylvania’sconflictsoflawprovisions,unlessotherwiseexplicitlyprovidedforherein.

27. DISPUTE RESOLUTION-MANDATORY ARBITRATION. READ THIS PROVISION CAREFULLY AS IT WILL HAVE A SUBSTANTIAL IMPACT ON HOW LEGAL CLAIMS YOU AND WE HAVE AGAINST EACH OTHER WILL BE RESOLVED. Except as expressly provided herein, any controversy, dispute or claim (“Claim”) arising out of or relating to this Agreement, your account, and/or the relationships of the parties hereto shall be resolved or otherwise settled by binding arbitration administered by the American Arbitration Association (“AAA”), under the AAA Consumer Rules in effect at the time the Claim is filed. Such arbitration shall take place in Cumberland County, Pennsylvania. Thearbitrator’sdecisionshallbefinal,bindingandnon-appealable.Anyjudgmentupontheawardmaybeenteredandenforcedinanycourthavingjurisdiction.Thisclauseismadepursuanttoatransactioninvolvinginterstatecommerceandshallbe

governedbytheFederalArbitrationAct.Thearbitratorshalldeterminetheprevailingparty, and the costs and expenses of the arbitration proceeding, including the arbi-trator’sfees,shallbebornebythenon-prevailingparty,unlessotherwiserequiredbylaw.ThismandatoryarbitrationprovisionshallsurvivetheclosingofyourAccountandtheterminationofthisAgreement.NoprovisionofthisAgreement,northeexerciseofanyrightunderthisAgreement,shallwaivethearbitrationrequirement. Notwithstanding anything contained herein to the contrary, the arbitration shall notlimittherightofeitherpartyto(1)obtainprovisionalorancillaryremedies,suchasinjunctiverelief,writofattachment,orprotectiveorderfromacourthavingjurisdictionbefore,duringorafterthependencyofanyarbitration;(2)exercisepermissibleself-helpremedies,suchassetoff;(3)evict,forecloseagainstorsellanyrealorpersonalproperty collateral by the exercise of a power of sale under a mortgage or other secu-rityagreementorinstrument,adeedoftrustorapplicablelaw;or(4)toproceedwithcollection of amounts owed by you to us in connection with this Agreement through all other legal methods, including, but not limited to, proceeding to court to obtain judgment.Additionally,notwithstandingtheforegoing,thisSection27isnotintendedto apply to Claims arising in connection with our extensions of consumer credit to “coveredborrowers”assuchtermisdefinedintheMilitaryLendingAct. TotheextentacourthasjurisdictionasexplicitlyagreedtointhisSection,thecourtwithexclusivejurisdictionshallbetheCourtofCommonPleaslocatedinCum-berlandCounty,PennsylvaniaortheUnitedStatesDistrictCourtfortheMiddleDistrictofPennsylvania.THE PARTIES UNDERSTAND THAT THEY WOULD HAVE HAD THE RIGHT TO LITIGATE THROUGH A COURT AND TO HAVE A JUDGE OR JURY DECIDE THEIR CASE. HOWEVER, THEY UNDERSTAND AND CHOOSE TO HAVE ANY CLAIMS DECIDED THROUGH AN ARBITRATION. IF THE PARTIES PURSUANT TO AN EXCEPTION EXPRESSLY PROVIDED HEREIN PROCEEDS TO LITIGATION, THE PARTIES EXPRESSLY AGREE TO WAIVE THE RIGHT TO TRIAL BY JURY.

28. CLASS ACTION WAIVER. Any Claim against the Credit Union must be brought intherespectiveparty’sindividualcapacityandnotasaplaintifforclassmemberinanypurportedclass,collective,representative,multipleplaintiffsorsimilarproceeding(“ClassAction”).ThepartiesexpresslywaiveanyabilitytomaintainaClassActioninanyforum.ThearbitratorshallnothaveauthoritytocombineoraggregatesimilarclaimsorconductanyClassAction,normakeanawardtoanypersonorentitynotapartytothearbitration.AnyclaimthatallorpartofthisClassActionWaiverisunenforceable,unconscionable,void,orvoidablemaybedeterminedonlybyacourtofcompetentjurisdictionandnotbyanarbitrator.ThepartiesagreethatthecourtwithexclusivejurisdictionshallbetheCourtofCommonPleaslocatedinCumberlandCounty,PennsylvaniaortheUnitedStatesDistrictCourtfortheMiddleDistrictofPennsylvania.THE PARTIES UNDERSTAND THAT THEY WOULD HAVE HAD THE RIGHT TO BE A PARTY TO A CLASS OR REPRESENTATIVE ACTION. HOWEVER, THEY UNDERSTAND AND CHOOSE TO HAVE ANY CLAIMS DECIDED INDIVIDU-ALLY THROUGH AN ARBITRATION.

29. DEATH OR INCOMPETENCE OF ACCOUNT OWNER. We may continue to honor allchecks,items,drafts,transferorders,withdrawals,deposits,andothertransactionsonanaccountuntilweknowofamember’sdeathorincompetence.Onceweknowofamember’sdeathorincompetence,wemaypaychecks,items,drafts,transferorders, withdrawals, and other transactions authorized by that member for a period of ten(10)daysafterthatdateunlesswereceiveinstructionsfromanypersonclaiminganinterestintheaccounttostoppaymentonthechecks,items,drafts,transferorders, withdrawals, and other transactions. We may require anyone claiming a de-ceased or incompetent owner’s account funds to indemnify us for any losses resulting fromourhonoringthatclaim.ThisAgreementwillbebindingupontheheirsorotherlegalrepresentativesofanyaccountowner.Upondeathofamemberorjointowner,wemayprovidetheCommonwealthofPennsylvaniatheaccountbalancesorotherinformation as required by law.

30. GENERAL. a. No Waiver – If we allow or honor a nonconforming transaction, we are not required to allow or honor future nonconforming transactions. You agree that we may waive,inoursolediscretion,anyfee,charge,termorconditionsetforthinthisAgree-mentatthetimetheaccountisopenedorsubsequentthereto,onaone-timebasisor for any period or duration, without changing the terms of the Agreement or your obligationtobeboundbytheAgreement,andwearenotobligatedtoprovidesimilar

waiversinthefutureorwaiveourrightstoenforcethetermsofthisAgreement.

b. No Legal Advice–NeithertheCreditUnionnoranyofitsaffiliatesgivetaxorlegaladvice.Ifyouhavetaxorlegalquestions,consultwithyourtaxorlegaladvisorforinformationspecifictoyoursituation.

c. Compliance with Laws and Unlawful Internet Gambling – You agree to comply with all local, state, and federal laws, rules and regulations, as amended fromtimetotime,includingwithoutlimitto,theBankSecrecyAct,theUSAPATRIOTACT,thefederalanti-money-launderingstatutes,andanylawsorregulationsthatareenforcedoradministeredbytheU.S.TreasuryDepartment’sOfficeofForeignAssetsControl(OFAC).AlldepositsandcreditstoyourAccount,including,withoutlimitation,wiretransfersandotherelectronicpayments,aresubjecttoreviewforcompliancewithapplicablelaw,including,withoutlimitation,regulationsenforcedbyOFAC.AnyfinancialserviceprovidedbytheCreditUnionmaybeusedforanytransactionpermittedbylaw.Youagreethatyouwillnotuseyouraccount(s)oranyotherfinancialservice,including,butnotlimitedto,yourdebitcard,foranyillegaltransactionsoractivity.Youwarrantandrepresentthatalltransactionsinitiatedorconductedbyyouarelegalandnotinviolationofanylaw.Youagreeandacknowledgethatillegaluseofanyaccountorfinancialservicewillbedeemedanactionofdefaultand/orbreachofcontractandsuchserviceand/orrelatedservicesmaybeterminatedattheCreditUnion’s discretion. You further agree, should you engage in any illegal use of any account(s)orfinancialservice,towaivetherighttosuetheCreditUnioninconnectionwithsuchillegalactivityoractivitydirectlyorindirectlyrelatedtoit.Youalsoagreetoindemnify and hold the Credit Union harmless from any suits or other legal action or liability, directly or indirectly resulting from such illegal use. Specifically,butwithoutlimitingtheforegoing,youherebyacknowledgeandagreethatyouwillnotuseyourdebitcardtopurchasegoodsorservicesontheInternetthatinvolvegamblingofanysort.Suchtransactionsinclude,butarenotlimitedto,onlinegamblingtransactions,includingthepurchaseofcasinochips,oroff-trackbettingandwagering.Youagreethatyouarenotengagedinunlawfulinternetgambling.Youagreethatyouwillnotuseyouraccount(s)oranyservicesprovidedbyus for unlawful internet gambling. Notwithstandingtheforegoing,youacknowledgethatintheeventthatachargeortransactiondescribedinthisSectionisapprovedandprocessed,youwillstillbeliable for the charge.

d. Relationship between the Parties–Youacknowledgeandagreethattherelationship between you and the Credit Union created in this Agreement is of a debtor andcreditorandthattheCreditUnionisnotinanywayactingasafiduciaryforyouoryourbenefit,youraccountisageneralaccount,andthatnospecialrelationshipexistsbetween you and the Credit Union.

e. Severability –IfacourtfindsanyprovisionoftheAgreementtobeinvalidorunenforceable,suchfindingwillnotmaketherestoftheAgreementinvalidorunenforceable.Iffeasible,anysuchoffendingprovisionwillbedeemedtobemodifiedtobewithinthelimitsofenforceabilityorvalidity;however,iftheprovisioncannotbesomodified,itwillbestrickenandallotherprovisionsoftheAgreementinallotherrespectswillremainvalidandenforceable.

f. Force Majeure – We shall not be liable for any loss or damage to you caused byourfailuretoprovideanyserviceordelayinprovidingsuchserviceresultingfromanactofGod,actofgovernmentalauthority,legalconstraint,war,terrorism,fire,ca-tastrophe, or electrical, computer, mechanical or telecommunications failure, or failure of any agent or correspondent or any other cause beyond our control.
