FROM THE PRESIDENTNeighbors, !The MCA and ACCC have received many complaints from residents regarding the decaying leaves left in the curbs and streets around some Montpelier homes. The leaves in the street are hazardous and unsightly. The MCA looked into hiring a private leaf vacuum service, but the cost to the community at that time was approximately $5,000. It also seemed an unreasonable expenditure to many residents who had raked and bagged their leaves themselves or already paid someone for the service. The County is not bringing the Leaf Vacuum Program back and the MCA has been told that the vacuum equipment was sold. According to Susan Hubbard, Public Information Officer for the Department of Public Works and Transportation,: The Leaf Removal Program was very costly and was only available to 350 communities throughout the county. The program never grew beyond its original designated communities because there was never enough funding to do so. It was a Cadillac program that few communities received. It is understood that those communities that had it appreciated the benefits provided by the program, but it was not feasible to continue it. Folks still have a leaf removal program, they just have to rake the leaves and bag them for pick up or they can use them for composting. We still remove leaves in the roadways that could potentially block the storm drains. If folks are still raking leaves to the curb and leaving them there, we would appreciate being informed of the addresses so we could inform that what they are doing is basically illegal. [Environmental Resourses @ 301 8835810 or [email protected] ] We would then give them the opportunity to bag the leaves, and if not, they would be cited. If folks would stop raking leaves to the curb knowing that the program has been discontinued, then we would all have less leaves in the streets. However, we also know that there will always be some leaves in the streets at any given time. So, we all have to work together. We agree that the trees are County-owned along our Montpelier streets (also county-owned), but it is unlikely that the County has any plans, or money, to do anything about these leaves and the MCA has been told that it is the homeowners responsibility much like having to clear the sidewalks (Montpelier Drive residents!) after a snow storm. Please look around and see if you have leaves in the curb or street near your home. If so, please bag them for the County pick-up on Wednesdays or gather than for your compost. If you dont want to clean them yourself, check the listing of Helping Hands on page 26 of this newsletter. FROM YOUR NEIGHBORSJack and Jacqueline Bienko of Oxwell Lane are proud to welcome their first-born child, Samuel Joseph Bienko, to the neighborhood. Samuel was born at Holy Cross Hospital on March 28th and is the beloved grandson of Jack and Dolly J. (Maryland) and Jack/Nora/Juliette B. (New York). The Goerling Clan on Radnor Lane would like to announce three graduations! Our daughter Genevieve is graduating with a Masters of Letters in Archaeological Studies from the University of Glasgow, Scotland. Our son Sean is graduating with a Bachelors of Arts in Computer Science from Saint Mary's College of Maryland. Our son Walter is graduating from Mount Saint Joseph High School. Our daughters, Cynthia Riordan Barbour and Beth Riordan Ismail, ran in the New York Marathon this past November. They were so pleased to finish the race (26 miles) even though they were a little tired. This past April, Cynthia ran in the Washington Cherry Blossom Race with her daughter Emily . They finished. Our grandson, Ben Janac, will be graduating in June. Ben was selected for the Science, Technology, Engineering, and Mathematics (STEM) Program. Ben got a Trustee Merit Scholarship for the 4 years of high school (as long as he keeps a certain GPA). This past March and April Ben competed in the 2011 Maryland Science Olympiad Regional and State Tournaments. Kathy and Les Riordan Royal Ridge Lane My daughter-in-law, Izolda Trakhtenberg, married to Rich Potter, the Clown and Entertainer, just published her second book and recently had a book party at the Laurel Women's Club. Izolda explored the idea of a modern-day fairy godmother complete with flaws and her own issues that can't be fixed with the wave of a magic wand in her humorous fantasy, "The Fiddler's Talisman." Montpelier Community Association, Inc.Board of Trustees Meeting MinutesFebruary 8, 2011 Trustees in Attendance: Paul Buehler, Richard Dengler, Bob Derrick, Patricia Douville, Lillian Fazio, Tony Fleming, Tim Jacobs and Jack Keating. Trustees Absent with Cause: Dave Eisenberg Community Members Present: Michael Boddie, Mary Derrick, Richard Fazio, Bruce Shaper and Mary Hughes President B. Derrick called the meeting to order at 7:06 PM. There was a quorum to conduct business. Secretarys Report: Tricia Douville The minutes of the January 2011 board meeting were reviewed and amended. Trustee Dengler made a motion to accept the amended minutes. Trustee Douville seconded the motion and it passed unanimously. Treasurers Report: Lillian Fazio The treasurer reported that 108 assessments have been received and they are steadily coming in. The contract for the audit needs to be signed. A compilation will cost $1,600 for each year, 2009 and 2010. Income tax records will be given to the accountant. Trustee Fazio met with the accountant for instruction of a new accounting method for reserve fund expenditures. The cost was $100. Trustee Keating asked that the balance sheet show the exact amount of money from assessment deposits. In addition, the accountant will be asked why the assessments arent on the accounts receivable. The accountant is shifting from a cash basis to an accrual basis. ACCC: Michael Boddie, Chairperson Trustee Keating reported that the complaint against the homeowner for providing food to the vultures was closed and no fine imposed. She purchased new trash cans and was not feeding the vultures and no one provided proof to the ACCC to the contrary. The committee is preparing an article for the newsletter, a letter to be sent to Eastbourne Lane neighbors and a letter to the homeowner. Trustee Fleming suggested that a USDA representative be invited to a board or ACCC meeting to discuss vulture issues. Trustee Douville asked for a copy of the letter being sent to Eastbourne neighbors. Mr. Boddie thanked board members for attending ACCC meetings. The signed guidelines were given to the board. The board received a letter complaining about leaves left in gutters along the street. The county can issue fines and complaints can be lodged with the Department of Environmental Resources for the county, but the ACCC does not feel that they have jurisdiction.

Trustee Fleming read the covenant regarding easements and suggested that there were options available to the association. While doing their surveys, the ACCC was asked to note addresses where leaves have been left in the gutters and the MCA Secretary will send out letters. Communications Committee: Tim Jacobs, Chairperson The Groupsite is still free and all other receipts have been turned in and the chairperson has been reimbursed. Trustee Fleming updated the website. He suggested other changes including an electronic resale package which could be purchased through Paypal. Web advertising was also discussed. Trustee Fleming has set up a small ad space which can change every time a page is refreshed. Various tracking options are available and could be provided to advertisers. Our regular advertisers and members will be given the first opportunity to advertise on the space, but to iron out any problems the first offer will be free. If all goes well, it will probably cost $30 per two month period. The social and swim team chairs will be trained on updating their pages on the website and a calendar will be added. Executive Committee: The Executive Committee met on January 30th along with Trustee Buehler to discuss the three bids for pool management. The Lighthouse option ($55,000) was chosen with the same coverage as last year during the high use period. During August and September there will be more flexibility in hours and staffing. Facilities Committee: Richard Dengler and David Eisenberg, Co-Chairpersons The committee members are: H. Bailey, D. Eisenberg, R. Dengler, P. Pettit, B. Jacobs, G. Hynes, P. Stainer, and C. Truesdale. Trustee Keating made a motion to accept the members of the Facilities Committee. Trustee Douville seconded the motion and it passed unanimously. Protocols will be provided. The committee met and discussed contracts from American Landscaping, Medina and Brickman. They recommended Brickman. Trustee Dengler made a motion to accept the 2011 Brickman contract for $4,697. The scope of work is the same as last years and back hill maintenance is included, and they will be asked to care for the hydroseeded grass. Dennis reported that the owner has secure trash cans and is not feeding the vultures. B. Dennis made a motion to send a letter to the owner to thank her for getting new trash cans and as she is not feeding the vultures, The meeting was called to order at 7:03 PM. J. pots. The property near the dumpster and pool parking lot need to be cleaned. It would be a good project for a volunteer day clean-up. The caution tape needs to be removed from the fence. Trustee Keating reported that the tennis court fence was discussed during the Executive Committee meeting. A suggestion was made to resurface three courts and turn the fourth court into a roller-hockey area. If money was saved it could be applied to a new fence. Trustee Fazio asked if the board had the authority to reduce the number of courts. As a contract was signed, she will discuss the changes with the contractor. Trustee Keating will check into any insurance issues or increased liability that might come from providing a sanctioned skate area. Fascia has fallen off areas of the pool buildings and quotes will be secured to fix it. Trustee Dengler needs the address of the homeowner whose fence was damaged by an MCA tree. The dumpster at the pool is being replaced.

Security Committee: Richard Dengler, Chairperson Trustee Dengler reported on increase in car thefts and thefts from autos in our vicinity. A neighborhood watch meeting is tentatively scheduled for February 23rd. Tennis Committee: Lillian Fazio, Chairperson The dead shrubbery needs to be removed. The wind screens will be put up now because the fence is not going to be replaced right now. Trustee Fazio will check into when the deposit on resurfacing is due. She was asked to check into revising the contract if one court is turned into a skate area. Governing Documents: Tony Fleming, Chairperson Trustee Fleming has corrected the errors in the scanned copy of the bylaws which are on the website. He obtained information from the last GDC chairperson, J. Witt, and will review those and proposed changes and try to simplify the bylaws as much as possible. He would like to have a members meeting in the summer to discuss any potential changes are transparent and understood by the community. OLD BUSINESS: M. Hughes will get with the treasurer to turn the billing of the 888 line over to the MCA. We still dont know how much to reimburse M. Segura. Trustee Keating has not received a response to his earlier inquiry about a gift to Deerfield. The MCA needs to have operating procedures on file. They will be turned over to the Secretary as they are finalized. Trustees Derrick and Keating will work on a Replacement Reserve Fund forecast.

Pool Committee: Paul Buehler, Chairperson Trustee Dengler made a motion to accept Trustee Buehler as pool chairperson. Trustee Jacobs seconded the motion and it passed unanimously. Trustee Dengler made a motion to accept M. Middlebusher, E. Brown de Colstoun, T. Forrey and P. Buehler as members of the pool committee. The motion was seconded and passed unanimously. Trustee Buehler reported that the swim team coach will not be returning because he wants more money. He asked if the MCA could subsidize or make a donation to the swim team. He will make a recommendation at the next meeting. Recycling is still at the pool and needs to be disposed of before the next meeting.

NEW BUSINESS Budget expenditures by committee chairs was clarified. Expenditures, except in the case of safety, must be planned in advance and then presented to the board. ACCC: Michael Boddie, Chairperson Trustee Keating reported that the request from the board for the ACCC to note houses where leaves remain in the streets was discussed, but one member said that he observed over 70 homes in his section. Many people believe that it is the Countys responsibility to remove the leaves in the street. Department of Environmental Services will be contacted to ask if it is the countys responsibility or homeowners. Communications Committee: Tim Jacobs, Chairperson The website design was discussed at the last meeting. Online advertising will be offered also. Trustee Fleming made a motion to accept the guidelines for online advertising ($30/two months beginning May 1, 280 x 120-350 pixels, 300 dpi resolution). Design services may be offered in the future. Trustee Dengler seconded the motion and it passed unanimously. Members may still advertise services on the list-serve twice a year free of charge. Boddie will monitor to see if the trailer was removed permanently. 9210 Twin Hill Lane Hold for response to request for proof of registration of covered vehicle. New Business: J. Keating reported that Montpelier Drive and Cedarbrook Lane have no trailers, RVs or stored/unregistered cars. T. Shrewsbury reported that Oxwell Lane had no new issues. P. Pettitt and D. Sowle reported no new issues in their respective sections. Homeowners are responsible for removing fallen trees and branches after a storm unless they are in the county right-of -way. The county should be notified if trees or branches need to be removed from their easement/right-of-way. All members present signed the ACCC guidelines. A copy will be given to the board. The next meeting of the ACCC will be Thursday, March 3, 2011 at 7:00 PM at Deerfield Community Center. The meeting adjourned at 8:07 PM.

Three bids on the soffit and fascia on the pool building: $950/Big Al to screw it back on or $1,800 to remove and replace it all; $1050/PG Builders to screw it back on or $1,450 for removing and replacing it all; $2600/Horizons will only remove and replace it all. Trustee Keating made a motion to accept PG Builders bid for $1450 (144 sq. feet) for all new soffit and fascia installation. Trustee Buehler seconded the motion and it passed unanimously. The fallen tree behind the pool has been removed and the fence fixed ($250). The caution tape will be removed. The broken swing had been fixed, but there is a new broken swing. Trustee Eisenberg will research parts and prices. Trustee Keating made a motion to accept the protocols and Trustee Jacobs seconded. The motion passed unanimously. Grasses need to be trimmed and plantings will be reviewed. Pool Committee: Paul Buehler, Chairperson Lighthouse will open the pool the first week of May. Trustee Buehler handed out a spreadsheet for various projects with some bids. The concrete around six to eight skimmer pads is cracked and needs to be replaced (bids ranged from $186 to $225 a piece); Wading pool leak needs to be fixed ($1250 to $3250) and the pump arrangement needs to be updated with a single pump ($9,500 to $16,470 for hair strainer, motor, impeller with spare motor). The pool committee needs to review the scope of work on the pump and whether a spare is a good idea. The skimmer pads and leak need to be repaired soon, so the committee will review and make a recommendation to the executive committee for approval. Trustee Buehler looked into a walk-in beach for the wading pool (only one bid so far at $19,165) and jet washes (one bid at $6,215) and a bucket dump water feature (one bid at $22,855). Some Board members considered these projects way too expensive while others felt it was reasonable. No motion was made to move forward on these last three projects. Tennis Committee: Lillian Fazio, Chairperson Three bids for lighting for two tennis courts were approximately $8900. Vote to light the courts was put off until other expenditures are discussed like new or painted fence for the tennis courts. Trustee Fleming made a motion to approve the tennis MONTPELIER TODAY 9

committee protocols. Trustee Douville seconded the motion and it passed unanimously. OLD BUSINESS: The water fountain hook-up needs to done for the fountain by the tennis courts. Trustee Keating spoke with someone regarding a gift for Deerfield Rec Ctnr. They have a list of ideas but have not offered any to MCA. If the tennis courts are reduced to three courts, it could safe $7,000 in the price of fencing. The lawyer would need to review the governing documents to see if reducing the number of courts would even be allowed. The hockey area was not recommended as the tennis court surface is too soft. There was a thought that our current Insurance would cover any activity on our premises but we would have to check with the insurance company to be sure. No action on this option was requested due to the desire to keep all 4 courts by many of the Board members. NEW BUSINESS Other projects discussed: Converting the flat roof on the guard shack to match the other pool buildings with a 4 foot overhang on the poolside. Estimated cost approximately $21,400. No request to get any more bids at this time. Wait to see what must be done with the pool and tennis courts. New play equipment for the playground and tire shreds will be discussed at the next meeting. Trustee Fleming made a motion to allow the Communications Committee to put a poll in the newsletter asking how members get the news (newsletter, list-serv, website) and all respondents will be entered in a raffle for a $25 gift certificate. Ms. Jan Townsend and Ms. Kelley Oklesson of the Neighborhood Design Center made a presentation on a pilot project to replace Bradford Pear Trees in the county. Montpelier was chosen as one of the first subdivisions considered for the project. The Bradford Pear presents many problems to the county due to inferior branching, shallow root system and invasiveness. Damage costs from fallen branches and trees, uprooted sidewalks, and damaged pipes and sewers, as well as safety concerns prompted the program. Dead, dying and high risk trees will be removed and replaced with a new flowering tree species. Community members may contact them to discuss their concerns and additional information will be posted on the web page. The next board meeting will be held on Tuesday, April 12, 2011 at 7:00 PM at Deerfield Recreation Center, preschool room. The motion was made and seconded to adjourn at 9:00 pm. ACCC REPORTMeeting of March 3, 2011 Committee Members Present: Michael Boddie, Toni Byrd, Brian Dennis, Jack Keating, Pauline Pettitt, Tim Shrewsbury and Diana Sowle. Committee Members Absent: Thomas Jaehnigen and Ron Lenart. Community Members Present: M. Hughes. The meeting was called to order at 7:06 PM. T. Shrewsbury made a motion to accept the February 2011 minutes. The motion was seconded by T. Byrd and passed unanimously

Old Business: 12203 Brittany Lane Hold for B. Dennis and D. Sowle visit with owner to discuss the hole on the side of the house. 12200 Cedarbrook Lane Owner removed broken split rail fence and requested information on hiring yard workers. Eastbourne Vulture Issue B. Dennis reported on conversations with neighbors and encouraged anyone concerned to call Wildlife Services (301-734-7921) to get their help. P. Pettitt reported that many houses in the area are still using white trash bags and cans without covers. She observed vultures tearing through these bags and trash. T. Byrd prepared a letter to be sent to Eastbourne Lane neighbors. It will be distributed to the committee for comments and then given to a board member for distribution. 8819 Gramercy Lane T. Shrewsbury will check on progress. It was reported that the trailer and cardboard in the windows was gone. 9302 Montpelier Drive J. Keating hand-delivered the certified letter (Notice of fine ($500) for proceeding without prior approval and removal of the oversized shed) and discussed removing snow from sidewalks. Hold for next meeting. 9300 Montpelier Drive J. Keating took care of the snow left on the sidewalks issue. 9314 Montpelier Drive Certified letter (Cease and Desist regarding the fence which is falling down in sections and the mold on the house siding) returned to sender. Repeated attempts have been made to notify the owner of the violations. T. Byrd made a motion to levy a $100 a month fine starting on April 1, 2011 and to invite the owner to attend the next meeting (April 7) to discuss the fine or compliance. The letter will be sent by priority mail. T. Shrewsbury seconded the motion and it passed unani-

Keating made a motion to approve the roof replacement. T. Byrd seconded the motion and it carried unanimously. The board requested that ACCC members note addresses where leaves remain in the streets and curbs while doing regular surveys. The board would like to send out letters asking that the leaves be picked up. A notice will also be put in the next newsletter reminding the community that leaving leaves in the street is unsafe for driving and walking and notifying owners that leaves and other debris should never be put in the storm drains. The committee discussed whether any house repairs could proceed without getting prior approval. According to the covenants, any alteration requires prior approval. The committee decided that replacing windows, siding or roofing with like kind and color was not an alteration and could proceed without approval. There was a request that all incoming mail be stamped with the arrival date. The committee was asked to suggest homes for the Countys Beautification Awards. The next meeting of the ACCC will be Thursday, April 7, 2011 at 7:00 PM at Deerfield Community Center. The meeting adjourned at 8:29 PM.

If a community member is absolutely opposed to having their trees removed and live on one of the streets in the list above, they should contact Kelley immediately. She is willing to discuss specific removals with residents, but if a tree is diseased, poses a safety risk , dead or dying then the tree will have to be removed. 8. Can I get a replacement tree for a Bradford Pear tree that has already died and been removed? The replacement supply is limited. All the removed will be replaced and some of the previously removed will be replaced. Due to limited supply, the program cannot guarantee replacements for old removals. done. 9. Is there any cost to the homeowners for removal of the Bradford Pear trees or their replacement? There is no cost to the homeowner for removal or replacement. The program is in place to hopefully lower future cost for removal or trimming of Bradford Pears by targeting the current dead, dying and high risk. Obviously the county must clean up fallen trees and limbs after storm events which is a very high cost due to inferior tree species like the Bradford Pear. Also the removal of the trees may decrease the chances of power outages due to fallen branches, thus reducing increases in electric bills. 10. What will happen to the stumps of the trees removed? MCA Pool Rules and RegulationsThe following rules and regulations have been established for the benefit, health and safety of all patrons of the pool facility. These will help provide enjoyable recreation for all members and their guests. Pool Management or the MCA Board of Trustees may institute new regulations at their discretion in the interest of safety. The following are not intended to be all inclusive:

All MCA Members should ensure their children and guests understand and observe all pool rules.1.

Please give the lifeguards and pool staff the respect they deserve. They are there for your protection and should never be considered babysitters. Children should not be left at the pool unsupervised. Parents and guardians are responsible for the behavior of their children. Members are responsible for the behavior of their guests. All children under age 8 must be continually supervised by an adult while at the pool. A parent or childcare provider must remain with children in the wading pool area at all times. Appropriate swimsuits are required in the pool. No street shorts or cut-offs are allowed. All swimmers are required to shower before entering the pool. Individuals who appear to present a health hazard (i.e. contagious diseases, infections, open cuts, bandaged wounds) will not be allowed to use the pool. Swim diapers are required for all children not completely toilet trained. No running, pushing, or horseplay in the pool area. Patrons will not use profanity or abusive language in the pool area. Spouting of water by mouth and similar unhygienic actions are not permitted. Swimmers may not sit, stand, hang, or play on pool ropes or lane lines. No glass or breakable containers are permitted in the pool facility. Bicycles must be parked in designated areas. Use of skateboards, scooters, roller blades and other like articles are prohibited in and around the pool area. Smoking is strictly prohibited in the pool area which includes the front gate and Food Pavilion. Food and beverages are allowed in designated areas. Patrons must deposit all trash in the proper receptacles. No diving into the pool except in the diving well. No floatation devices of any kind are permitted in the diving well. Flips off the pool edge are prohibited. Only one person allowed on the diving board at a time. Jump or dive straight out off the end of the diving board, not off the side. Divers must keep both their feet on the pool deck until the previous diver has reached the ladder. Swim directly to the ladder after going off the board. Do not swim to the wall.

Tipping, rocking or use of pool chairs for other than their intended use is prohibited. Patrons are responsible for any damage they cause by willful misuse of pool property. The MCA and Pool Management are not responsible for lost, stolen, or damaged personal property. The pool staff will hold found articles for two weeks before disposing. The pool will be open for all ages on the hour through 45 minutes past the hour. The last 15 minutes of each hour will be reserved for adults only swimming. Patrons must be at least 16 years old to use the pool during these periods. Under no circumstances shall a member or guest enter the water without a lifeguard on duty. No unauthorized entry into the gate office, guard room, or pump room is permitted. Patrons must obey all posted rules. The Pool Manager or Assistant Manager may close the pool at any time due to personal discretion, operational difficulties, or inclement weather. Pool Management has the right to discipline anyone that refuses to follow the rules and regulations of the pool facility. They have been given the authority by the MCA Board of Trustees to enforce these rules. No alcohol or drugs are allowed on the premises. Persons that appear to be under the influence of alcohol or drugs will not be allowed on the premises.

Guest Policy and Procedure:MCA members who are registered pool users, in good standing, may bring guests to the pool. A guest pass is required for any non-member age 6 and over entering the pool and is good for the entire day. 1. Guest passes must be purchased at the pool in groups of 5 for $25.00. Each pass is good for a one day pool admission. No single day passes will be sold. 2. No cash will be taken at the pool. Only checks from the MCA member with a valid picture ID (which includes their MCA address) will be accepted 3. All guests must be signed in and accompanied by the MCA member. 4. Guest passes do not expire and passes from previous years will be honored. The Bonus Guest Pass issued for paying your assessment by March 31, 2011 will expire at the end of the 2011 swim season.

Age Requirement for Admittance:(All results for proficiency swim tests must be registered with the Pool Manager.) 8 to 10 Years Old: Member children who have passed our pool proficiency swim test may be supervised at the pool by an adult or sibling age 13 and above, provided they too have passed our proficiency swim test. 11 to 15 Years Old: Member children may enter without adult supervision provided they have passed our pool proficiency swim test. Children who do not pass the swim test must be supervised by a member 13 or older, who has passed the proficiency swim test.

Swim Team is not the place for children who do not know how to swim but a basic, beginner swimmer who passes the test will have plenty of opportunity to improve and learn new skills. The test, treading water for 1 minute and swimming across the well, will be administered by the Coaches. For our younger swimmers who meet these requirements, an evaluation should be coordinated with the coach.

Registration: Three days of registration from Tuesday, May 31 to June 2, 6:30-8pm, at our community pool on Cedarbrook Lane. The homeowner requesting approval of a project (requester) will contact the neighbor(s) residing on each side of his home to obtain their concurrence or comments. In the event the requester resides on a corner lot, the neighbor residing adjacent to his rear property line must be contacted. The neighbors residing across the street must also be contacted if the project, when completed, can be seen from their property. ACCC POLICY ON COVERED VEHICLESAlthough the MCA Covenants state in Article IV Uses: Section 5. Parking/Storing of Vehicles and Boats No Passenger Vehicles, Camping Trailers or Commercial Vehicles shall be stored on any Lot except in the garage or carport the ACCC has struggled with the definition of parking versus stored. Several years ago, the ACCC decided that an unregistered car was stored while a registered car was parked and began to ask for proof of registration of cars under cover in order to enforce the covenant.
