That Daniel Howe is a(n) POLICE OFFICER with the BELLEVUE POLICEDEPARTMENT and has reviewed the investigation conducted in BELLEVUE POLICE DEPARTMENT Case Number: 12-4841

There is probable cause to believe that, MICHAEL F. JACOBS committed the crime(s) of

ASSAULT FOURTH DEGREE - DV, RCW 9A.36.041 MALICIOUS MISCHIEF THIRD DEGREE - DV, RCW 9A.48.090 OBSTRUCTING LAW ENFORCEMENT OFFICER, RCW 9A.76.020

This belief is predicated on the following facts and circumstances:

The following occurred in the City o f Bellevue, County of King, State of Washington.

On 03/04/12 at approximately 23:45, I was dispatched to investigate a domestic disturbance at 1625 168th Ave NE in Bellevue.

I arrived and met with the complainant, Carol L. Jacobs. Ms. Jacobs stated that her husband Michael F. Jacobs had been at home when she arrived, and the two became involved in an argument about her not answering his phone calls. She said that her husband had been drinking and had locked her out of the house, standing in front of the doorway and refusing to allow her and their two daughters to come inside. Ms. Jacobs said that during the argument, her husband shoved her backwards with two hands, causing her to fall backwards onto the porch/garden area of their front house. Ms. Jacobs advised that her fall did hurt, but she was not injured.

Ms. Jacobs also advised that her husband had thrown her cell phone down on the street pavement in front of their house, breaking it. I observed that the back battery/cover plate of a cell phone was lying in the street in front of the home, and appeared to have been broken.

While talking with Ms. Jacobs, her husband Michael came outside and stood in the front porch area. When I approached him and asked to speak with him, he turned away and attempted to flee inside his house. I ordered him to remain outside, but he attempted to enter the doorway. Ofc. Finney ordered Michael not to enter or to shut his door, but Michael entered and attempted to shut his door as I approached. Ofc. Finney and I entered and placed Michael under arrest for assault. I secured Michael in the back of my patrol car and notified him of his Miranda rights per my department-issued card.

a maximum possible penalty o f 10 years in prison and a $250,000 fine. An exception exists for law enforcement officers and military personnel when carrying department/government-issued firearms. 18 U.S.C. § 925(a)(1). I f the violation o f the protection order involves travel across a state line or the boundary o f a tribal jurisdiction, or involves conduct w ithin the special maritime and territorial jurisdiction of the United States, which includes tribal lands, the defendant m ay b e subject to crim inal prosecution in federal court under 18 U.S.C. § 2261, 2261 A, or 2262.

In addition to the state and federal prohibitions against possessing a firearm upon conviction o f a felony or a qualifying misdemeanor, upon the court issuing a no-contact order after a hearing at which the defendant had an opportunity to participate, the defendant, if a spouse or form er spouse, a parent o f a common child, or a current or form er cohabitant as intimate partner o f a person protected by this order, may not possess a firearm or am munition for as long as the no-contact order is in effect. 18 U.S.C. § 922(g). A. Jorgensen, and the Defendant, Michael F. Jacobs, by and through his/her

That the Defendant has been charged with Domestic Violence Assault 4th

Degree and Domestic Violence Malicious Mischief . The elements of the offense(s)

which must be proven are noted in the attached complaints. The maximum

penaity(ies) for each count are: 364 days in jail and a $5000 fine with a mandatory

minimum penalty of loss of the right to possess a firearm.

That the above-captioned matter should be continued for a period of eighteen

That for the purposes of this Stipulated Order of Continuance, the Defendant

waives the right to be tried within ninety days of arraignment and agrees to waive his

or her right to a speedy trial for the duration of this agreement. By his or her

signature below the Defendant affirms that he/she has read or has had read to

him/her both the attached Statement of Rights and Stipulation and knowingly,

intelligently and voluntarily accepts the terms of the stipulation.

That if the Defendant completes all of the conditions set forth above the City

As the Defendant charged in this court with a violation of law, I freely,

knowingly and voluntarily stipulate (agree) to the following:

1. l have been advised of my constitutional rights by the court and/or my

attorney and I am knowingly, intelligently and voluntarily entering into this stipulation,

understanding all of the constitutional rights that I will be waiving or giving up.

2. I have not been threatened or coerced into entering this stipulation. No

one has made any promises of any kind to me except those contained in this

6. In the event this stipulated order of continuance is revoked for any

reason, I will have only a stipulated facts trial, before a judge, based solely on the

police reports and evidence referenced therein, and any other related documents

submitted to the court at the time the SOC is approved or revoked unless otherwise

agreed to in writing and incorporated into this agreement at the time of signing. The

police reports and other documents may be marked as exhibits but will not be

admitted into evidence unless the case proceeds to trial.

7. I also agree that such stipulated facts trial will consist of the court

reading the police report in police incident number 12-4841, cause number

BC169363 which along with any related attachments will be admitted as evidence

and placed in the court file. I further stipulate to the accuracy and admissibility of

that police report for purposes of this agreement.

8. I further acknowledge that I will not be permitted to present any other

evidence and that I am waiving my right to confront and question witnesses, my right

to call witnesses on my behalf, and my right to testify or not to testify.

9. 1 understand that this agreement is not an admission of guilt. In the event

that a stipulated facts trial occurs, the court will make the determination if the

stipulated evidence establishes all elements of the crime beyond a reasonable doubt

sufficient to make a finding of guilt.
