MINUTES OF THE REORGANIZATIONAL MEETING OF THE BOARD OF EDUCATION

OF THE KINGSTON CITY SCHOOL DISTRICT August 31, 2016

CALL TO ORDER/ROLL CALL/PLEDGE OF ALLEGIANCE  Ms. Scherer, President, called the meeting to order at 6:00 p.m. All Board members were present with the exception of Dr. Jacobowitz and Mr. Shaughnessy who were excused.

 MOMENT OF SILENCE

Ms. Scherer asked for a moment of silence to honor former Kingston High School students Jordan DePace & Kerry A. Stoutenburgh.

EXECUTIVE SESSION  On a motion by Ms. Jordan, seconded by Ms. Collins, the Board Members unanimously agreed to adjourn into executive session at 6:02 p.m. to discuss collective bargaining under the Taylor Law; matters leading to the employment of particular individual(s); employment history of particular individual(s) or corporations(s) and review of programs and placements of students with disabilities; proposed, pending or current litigation; and proposed acquisition, sale, or lease of real property and publicity would substantially affect the value thereof.  

RETURN TO PUBLIC SESSION  The Board Members returned to public session at 7:03 p.m.

Ms. Heidecker shared a video highlighting the Kindergarten Academy at JFK and GW. A brief discussion followed.

PUBLIC PARTICIPATION

Alex Deane, Citizen Action spoke regarding Campaign for Fiscal Equity, AQE March from NYC to Albany and a forum on Sept. 22 at KHS.

Carol Dexter expressed special thanks for the Kindergarten Academy and the buses that were provided.

SUPERINTENDENT’S REPORTS

Superintendent Goals Dr. Padalino stated that his draft goals were in the packet and he would submit them for adoption at the Sept. 7th meeting. Meagher Update Dr. Padalino gave a brief presentation on using Meagher for Central Offices. Discussion followed. School Calendar Dr. Padalino stated that there has been concerns expressed regarding the November 8th Election Day and asked the Board if they would consider changing it to a Supt. Conference Day or changed it to a day off and replace it with April 17th as a school day. Discussion followed. 2nd Century Project KSQ & BBL Mr. DeLima reviewed the bid and building schedule; Ms. Scrodanus reported that the certificate of occupancy has been issued for the field house and reported on the work that has been completed; Mr. Hillje gave a brief overview of the 5-year plan.

RESOLUTIONS (Consent Agenda)  Ms. Scherer asked if Board members had any resolutions they would like pulled from the consent agenda; Board Members pulled B28 & B29. Rev. Childs made a motion to adopt the consent agenda minus B28 & B29; seconded by Ms. Guido. The motion carried unanimously.  PERSONNEL P26 - Professional Personnel BE IT RESOLVED, upon the recommendation of Dr. Paul J. Padalino, Superintendent of Schools, that the following be approved by the Board of Education: Appointments Jennifer Brannigan, probationary appointment in the special subject tenure area of art, Step 1 B at an annual salary of $ 52,781, effective September 1, 2016 with a probationary period ending August 31, 2020, except to the extent required by Section 3012-d Education Law.**. Initial certification visual arts. Katherine Driscoll, permanent substitute appointment as a speech language therapist, Step 1 M at an annual salary of $ 58,424 effective September 1, 2016 through the maximum period through June 30, 2017, to serve at the pleasure of the Board. Initial certification, speech & hearing handicapped. Tia Fitzpatrick, probationary appointment in the special subject tenure area of foreign languages, Step 1 M at an annual salary of $ 58,424 effective September 1, 2016 with a probationary period ending August 31, 2020, except to the extent required by Section 3012-d Education Law.** Permanent certification, French 7-12. B28 - Approval of Homestead - Non-Homestead Tax Shift WHEREAS, the City of Kingston, an approved assessing unit containing one-third or more of the parcels included in the Kingston City School District, has adopted the homestead and non-homestead tax rate system under the provisions of Section 1903 of the Real Property Tax Law, and

WHEREAS, this action provides the school district with the option to use a dual tax rate system for all properties within the district, which includes the City of Kingston and parts of the Town of Esopus, Town of Hurley, Town of Kingston, Town of Marbletown, Town of New Paltz, Town of Rosendale, Town of Saugerties, Town of Ulster and the Town of Woodstock, NOW THEREFORE BE IT RESOLVED, that the Board of Education of the City School District of the City of Kingston adopt the provisions of subdivision 5 of section 1903 of the Real Property Tax Law for purposes of school taxes levied for the fiscal year 2016-2017, using a shift of 11.0%. BE IT FURTHER RESOLVED, that this authorization is valid for one year only. However, the Board of Education, by Law, reserves the right to renew or rescind this authorization at any time prior to the adoption of a tax warrant Note: Tax Apportionment for Homestead/Non-Homestead School Districts Article 19 of the Real Property Tax Law (RPTL) describes the use of Homestead and Non- Homestead tax rates; Section 1903 addresses eligibility and options

Generally speaking, Homestead property is 1-, 2-, and 3 - family residences, condominiums and the first 10 acres of residential vacant land; Non-Homestead property is everything else.

The first step in applying the Homestead/Non-Homestead option is the determination of the proportionate percentage of taxable real property wealth between the two classes of property.

Within limits determined by Section 1903 of the RTPL a school board may re-apportion the share of taxable real property wealth between the Homestead and Non-Homestead class

The Homestead share may not be decreased below 75% of the aggregate proportion; the Non-Homestead share may not be increased more than 125% of the aggregate proportion.

The re-apportionment of wealth (Homestead v. Non-Homestead) accomplish a shift of the apportioned tax levy in the direction of the Non-Homestead property.

The tax levy having been re-apportioned between the two classes of property is then allocated to each municipal segment (city and towns) based upon the full value of each segment

B29 - 2016-2017 TAX RATES WHEREAS, the Board of Education of the City School District of the City of Kingston, has duly adopted a budget for the current school year, pursuant to the manner prescribed by the Education Law of the State of New York, and WHEREAS, such budget became effective and the expenditures, revenues and the amount necessary to be raised by tax on real estate became applicable, all on the 1st day of July, 2016, and

WHEREAS, the Kingston City School District must raise Forty-Eight Thousand and no/100 Dollars ($48,000.00) as authorized by public vote on May 15, 2001, Resolution 2000-B67 to pay such monies to the area libraries as listed in Proposition #2, and WHEREAS, the necessary assessment rolls of the taxable property of the City of Kingston, and Towns of Esopus, Hurley, Kingston, Marbletown, New Paltz, Rosendale, Saugerties, Ulster and Woodstock have been completed; and WHEREAS, there has been prepared a tax list for the tax required to be levied, as stated in such current school budget, the aforesaid tax list is hereby confirmed, NOW THEREFORE BE IT RESOLVED, that the Board of Education establish a legal reserve of $6,463,944.40 from the total unreserved fund balance at July 1, 2016 of $12,089,524.67 thereby applying $1,000,000.00 to the revenues of the 2016-2017 Budget, $1,619,253.25 to the Tax Certiorari Reserve, and apply $251.66 to the Unemployment Reserve, and apply $3,251.94 to the Reserve for Employee Retirement Contribution, $59.44 to the Liability Reserve and $59.32 to the Property Loss Reserve, and $3,002,704.66 to the Capital Reserve. Audit & Finance Committee Ms. Scherer reported that they had a brief meeting on August 24th and reviewed the financial reports for the period ending June 30th as well as the tax warrant. The next meeting will be on Tuesday, September 27th. Ms. Scherer made a motion to adopt the following resolutions; seconded by Ms. Jordan. The motion carried unanimously.  BOE29 – Claims Auditor Report –July 2016 BE IT RESOLVED, that the following Claims Auditor reports be accepted for July 2016 as attached.

OLD BUSINESS Ms. Scherer announced that the next steering committee meeting would be on September 14th at 2 at KHS room 107, followed by a facilities meeting which would consist of a tour of the high school project at 3:30 and a Board Retreat at Crown St. that would begin at 5:30. Ms. Scherer asked for a board volunteers to form a subcommittee to draft the board goals. Ms. Jordan, Ms. Guido and Ms. Scherer volunteered and would meet on Tuesday, Sept 6th at 5:30. Ms. Scherer announced that Ulster County School Board Association would like two volunteers from each district to serve as needed on the Legislative Action Committee. Ms. Jordan volunteered.

NEW BUSINESS Nothing was offered at this time.

BOARD MEMBER ANNOUNCEMENTS Ms. Jordan stated that she had attended her first summer graduation and although there was only one student present she found it to be extremely moving and special. She expressed appreciation to Dr. Padalino and staff for their attendance.

PUBLIC PARTICIPATION 

Ms. Bowers spoke regarding the 5-year plan for Myer Elementary and the dangers of the road behind the school.

Policy 5151

HOMELESS CHILDREN

The Board of Education recognizes its responsibility to identify homeless children within the district, encourage their enrollment and eliminate existing barriers to their education which may exist in district practices. The Board will provide homeless children attending the district’s schools with access to the same free and appropriate public education and other school programs and activities, including preschool education, as other children. A homeless child is a child who lacks a fixed, regular, and adequate nighttime residence or who has a primary nighttime location in a public or private shelter designed to provide temporary living accommodations, or a place not designed for, or ordinarily used as, a regular sleeping accommodation for human beings. This definition also includes a child who shares the housing of others due to loss of housing, economic hardship, or similar reason; lives in motels, hotels, trailer parks, or camping grounds due to the lack of alternative adequate accommodations; lives in a car, park, public space or abandoned building, substandard housing, bus or train station or similar setting; has been abandoned in a hospital or is awaiting foster care placement; or is a migratory child who qualifies as homeless. An unaccompanied youth is a homeless child for whom no parent or person in parental relation is available. A homeless child has the right to attend school in either the school of origin (i.e., where he/she resided before becoming homeless, or the school he/she was last enrolled), the school in the district of current location (i.e., where he/she currently resides as a result of his/her homelessness) that he/she is entitled to attend based on attendance zone or general eligibility, or a school in a district participating in a regional placement plan. Such schools include preschools. The homeless child is entitled to attend the designated school on a tuition-free basis for the duration of his or her homelessness. If the child becomes permanently housed, the child is entitled to continue to attendance in the same school building until the end of the school year and for one additional year if that year constitutes the child’s terminal year in such building. If a homeless child completes the final grade level in his/her school of origin, the child may also attend the designated receiving school at the next grade level. The Superintendent of Schools shall develop procedures necessary to expedite the homeless child's access to the designated school. Such procedures shall include:

1. Admission: Upon designation, the district shall immediately admit the homeless child to school, even if the child is unable to produce records normally required for enrollment, such as previous academic records, medical or immunization records, proof of age or residency or other documentation and even if there is a dispute with the child’s parents regarding school selection or enrollment. During a dispute, the student may continue attending the school until final resolution of the dispute, including all available appeals. Homeless children will have the same opportunity as other children to enroll in and succeed in the district’s schools. They will not be placed in separate schools or programs based on their status as homeless. The district shall eliminate barriers to

identification, enrollment and retention of homeless children, including barriers to enrollment and retention due to outstanding fees, fines or absences.

2. Transportation: The district shall provide transportation for homeless students currently residing within the district as required by applicable law, as described in the accompanying regulation.

3. School Records: For homeless students attending school out of the district, the district

shall, within five days of receipt of a request for records, forward a complete copy of the homeless child's records including proof of age, academic records, evaluation, immunization records and guardianship paper, if applicable. For homeless students attending school in the district, the district shall request the student’s records (academic, medical, etc.) from the school the student last attended.

4. Coordination: The district shall coordinate with local social services agencies and

other entities providing services to homeless children and their families for the provision of services to homeless children, and shall coordinate with other school districts on issues of prompt identification, transportation, transfer of records, and other inter-district activities. This shall include ensuring the provision of appropriate services to homeless students with disabilities who are eligible for services under either Section 504 or IDEA.

Information about a homeless child’s living situation shall be treated as a student

education record, and shall not be deemed to be directory information under FERPA (see policy 5500). The Superintendent shall also designate a liaison for homeless children and ensure that this person is aware of his or her responsibilities under the law. The Superintendent shall ensure that the liaison receives appropriate professional development on identifying and meeting the needs of homeless students, including the definitions of terms related to homelessness. The liaison’s responsibilities shall include, but not be limited to, ensuring that: 1. parents or guardians of homeless children are informed of the educational and related

opportunities available to their children, and are provided with meaningful opportunities to participate in the education of their children;

2. parents and guardians and unaccompanied youth are fully informed of all transportation services available to them, and are assisted in accessing them;

3. enrollment disputes involving homeless children are promptly mediated and resolved; 4. school personnel, through outreach and in coordination with shelters and social service

agencies and other appropriate entities, identify homeless children, including homeless preschoolers;

5. homeless children receive educational services, including Head Start and preschool services to which they are eligible, as well as referrals to health care and other appropriate services for homeless children and their families;

6. public notice of the educational rights of homeless children is disseminated in locations frequented by homeless unaccompanied youth and parents/guardians of

homeless children, in a manner and form understandable to them; 7. staff who provide services to homeless students receive required professional

development and support on identifying and meeting the needs of homeless students; 8. homeless unaccompanied youth are informed of their rights, are enrolled in school,

and have opportunities to meet the same state standards set for all students, including receiving credit for full or partial coursework earned in a prior school pursuant to Commissioner’s regulations.

In accordance with law and regulation, the district will offer a prompt dispute resolution process (described in more detail in the accompanying administrative regulation). In accordance with Commissioner’s regulations, the district shall collect and transmit to the Commissioner information necessary to assess the educational needs of homeless children within the State.
