(PRN). To accommodate individuals wishing to address the Board, the Board Chair may adjust the sequence of the agenda items. The minutes reflect the actual sequence of events rather than the original agenda order. Due to participation in the Probable Cause Panel, Mr. Frey was recused from tabs 1 and 2, and Mr. Broeker was recused from tab 3. DISCIPLINARY PROCEEDINGS MOTION FOR BOARD’S FINAL ORDER BY HEARING NOT INVOLVING DISPUTED ISSUES OF MATERIAL FACT

1. Allison M. Hopkins, R.R.T., Case No: 2016-25633 (PCP, Frey & Fields) Respondent was not present, nor represented by Counsel. Mr. Colon stated that he has a professional association with Ms. Hopkins, however he is able to remain objective in the case and will not need to recuse himself. Ms. Sykes summarized the case for the Board. Respondent was charged with the following violations: Count I: Section 468.365 (1)(w), Florida Statutes (2016), by being unable to practice with reasonable skill and safety to patients. Count II: Section 456. 365 (1)(g), Florida Statutes (2016), engaging or attempting to engage in the possession, sale, or distribution of controlled substances, as set forth by law, for any purpose other than a legitimate purpose. The case was presented as a Hearing Not Involving Disputed Issues of Material Fact, which requires the Board to impose whatever discipline upon the Respondent’s license that the Board deems appropriated and to assess costs of the investigation. MOTION: Dr. Friday-Stroud made a motion to accept the investigative report and exhibits into evidence for the purposes of imposing penalty, making a finding that the Respondent was properly served and has waived his right to a formal hearing, adopted the findings of fact and conclusions of Law as set forth in the Administrative Complaint and that this constitutes a violation of the Florida Statutes, as set forth in the Administrative Complaint. The motion was seconded by Mr. Mitchell and carried 6/0.

MOTION: After discussion, Dr. Friday-Stroud made a motion to impose the following penalties:

• Revocation of Respondents license.

• Costs of $4,937.42 to be paid within one (1) year of the filing of the Final Order.

The motion was seconded by Mr. Mitchell and carried 6/0. MOTION FOR BOARD’S FINAL ORDER BY HEARING NOT INVOLVING DISPUTED ISSUES OF MATERIAL FACT AND DETERMINATION OF RESPONDENT’S WAIVER OF RIGHT TO REQUEST A FORMAL HEARING 2. Francisco J. Dominicci, C.R.T., Case No: 2017-00847 (PCP, Frey & Nunez) Respondent was not present, nor represented by Counsel. Ms. Sykes summarized the case for the Board. Respondent was charged with the following violation: Section 468.365 (1)(x), Florida Statutes (2017), through a violation of Section 456.072(1)(c), Florida Statutes (2017), by being convicted or found guilty of, or entering a plea of guilty or nolo contendere to, regardless of adjudication, a crime in any jurisdiction which relates to the practice of, or the ability to practice. The case was presented as a Hearing Not Involving Disputed Issues of Material Facts and determination of Respondent’s waiver of right to request an informal hearing by default. MOTION: Dr. Friday-Stroud made a motion to accept the investigative report and exhibits into evidence for the purposes of imposing penalty, making a finding that the Respondent was properly served and has waived his right to a formal hearing, adopted the findings of fact and

The motion was seconded by Ms. Hom and carried 6/0. MOTION: After discussion Dr. Friday-Stroud made a motion to impose the following penalties:

• Revocation of the Respondent’s license.

• Costs of $1,660.59 to be paid within one (1) year of the filing of the Final Order. The motion was seconded by Mr. Garcia and carried 6/0. 3. Candice R Maltezos, C.R.T., Case No: 2016-25723 (PCP, Broeker & Fields) Respondent was not present nor represented by Counsel. Ms. Sykes summarized the case for the Board. Respondent was charged with the following violations: Section 468.365 (1)(i), Florida Statutes (2015), by violating a lawful order of the Board previously entered in a disciplinary hearing. The case was presented as a Hearing Not Involving Disputed Issues of Material Facts and determination of Respondent’s waiver of right to request an informal hearing by default. MOTION: Mr. Colon made a motion to accept the investigative report and exhibits into evidence for the purposes of imposing penalty, making a finding that the Respondent was properly served and has waived his right to a formal hearing, adopted the findings of fact and conclusions of Law as set forth in the Administrative Complaint and that this constitutes a violation of the Florida Statutes, as set forth in the Administrative Complaint. The motion was seconded by Mr. Mitchell and carried 6/0. MOTION: After discussion Mr. Colon made a motion to impose the following penalties:

• Reprimand

• Fine of $300.00 to be paid within ninety (90) days of the filing of the Final Order.

• Costs of $321.27 to be paid within ninety (90) days of the filing of the Final Order.

• Respondent’s license to practice respiratory care in the State of Florida shall be SUSPENDED for six (6) months of the filing of the Final Order.

MOTION: Dr. Friday-Stroud made a motion to allow prosecution to continue prosecuting year-old cases. The motion was seconded by Mr. Colon and carried 7/0. ADMINISTRATIVE PROCEEDINGS PERSONAL APPEARANCE PURSUANT TO §456.013(3)(c), F.S. 5. Jonathan Philip Angello, Certified Respiratory Therapist Mr. Angello was present and sworn in by the court reporter. He was requested to appear before the board due to the “yes” answer in the criminal history section of his application. MOTION: After discussion, Mr. Frey made a motion to grant Mr. Angelo Certified Respiratory Therapist licensure with no conditions and delegated Board Staff the administrative authority to approve Mr. Angello’s application for Registered Respiratory Therapist licensure upon submission and completion, if no additional history is indicated on the application. The motion was seconded by Dr. Friday-Stroud and carried 7/0. 6. Karin Angela Hood, Registered Respiratory Therapist Ms. Hood was present and sworn in by the court reporter. She was requested to appear before the board due to the “yes” answer in the criminal history section of his application. MOTION: After discussion, Mr. Mitchell made a motion to grant licensure with no conditions. The motion was seconded by Mr. Frey and carried 7/0.

At this time, the Board re-visited tab one regarding a fax brought to their attention from the Boards Staff regarding Ms. Allison M. Hopkins, R.R.T., Case No: 2016-25633, from Attorney Glasser, requesting a continuance of Ms. Hopkins’ Case. MOTION: After discussion, Mr. Garcia made a motion to deny the request for continuance. The motion was seconded by Mr. Frey and carried 7/0. 7. Andrew Christopher Jones, Certified Respiratory Therapist Mr. Jones was present and sworn in by the court reporter. He was requested to appear before the board due to the “yes” answer in the criminal history section of his application. MOTION: After discussion, Dr. Friday-Stroud made a motion to grant licensure with no conditions. The motion was seconded by Mr. Mitchell and carried 7/0. MOTION: Mr. Garcia made a motion to delegate Board Staff to administratively approve Mr. Jones’ application for Registered Respiratory Therapist licensure upon submission and completion, if no additional history is indicated on the application. The motion was seconded by Mr. Mitchell and carried 7/0. 22. Eric Lamont Wright, Certified Respiratory Therapist Mr. Wright was present and sworn in by the court reporter. He was requested to appear before the board due to the discipline employment history reported with his application. MOTION: After discussion, Mr. Colon made a motion to grant licensure with no conditions. The motion was seconded by Mitchell and carried 7/0. 23. Tommy Daigle, Registered Respiratory Therapist Mr. Daigle was present and sworn in by the court reporter. He was requested to appear before the board due to the “yes” answer in the criminal history section of his application. MOTION: After discussion, Mr. Colon made a motion to grant licensure with the following conditions:

• Applicant shall make contact with the Florida Professionals Resource Network (PRN) within 30 days, undergo an evaluation coordinated by PRN within 60 days of the filing of the Order and if recommended, comply with any and all terms or conditions imposed by PRN within 90 days of the filing of the Order as a result of said evaluation.

• Staff may issue license if PRN deems applicant safe to practice.

The motion was seconded by Mr. Mitchell and carried 6/1. Mr. Broeker opposed.

Motion: Mr. Colon made a motion stating if applicant does not comply with the imposed conditions, the application is to be denied. The motion was seconded by Mr. Garcia and carried 7/0. APPLICANT RATIFICATION LISTS 8. Certified Respiratory Therapists MOTION: Mr. Colon made a motion to ratify the list of 29 names (Exhibit A), beginning with

Sandra Desgraves and ending with Darren Ward Gibson for CRT licensure by endorsement. The motion was seconded by Mr. Broeker and carried 6/0. 9. Registered Respiratory Therapists MOTION: Mr. Mitchell made a motion to ratify the list of 145 names (Exhibit B), beginning with Matthew Benson and ending with Cedric Young for RRT licensure by endorsement. The motion was seconded by Ms. Hom and carried 6/0. 10. New Continuing Education Provider MOTION: Mr. Broeker made a motion to ratify the two names (Exhibit C), HealthSouth Emerald

Coast Rehab Hospital and Respiratory CEU Center Inc., for continuing education providers. The

motion was seconded by Mr. Mitchell and carried 6/0.

11. Exemption from Employment Disqualification MOTION: Mr. Mitchell made a motion to ratify the two names (Exhibit D) Joseph Blais and Arthur R. Orem Jr., for exemption for disqualification from employment by delegation of authority from the Board for staff to administratively review and approve exemption applications that meet certain criteria. The motion was seconded by Mr. Frey and carried 6/0. NEW BUSINESS 12. Professionals Resource Network (PRN) Presentation Dr. Martha E. Brown, was present on behalf of PRN and provided an extensive presentation of the PRN process. 13. Proposed 2019 Meeting Dates The following dates were presented for Board consideration. Probable Cause Panel Meetings - 8:00 a.m. February 5 April 16 June 18 August 20 October 15 December 10 Mr. Colon expressed concerns with Board Members excusing themselves before the meeting concludes. Appointee for the first three Probable Cause Panel meetings are Mr. Frey and will serve as the panel Chair. The appointee for the last three meetings in 2019 will be Mr. Mitchell and will he will serve as the panel Chair. MOTION: After Discussion, Mr. Frey made a motion to accept the proposed 2019 Board

Business Meeting dates and the Probable Cause Panel meeting dates listed above. The motion

was seconded by Mr. Mitchell and carried 6/0.

14. National Board for Respiratory Care Annual Meeting The National Board for Respiratory Care (NBRC) will be inviting one person to the 2018 annual meeting and the board will need to select a representative. The meeting will be held August 24-25, 2018, at the Overland Park Sheraton at the Convention Center in Overland Park, Kansas. In case the primary representative is unable to attend, the Board should nominate an alternate representative also. Mr. Dennis Willerth, Executive Director of the Florida Society for Respiratory Care, indicated when the upcoming meetings being conducted by the FSRC will take place. OLD BUSINESS 19. Future of Respiratory Licensure in Florida, within Statutory Guidelines On April 6, 2017 a Strategic Planning/Long Range Planning meeting was held and the following topics were discussed:

• Role of the Board and Board Authority

• Education

• Licensure and the Future of Respiratory Care The discussion has continued at subsequent meetings where the Board encouraged and received input from licensees and stakeholders. The Board scheduled the discussion at the April 2018 meeting with the intention of determining a course of action. Mr. Garcia stated that the Board will be concluding their discussion on this topic and allow the Florida Society of Respiratory Care (FSRC), to continue the discussion for any future action.

Mr. Glen Malone, Region Five Director of the FSRC, addressed the Board.

• January 5, 2018 General Business Meeting Motion: After Discussion, Mr. Frey made a motion to approve the January 5, 2018, General Business minutes as presented. The motion was seconded by and Mr. Colon carried 6/0.
