UponreceiptofthisfollowupinformationtheUKMDAauditorwilldetermineifcompliancehasbeenmet,orthatare-auditofthatnon-conformanceisrequired.

IfaCAT1nonconformancenoticeisraisedthecompanywillbegiven30daystoprovidewrittenconformationthatthecompanyhasnowcorrectedthemajornonconformanceandachievedtheUKMDAMinimumStandard.

Amemberoftheappealscommitteemaynotpresideoverareviewofhisowncompany.InthiscaseanotherBoardMemberwilltakehisplace.

IntheeventthatthememberhasnotsatisfactorilysignedofftheCAT1non-conformancenotice,thecompanymayhaveitsUKMDAMembershipsuspended.Thediscussiontosuspendthemembercanonlybemadebytheagreementof2membersoftheUKMDABoard(oneofwhichmustbetheChairman)andtheauditor.

AnappeallaunchedtoargueaCAT1noticeshallbeheardfreeofchargewhilstanappealbroughtbyamembercompanytoappealagainstaCAT2noticeoraspecificgradingincategoriesshallcommandachargeof£500plusVATtocovertheadditionalexpenseincurredbyUKMDA.

PriortoanymemberhavingtheirUKMDAMembershipsuspendedandthesuspensionloggedontheUKMDAwebsite,themembercompanycanapplyinwritingandappealwithin14daysofreceiptofasuspensionletterissuedbyUKMDA.Receiptwillbedeemedtohaveoccurredtwoworkingdaysfollowingposting.

TheUKMDABoardwillarrangewithin21days(uponreceiptoftheappeal)ameetingatthemember'spremises.Themeetingisforthememberto"statetheircompany'scase".Theappealcommitteewillconsistofthe3members,thesebeing:-

Wheretheauditoridentifiesanareaofnoncompliancetheywillraiseanonconformancenoticedependingontheseverity,i.e.CAT1orCAT2.

Ifintheopinionoftheauditor,theCAT1noticehasnotbeenclosedout,theauditorwillinformtheUKMDABoardwhowillwritetothecompany/memberandinformthemoftheactiontheUKMDABoardwilltake.Thismayincludethecompanybeingre-auditedwithina90dayperiodoranexistingmembersUKMDAmembershipbeingsuspendedandloggedontheUKMDAMemberswebsitepageaccordingly.

Uponreceivinganobservationnotice,thecompanyormembermaydecidenottoimplementtherecommendationandthiswillnotbeseenasafailurebythecompany,unlessinfutureauditstheUKMDABoardmaketheproposedstandardaUKMDAMinimumStandard.

Forthis,theauditorisencouragedtoraiseaCAT3observationnoticeduringeachaudit.Thereforeanobservationnoticeisnotanon-conformancenoticeanddoesnotrequirefeedbacktotheUKMDABoard.

Duringtheaudit,theauditorwillbeencouragedtorecommendwaysinwhichthecompanyormembercanimprovetheirperformance.
