requiredtopublishnoticeoftheirrulemakingactionintheStateRegister.PublishedeveryMonday,theStateRegistermakesiteasytofollowandparticipateintheimportantrulemakingprocess.Approximately80stateagencieshavetheauthoritytoissuerules.EachagencyisassignedspecificMinnesotaRulechapternumbers.Everyodd-numberedyeartheMinnesotaRulesarepublished.Supplementsarepublishedtoupdatethissetofrules.Generallyspeaking,proposedandadoptedexemptrulesdonotappearinthissetbecauseoftheirshort-termnature,butarepublishedintheStateRegister.
AnagencymustfirstsolicitCommentsonPlannedRulesorCommentsonPlannedRuleAmendmentsfromthepubliconthesubjectmatterofapossiblerulemakingproposalunderactiveconsiderationwithintheagency(MinnesotaStatutes§§14.101).ItdoesthisbypublishinganoticeintheStateRegisteratleast60daysbeforepublicationofanoticetoadoptoranoticeofhearing,orwithin60daysoftheeffectivedateofanynewstatutorygrantofrequiredrulemaking.
Whenrulesarefirstdrafted,stateagenciespublishthemasProposedRules,alongwithanoticeofhearing,oranoticeofintenttoadoptruleswithoutahearinginthecaseofnoncontroversialrules.Thisnoticeasksforcommentontherulesasproposed.Proposedemergencyrules,andwithdrawnproposedrules,arealsopublishedintheStateRegister.Afterproposedruleshavegonethroughthecommentperiod,andhavebeenrewrittenintotheirfinalform,theyagainappearintheStateRegisterasAdoptedRules.Thesefinaladoptedrulesarenotprintedintheirentirety,butonlythechangesmadesincetheirpublicationasProposedRules.Toseethefullrule,asadoptedandineffect,apersonsimplyneedstwoissuesoftheStateRegister,theissuetheruleappearedinasproposed,andlaterasadopted.

If,duringthe30-daycommentperiod,25ormorepersonssubmittotheagencyawrittenrequestforahearingoftheproposedrules,theagencymustproceedundertheprovisionsof§§14.1414.20,whichstatethatifanagencydecidestoholdapublichearing,itmustpublishanoticeofintentintheState Register.

Overview.ThisnoticeistheMinnesotaPollutionControlAgency’s(MPCA’s)legalnoticeofitsintenttoadoptamendedairrulesafterahearing.Thepurposeoftheseruleamendments,knownasCleanCarsMinnesota,istoreducegreenhousegas(GHG)andotherairpollutantemissionsfromlight-dutyandmedium-dutyvehiclesbyadoptingtheLow-EmissionVehicles(LEV)andZero-EmissionVehicles(ZEV)standardsadoptedbytheCaliforniaAirResourcesBoard,asallowedundersection177oftheCleanAirAct(CAA).ThisnoticeprovidesyoutheopportunitytosubmitcommentsonthisruletotheAdministrativeLawJudge(ALJ),eitherorallyatthehearingorinwritingatanytimebeforethecloseofthehearingrecord.TheSubject of Rulessectionprovidesfurtherdescriptionoftheseproposedrules.Iftheproposedrulechangesaffectyouinanyway,theMPCAencouragesyoutoparticipateintherulemakingprocess.

Proposed Rulesandotherairpollutantsfromlight-dutyandmedium-dutyvehicles.TheLEVstandardwouldrequireautomobilemanufacturerstodeliverforsaleinMinnesotaonlyvehiclesthatmeetthemorestringentGHGandotherairpollutantemissionsstandardsestablishedbyCaliforniaandlateradoptedbyseveralotherstates,asallowedundertheCAA.TheZEVstandardwouldrequireautomobilemanufacturerstodeliverforsaleinMinnesotaeachyearacertainpercentageofvehicleswithzerotailpipeemissions,includingbatteryelectricvehicles,plug-inhybridelectricvehicles,andhydrogen-fueledvehicles.
Minnesota Statutes, section116.07,subdivision4authorizestheMPCAtoadoptrulesfortheprevention,abatement,andcontrolofairpollution.Minnesotastatutes,section116.07,subdivision2authorizestheMPCAtoadopt“maximumallowablestandardsofemissionofaircontaminantsfrommotorvehicles.”

TheCOVID-19pandemiccontinuestopresentanunprecedentedandrapidlyevolvingchallengetoourState.TheWorldHealthOrganizationcharacterizedtheCOVID-19outbreakasapandemiconMarch11,2020.ThePresidentdeclaredanationalemergencyrelatedtoCOVID-19onMarch13,2020.Sincethen,andforthefirsttimeinhistory,thePresidenthasapprovedmajordisasterdeclarationsforallfiftystatesandtheDistrictofColumbia.Alongwiththesefederalactionsandtheactionsofstatesacrossthenation,MinnesotahastakenextraordinarystepstopreventandrespondtotheCOVID-19pandemic.
OnMarch13,2020,IissuedExecutiveOrder20-01anddeclaredapeacetimeemergencyunderMinnesotaStatutes2020,section12.31,subdivision2.OnMarch16,2020,theExecutiveCouncilapprovedanextensionofthepeacetimeemergency.AfternotifyingtheLegislature,onApril13,2020,May13,2020,June12,2020,July13,2020,August12,2020,September11,2020,October12,2020,andNovember12,2020,IissuedadditionalExecutiveOrdersextendingthepeacetimeemergency.InthisExecutiveOrder,thepeacetimeemergencydeclaredinExecutiveOrder20-01andextendedinExecutiveOrders20-35,20-53,20-75,20-78,20-83,20-89,20-92,and20-97isreferredtoasthe“COVID-19PeacetimeEmergency.”
AsaresultoftheCOVID-19pandemic,all50stateshavedeclaredstatesofemergency,and49ofthemareinplacetoday.ThisisbecauseCOVID-19casesanddeathscontinuetoproliferate.AccordingtotheUnitedStatesCentersforDiseaseControlandPrevention(“CDC”),morethan16millionpeoplehavebeeninfectedintheUnitedStates,resultinginover298,000deaths.TheUnitedStatesreportedover3,300deathsonFriday,thehighestdailydeathtollsincethepandemicbegan.OnSaturday,COVID-19hospitalizationsacrossthecountryhitarecordhighfortheseventhdayinarow.Asithaswiththerestofthenation,theCOVID-19pandemiccontinuestotakeitstollonMinnesota.Thissurgehasplacedourhospitalsunderimmensestrain.Hospitalizationsremainhigh,andIntensiveCareUnitsareonthevergeofdangerouscapacityshortagesinmanyareasofthestate.Minnesotahashadover381,000confirmedCOVID-19cases,over19,000hospitalizations,andrecentlysurpassed4,400fatalities.
TheWhiteHousewrotebluntlyonDecember8,2020:“Despitetheseverityofthissurgeandthethreattothehospitalsystems,manystateandlocalgovernmentsarenotimplementingthesamemitigationpoliciesthatstemmedthetideofthesummersurge;thatmusthappennow.”IhavenotedinpreviousExecutiveOrdersthattheCOVID-19PeacetimeEmergencyopensourtoolboxtoallowustotakeswiftactiontoprotectthehealthandwell-beingofourfamilies,communities,andbusinesses.DuringtheCOVID-19PeacetimeEmergency,IhaveexercisedexecutiveauthoritythroughnumerousexecutiveorderstoprovidereliefandfurtherprepareourStatefortheCOVID-19pandemic.Suchactionshaveincludedtheclosureofschoolsandimplementationofadistancelearningperiod;enhancedprotectionsforveteransinourveteranshomes;activationoftheNationalGuardtoassistinreliefefforts;measurestopreservepersonalprotectiveequipment;temporaryclosureofbars,restaurants,andotherplacesofpublicaccommodation;effortstoprovideeconomicreliefandstabilitytothoseimpactedbythepandemic;regulatorychangesallowingourstateagencies,healthcareproviders,andlicensingboardstoensurefastrelieftoMinnesotans;andorders

Executive OrdersrequiringMinnesotanstostayathomeandtowearfacecoveringsincertainsettings.Ourcollectiveactionshavesavedlives,butthethreatremains,andourworkmustcontinue.RecognizingthegravityoftherecentsurgeinMinnesota,wehaverecently“dialedback”andtightenedrestrictionsofsocialgatheringsandtheactivitiesandvenuesthatweknowpresentelevatedtransmission.
Recently,thankstoMinnesotan’scompliancewithpreviousexecutiveorders,casecountshavebeguntoplateau.Tomaintaincourse,wecontinuetoneedstatewidecoordinationandresourcestofightthepandemic.Andemergencypowersareessentialinourpreparationsforquick,equitable,andsafedistributionofthevaccinebyenablingtimelyacquisitionofsuppliesandtechnology.TheStateEmergencyOperationsCenterprovidesongoingsupporttolocalgovernments,and—astheappropriationofsignificantpublicfundstofightthepandemicplainlyshows—localresourcescontinuetobeinadequatetoaddressthethreat.
InMinnesotaStatutes2020,section12.31,subdivision2(a),theMinnesotaLegislatureauthorizedtheGovernortodeclareapeacetimeemergencywhenanactofnatureendangerslifeandpropertyandlocalgovernmentresourcesareinadequatetohandlethesituation.WiththeapprovaloftheExecutiveCouncil,apeacetimeemergencymaycontinueforupto30days.MinnesotaStatutes2020,section12.31,subdivision2(b),providesthemechanismfortheGovernortoextendapeacetimeemergencybeyond30days.IftheGovernordeterminesaneedtoextendapeacetimeemergencydeclarationbeyond30days,andtheLegislatureisnotsittinginsession,theGovernormustissueacallimmediatelyconveningbothhousesoftheLegislature.
TheLegislatureadjourneditsregularsessiononMay17,2020.OnJune10,2020,July10,2020,August7,2020,September9,2020,October7,2020,andNovember9,2020,IissuedproclamationscallingtheLegislatureintospecialsessions.OnDecember9,2020,IagainissuedaproclamationcallingtheLegislatureintoaseventhspecialsessiontobegintoday,December14,2020.TheLegislaturemayterminateapeacetimeemergencyextendingbeyond30daysbyamajorityvoteofeachhouse.
Minnesotalawdoesnotclearlyimposeadditionalrequirementsforanextensionofapeacetimeemergencybeyondtheinitial30days.Giventheimportanceofthisdecision,Ipreviouslyconcludedthattheprudentcoursewastolimitsubsequentextensionsto30-dayincrementsandseektheExecutiveCouncil’sapprovalofsuchextensions.Icontinuethatcoursetoday.
Forthesereasons,Iorderasfollows:
1. IhavedeterminedthattheCOVID-19pandemic,anactofnature,continuestoendangerlifeandpropertyinMinnesota,andlocalresourcesareinadequatetoaddressthethreat.TheCOVID-19PeacetimeEmergencymustthereforecontinue.

Ensuringaccesstocounselingfromlicensedprofessionals,especiallyduringthechallengingtimesofapandemic,iscriticaltoMinnesotans’healthandwellbeing.Giventhepresentconstraintsonthesupervisionandlicensingprocess,toensurethatourhealth-relatedprofessionalscanfullysupportMinnesotansduringtheCOVID-19pandemic,BBHTmusthavetheauthoritytoappropriatelymodifysupervisionandlicensingrequirementsduringtheCOVID-19peacetimeemergency.

Executive OrdersExecutiveOrder20-05hashelpedensurethatUnemploymentInsurancebenefitsareimmediatelyavailableto
workerswhosejobswereaffectedbytheCOVID-19pandemic.TheUnemploymentInsurancesystemisabulwarkofouroverallpublichealthresponsetothepandemic,protectingindividualswhohavelostemploymentthroughnofaultoftheirown.WithoutfinancialassistancefromUnemploymentInsurance,manyMinnesotaworkerswouldnothavebeenabletosupporttheirfamilies,stayintheirhomes,orsustainthemselvesduringperiodswherebusinessclosuresorrestrictionswerenecessary.UnemploymentInsurancealsoallowsworkerstoavoidgraverisktotheirownhealthorthehealthoftheirfamilies,andithasalsosupportedparentswhosejobcouldnotaccommodatetheirneedtobeathomewithachildduringdistancelearning.Unemploymentbenefitshavenowhelpedmorethan790,000Minnesotansweatherthispublichealthcrisis.WithMinnesotafacingarecentsurgeininfections,manybusinesseshavehadtocloseorlimitoperationstoprotectthehealthoftheirworkersandpatrons.OurUnemploymentInsurancesystemisascriticalaseverinhelpingMinnesotansmaintaintheirhealthandsafetyduringthepandemic.
MinnesotaStatutes2020,section268.051,subdivision3(a),requirestheDepartmentofEmploymentandEconomicDevelopment(“DEED”)tocomputeanexperienceratingforeachtaxpayingemployerwhohasbeenrequiredtofilewagedetailreportsforthe12-monthperiodpriortoJune30ofthatyear.Undersection268.051,subdivision3(a),theexperienceratingperiodforcalendaryear2021includesJanuarythroughJuneof2020.DEEDmustcompleteitscalculationsandnotifyemployersoftheresultsonorbeforeDecember15ofeachyear.
Eveninanordinaryyear,calculatingindividualexperienceratingsisanadministrativelyburdensomeprocess.ItrequiresDEEDstafftodetermineindividualizedtaxratesforover130,000employersbasedonmillionsofrecords.Tomeetthestatutorydeadlinesinthisunprecedentedyear,DEEDwouldneedtoredirectcriticalstafffromprovidingfinancialrelieftoMinnesotanswhosehealth,safety,andeconomicsecurityareatriskduringthepandemic.Moreover,giventheexigenciescreatedbythepandemic,itisuncertainwhetheralltaxpayingemployershavesubmittedtheirfullpayrollrecordsforthefirstsixmonthsof2020.Additionally,giventheunprecedentedsurgeinunemploymentclaimssinceMarch,DEEDhasnotyetreviewedallbenefitspaidduring2020todetermineiftheyshouldbeusedinthecalculationofemployers’2021experienceratingsinaccordancewithapplicablelaw.Calculatingexperienceratingswithoutmakingtheseadjustmentsrisksunnecessarytaxincreasesforemployersin2021.Forallofthesereasons,amodestextensionofthedeadlinesrelatedtothecalculationanddisseminationofexperienceratingsisnecessary.
InMinnesotaStatutes2020,section12.02,theMinnesotaLegislaturerecognizedthe“existingandincreasingpossibilityoftheoccurrenceofnaturalandotherdisastersofmajorsizeanddestructiveness”andconferredupontheGovernoremergencypowersto“(1)ensurethatpreparationsofthisstatewillbeadequatetodealwithdisasters,(2)generallyprotectthepublicpeace,health,andsafety,and(3)preservethelivesandpropertyofthepeopleofthestate.”PursuanttoMinnesotaStatutes2020,section12.21,subdivision1,theGovernorhasgeneralauthoritytocontrolthestate’semergencymanagement,aswellastocarryouttheprovisionsoftheMinnesotaEmergencyManagementAct,MinnesotaStatutes2020,Chapter12.Pursuanttosubdivision3ofthatsamesection,theGovernormay“make,amend,andrescindthenecessaryordersandrulestocarryouttheprovisions”oftheMinnesotaEmergencyManagementAct.WhenapprovedbytheExecutiveCouncilandfiledintheOfficeoftheSecretaryofState,suchordersandruleshavetheforceandeffectoflawduringthepeacetimeemergency.Anyinconsistentrulesorordinancesofanyagencyorpoliticalsubdivisionaresuspendedduringthependencyoftheemergency.

TheCOVID-19pandemiccontinuestopresentanunprecedentedandrapidlyevolvingchallengetoourState.Minnesotahastakenextraordinarystepstopreventandrespondtothepandemic.OnMarch13,2020,IissuedExecutiveOrder20-01anddeclaredapeacetimeemergencybecausethispandemic,anactofnature,threatensthelivesofMinnesotans,andlocalresourcesareinadequatetoaddressthethreat.SincedeclaringthepeacetimeemergencyinMarch,Ihaveextendeditevery30days,withthemostrecentextensionoccurringonDecember14,2020.
Minnesotarecentlyjoinedanincreasingnumberofstatesindialingbacksocialgatherings,organizedsports,andactivitiesinarangeofplacesofpublicaccommodation.Accordingtoguidanceanddatafromfederalandstatepublichealthauthorities,includingtheWhiteHouseCoronavirusTaskForce,ourrecentsurgeofcasesleftuswithnootheroption.Threeweekslater,wearestartingtoseetheresultsofourefforts.Althoughdailycasescountsarestilldangerouslyhigh,newcasesreportedbytheMinnesotaDepartmentofHealth(“MDH”)havedecreasedinrecentdays.NinemonthsintooneofthemostchallengingeconomicandpublichealthmomentsinMinnesota’shistory,IamproudthatMinnesotanshaveagainshownthatwehavethestrengthtomakesacrificestocombatthisvirus.
Unfortunately,wearenotyetoutofthewoods.ThemostrecentdatafromMDHcontinuestoreflectalarminglevelsofcommunityspread.MinnesotaisalsostillwellwithintheWhiteHouseCoronavirusTaskForce’s“RedZone”thresholdsfortestpositivityrateandcasesper100,000residents.Andasthedevastatingconsequencesofrecentcasesurgescontinuetoemerge,wecannotaffordasetback.IndividualswhowerehospitalizedatrecordratesinlateNovemberareperishingatalarmingrates,andnewadmissionscontinuetostretchthecapacityofourhospitalsandICUs.The14-dayaverageforCOVID-19deathshasincreasedtoover60deathsperday.
Irecognizethatrestrictionsongatheringsandactivitiescreatetheirownpublichealthproblems.TheCentersforDiseaseControlandPrevention(“CDC”)haspublishedevidenceofincreasedmentalhealthdisorders,substanceusedisorders,andsuicidalthoughtsduringtheCOVID-19pandemic.Withtheprogresswehavemade,wecanaffordtotakesmall,measuredstepstoprovideMinnesotansneededoutletstoaddresstheseworrisomeimpacts.Thisincludessomeflexibilitytogatherinsmallgroupswithfamilyandfriendsinsafe,outdoorenvironments,includingattherestaurants,

Inaddition,recognizingthatthepauseonsocialgatheringshasbeenasignificantchallenge—particularlyforindividualswholivealone—IamaskingthatMinnesotanslimitindoorsocialgatheringstoamaximumof10peoplewithnomorethantwohouseholds.And,sinceoutdoorenvironmentsarerelativelylessrisky,Iamaskingthatoutdoorsocialgatheringsbelimitedtoamaximumof15peoplewithnomorethanthreehouseholds.Inallcases,wemustadheretotheincreasedprecautionsforsocialgatheringspostedtotheStaySafeMinnesotawebsite(https://staysafe.mn.gov).
Weknowthatphysicalactivitycanstrengthenimmunesystemsandprovidementalhealthbenefits.ResearchsuggeststhatphysicalactivitycanhelpaddressthestressandanxietyresultingfromtheCOVID-19pandemic.Forsome,Minnesotawinterscanbeadifficulttime.WehavesixfewerhoursofdaylightinDecemberandJanuarythanintheheightofsummer.Shorterdaysandwinterweathercanleadtolessexercise,particularlyoutdoors.Althoughoutdoorrecreationandexercisecontinuetobethesafestwaytostayactive,wealsoneedoptionstoexerciseindoors.Wearehopefulthatourgyms,fitnesscenters,exercisestudios,andothersimilarfacilitiescanprovidethoseoptionswithoutasignificantincreaseintransmission.Thescienceshowsusthatlargegroups,smallspaces,andsocialsportscreateserioustransmissionrisks,particularlywhenpeopleareexertingthemselveswithoutwearingfacecoverings.Inbalancingtheriskofinfectionwiththepositivebenefitsofexercise,exercisefacilitieswillneedtolimittheircapacity,increasesocialdistancingrequirements,requiretheirpatronstowearfacecoveringsatalltimes,andfollowtheguidanceavailableontheStaySafeMinnesotawebsite(https://staysafe.mn.gov).
Forsimilarreasons,IknowthatMinnesotansareeagertoreturntotheorganizedsportsactivitiesthathavebeenonpauseforthelastfourweeks.Theseactivitiesareriskierthanindividualexercise,astheytypicallyoccuringroups.ButorganizedsportsalsoprovidedevelopmentalopportunitiesforyouthandmentalandphysicalhealthbenefitsforMinnesotansofallages,soweshouldstarttobringbacktheseactivitiesifwecandososafely.Wecanlimitriskforparticipants,coaches,andfamiliesbyfirstreturningtopracticesinsmallergroupswithheightenedprecautions.Bystartingsmallandkeepingtransmissionlownow,wecanbegintoconsiderreturningtogamesandcompetitionsthatrequireinteractionsbetweendifferentteamsandthepresenceofspectators.Sportsactivities,whenallowed,willalsoneedtofollowguidanceontheStaySafeMinnesotawebsite(https://staysafe.mn.gov).
Evenasdecliningcaseratesandtheprospectofwidespreadvaccinationbringushope,weneedtomaintainsomedifficultmeasuresofthecurrentdialbackintoJanuary.Thismeansmorevirtualholidaycelebrationsandcontinuedeconomichardshipforsomebusinesses.Tohelpthosewhohavemadesacrificestokeeptheirneighborssafe,I’msigningintolawa$216millionreliefpackagethatwillprovidedirectsupportforbusinessesandworkersaffectedbythepandemic.Thisreliefpackageisastart,butmoreisneededfromourfederalpartners.ThatiswhyIcontinuetocallonCongresstopassarobustfederalaidpackagethatwillhelpourbusinessesandworkers.
