WHEREAS, the Holland & Knight law firm has long been associated with philanthropic activities in the communities where their attorneys live and work; and WHEREAS, a guiding principle at Holland & Knight is that a work force sensitive to and actively involved in community issues is an important asset both to the Holland & Knight law firm family and the communities in which they serve; and WHEREAS Holland & Knight, through the generous support of its attorneys and employees, created and supports the Holland & Knight Charitable Foundation, Inc. which sponsors programs such as Opening Doors for Children, Holocaust Remembrance Project, Young Native Writers Essay Contest, DREAM Scholarship Essay Contest, NYC Firefighter Memorial Wall, Glenn Winuk Memorial Humanitarian Fund and Chesterfield Smith Classroom; and WHEREAS, the Holland & Knight Charitable Foundation, Inc. was created in 1996 to take over the management and coordination of the law firm’s ever-increasing charitable contributions and activities. One of the Foundation’s most notable community programs is the Holocaust Remembrance Project, which is a lasting memorial to all who perished in the Holocaust and an educational tool to help teach the prevention of prejudice, discrimination and violence; and WHEREAS, Holland & Knight’s Holocaust Remembrance Program is a national essay contest for high school students (14 – 18) designed to encourage and promote the study of the Holocaust. Now in its 15th year, the Project receives essays from thousands of students each year and awards college scholarships ranging from $2,500 to $10,000 to the top 10 finalists; and WHEREAS, the finalists participate in a week-long encounter of learning with Holocaust survivors and other scholars of the Holocaust. The project has used Washington DC as a venue in subsequent years (because of the location of the US Holocaust Memorial Museum). This year, the project will be centered in Skokie, Illinois at the new Illinois Holocaust Memorial Museum and Education Center. NOW, THEREFORE, I, GEORGE VAN DUSEN, Mayor of the Village of Skokie, do hereby proclaim the week of June 21 through June 27, 2009, as

“HOLLAND & KNIGHT HOLOCAUST REMEMBRANCE WEEK”

and commend and thank Holland & Knight, and their attorneys and employees, for their continuing contributions, efforts and work to end hate, discrimination and prejudice. A RESOLUTION CONGRATULATING ELLIOTT APPEL AS A FIRST-PLACE WINNER IN THE HOLLAND & KNIGHT

CHARITABLE FOUNDATION, INC., 2009 HOLOCAUST REMEMBRANCE PROJECT ESSAY CONTEST

WHEREAS, Holland & Knight law firm created the Holland & Knight Charitable 1

Foundation, Inc, a not for profit corporation (hereinafter “Holland & Knight Foundation”), 2 which sponsors a Holocaust Remembrance Project; and 3

4 WHEREAS, the Holocaust Remembrance Project (hereinafter “Project”) is an essay 5

contest open to high school students across the United States and Mexico. It is designed to 6 encourage and promote the study of the Holocaust. Participation in this Project encourages 7 students to think responsibly, be aware of world conditions that undermine human dignity, 8 and make decisions that promote the respect and value inherent in every person; and 9 10

WHEREAS, now in its 15th year, the Project serves as a living memorial to the 11 millions of innocent victims of the Holocaust. The Holland & Knight Foundation recognizes 12 the moral imperative of teaching young people about this watershed event and the central 13 importance of passing on to future generations a profound understanding of the 14 consequences of the Holocaust and a sense of responsibility to the human community; and 15

16 WHEREAS, the Holland & Knight Foundation honors the first-place students with a 17

medal, awards each with a financial scholarship to assist with their college education, and 18 provides for a four day trip to a national holocaust museum to further their understanding of 19 the Holocaust along with the opportunity to meet with survivors and interact with academia 20 and other experts on issues related to the Holocaust; and 21

22 WHEREAS, during the month of June 2009, the First-Place Winners will make the 23

trip to Chicago, Illinois, to receive their awards. The students will visit the newly opened 24 Illinois Holocaust Museum and Education Center in Skokie, Illinois, and meet with Chicago 25 area survivors of the Holocaust; and 26

27 WHEREAS, the students will have an interactive discussion with George Van 28

Dusen, Mayor of Skokie, the Honorable Harvey Schwartz, retired Circuit Court Judge and 29 former Skokie Corporation Counsel, and Bernie Schutz, a Holocaust survivor, in relation to 30 a neo-Nazi group’s efforts to parade in Skokie in the late 1970’s, the legal issues presented 31 at that time and the response of the community; and 32

33 WHEREAS, in 2009, over 7,000 students participated in the essay contest and the 34

essays have been judged by an independent panel of educators and ultimately by attorneys 35 affiliated with Holland & Knight; and 36

22 WHEREAS, during the month of June 2009, the First-Place Winners will make the 23

trip to Chicago, Illinois, to receive their awards. The students will visit the newly opened 24 Illinois Holocaust Museum and Education Center in Skokie, Illinois, and meet with Chicago 25 area survivors of the Holocaust; and 26

27 WHEREAS, the students will have an interactive discussion with George Van 28

Dusen, Mayor of Skokie, the Honorable Harvey Schwartz, retired Circuit Court Judge and 29 former Skokie Corporation Counsel, and Bernie Schutz, a Holocaust survivor, in relation to 30 a neo-Nazi group’s efforts to parade in Skokie in the late 1970’s, the legal issues presented 31 at that time and the response of the community; and 32

WHEREAS, currently there are 16 Boards and Commissions in the Village whose 4 members are appointed by the Mayor and confirmed by the Board of Trustees; and 5

II, SECTION 118-32 PERTAINING TO RECOMMENDATIONS AND DETERMINATIONS BY THE PLAN COMMISSION

WHEREAS, Chapter 94 of the Skokie Village Code (the “Code”) provides for rules and 1 regulations governing the subdivision and dedication of land; and 2

WHEREAS, Section 118-32 of the Code provides for the regulation of 3 recommendations and determinations by the Plan Commission; and 4

WHEREAS, the Community Development staff (the “Staff”) initiated a comprehensive 5 review of Chapter 94, regulating subdivisions. After reviewing numerous subdivision 6 ordinances from municipalities around the country and the American Planning Association’s 7 recommendations for subdivision regulations, it was determined that the existing 8 requirements in Chapter 94 were lacking several key requirements and processes, such as: 9 guidelines regarding plats, the plat review and approval process by the Village, and the 10 information required to subdivide land and prepare a plat for recording; and 11

WHEREAS, subsequent to its review the Staff recommended to the Skokie Plan 12 Commission that the entire Chapter 94 be deleted and replaced with more comprehensive 13 language, which, in addition to the aforementioned requirements, would include references to 14 (i) the recently adopted Chapter 89 of the Code, pertaining to detailed requirements for street 15 names and address numbers within the Village and (ii) a Plat Guidelines Pamphlet to assist 16 surveyors with the plat preparation and the recording process; and 17

WHEREAS, Staff further recommended to the Plan Commission that Section 118-18 32(a)(9) be amended to give authority to the Plan Commission to make recommendations to 19 the Mayor and Board of Trustees to grant relief from lot size and dimensions as required in 20 Chapter 118 of the Code, when the development for which the subdivision was requested, 21 requires a planned development; and 22

WHEREAS, the Skokie Plan Commission, at a public meeting duly held on March 5, 23 2009, for which proper legal notice had been achieved and no interested parties appeared, 24 heard discussion and testimony from the Staff with regard to the proposed Chapter 94 25 language. In response to questions raised by the Commissioners, Staff responded as 26 follows: (i) that while many of the communities researched were experiencing rapid growth 27 and included design guidelines for large scale developments, Staff felt that a design 28 guidelines section were not appropriate in the proposed Chapter 94, as the main focus was to 29 regulate the platting of land and the preparation of the plat document and (ii) since Skokie had 30 developed in a grid pattern, encouraging future curvilinear development would reduce 31

thoroughfare connectivity, create more dead-end streets, and force the backs of houses to 1 front on some streets; and 2

WHEREAS, the Plan Commission voted to recommend to the Mayor and Board of 3 Trustees that Chapter 94 and Chapter 118, Article II, Section 118-32(a)(9) of the Skokie 4 Village Code be amended in accordance with the Staff recommendations; and 5

WHEREAS, the Mayor and Board of Trustees at a public meeting duly held on May 6 18, 2009, concurred in the aforesaid recommendations of the Skokie Plan Commission; 7

NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Board of Trustees of the 8 Village of Skokie, Cook County, Illinois; 9

Section 1: That Chapter 94, of the Skokie Village Code be and the same is hereby 10 amended in the manner hereinafter indicated. The new material is highlighted in bold and 11 the material to be deleted is highlighted and stricken through. 12

Chapter 94 SUBDIVISIONS 13

Sec. 94-1. Plat approval. 14

Any person subdividing any tract of land, parcel, or lot of record or any part thereof in the 15 Village shall provide a plat thereof and, before recording the plat in the County Recorder's 16 Office as provided by law, shall submit it, with a duplicate thereof, to the Board of Trustees for 17 approval or rejection. If approved, such approval shall be certified thereon, and signed by the 18 Mayor and Village Engineer and attested by the Clerk, and no such plat shall be valid or 19 entitled to recording until it shall have been approved as required by this section. 20

Sec. 94-2. Plat requirements; monuments. 22

The plat required by Section 94-1 shall be drawn to a common engineering scale and shall 23 show all lot lines and right-of-way lines, as well as all monuments, existing and proposed, and 24 other features required by the Village. One permanent monument shall be placed at each 25 corner of each lot and of the entire subdivision. 26

Sec. 94-3. Installation of improvements. 28

No plat of subdivision shall be approved unless all streets and sidewalk pavements and water 29 and sewer mains have been installed or provision has been made to ensure such installation 30 in compliance with the codes, ordinances and rules and regulations of the Village. 31

No plat of subdivision shall be approved unless every lot thereon shall comply with the Zoning 1 Ordinance (Chapter 118). 2

Sec. 94-5. Certified survey required; filing of copies of plat; approval of improvements; 4 submission of as-built drawings. 5

No plat of subdivision shall be approved until the plat shall have been properly certified by a 6 surveyor and acknowledged by the owner as provided by statute. The duplicate of such plat 7 shall be kept on file with the Village. All improvements must meet the approval of the Village 8 Manager or designee. As-built drawings shall be submitted to the Village Manager or 9 designee. 10

Sec. 94-6. Payment of taxes and assessments prerequisite to recording of plat. 13

All taxes and assessments on property platted must be paid before the plat shall be recorded, 14 as provided by law. 15

Sec. 94-7. Water, sewer and street improvements. 17

No plat of subdivision shall be approved by the Mayor and Board of Trustees unless provision 18 has been made to ensure installation of water and sewer connections to the lots therein 19 provided and to ensure paving of streets and alleys, installation of sidewalks, and a way for 20 public service facilities, all in compliance with Village codes, ordinances, and rules and 21 regulations. 22

Sec. 94-8. Deposit for cost of street signs. 25

Sec. 94-9. Deposit for costs of streetlights. 2

Sec. 94-10. Public utilities. 12

(a) All public utility distribution lines shall be placed in easements and be underground. 13 Installation of such facilities shall be made in compliance with the applicable orders, rules and 14 regulations of the Illinois Commerce Commission, now and hereafter effective. The owner 15 shall be responsible for compliance with rules and regulations, now and hereafter effective, 16 and filed with said Commission pursuant to the Illinois Public Utilities Act, of any public utility 17 whose service will be required for the building with respect to the provision of such facilities. 18

(b) All utility lines and facilities for water and sewer shall be placed in appropriate 19 easements and entirely underground. 20

(c) Overhead utilities directly serving the subdivision that cross a public right-of-way 21 adjacent to the site shall be placed or relocated underground on the opposite side of said 22 right-of-way. Accommodation shall be made on-site for transformers or other devices 23 necessary to make these improvements. 24

(d) Underground public utility distribution lines, including conduits and cables, shall be 25 placed within easements or dedicated public ways in a manner which will not conflict with 26 other underground services. All utility structures shall be located so as not to be unsightly or 27 hazardous to the public. 28

(e) When a subdivision in an R-1 Single Family or R-2 Single Family residential district is 29 less than 4 lots and is for the purpose of construction of single family residences, or when a 30 lot that is created by the subdivision that contains an existing single family residence, existing 31 overhead utilities are exempt from this requirement for lots containing those residences, 32 except that service from the distribution lines to the residence for all new residences shall be 33 placed underground. 34

2 Sec. 94-1. Title. 3 4

This chapter shall hereafter be known, cited, and referred to as the Skokie 5 Subdivision Ordinance. 6 7 Sec. 94-2. Purpose. 8 9

This chapter prescribes rules and regulations governing the subdivision and 10 dedication of land. These regulations are intended to further the orderly layout of 11 land within the Village of Skokie. 12 13 Sec. 94-3. Jurisdiction. 14 15

The regulations contained in this chapter shall apply to all proposed 16 subdivisions of land located within the corporate limits of the Village of Skokie and 17 all proposed subdivisions within unincorporated Cook County lying within the 18 planning jurisdiction of the Village of Skokie (1.5 miles from the corporate 19 boundaries). If the unincorporated land is within 1.5 miles of both the Village of 20 Skokie and another incorporated municipality, the jurisdictional boundary line shall 21 be considered to be a line agreed to by both municipalities, pursuant to , pursuant to 22 65 ILCS 11-12-9. If no such agreement exists, unincorporated areas within 1.5 miles 23 of the corporate boundaries of the Village of Skokie shall be within the jurisdiction of 24 this chapter up to a median line equidistant from the boundaries of the Village of 25 Skokie and the nearest corporate authority. All subdivisions of land within the above 26 area of jurisdiction shall require a subdivision under the regulations provided within 27 this chapter. Additionally, individuals applying for occupancy permits in conjunction 28 with building permits, and applicants for Zoning Board of Appeals and Plan 29 Commission hearings shall be required to subdivide their property into 1 lot of 30 record if their subject site encompasses parcels which happen to lie within multiple 31 existing subdivisions. 32 33 Sec. 94-4. Interpretation and Severability. 34 35 (a) Interpretation. The provisions of this chapter shall be held to be the minimum 36

requirements for the promotion of the public health, safety, general welfare, 37 and the purposes provided above. Where the conditions imposed by any 38 provisions of this chapter upon the subdivision of land are either more 39 restrictive or less restrictive than comparable conditions imposed by any 40 other provisions of these regulations or of any other applicable law, ordinance, 41 rule, or regulation of any kind, the regulations that are more restrictive and 42 impose higher standards or regulations shall govern. 43

44 (b) Severability. The provisions of this chapter shall be severable in accordance 45

(1) If any court of competent jurisdiction shall adjudge any provision of this 1 chapter to be invalid, such judgment shall not affect any other provision 2 of this chapter not specifically included in said judgment. 3

4 (2) If any court of competent jurisdiction shall adjudge invalid the 5

application of any provision of this chapter to a particular subdivision of 6 land, such judgment shall not affect the application of said provision to 7 any other subdivision of land not specifically included in said judgment. 8

9 Sec. 94-5. Enforcement and Filing Fees. 10 11 (a) Enforcement. No plat of subdivision shall be approved which does not comply 12

with all the provisions of these regulations unless relief is granted in 13 accordance with Section 94-13. No land shall be considered subdivided until 14 the subdivision is approved by the Mayor and Board of Trustees and filed with 15 and recorded by the Cook County Recorder of Deeds. No owner or agent of 16 the owner of any parcel of land located in a proposed subdivision shall 17 transfer or sell any parcel before a plat of subdivision has been approved by 18 the Village. The subdivision of any lot or any parcel of land by the use of 19 metes and bounds description for the purpose of sale, transfer, or lease with 20 the intent of evading these regulations is prohibited. For the purposes of this 21 chapter, a proposed subdivision shall mean a draft of a plat of subdivision, 22 prepared by a licensed surveyor and submitted to the Village in support of a 23 petition for subdivision. 24

25 (b) Filing Fees. In order to cover the costs of plan examination, filing, 26

publications, recording and other expense incidental to the approval of a 27 subdivision, the petitioner shall pay a fee at the time of application for 28 approval of a plat, as specified in Section 46-251 of the Village Code. Each 29 separate common area and outlot shall be counted as an additional lot. All 30 petitioners filing for subdivisions shall also pay an additional fee to cover the 31 cost of recording the plat with Cook County. 32

33 (c) Certificate of Insurance. If work is to be performed on public property or if 34

public property is utilized or impacted during construction and or 35 development, the owner shall provide, or shall cause the developer and/or 36 contractor to provide, the Village of Skokie with a certificate of insurance 37 naming the Village of Skokie as additionally insured for any and all claims 38 related to any and all work. The owner shall hold, and shall cause the 39 developer and/or contractor to hold, the Village of Skokie harmless and 40 indemnify the Village for any and all claims for property damage or personal 41 injury related to work on or use of public property. 42

43 (d) Compliance. The petitioner shall comply with all Federal and State statutes, 44

laws, rules, and regulations and all Village codes, ordinances, rules, and 45 regulations. 46

(a) Rights-of-Way. 1 2

(1) Design and Arrangement. 3 4

a. All streets shall be properly interconnected and aligned with the 5 existing and proposed streets, alleys, and dedicated rights-of-6 way as established on the Village zoning map and the 7 Comprehensive Plan. 8

9 b. The existing rectangular gridiron street pattern shall be adhered 10

to for local and collector streets wherever practical, and the use 11 of curvilinear streets, cul-de-sacs, or U-shaped streets shall be 12 minimized, except where such use will result in a more desirable 13 layout to avoid existing obstructions. 14

(2) Width. All street rights-of-way shall be dedicated to a width that can 15 accommodate, where applicable, traffic lanes, bicycle lanes, turn lanes, 16 sidewalks, and streetscaping. The following table establishes the 17 minimum right-of-way width from right-of-way line to platted centerline, 18 in lineal feet, for streets within the Village of Skokie: 19

a. Rights-of-way terminating in cul-de-sacs and dead-end streets 1 shall provide pedestrian through-access at the dead-end to the 2 next street in the form of a dedication or easement, where 3 practical. 4

5 b. If a cul-de-sac or dead-end street is constructed without a water 6

main loop, the street shall not exceed 300 feet in length measured 7 along the street right-of-way centerline from the centerline of the 8 nearest cross street right-of-way to the edge of right-of-way 9 furthest from the nearest cross street right-of-way. A cul-de-sac 10 or dead-end street with water main loops present shall not 11 exceed 500 feet in length. 12

13 c. For subdivisions within residential zoning districts, the diameter 14

of a cul-de-sac turnaround shall not be less than 100 feet (as 15 measured at the right-of-way line). 16

17 d. For subdivisions not within residential zoning districts, the right-18

of-way diameter of a cul-de-sac turnaround shall not be less than 19 120 feet. 20

21 (4) Intersections. 22 23

a. Rights-of-way shall be laid out so as to intersect as nearly as 24 possible at right angles. An intersection of new streets at an 25 angle of less than 75 degrees shall be prohibited. 26

b. No more than 2 streets (4 corners) shall intersect at any 1 point. 27 Where possible, rights-of-way shall be laid out so as to contain 28 no more than 4 corners. 29

30 c. New rights-of-way shall be aligned with or be located more than 31

200 feet from an existing intersection. Where right-of-way 32 centerlines intersect arterial rights-of-way, their alignment shall 33 be continuous. 34

35 (5) Alleys. 36

37 a. Alleys wholly within single-family residential zoning districts 38

shall be 16 feet wide. All other alleys shall be 20 feet wide. 39 40

b. Blocks shall be laid out so as to enable the alignment of alley 41 rights-of-way with existing alley rights-of-way in adjacent blocks. 42

43 c. Dead-end alleys are prohibited. 44 45 d. In residential zoning districts where “T” or “L” alleys are 46

necessary or already present, an additional triangular area 10 feet 47 back from each alley corner shall be dedicated to make the turn 48 more accessible and create a sight distance triangle. 49

1 e. In districts not zoned residential, a triangular area 15 feet back 2

shall be required to be dedicated where “T” or “L” alleys are 3 necessary or already present. 4

5 (b) Easements. 6

7 (1) When required, utility easements (private and municipal) shall wherever 8

possible be centered on rear or side lot lines and be at least 20 feet wide 9 in order to provide adequate access. 10 11

(2) Proper coordination shall be established between the petitioner and the 12 applicable utility companies for the establishment of utility easements. 13

14 (c) Blocks. 15

16 (1) Block orientation and shape shall, where possible, adhere to the 17

existing grid system. 18 19 (2) Blocks shall have sufficient width to provide for 2 tiers of lots of 20

appropriate depths. Exceptions to this prescribed block width shall be 21 permitted in blocks adjacent to arterials, railroads or waterways. 22

23 (3) Blocks shall be oriented to maximize solar exposure. 24 25 (4) The lengths, widths, and shapes of blocks shall be appropriate for the 26

locality and the type of development contemplated; however the 27 maximum length of a residentially-zoned block shall be 600 feet as 28 measured along the longest block face, including any gaps created by 29 openings for alley rights-of-way. Non-residentially-zoned blocks shall 30 not exceed 1300 feet in length as measured along the longest block 31 face, including any gaps created by openings for alley rights-of-way. 32

33 (5) A 10-foot wide right-of-way dedication for pathway purposes shall be 34

required through the center of blocks more than 800 feet long. Pathway 35 dedications of a greater width may be required by Village staff where 36 deemed essential to provide circulation or access to schools, 37 playgrounds, shopping centers, transportation, or other community 38 facilities. 39

40 (d) Lots. 41 42

(1) The size, shape, and orientation of lots shall be appropriate for the 43 location of the subdivision and for the type of development and use 44 contemplated. Lot dimensions shall conform to the requirements of 45 Article III of the Zoning Chapter. 46

(2) Every lot shall front on or abut a public right-of-way, or provide a 1 permanent easement to permit ingress and egress to lots not abutting 2 the right-of-way. 3

4 (3) Through lots shall be avoided, except where necessary to overcome 5

specific disadvantages created by existing block orientation. 6 7

(e) Subdivisions Created by Successive Divisions. 8 9 (1) Whenever a parcel of land is subdivided into lots containing 1 or more 10

acres, and there are indications that such lots will eventually be 11 subdivided into smaller building sites, the Plan Commission may 12 require that such parcel of land be divided so as to allow for the future 13 opening of streets and the ultimate extension of adjacent streets. 14 Easements providing for the future opening and extension of such 15 streets may be made a requirement of the plat. 16

17 Sec. 94-7. Required Improvements. 18 19 (a) Installation of Improvements. No plat of subdivision shall be approved for the 20

issuance of building permits unless all street and sidewalk pavements, water 21 and sewer mains, street lighting, and parkway trees have been installed or 22 provisions have been made to ensure such installation in compliance with the 23 codes, ordinances and rules and regulations of the Village. A cash bond shall 24 be posted with the Village for 110% of the cost of the required work. 25

26 (b) Public Utilities. All plats of subdivision shall be laid out so as to adhere to the 27

procedure statement for Underground Utility Placement, available for viewing 28 in the Community Development Department. 29

30 (c) Flood Plain Regulations. It shall be the responsibility of the developer to hire 31

an appropriate consultant to determine whether any portion of a proposed 32 subdivision is located within a wetland, flood plain, or flood hazard area, and if 33 so, to stake, survey, and include any such locations on the plat of subdivision. 34

35 Sec. 94-8. Address Numbers and Street Names. 36 37

No plat of subdivision shall be approved until the plat is properly certified by a 1 surveyor and acknowledged by the owner. The duplicate of such plat shall be kept 2 on file with the Village. 3

4 Sec. 94-11. Payment of taxes and assessments prerequisite to recording of a plat. 5

All taxes and assessments on property platted must be paid before the plat 7 shall be recorded, as provided by law. 8 9 Sec. 94-12. Amendments to a Plat. 10 11 (a) Vacation of a Subdivision. Any plat of subdivision or any part of a plat may be 12 vacated by the owner at any time before the sale of any lot therein, by a plat of 13 vacation of the subdivision, to which a copy of the original plat of subdivision shall 14 be attached, declaring the same to be vacated. The plat of vacation shall be 15 approved by the Plan Commission and Mayor and Board of Trustees as required by 16 this chapter. The Mayor and Board of Trustees may reject any such plat of vacation, 17 which abridges or destroys any public rights in any of its streets or alleys. The plat of 18 vacation shall be executed, acknowledged or approved, and recorded or filed in the 19 same manner as the plat of subdivision; and being duly recorded or filed, shall 20 operate to destroy the force and effect of the recording of the plat so vacated, and to 21 divest all public rights in the streets, alleys, and public grounds, and all dedications 22 laid out or described in such plat. 23 24 (b) Certificate of Correction. Any plat of subdivision may have errors corrected 25 after recording by submitting a Certificate of Correction prepared by a surveyor. The 26 Certificate of Correction shall only contain the correction of errors noticed after the 27 recording of the Plat and shall in no instances contain intentional modifications to 28 the plat no matter how minor. The Mayor and Board of Trustees shall have the 29 authority to approve or reject the Certificate of Correction. The Certificate of 30 Correction shall be executed, acknowledged or approved, and recorded or filed in 31 like manner as the Plat of Subdivision. 32

33 Sec. 94-13. Relief. 34 35 At the request of a petitioner, the Plan Commission shall after a public hearing 36 make recommendations to the Mayor and Board of Trustees on relief of subdivision 37 layout requirements for sites 4 acres or greater. A RESOLUTION APPROVING AN AGREEMENT WITH THE 3

METROPOLITAN WATER RECLAMATION DISTRICT OF GREATER 4

CHICAGO AND EVANSTON SUBARU PERTAINING TO A MANHOLE AT 5

3350-3400 OAKTON STREET, SKOKIE, ILLINOIS 6 7

WHEREAS, Village of Skokie Ordinance Number 05-4-Z-3353 granted site plan approval 8 for a planned development at 3350-3400 Oakton Street, Skokie, Illinois, to Evanston Subaru for 9 the establishment and operation of a motor vehicle sales facility; and 10

WHEREAS, the site plan approval required the upgrade of the storm water detention and 11 control facilities of the development to meet Village of Skokie standards; and 12

WHEREAS, the storm water system for this development connects directly to a 20 inch 13 interceptor sewer owned by the Metropolitan Water Reclamation District of Greater Chicago (the 14 “MWRD”), which necessitated the building of a manhole (the “Structure”) above the sewer 15 adjacent to the connection; and 16

WHEREAS, Evanston Subaru completed all work on the storm water system, the 17 connection to MWRD’s sewer and the manhole at its own expense; and 18

WHEREAS, a condition of MWRD Permit 08-050 requires both co-permitees, (i) the owner 19 of the property upon which the development is established, technically a land trust with Evanston 20 Subaru as the beneficial owner, and (ii) the Village of Skokie, to convey all rights, title and interest in 21 the Structure to the MWRD; and 22

WHEREAS, there is no benefit to the Village in retaining ownership of the manhole because 23 the storm water system does not connect to any Village infrastructure and is located on Cook 24 County public right of way; and 25

WHEREAS, this agreement fulfills the Village’s obligation and conveys all rights, title and 26 interest in the Structure to MWRD. All maintenance, upkeep and replacements of the Structure are 27 the responsibility of MWRD; and 28

WHEREAS, the Senior Civil Engineer and Corporation Counsel recommended to the Mayor 29 and Board of Trustees that the Structure Assignment Agreement for the conveyance of rights, title 30 and interest in the Structure to MWRD, located at 3350-3400 Oakton Street, be approved, 31 substantially in the form attached hereto and marked as Exhibit “1”, subject to changes approved by 32 the Village Manager or designee and the Corporation Counsel of the Village of Skokie; 33

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the Village 34 of Skokie, Cook County, Illinois that the Village of Skokie is hereby authorized to enter into the 35 Structure Assignment Agreement with MWRD, a copy of which is attached hereto, and hereby 36 made a part of this Resolution or as changed with the approval of the Corporation Counsel of the 37 Village of Skokie. 38

PERTAINING TO WATER RATES

WHEREAS, Chapter 46, Article VI, Section 46-193 of the Skokie Village Code 1 establishes the water rates for customers of the Village water service; and 2

WHEREAS, the Mayor and Board of Trustees have determined that water rates be 3 adjusted annually, if necessary; and 4

WHEREAS, the City of Evanston is increasing the amount it charges the Village of 5 Skokie for water by 2.0% and the Village of Skokie is facing additional inflationary increase in 6 other Water Fund expenditures; and 7

WHEREAS, in light of the aforementioned increase and an adjustment in expected 8 pumpage, the cost of delivering water services is projected to increase 9.73% in FY2010, 9 from $26.40 per thousand cubic feet to $28.97 per thousand cubic feet. This increase will 10 equate to an average $3.03 per month; and 11

WHEREAS, the Director of Finance and the Village Manager recommended to the 12 Mayor and Board of Trustees that water rates provided for in Chapter 46, Article VI, Section 13 46-193 of the Skokie Village Code be increased by 9.73%; and 14

WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on May 6, 15 2009, considered and reviewed the increases to the Water Fund expenditures and the need 16 to increase the water rate to $28.97 per thousand cubic feet as part of the first hearing for the 17 FY10 budget; and 18

WHEREAS, the increase in water rates will be phased in through October 2009 due to 19 the nature of the bills being issued on a quarterly basis; 20

NOW, THEREFORE, BE IT ORDAINED, by the Mayor and Board of Trustees of the 21 Village of Skokie, Cook County, Illinois; 22

AN ORDINANCE DETERMINING THE PREVAILING RATE OF WAGES PURSUANT TO THE PREVAILING WAGE STATUTE

WHEREAS, the State of Illinois has enacted "An Act regulating wages of laborers, 1 mechanics and other workers employed in any public works by the State, county, city or any 2 public body or any political subdivision or by anyone under contract for public works," approved 3 June 26, 1941, as amended, 820 ILCS, 130/0.01 et seq. (2006) (hereinafter the “Act”); and 4

WHEREAS, the Act requires that the Village of Skokie, Cook County, Illinois, investigate 5 and ascertain the general prevailing rate of hourly wages as defined in the Act for laborers, 6 mechanics and other workers in the locality of the Village; and 7

WHEREAS, the Act allows municipalities to rely on the determinations of the Illinois 8 Department of Labor in relation to its ascertainment of the general prevailing rate of hourly wages 9 and the Department has ascertained the pertinent rates; and 10

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the 11 Village of Skokie, Cook County, Illinois: 12

Section 1: To the extent and as required by "An Act regulating wages of laborers, 13 mechanics and other workers employed in any public works by State, county, city or any public 14 body or any political subdivision or by any one under contract for public works," approved June 15 26, 1941, as amended, the general prevailing rate of wages in this locality for laborers, mechanics 16 and other workers engaged in construction of public works coming under the jurisdiction of the 17 Village of Skokie is hereby ascertained to be the same as the prevailing rate of wages for 18 construction work in the Cook County area as determined by the Department of Labor of the State 19 of Illinois as of June 2009, a copy of that determination being attached hereto and incorporated 20 herein by reference. As required by said Act, any and all revisions of the prevailing rate of wages 21 by the Department of Labor of the State of Illinois shall supersede the Department's June 2009 22 determination and apply to any and all public works construction undertaken by the Village of 23 Skokie. The definition of any terms appearing in this Ordinance which are also used in the 24 aforesaid act shall be the same as in said Act. 25

Section 2: Nothing herein contained shall be construed to apply said general 26 prevailing rate of wages as herein ascertained to any work or employment except public works 27 construction of the Village of Skokie to the extent required by the aforesaid Act. 28

Section 3: The Village Clerk shall publicly post or keep available for inspection by any 29 interested party in the main office of the Village of Skokie this determination or any revisions of 30 such prevailing rate of wages. A copy of this determination or of the current revised determination 31 of prevailing rate of wages then in effect shall be attached to all contract specifications. A copy of 32 the prevailing wage schedule effective June 1, 2009, is attached hereto, marked Exhibit "1", and 33 hereby made a part of this Ordinance. 34

Home Health Care Agencies

General Information Petitioner Village of Skokie Planning Division

Purpose To add home health care agencies as a specific use under Health and Human Services in Appendix A of Chapter 118 of the Skokie Village Code and any other regulations that may need to be amended as a result of this request.

STAFF ANALYSIS The Planning Division requests a review of home health care agencies and to add them as a specific use under Health and Human Services in Appendix A. The American Planning Association’s Land-Based Classification System (LBCS) lists these along with in-home hospice agencies, doula offices, and midwifery, and other similar uses as medical and diagnostic laboratories, which have a very low parking ratio of 1.5 spaces per 1000 ft2 of gross floor area. Acknowledging that in practice these uses are very different, Community Development has been classifying the use as “office and administrative services” or “office, not otherwise listed” on certificates of occupancy. With a very large increase in the number of these agencies recently (there are now 55 in Skokie), Staff felt that it is necessary to address the land use issue and establish a separate parking requirement. Currently, both “office and administrative services” and “office, not otherwise listed” are permitted uses off retail streets in NX, TX, CX as well as in B1, B2, B3, B4, M1, M2, M3, and OR and are restricted in B6 only to science and technology related uses. These uses are not allowed in H1. Staff recommends adding a new category, home hospice and health care agencies, in similar zones, except not in B6 (Downtown Science and Technology) and adding H1 (Hospital). Staff also looked at parking demand for these uses. Most of the time, parking demand is very low since most employees work off-site in the field. However, infrequently, on-site meetings are held that create a temporary spike in parking demand beyond typical office parking, similar to realtor offices or other uses with field staff. The Village has never received a complaint about these temporary parking overflows. Staff recommends establishing the parking requirements at 3.0 parking spaces for each 1,000 feet2 of gross floor area similar to other health care related office uses.

The Community Development Department is continuing its alley vacation program that was started in 2002 to vacate unopened and unimproved residential alleys in the Village that are unnecessary for Village transportation and access needs. In this request, the north/south alley adjacent to 9435, 9441, 9445, and 9451 Kenneth Avenue; 9436, 9444, and 9450 Kostner Avenue; and 4401 and 4425 Foster Street is being considered for vacation. The southern half of the alley was vacated per case 2006-9P. At that time, the northern half of the alley was left open due to the presence of a garage located at 9435 Kenneth Avenue that had access to the alley. Staff has since been notified by the property owner at 9435 Kenneth Avenue that the garage is no longer being used for vehicular storage. The Plan Commission concurred with Staff’s recommendation to vacate the alley. INTERESTED PARTIES Legal notice was properly posted, advertised and delivered to property owners in the area of the subject site as prescribed by the zoning chapter. No interested parties spoke on the subject case. Division. All other departments either had no comment or were in favor of the proposed vacation. Engineering Division The Engineering Division approves the granting of the requested alley vacation as long as an easement for the full width of the alley is provided to accommodate existing overhead utilities. Planning Division The Planning Division staff supports the proposed alley vacation. There are many similar unopened and unused alleys within the Village of Skokie. This alley was dedicated along with the original subdivisions back in the 1920s but was not improved when the homes were constructed. Although it is still Village property and may contain utilities, the Village has no intent to open or pave the alley. Thus, the Village has a program to vacate this alley and return the property to the adjacent property owners. In many cases adjacent property owners, perhaps unaware that this alley exists, may have assumed use and maintenance of this land. It is therefore in the best interest of residents and the Village to have this alley vacated at no cost to the adjacent property owners. When the alley is vacated, a utility easement over the entire right-of-way will remain so that utility companies can maintain their existing facilities. The vacated alley will be divided down the middle and transferred to the adjacent properties. The alley’s approximate southern boundary in the subject case has been marked with pink wooden stakes along Foster Street. Once the alley is vacated, the adjacent property owners will be sent a copy of the Plat of Vacation. When the property owners sell their property, their surveyor will prepare a new Plat of Survey indicating the additional land that has been added to the property. Residents may use the additional land as they would any other part of their property, with the exception that structures other than fences may not be constructed in the easement area, and this space must always be maintained for unobstructed drainage. Chapter 5 of the Comprehensive Plan supports the vacation of this alley. This alley represents group number 34 of the 127 alley groups identified for vacation in the Alley Plan. To date, 87 of the 127 alley groups identified have been vacated. STAFF RECOMMENDATIONS Staff recommends that the proposed alley vacation be GRANTED subject to the following conditions: 1. Easements shall be reserved for all Village and Village franchised public utilities over

the entire area to be vacated. A permanent public drainage easement shall be maintained in the vacated alley.

2. Property owners shall not alter the grade or change the drainage pattern in the easement area without a permit from the Engineering Division.

3. Other than a fence, no structures or trees shall be constructed or planted within the easement area.

4. The vacation shall be effective upon the recording of a Plat of Vacation by the Village in the Office of the Recorder of Deeds of Cook County, Illinois.
