Agenda Item No.1 Confirmation of the minutes of 46th meeting ofEducation Committee (Ay.) held on 13th March2002 at New Delhi

It was noted that the minutes of 46th meeting of Education Committee (Ay.) held on 13th March,2002 were ratified by Ayurved Committee including members of Education Committee (Ay.)held on 14.3.2002.

Therefore, the Education Committee confirmed the same.

Agenda Item No.2 Inclusion of Ayurved Vachaspati –MD (Ay.) Degreeawarded by Bharati Vidyapeeth Deemed University,Pune in the Second Schedule to IMCC Act, 1970.

It was noted that a proposal of Bharti Vidyapeeth (Deemed University), Pune torecognise/include the Post-Graduate qualification being awarded by the Univresity in IIndSchedule to IMCC Act, 1970 has been received which is not included in the above schedule sofar.

In this regard, following facts were also noted

(i) Ayurvedacharya degree awarded by this University is included as under in 2nd Schedule toIMCC vide S.No.56, S.O.No.486 E dated 30th May , 2001

(ii) Government of India vide their letter No.12013/79/2002-Ay.Desk dated 17.10.2002 hasforwarded the request of the university as required under Section 14(2) of IMCC Act, 1970 forcomments.

(iii) The college has been established in 1990-91

(iv) Earlier college was affiliated to Poona University. Later on the college got DeemedUniversity status.

(v) College has been permitted by Central Council to start PG Course in the session 1999-2000in the subject of Ayurved Siddhant & Darshan 04, Rachna Sharir 04 and Dravyaguna 04.

(vi) Again college has been permitted to start P.G. Course in Kayachikitsa 05, Rog Nidan 03and Prasuti & Striroga 05 for the session 2001-2002 onwards.

(vii) Recently college was visited on 29.4.2002 and verification was also carried out on18.6.2002.

It was noted that D.A.V. College Managing Committee, Delhi has requested to include thequalification i.e. Vaidya Vachaspati from 1954 to 1965 onwards in the IInd schedule to IMCCAct, 1970 as same is not included in the Schedule.

In this regard, it was further noted that diploma has been awarded before 1947, the same diplomahas been awarded from Delhi 1955 to 1965 therafter college got affiliated to Punjab StateFaculty of Ayurveda. At present college is affiliated to Baba Farid University of HealthSciences, Faridkot.

Details of the students and Curriculum and Syllabus are not available with the management.

The Education Committee decided that further details about year-wise list of the students passedand other relevant information be obtained.

Agenda Item No.4 Proposal of Rajiv Gandhi University of HealthSciences, Bangalore.

It was noted that a proposal of Rajiv Gandhi University of Health Sciences, Bangalore forinclusion/recognition of Ayurvedacharya (BAMS), Ayurved Vachaspati, M.D.(Ay.) degree inSecond Schedule to IMCC Act, 1970 has been received.

In this regard following facts were noted

1. Before the establishment of Rajiv Gandhi University of Health Sciences, Bangalore,there were following universities affiliating the colleges of Karnataka for conductingAyurvedacharya and Ayurved Vachaspasti Course .

3. Central Council after assessing the available facilities of teaching and practical traininggranting permission to the colleges affiliated to this university for conducting UG/PG courses.

4. It was also observed from the previous proposals that university is not following theRegulations and Syllabus for conducting UG/PG Course in toto as prescribed by CentralCouncil.

5. It was also observed that university is not following the nomenclature for awardingdegree to the successful candidate as per nomenclature prescribedby Central Council under concerned Regulations. The same was communicated to theuniversity.

Now university has submitted the cancelled copy of degree by amending the same by handand assuring to follow the Regulations and Syllabus prescribed by Central Council in toto.

Agenda Item No.6 Recognition/inclusion of MD (Ayurved) degreeawarded by University of Calcutta.

It was noted that Post-graduate course of Ayurveda is being conducted in Institute of Post-graduate Ayurved Education & Research (Shayamadas Shastra Vaidyapith Calcutta. But thePost-graduate degree awarded by University of Calcutta is not included in the Second Scheduleto the IMCC Act, 1970. As per provision of Section 14(2) and 17, the qualification included inthe Second, Third & Fourth Schedule of IMCC Act, 1970 shall be sufficient qualification forenrollment on State/Central Register.

In this regard following facts were noted:-

1. Following two colleges are affiliated to University of Calcutta.

(i) Institution of Post-graduate Ayurveda Only PG Course inEducation & Research (Shyamdas (i) KayachikitsaVaidya Shastra Vidyapeeth) (ii) Roga Vigyan & Vikriti Vigyan

reciprocal relations almost in all relation.

2. Ayurvedacharya (BAMS) awarded by University of Calcutta is included in SecondSchedule to the IMCC Act, 1970.

Brief History

3. Shyamadas Vaidya Shastra Vidyapeeth Calcutta with its 75 beded hospital was takenover by the Government of West Bengal on 1.3.71 from private management for theconversion of the same into an Institute of Post-graduate Ayurved Education andResearch in West Bengal.

Government of India approved the upgrading of a Department of Post-graduate education& Research in Kayachikitsa including Panchkarma at Shyamadas Vaidya ShastraVidyapeth, Hospital as a centrally Sponsored Scheme vide letter No.Health/6109/1A-63/75 dated 21.8.75.

Calcutta University granted affiliation in Kayachikitsa including Panchkarma therapy tothe Post-graduate therapy to the post-graduate standard with effect from the session 1973-74 vide letter No.C/1981/217-Ast. Dated 1st October 1979.

4. In addition to the above, Government of India, Ministry of Health & Family Welfareapproved the upgrading of the three departments as per details given below underCentrally Sponsored Scheme with the financial assistance.

(a) Sharir & Samhita and Dravyaguna Z.14014/6/91-Desk I dated 27.3.91.

(b) Rog Vigyan & Vikriti Vigyan Z.14013/6/91-Ay Desk I dated 6.3.92

5. Government of West Bengal under Section 23 of Paschim Banga Ayurvedic System ofMedicine Act, 1960 has included MD (Ayurved) Doctor of Medicine (Ayurved) awardedby University of Calcutta in the Schedule to the State Act vide Notification.Health/AUH/591/1A-10/93 dated 12th October 1993 published in Extra Ordinary, Gazetteof West Bengal dated 7th February 1994. When it came to the notice of the CentralCouncil that Government of West Bengal has included Post-graduate degree awarding byCalcutta University, Calcutta in the Schedule of the State Act without taking care of theprovision of Section 14 & 17 of IMCC Act, 1970. However, it was suggested thatGovernment of India be requested to take up the matter with the State Government forinstruction of the Secretary dated 3.8.95 stating that as per instruction of Chairman,Education Committee (Ayurved) this letter be kept in pending till the visitation of theInstitution.

Agenda Item No.8 Qualification for admission – regarding.

It was noted that a letter has been received from Central Council of Homoeopathy seekingclarification that a candidate who has passed Higher Secondary School Examination (10+2) ofscience group as Private candidate through Board of Secondary Education Madhya Pradesh,Bhopal can be eligible for admission to BAMS Course.

In this regard, it is submitted that following admission qualification has been prescribed in IndianMedicine Central Council (Minimum Standards of Education in Indian Medicine) (Amendment)Regulations, 1989.

“12th Standard with Science (Physics, Chemistry and Biology) and Sanskrit.

Wherever provision and facilities for teaching Sanskrit as optional subject are not available at12th standard (Biology Science group), the students with 12th standard (Biology Science Group)be admitted and Sanskrit be taught in main course.

Uttar Madhyama of Sampurnanand Sanskrit Vishwavidyalaya with Science and English.

or

Any other equivalent qualification recognized by State Governments and State EducationBoards concerned with the examination.

ii) The Pre-Ayurved Course of one year duration in respect of Uttar Madhyama orHigher Secondary/PUC preferably with Sanskrit or an examination equivalent theretoand Pre-Ayurved Course of two years duration in respect of Purvamadhyama orSSLC/Matriculation preferably with Sanskrit or an examination equivalent thereto,however, will continue till 1990 if the State Government or University so desires.”

Further, it was noted that provision made under Regulations does not depict the true picturewhether the candidate passed 10+2 privately will be eligible for admission in AyurvedacharyaCourse or not. However, the provision reads as under:-

“Any other equivalent qualification recognized by State Governments and State EducationBoards concerned with the examination.”

In this regard Rajiv Gandhi Health Sciences University has asked that whether vocationalqualification will be eligible for admission in BAMS & BUMS Course.

It seems that as per provision marked State Government/State Education Boards arecompetent authority to decide the matter.

The Committee discussed the issue and decided that matter of equivalence rests with the StateGovernment.

Agenda Item No.9 Representation of M/s Vishwamitra Education &Medical Research Foundation, Rajkot

It was noted that Ministry of Health & Family Welfare has forwarded the representation of M/sViswamitra Education & Medical Research Foundation, Rajkot to promote Education for IndianMedicine. He has stated that western world has accepted that ancient medicine of Bharat is moreperfect and has less adverse effect to the patient and has decided to promote Ayurveda. Stilltoday our Government has not thought anything in this field of treatment. Ayurveda haseverything except the Modern Surgery.

He has requested to change the rules made by CCIM.

- There should be one student – one bed instead of three

- One Professor and one tutor/Assistant Professor for one subject education qualificationshould be Post-graduate and Graduate for tutor.

It was noted that a Workshop was organized on 19-20th February, 2003 atGovernment Ayurved College, Thiruvanathapuram. As recommendations of theWorkshop could not be prepared at that time. Hence, the Committee deferred thesame for next meeting.

Agenda Item No.12 Provision of ATKT – regarding.

It was noted that a letter No.V.27016/7/2002-Ay.Desk dated 27th May, 2002 ofMinistry of Health & Family Welfare, Department of ISM&H stating as under:-

“You have communicated to this Department that CCIM Regulations aremandatory and the provisions of ATKT has been made in these Regulations.These Regulations have been sent to the State Governments/Directors of the Stateand all the Universities having Faculty of Ayurveda for implementation to conductcourses as per Regulations.

Department of ISM&H of the view that although the provisions of ATKT has beenprovided in the CCIM Regulations namely Indian Medicine Central Council(Minimum Standards of Education in Indian Medicines) (Amendment)Regulations, 1989. These Regulations are prescribed for Minimum Standards ofEducation of Indian Medicines as the title of the Regulation clearly indicates.

Removal of provision of ATKT in no way results in lowering Minimum Standardsof Education. On the contrary such a measure will increase the standards.Maharashtra University of Health Sciences, Nasik had adopted this measure for allthe faculties including Faculty of Ayurveda. Isolation of Faculty of Ayurved bymaking provision of ATKT will disturb the uniformity in the University. As theUniversity is not lowering the Minimum Standards of Education in IndianMedicines it is implementing the CCIM Regulations.

It is requested to communicate the view of the Council with regard to ISMDepartment’s view mentioned above at the earliest.”

In this regard following facts are placed below:-

1) Central Council/Education Committee (Ayurved) took a serious note time totime regarding non-adoption of provision of ATKT made under the concernRegulation namely, “IMCC (Minimum Standards of Education in IndianMedicine) (Amendment) Regulation, 1989 by Maharashtra University ofHealth Sciences, Nasik.

2) Maharashtra University of Health Sciences, Nasik was requested severaltimes to follow the same.

3) Maharashtra University of Health Sciences, Nasik approached to theMinistry of Health & Family Welfare.

4) Dr. SS Savarikar asked the comments in this regard.

5) The reply was sent by office.

Now Government of India has informed as mentioned above.

As meeting of Sub-Committee of Vice-Chancellor (constituted in Conferenceorganized 8.3.2003) is Scheduled on 24.2.2003 at Rajiv Gandhi University ofHealth Sciences, Banglore and Vice-Chancellor of Maharashtra University ofHealth Sciences is also a participant in this Committee. Addl. Agenda Item No.1. Recognition/inclusion of Ayurvedacharya degreeawarded by Maharashtra University of HealthSciences, Nasik.

It is submitted that Maharashtra University of Health Sciences, Nasik hasrequested the Council to recognize the Ayurvedacharya degree awarded by theuniversity and include in the Second Schedule to the IMCC Act, 1970.

In this regard following facts are placed below:-

1. The Government of India, Ministry of Health & Family Welfare,Department of ISM&H has forwarded the request of the University to theCouncil as required under Section 14 (2) of IMCC Act, 1970.

2. There are about 57 Ayurvedic colleges affiliated to the University.

3. These colleges are permitted by the Central Council of Indian Medicineimparting education of Ayurveda.

4. After going through the copy of degree of Ayurvacharya furnished by theUniversity to be awarded to the successful candidates, it has been observedthat the nomenclature of the degree is only Ayurvedacharya, whereas itshould be Ayurvedacharya (Bachelor of Ayurvedic Medicine & Surgery)as prescribed by the Central Council under the Regulations.

5. The degree to the First batch will be awarded by the University in 2003.

6. The University is not following the provision of ATKT of the prescribedRegulation which is violation of the prescribed Regulations.

Education Committee considered the issue and decided that further clarification beobtained from the University.
