MINUTES The meeting was called to order with Roll Call by Mayor Tim Maniez. Roll Call: Lane Present Ritter Absent McDaniel Present Murdock Present Walker Present Mayor Maniez led the Pledge of Allegiance. Citizens signed the book on page 14. PRESENTATION: Property Beautification Award to Mark Snider at 33165 W. 84th Street. Mr. Snider was not present so this presentation will be moved to the next City Council meeting. Consent Agenda Items will be acted upon by one motion unless a Council member requests an item be removed for discussion and separate action.

1. Consent Agenda: a. Approve Minutes of the Council Meeting of December 15th, 2016. b. Approve Pay Ordinance No. 798. c. Approve Extension of 2016 Mowing Contract for the 2017 Mowing Season.

Motion by Councilman Walker to approve the Consent Agenda; second by Murdock. Roll Call: Lane Yes Ritter Absent McDaniel Yes Murdock Yes Walker Yes Motion carried. 2. Call to Public:

“Members of the public are welcome to use this time to comment about any matter relating to City business not listed on this Agenda. The comments that are discussed under Call to Public may or may not be acted upon by the Council during this meeting. There is a four-minute time limit. Please stand and wait to be recognized by the Mayor. You must state your name and address.”

Darrel Zimmerman, 34055 W. 86th Terrace, read a statement concerning the Governing Body’s proposed strategic planning committee meetings. Mr. Zimmerman commented on building of apartments in other cities in Johnson County. He read the lyrics from a song and asked Council members to consider what might be lost, as well as what can be gained.

3. Old Business: None 4. New Business: a. Consider 2017 Capital Improvement Projects. Administrator Brungardt said this is something Council does each year, and Staff has compiled a listing of recommendations for this year’s CIP program. He previously shared the list with the Council during the August budget process. In the 2017 CIF budget there is approximately $764,000 available for projects. Some projects were not done in 2016, thus the funding was carried over. He listed the total of five projects totaling $166,000. By subtracting the 2016 projects from the fund, an amount of $597,913 is available for 2017 projects. Administrator Brungardt commented on the

CDBG funding of $60,000 for the Phase II Fire Station Rehab. He provided Council with the CIP Master List dated January, 2017, with each project broken out by department. The list includes the scope, cost estimates and general project descriptions. He commented on the Vehicles, Equipment and Asset Management projects and stated the funding this year was budgeted for the front-end loader. Staff is working on a full Asset Management program and hopefully will have that completed by the end of this year. Administrator Brungardt further commented on the City’s Street Maintenance Program. He has introduced a new pavement process called UBAS. He said it is a step up from the slurry seal process and it has a good longevity. Staff has not updated the 2016 road conditions indexes for this year, and those will need to be reviewed for the road segments designated to be repaired. Administrator Brungardt commented on the 91st Street Rehabilitation project and said it has been a high priority for the Council, as well as staff. Mayor Maniez commented that the bridge on 83rd Street going over the railroad tracks isn’t on the list and it has been in the past. Discussion ensued. Mayor Maniez and Administrator Brungardt discussed the cost being close to a million dollars. Discussions ensued between Councilman Walker, Mayor Maniez and Administrator Brungardt in getting a feasibility study for this and look into funding possibilities. Administrator Brungardt requested Council review the proposed projects and the cost estimates on the option matrix. This matrix is suggestions and Council may have another project they wish to consider. He commented on the updating of the City’s Comprehensive Plan and review of the Future Land Use Plan. Councilman Walker said he thinks the 91st Street project is a ‘front door’ kind of project as people see it when they come into town. He feels it is time to do something on this project. The road maintenance program shouldn’t be abandoned, and some funding should be set aside for that. The Sunflower Road project is what the City has agreed to help the County with. Discussion ensued among Councilman McDaniel on how the County is going to get their equipment to the new park. They should help with either 95th Street or 87th Street as people from everywhere are going to be driving on our streets. Councilman McDaniel stated 91st Street needs to be done. Discussion ensued. Councilman Walker suggested pulling out enough funding for the Comp Plan update and he agreed 91st Street should be done. Councilman Walker said Staff will do their due diligence on 87th and 95th Streets and if the traffic increases due to the Rieke Park development, then the City can approach the County for road improvement funding. Discussion ensued that the design for 91st Street will be done in house. Councilman McDaniel commented on the Ottawa sidewalk project being done. Administrator Brungardt commented he will begin work on the 91st Street rehabilitation project, and look at recommendations for $150,000 for the yearly road maintenance program. Decisions on the remaining funding will come at a later time. He commented on the Parks Department’s request for the Rotodarian and said if Council approved that, Jay would begin going out for bids. No further comments on this.

b. Consider Authorizing Repairs to Street Department Backhoe. Administrator Brungardt said the backhoe has been leaking hydraulic fluid for some time and needs a re-build. Staff can’t do the work in-house because it will require the removal of the entire cab.

Motion by Councilwoman Murdock to authorize the City Administrator to proceed with repairs at an estimated amount of $5,597.32; second by McDaniel. Roll Call: Lane Yes Ritter Absent McDaniel Yes Murdock Yes Walker Yes

Motion carried. c. Consider Resolution No.977 for the Appointment of City representative to the NWCFD Board. Attorney Reavey commented on the City’s appointment to the Board and this is a City Council appointment. Doug Bedford’s term expired December 31st and the purpose of this resolution is to appoint Mr. Bedford for a three-year term, if Council wishes to do so.

Motion by Councilman Lane to approve Resolution No. 977 appointing Doug Bedford to the NWCFD Board; second by Walker. Roll Call: Lane Yes Ritter Absent McDaniel Yes Murdock Yes Walker Yes Motion carried.

Walt McDaniel introduced Mr. Mike Brown, the new county commissioner for the 6th District. He stated Mr. Brown has the City of De Soto at heart. The Fire Department is in the process of buying some new equipment. Discussion ensued between Attorney Reavey and Council members concerning the lease agreement with the Fire Board and the improvements to the building. Attorney Reavey stated the agreement was presented to the Fire Board a year ago and nothing has been heard back, so there needs to be some discussion to set forth everyone’s understanding and adopt the lease.

5. Executive Session: N/A

6. Advisory Reports: a. City Administrator, Mike Brungardt, commented on the Activity Report from the department heads so Council has an idea of what is going on and what is being worked on. He stated January 16th is Martin Luther King Day and it is the Council Visioning Workshop day for two meetings facilitated by Johnson County Community College. Fifty residents were sent invitations to attend the workshops. Administrator Brungardt stated the Lexington Avenue Traffic Signal has been a discussion. Councilman Walker has assisted him concerning the left-turn options at the Commerce Drive area. Since the dip has been removed, traffic is moving much faster and zipping through the intersection. There will need to be some discussions with KDOT and he provided a memo to Council with some options to consider. Councilwoman Murdock commented on the intersection and asked the Sheriff’s Officer present at the meeting about it. Councilman McDaniel said he doesn’t understand why KDOT doesn’t want to help the City with this. Discussion ensued.

b. City Attorney, Patrick Reavey, commented that about a year ago he worked with Mr. Shane Lamb regarding the Outpost property. Mr. Lamb acquired the property and said he would address any code violations within ninety days of taking possession. Mr. Lamb hasn’t done that and now Mr. Lamb is moving out of state. He has a buyer for the property. Attorney Reavey has sent the same letter to the potential buyer requesting the code violations be taken care of within ninety days of taking possession of the property. Councilwoman Murdock said 90 days is enough time for the new owner to get moving on repairs.

c. City Clerk, Lana McPherson, commented on the Statement of Substantial Interest form which needs to be completed for this year by the elected officials, as well as the 2017 W-4 form.

Councilwoman Murdock had no further comments. No further comments from Councilman Walker. Councilman McDaniel said he spoke with Ron Creason about the new loader and they are really happy with it. It’s working out well. Councilman McDaniel commented on the new water tower being operational. Councilman Lane said he wanted to compliment Administrator Brungardt on the Citizen Participation Workshops. He said this is a good thing for our community.
