SECTION 6. AMENDMENT. Subsection 4 of section 5 7 -35 . 2-01 of the North Dakota Century Code ' s amended and reenacted as follows:

4. "Trust company" means any tri..st company organized under the laws of this state, any other state, ~the United States, iii t~ a ~laee sf a foreign co~ntry, or a dependency or i nsular possession of the United States, and doing business in this state.

SECTION 7. A new section to chapter 57-35.2 of the North Dakota Century Code is created and enacted as fo 11 o•t1s:

Imoosition of tax on interstate trust companies. ~ provisions of this chapter do not fairly represent the extent of the trust company's bus i ness activity i n this state, the tax conmissioner may require, with respect to all or any part of the trust company's business activity, if reasonable, the emp loyment of another method to effectuate an equ i tab l e allocation and apportionment of : he trust company ' s income.
