Any court reporter who has been practicing more than a second knows the paralegal is their best friend in the law office. The paralegal is the engine of the lawyer’s practice and is the person who makes everything run smoothly. Working with court reporters is routine in most law offices. The ultimate objective of both the paralegal and court reporter is to have a deposition scheduled, conducted, and transcript delivered without any hitches. Therefore, a good working relationship is vital. Having a long-term working relationship between a paralegal and a court reporter can be like an old married couple; one person knows what the other needs without even having to talk about it. One way to have a great working relationship is knowing what the other needs to get their part of the work completed in the desired fashion. Communication is essential.

When the paralegal calls to schedule a deposition, have as much information as you possibly can get from the lawyer. This would include if the transcript is going to be needed in an expedited fashion, will a videographer be required, will realtime hookups be needed. Knowing when the transcript is needed is extremely important. This information helps the reporter know if they can schedule that deposition themselves or if they need to get another reporter to take it in order to accommodate the request. As soon as the deposition is scheduled, the court reporter needs the Notice as soon as possible. If a deposition is going to be of a technical nature and particularly if it is going to be an expedited transcript, having a word list of the technical vocabulary is incredibly helpful to the reporter. This assists them in producing the transcript more quickly. Finally, if there are any changes in the scheduling of the transcript (cancellation, change of time and/or location), let the reporter know as quickly as possible. Exchanging all this information up front reduces the chances of missteps and confusion and helps get the transcript delivered more expeditiously.

Court reporters should immediately provide to the paralegals all of their contact information (office and cell phone numbers, e-mail, mailing address). Request the reporter call the day before the deposition to confirm everything is still on as scheduled. Expect the reporter to return calls promptly and be professional. If the paralegal requires some other information, do not hesitate to ask.

The paralegal and the court reporter truly are a team. A good working rapport and communication are vital in accomplishing the ultimate goal of getting a transcript to the lawyer in a timely and professional manner.

Scott was a practicing court reporter until taking over the business from his father, Stuart S. Huseby, in 2001. Other members of The Huseby Family of Reporting Professionals who were involved in the start of the business are Scott’s wife, Joye Huseby; Scott’s brother, Steve Huseby (who is still practicing in Atlanta), and Steve’s wife, Slone Huseby.

5. If you provide multiple services, which service generates the most business for your company? Court reporting and videography are the bread & butter of Huseby, Inc.

Traditionally, Huseby, Inc. has not provided anything with deliveries since our clients are all over the country. This has changed this year when we started sending small marketing items out with our final transcripts. So far, we have sent reusable shopping bags in response to our attempts to “go green.”

7. Please provide a few tidbits of information that about your business (funny and/or educational) that not many people would know. We only have sales people in Charlotte, NC Atlanta, Ga and San Antonio, Tx. Scott Huseby was the court reporter in the AZT patent case for 6 weeks in New Bern, NC where Debbie Lawrence was the lead paralegal for Burroughs Wellcome Co. Who knew 15 years later he’d become her boss.

First Vice President (Membership): There are currently 260 MPA members.

Second Vice President (April L. Ritter, CLA, NCCP): I am pleased to say that the Annual Seminar went well. Those who attended enjoyed good speakers, special time with the patrons, and tasty food at the Marriott City Center. Our next seminar will be in September.

It's with mixed feelings that I say that the May meeting will be my last as MPA 2nd VP. The past two years have been fun and challenging serving the association in this position, and I am glad I decided to take it on. I have met a lot of interesting people while coordinating speakers for our meetings and seminars, and feel that the position has helped my confidence grow in many ways. Thank you to all those who made suggestions on speakers and topics. Those suggestions helped make the job easier. I hope you are joined by many others who will provide ideas for the next 2nd VP.

Secretary (Sarah L. Swanson, NCCP): It was a pleasure being able to serve as interim MPA Secretary this past term. Recording the social activities and programs for business meetings was a reminder of how volunteerism marks this organization as one with a heart for community. Some of the most exciting practices of Metrolina Paralegal Association (MPA), is the measure by which its members give back to the community and help one another as well. My membership experience with MPA was enhanced with the behind the scene looks at the structure of our organization. As you know, the Executive Board continuously strives to bring innovative training seminars each month to its members. The luncheons are great networking opportunities to learn about areas of law outside our practice areas. The educational presentations provided are innovative tools that help to enhance our skill set. Congratulations to all who have taken advantage of the seminars and training. It was my pleasure to record those events as your Secretary.

CLA/CP EXAM TO GO ON-LINE, FALL 2010

"The Certified Paralegal Examination will transition from a paper-and-pencil test to computer-based testing in 2010," according to Karen Trumpower, ACP, NALA Certifying Board Chair. "The first computer-based CP exam is anticipated for September," she said. She was joined by NALA President Linda Wolf, ACP, in praising this evolution of NALA's national professional certification exam for all paralegals.

"Our Association has always pushed the boundaries in advancing educational opportunities and professional esteem for paralegals," Ms. Wolf said. "Adoption of computer-based testing for the Certified Paralegal credential emphasizes our dedication to progress in the 21st Century that was highlighted in 2006 when we launched the Internet-based Advanced Paralegal Certification program."

Ms. Trumpower said the Certifying Board considered the many factors involved in the transition to the new format, and will continue to monitor the new process to ensure the best possible outcomes for paralegals seeking professional certification.

The new exam format will be available at all of the NALA testing centers across the nation, greatly expanding accessibility of the exam to more than 200 locations. Further details on this program will be posted on the NALA Website as they become available.

NC SECRETARY OF STATE EXTENDS CUSTOMER

SERVICE HOURS FOR ANNUAL REPORT FILINGS

The Corporations Division of the North Carolina Secretary of State’s office has extended the customer service call center hours from 7:30 a.m. to 8:00 p.m. Monday through Friday during the Annual Report peak filing season. These hours will be effective from March 22, 2010 through June 4, 2010. The call center number is (919) 807-2225.

HISTORIC CHATHAM COUNTY COURTHOUSE SUFFERS MAJOR FIRE DAMAGE ON

MARCH 25, 2010The Chatham County Courthouse in Pittsboro caught on fire on March 25, 2010. The courthouse was undergoing a restoration project at the time of the blaze. Despite the fire damage, court sessions have resumed in an alternate location. A DAY IN THE LIFE. . . OF A REAL ESTATE PARALEGAL

This quarter is a behind the scenes look at a day in the life of a real estate paralegal. Melba Merritt is a real estate paralegal at Boston National Title.

I am a Real Estate Paralegal/Title Processor for residential real estate. The typical tasks of this position include researching and reviewing property titles and clearing title issues. Working with the lender to provide everything needed to prepare the closing package. Preparing any legal documents that need to be executed at closing which are reviewed and approved by our in-house attorney. Scheduling the closing and coordinating a Notary to witness signatures. Preparing the executed closing package to be returned to the lender and providing the lender with everything needed to authorize disbursement of funds. Once authorization to disburse is received, the mortgage and other documents are recorded , all funds are disbursed and the file is moved to post closing.

My typical workday starts at 8 a.m. and ends at 5p.m. three days a week and 11 a.m. and ends at 8p.m. two days a week. A run down of my typical workday is:

1. Check the schedule for files closing and funding for the day.

2. Check emails and respond accordingly.

3. Starting with the first closing of the day, finish processing the files for closing. This usually means finalizing the HUD/Settlement Statement and getting it approved with the lender to receive the loan package. Once I receive the loan package and have HUD/Settlement Statement approval, I forward the closing documents via email to the closer.

4. For files that are funding for the day, I make sure the receipts and disbursements match each other. Since my office is paperless, everything is done via computer with a program that allows us to move files from one person to the other electronically. I move the file to have it reviewed. After review, it is moved to Accounting for check printing. Once checks are printed, I receive the file back, prepare mortgages for recording and disbursements to send out.

5. In addition to these activities, I process new incoming files by entering new files into our system and once we have received the title search and the title commitment is completed, preparing a preliminary HUD/Settlement Statement and forwarding what we call the preliminary package to the lender for processing on their end.

I think my most favorite part of being a paralegal has been the ability to help clients achieve homeownership and learning something new almost every day. The process itself becomes repetitive after a while, but, the title or situation of each file is different and you usually learn something that you did not know. I also enjoy doing transactions in various states around the United States. Probably my least favorite thing about being a Real Estate paralegal is that I spend a lot of my time waiting on someone to get back to me. It sometimes gets a little frustrating when you are ready to ship out closing documents but cannot because you are waiting on the lender to get back with you and when they do, it ends up being at the eleventh hour before closing.

I think my most rewarding experience is when I am able to resolve a problem during closing that has the potential to stop the transaction in its tracks. It is also rewarding to see the look of excitement on a new homeowner`s face once the transaction is complete.

If I could try another legal specialty, I think I would try Litigation. It requires research and deals with lots of documents like real estate. But once you go to trial, it seems like it would also be high stress and fast-paced like real estate can be when getting ready for a closing.
