Approach

Build and support judicial leaders Equip judicial leaders in a continual

process of ensuring justice for Indian children, families and tribes in child welfare cases

Assist judges to identify areas in which knowledge can be strengthened to ultimately ensure that children and families are provided with the full enforcement in spirit and letter of ICWA

Learning Objectives

Participants will recognize the historical, philosophical, and legal basis for the ICWA

Participants will understand the role of the judge in ensuring positive outcomes for Indian children, their families and tribes

Participants will be able to apply the provisions of ICWA Inquiry and Investigation of Native Ancestry Noticing of Tribes Active Efforts Use of Expert Witnesses Adoption and Foster Care Placement Requirements

Learning Objectives (cont’d)

Participants will value how critical it is to identify Indian children during the initial stages of child welfare proceedings and the ongoing duty to inquire throughout the case.

Participants will value engaging and working with tribes as resources for decision-making throughout the case.

Participants will value Indian children’s connection to their tribe and community including membership in their tribe.

Participants will understand their role in promoting equity and fairness by ensuring ICWA is followed.
