TOTAL BASIC VALUE: Rs. 1,89,00,000.00 (Rupees One Crore Eighty Nine

Lakh only).

TERMS & CONDITIONS:

1. BASIS OF PRICE: FOR destination to the respective consignees for

whish Freight Charges and Transit Risk Insurance Charges shall be

paid extra as indicated in the subsequent clauses. The prices will remain

firm till completion of supplies.

2. EXCISE DUTY Exempted / Not Applicable at present. If applicable in

future, the same shall be borne by you.

3. CST : Central Sales Tax will be payable extra at actuals as legally applicable

at the time of supply. For availing concessional rate of Sales Tax, requisite

Sales Tax declaration form will be furnished by the Consignee. The present

rate of CST is @ 2 % against form ‘C’.

4. FREIGHT CHARGES: Shall be paid extra @ 1.5% of Basic Price.

5. Transit Risk Insurance Charge: Payable extra @ 0.5% of Basic Price.

Safe arrival of materials up to destination will be your responsibility.

6. ENTRY TAX: Shall be paid extra at actuals by NCL directly to State

Authorities as mentioned above for supply of vehicles in MP which is

presently applicable @2%. No entry tax shall be payable for supply in UP

state.

In case of any increase in taxes and duties after expiry of the scheduled

delivery period, the increase will be to supplier’s account and in case

there is any decrease, the same shall be passed on to NCL.

7. SECURITY DEPOSIT: You are advised to submit Security Deposit within

15 days for Rs. 19,99,296.00 in the form of Bank Draft payable at Morwa

Branch, Dist, Singrauli (M.P.) of any Nationalized/Scheduled Bank or in the

form of Bank Guarantee executed by any Nationalized / Scheduled Bank in a

prescribed Format (i.e. as per Annexure D of NIT) in favor of Northern

Coalfields Limited. In case you fail to deposit the Security Money, the order

shall be cancelled & the case shall be processed to order elsewhere & your

firm’s performance shall be kept recorded for future dealings with your firm.

Security Money will be refunded within 30 days of satisfactory execution of

the supply order. Security money may be converted into performance Bank

Guarantee. Whenever Security money shall be treated as performance

coverage of the supply order, the operation of security Money BG/

Performance BG shall be guided by the stipulated Performance Bank

Guarantee & Guarantee/ Warranty clause of this supply order.

8. Delivery : Supply to commence within 6 (Six) months from the date of

receipt of supply order and to be completed within 9 (Nine) Months. No

vehicle should be supplied beyond the specified delivery period unless

amendment for extension of delivery period is obtained from the purchaser

i.e. NCL. Date of receipt of Mobile Service Vans at consignee’s premises

will be taken as date of delivery.

10. TERMS OF PAYMENTS: (a) 80% payment shall be released within 21

days after delivery of Mobile Service Vans at consignee’s end or submission

of Bills complete in all respect & acceptable Bank Guarantees, whichever is

later. The payment will be made by “Electronic Fund Transfer” (EFT) or e-

payment after receipt and acceptance of Performance Bank Guarantee.

(b) Balance 20% payment shall be released within 21 days after successful

commissioning of Mobile Service Vans to be certified by respective Staff

Officer (Excv) of the respective Projects. The full details of Bank Name,

Bank Address & Account No. & other relevant details must be

indicated.

12. SUBMISSION OF BILLS:

A. Following documents may be submitted to the Consignee :

i) Delivery Challan in original.

ii) One copy of the Bill.

iii) Guaranty/ Warranty Certificate

iv) Price Fall Clause certificate

v) Any other relevant dispatch documents specified in the Order.

B. Following documents should be submitted to the Paying Authority :

i) 100% bill in triplicate duly pre-receipted and stamped.

13. LOWEST PRICE CERTIFICATE: You shall submit a certificate stating

that the price charged by you against this Purchase Order is the lowest and is

the same as applicable to other Government Departments/ Undertakings/

Other Organizations including other subsidiaries of Coal India Ltd. You

should also certify that the price charged is not higher than the prices quoted

/ charged for same/ similar items to other Customers.

14. INSPECTION: Pre-delivery inspection at the manufacturer’s works as well as Final

inspection at the consignee’s end shall be carried out by the authorized

representative of GM (Excv)/NCL in each case.

15. RISK PURCHASE : In the event of failure of supplier to deliver or

dispatch the stores within the stipulated date/period of supply order, or in the

event of breach of any of the terms and conditions mentioned in the supply

order, Northern Coalfields Limited have the right to purchase the stores from

elsewhere after due notice to the defaulting supplier at the risk and cost of

the defaulting supplier. It is mentioned clearly that in the event of failure of

supplier as detailed above, the cost of risk purchase exercise may be

recovered from the bills against any other supplies pending at NCL and also

in any other Subsidiary Company/Coal India Limited.

16. LIQUIDATED DAMAGE: In the event of failure to deliver the stores

within the stipulated date/period in accordance with the specifications

mentioned in the supply order and in the event of breach of any of the terms

and conditions mentioned in the supply order, NCL should have the right:-

a) To recover from the successful tenderer as agreed liquidated damages a

sum not less than 0.5% of the price of any store which the successful

tenderer has not been able to supply as aforesaid for each week or part of a

week during which the delivery of such stores may be in arrears limited to a

ceiling of 10%. Where felt necessary, the limit of 10% can be increased to

15% at the desertion of GM (MM)/ NCL.

OR

b) To purchase from elsewhere after due notice to the successful tenderer

on the account and at the risk of the defaulting supplier the stores not

supplied or other of a similar description without cancelling the supply order

in respect of consignment not yet due for supply.

OR

c) To cancel the supply order or a portion thereof and if so desired to

purchase the stores at the risk and cost of the defaulting supplier and also-

d) To extend the period of delivery with or without penalty as may be

considered fit and proper. The penalty if imposed shall not be more than the

agreed liquidated damages referred to in clause (a) above.

e) To forfeit the security deposit - full or in part.

f) Whenever under this contract, a sum of money is recoverable from and

payable by the supplier, NCL shall be entitled to recover such sum by

appropriating in part or in whole by deducting any sum or which at any time

thereafter may become due to the successful tenderer in this or any other

contract. Should this sum be not sufficient to cover the full amount

recoverable, the successful tenderer shall pay NCL on demand the remaining

balance. The supplier shall not be entitled to any gain on any such purchase.

17. PRICE FALL CLAUSE: If you, at any point of time during the period of

execution of supply of the contract of NCL, supply equipment /store of

identical description in India to any customer including CIL, Subsidiary

Companies at a price lower than the price stipulated in the first contract, you

shall forthwith notify such reduction of sale price and NCL shall amend its

contract price to the lower price. In event of non-intimation by you to this

effect, suitable penal action may be considered against you.

The price fall clause shall apply when the period of execution of supply

against contract of NCL (first contract) is concurrent with supply of another

contract by you to other organisation including CIL/Subsidiary Companies

(other contract). The lower price of the two will be applicable against the

supplies made against the first contract, during the concurrent period of

execution of supplies of the said two contracts.

18. Warranty / Guarantee: You shall give Warranty/Guarantee that the

Mobile Maintenance Service Van supplied pursuant to this contract shall

be available for use by the Purchaser and shall meet the performance

criteria at the level and in accordance with the terms and conditions of the

Warranty/Guarantee herein contained.

Where Mobile Maintenance Service Van supplied under the tender fails to

meet the criteria of the Warranty/ Guarantee, you shall, at your own

cost, provide suitably qualified and experienced personnel at Site to

demonstrate to the Purchaser's satisfaction.

You shall provide the Services of such personnel at Site within seven

(7) days of notification by the Purchaser that the availability criteria have

not been met in any one (1) month.

Maintenance

You shall provide following schedule of maintenance required to carry out

each maintenance task.

(a) routine servicing and maintenance in accordance with the

manufacturer's published recommendations, including changing oils, oil

filters and air filters; lubrication, changing identified consumable or wear

parts and

(b) planned preventive maintenance programmes.

Duration of Warranty / Guarantee:

This Warranty/Guarantee shall become effective on the day on which the

Mobile Maintenance Service Van is commissioned at the Site.

Commissioning shall be evidenced by the issue of the Purchaser's

Acceptance Certificate.

The Guarantee shall remain effective for warranty period and thereafter

for twenty four (24) months from the date of issue of acceptance

certificate ; irrespective of the hours worked by the Mobile Maintenance

Service Van during the period of guarantee.

Composite Warranty / Guarantee:

You shall give warranty that the equipments of Mobile Maintenance Service

Van supplied under this contract is:

a) In accordance with the contract specifications.

b) The equipments shall have no defects arising out of design, material or

workmanship & the complete equipment shall be warranted for 12 months

from the accepted date of commissioning.

Any defect arising / observed on this account will have to be attended

immediately. Any failed assembly/ sub assembly/ parts due to design,

manufacturing or workmanship defect during this warranty period of 12

months shall be supplied by the supplier free of cost and shall not be drawn

from the spares purchased by NCL.

The warranty shall cover for total equipments including chassis of Mobile

Maintenance Service Van so that ultimate / comprehensive responsibility

lies only with you although components may be supplied by different

suppliers to you.

However, in the case of chassis of service van, the criteria of chassis

manufacturer shall be considered.

19. PERFORMANCE BANK GUARANTEE: You will submit Performance

Guarantee for Rs. 19,99,296.00 (Rupees Nineteen Lakhs Ninety-nine

Thousand Two Hundred Ninety Six only) to cover both satisfactory

performance and warranty. The Performance Guarantee should be furnished

in the form of Bank Guarantee executed by any scheduled bank on a Non-

Judicial Stamp Paper of required value in prescribed Format enclosed as

Annexure-II. The stamp paper must be in the name of issuing Bank and the

BG must be kept valid for 21 months from the date of receipt & acceptance

of materials at consignee’s end and the same shall be either released if no

claim is pending or encashed or extended thereafter, as deemed fit. In case

Security money is submitted in the form of Bank Guarantee, the same may

be converted into Performance Bank Guarantee provided the validity is 21

months from the date of receipt & acceptance of materials at consignee’s

end. Whenever Security money shall be treated as performance coverage of

the contract, operation of security Money BG/ Performance BG shall be

guided by Guarantee/ Warranty clause of this supply order.

20. TECHNICAL SUPPORT & SERVICE: In addition to normal after sales

service, you will render technical support and services to ensure fitment,

proper usage, maintenance and satisfactory performance of the supplied

vehicles.

21. Quality Assurance: You shall furnish in detail your quality assurance

plan for various stages of manufacture. The Quality Assurance plan shall

comply with an internationally recognized quality assurance standard such as

ISO 9001 -2008 or latest. You shall provide facilities to Purchaser or their

authorized representatives for progress inspection during manufacture at

your works and furnish all test data available in this regard for quality

control, both for bought out items and your own manufactured items.

The Purchaser or their agent, when so required by them, shall also be

provided with samples of “bought-out” materials for the purposes of

undertaking independent tests, which shall be at the expense of the Purchaser.

22. JURISDICTIONOF COURT: All disputes are subject to jurisdiction of

“Singrauli court” only.

This order will also be governed by the "General Terms & Conditions of

supply of Stores" enclosed with our NIT and all the terms & conditions

thereof as well as Provisions of CIL Purchase Manual will be applicable

unless otherwise specified in this order.

You are requested to kindly acknowledge receipt and acceptance of order

within 10 (Ten) days from the date of issue of order. In case no reply is

ANNEXURE-I

TECHNICAL SPECIFICATION of Mobile Maintenance Service Van -

Part – A: Scope of Supply

A1. Equipment Package M/s Hi Tech Services , Pune shall supply a complete package of Mobile Maintenance Service Van (which includes chassis of Ashok Leyland 1616 il /4330wb BSIII Make Full Forward control) with all Service Equipments and systems for the supply, Accessories, Spare Parts, Training, Installation, Commissioning and Testing to coal mining projects of NCL.

A.2 Supplementary Items I. Each Maintenance Service Van shall be provided with a comprehensive tool kit required for the maintenance and repair of all the Equipment as per ANNEXURE – A. II. First fill of all Oils, Grease and Lubricants needed for testing and commissioning of Maintenance Service Van. However, this will not include fuel. III. All Filters & associated O-rings pertaining to all systems including standard engine filters adequate as per recommended change intervals for first 2000 working hours of the equipments as per ANNEXURE – B.

A.3 Information and Drawings A.3.A The Supplier shall provide following with each Mobile Maintenance Service Van Suitably illustrated Printed copies of (i) Service / Shop Manual (ii) Parts Book and (iii) Operation & Maintenance Manuals for each type / model of equipment covering all Assemblies & Accessories, written in English language bound in book form. · 1 Printed set of above three items to project/each project site and · 1 Printed set preferably along with its soft copy in CD/ Pen-drive, to GM (Excv) office NCL, Singrauli (MP).

A.3.B M/s Hi-Tech Services has submitted the data identified in the specifications for major assemblies / items of Equipment proposed. The supplier has submitted detailed Equipment’s drawings illustrating major assemblies’ locations, foundation and placement / layout of all Service Equipments and systems such as Air Compressor, Air Operated Grease Pump, Air operated oil pressure pump, Air operated oil transfer pump, Monorail crane, Air operated water pump, Diesel Generator Set with engine, Diesel driven Welding Generator set etc. and other installations including layout for Fire Fighting System in chassis as per ANNEXURE – C .

A.4 Training – The Supplier shall also be responsible to impart adequate and proper training necessary for operation and maintenance of the Maintenance Service Van, equipments and accessories supplied. The supplier in consultation with the project in-charge / Staff Officer (Excavation) of the respective Area/site shall make available experienced personnel to conduct training of Engineers, Supervisors, Technicians and Operators for suitable period from the date of

issue of acceptance certificate of the equipment.

The training shall cover the following: A. Equipment Maintenance, Repair / Overhaul & Trouble-shooting aspects. B. Equipment operation and safety aspects.

Comprehensive training manuals with clear illustration shall be provided to each participant. The training courses shall be conducted in either English or Hindi languages as suitable to the site.

The Supplier shall also be responsible to provide any specialised training related to equipment free of cost at site during the warranty period of equipment.

Part B. : General Requirements

B.1 Geography and Climatic Conditions The supplied Mobile Service Vans shall be suitable to operate in the following Geographical and Climatic conditions: Elevation: The natural surface varies from 100 to 1000 m above mean sea level. Climate: The climate is sub-tropical to tropical, dusty, with a hot and humid atmosphere. Monsoon rains occur in the period from June to October. Ambient Conditions: Relative Humidity - Maximum 98% Temperature - Minimum 0º C Maximum 50º C Rainfall: The mean annual rainfall is 1,000 mm, 90 to 95% of which may fall in rainy season from June to October. Wind: April to September - South to South Westerly October to March - North- Westerly Speed - 8 km per hr average - 100 km per hr maximum

B.2 Goods (Equipment and Machinery) Detailed specifications of the Equipment to be supplied are given in Part C , specification of Chassis in Part D of this section.In general, all items shall be:

New, unused and of the current design (incorporating latest proven features) and not likely to be discontinued or become obsolete in near future.

Designed and constructed to handle without overload and for the working hours stated the maximum volumes/ rates specified.

Designed to facilitate ready access cleaning inspection, maintenance and repair of component parts.

Designed to facilitate rapid changeover of consumable items. The component parts of all items shall, wherever possible, be selected from the standard ranges of reputable manufacturers. The Equipment and accessories shall be physically robust and where necessary capable of dismantling for transportation and ready re-assembly using simple tools. All Equipment items provided shall be designed to be compatible within the proposed overall Scope of Supply.

Electrical Equipment shall be provided with all protection devices, controls and interfaces for the Equipment to operate safely and efficiently. All workmanship and materials shall be of first class quality in every respect. All parts and surfaces which are exposed to corrosive environments shall be suitably protected to prevent any effects of corrosion or erosion.

B.3 Services Provision of Specialist Technicians and Labour : The supplier shall provide the Services of Specialist Engineers, Technicians and Labours, skilled as well as experienced in the installation, commissioning and maintenance of the Equipment and accessories to be supplied.The supplier and its Engineers, Technicians and Labour shall be responsible for the installation erection /assembly commissioning and performance testing of the plant equipment and accessories to be supplied.The Engineers/Technicians shall be responsible for ensuring and certifying that each item of Equipment is installed entirely to the Supplier’s and Purchaser’s satisfaction.The Engineers/Technicians shall remain at site until all necessary personnel are fully conversant with the maintenance and operation of the Equipment.

B.4 Standards The design supply, erection, testing and commissioning of all Equipment under this Contract shall in all respects comply with the requirement of this specification and with the appropriate current Indian standards and codes, or relevant Standards. The system of units for all measurements shall be the Systeme International d’Unites (S.I.)

B.5 Supplier’s Responsibility. The Purchaser requires that the Supplier shall accept responsibility for the provision of complete operable and compatible Mobile Maintenance Service Van, its various Service Equipments and systems within the Scope of Supply. This document identifies only the major items required for the installation and the Supplier shall ensure that the total supply includes all necessary Equipment for it to function effectively and safely. Any additional items the Supplier considers necessary to ensure compliance with such a requirement shall be identified and included. If the supplier observes that this Specification document contains any anomalies, ambiguities, flaws, errors or omissions, the supplier shall immediately bring these to the attention of the Purchaser. The Supplier shall be responsible for the testing and commissioning of the Equipments and ensure that it meets the requirements as specified. The commissioning and setting to work of the whole Equipment Supply package shall be carried out under the supervision of the Supplier in conjunction with the Purchaser’s nominated personnel.

B.6 Spare Parts Provisions B.6.1.a Availability of Spare Parts. All items and Equipments supplied shall be of current design and manufacture. The Supplier shall warrant that sufficient spares and servicing facilities will be available to maintain the Equipments in use throughout its life.

B.6.1b Bought out Assemblies and sub-assemblies. The supplier has furnished details of all major bought out assemblies/items as indicated in the technical specification. The supplier has furnished a certificate indicating therein that "All other major assemblies / sub-assemblies not identified / mentioned herein are manufactured by the supplier at their works exclusively i.e. these are proprietary of the supplier's firm." List of Bought-Out items along with Certificate - as per ANNEXURE – D.

B.6.2 Provision of Spare Parts B.6.2.1 (a) (a) Within the Contract Price, the Purchaser shall agree to purchase operational, maintenance and standby / consumable spares, spare parts, wear materials (excluding tyres), maintenance tools and special tools in accordance with the supplier's recommendations. Similarly, within the contract price the purchaser shall also agree to purchase consumable items [herein after referred to as "consumables"] in accordance to the supplier's recommendation.

Within the contract price each machine shall be delivered with consumable spares and consumables required for operation of the equipment (on per equipment basis) during warranty period of operation from the date of issue of the purchaser's acceptance certificate. Each Mobile Service Vans shall be delivered with consumables and consumable spares required for operation of the equipment during warranty. These consumable shall be delivered in one lot during warranty period.

Thereafter, Spare Parts and Consumables [hereinafter referred to as “fast moving spares"] per equipment wise per year for balance 2 years beyond the warranty period of the equipment shall be delivered. These items shall be delivered in one lot in each year; on per equipment basis i.e. One lot in one year on per equipment basis.

Consumables shall not include oils, lubricants and fuels for the purpose of the guarantee but the supplier shall provide all necessary oils, lubricant, fuels and all other consumables as may be required for the purpose of commissioning the equipment and undertaking tests on completion of commissioning in accordance with the contract. In addition to above, within the contract price the purchaser shall also agree to purchase slow moving assemblies/sub-assemblies and any other spares [hereinafter referred to as "Slow moving spare parts"] required for repair of assemblies / sub-assemblies etc. and equipment, after the warranty period which shall be delivered in the form of module for full quantity of Mobile Service Vans supplied.

List of (i) Consumables & consumable spares for warrantee period per equipment wise as per ANNEXURE – E, (ii) Spare Parts and Consumables (fast moving spares) as per ANNEXURE – F , for balance 2 years beyond the warranty period of the equipment per year per equipment wise and (iii) Slow moving spare parts for 2nd & 3rd year of operation as per ANNEXURE – G in the form of one module for full quantity of supplied Mobile Service Vans.

6.2.1(b) The Purchaser reserves the right to review the requirement of fast moving spares ordered for two years beyond the warranty period of the equipment considering the actual consumption of spares and consumables during the warranty period of the equipment and in the subsequent year. If needed the purchaser reserves the right to decrease or delete the quantity of any of these fast moving spares ordered for the two years beyond the warranty period of the equipment.

6.2.1 (c) The seller shall have the right to alter the quantity of quoted "slow moving spares parts" depending upon consumption, in consultation with the project's head. Accordingly the total value of slow moving spares will stand modified based on the unit price of the altered items. However the total value of slow moving parts after such alteration shall not exceed the total value of slow moving spares mentioned in the supply order/contract. In case any other item is required over and above the recommended list furnished above by the supplier as above, the same shall be supplied free of cost by the supplier.

B.6.2.2 Within the contract price, in the event that the consumable spares, Fast moving spares and slow moving spares as recommended by the supplier, in any way falls short of actual requirements during the period, for which they are said to be adequate, the supplier shall provide such additional consumable spares, fast moving spares as are necessary at the final destination. Such additional consumable spares, fast moving spares and slow moving spares shall be provided by the supplier to the purchaser free of cost and shall be transported to the final destination at no cost to NCL as per ANNEXURE – H.

B.6.2.3 In the event that the operation of the equipment is inhibited or frustrated as a direct result of lack of consumables and consumable spares, fast moving spares and Slow moving spare parts pursuant to clause B.6.2.2 hereof, then the period for which operation as aforesaid was inhibited or frustrated shall be treated as Deemed Breakdown period (the credit for keeping machine available shall not be given to the supplier).

B.6.2.4 The supplier shall not be liable for the supply of additional Consumable spares, Fast moving spares and Slow moving spare parts, if these are required by reasons of unforeseen accidents, negligence or misuse on the part of the purchaser.

B.6.2.5 The assessment of the supplier of the Consumable spares, Fast moving spares and Slow moving spare parts requirements shall be based upon the expected number of working hours per year as defined in the individual equipment specification included as the attachment to the technical specification. However, Any shortfall in quantity of these spares and any other spares over and above the list submitted with offer during the period of 36 months or up to 6000 working hrs, shall have to be supplied by the supplier at free of cost. Any shortfall in quantity of above items during the period of 36 months, if required beyond 6000 working hrs, shall have to be supplied by the supplier at extra cost.

B.6.3 Emergency Spare Parts B.6.3.1 Emergency spare parts required by the purchaser to repair breakdowns shall be dispatched to the site by the supplier by the fastest, practicable means as directed from time to time by the purchaser. B.6.3.2 For the purpose of the clause B.6.3.1 “Emergency spare parts" shall mean those spare parts or components required by the purchaser to repair any item of plant supplied pursuant to the contract in the event of a breakdown not attributable to a failure covered by the guarantee or a failure of the supplier to provide adequate spare parts or consumables. B.6.3.3 Payment in respect of the supply and delivery of such emergency spare parts shall be made promptly and retrospectively by the purchaser in a manner consistent with the term of payment described in the contract.

B.6.4 Lifetime Spare Parts The Supplier undertakes and guarantees to produce and maintain stocks, to be available for purchase by the Purchaser under separate agreement, of all Spare Parts and Consumables as may be required for maintenance and repair of the Plant throughout its working life. In the event that the Supplier wishes to terminate production of such Spare Parts, the Supplier shall: B.6.4.A Give not less than six months notice in writing of it's intention to terminate production in order to permit the Purchaser reasonable time in which to procure needed requirements; and B.6.4.B Immediately following termination, provide to the Purchaser at no cost, manufacturing drawings material specifications and all necessary permissions to facilitate manufacture of the Spare Parts elsewhere. B.6.4.C

Any change in part number or superseded part number should be informed to the NCL headquarter - Excavation Department, MM Department and the in-charge at project/site wherever the equipment is operating. In any event, the Supplier shall not seek to terminate manufacture of spare parts for a period of not less than ten (10) years from Taking - Over.

B.6.5 Oils, Lubricants and Fluids Not less than three (3) months before the scheduled date for Acceptance, the Supplier shall provide to the Purchaser a detailed schedule of all necessary oils, lubricants, fluids and the like for the operation and maintenance of Equipments. The schedule shall indicate estimated annual consumption and specify the appropriate international standard number or the name and reference number of an equivalent available in India considered to be acceptable by the Supplier.

B.6.6 General Nothing in this Clause B.6 shall relieve the Supplier of any Warranty/Guarantee, Performance or other obligations or liabilities under the Contract.

B.7 Warranty / Guarantee

B.7.1 Introduction

B.7.1.1 The Supplier shall Warranty/Guarantee that the Mobile Maintenance Service Van supplied pursuant to this Contract shall be available for use by the Purchaser and shall meet the performance criteria at the level and in accordance with the terms and conditions of the Warranty/Guarantee herein contained.

B.7.1.2 Where Mobile Maintenance Service Van supplied under the Contract fails to meet the criteria of the Warranty / Guarantee, the Supplier shall, at it's own cost, provide suitably qualified and experienced personnel at Site to demonstrate to the Purchaser's satisfaction.

B.7.1.3 The Supplier shall provide the Services of such personnel at Site within seven (7) days of notification by the Purchaser that the availability criteria have not been met in any one (1) month.

B.7.2 Maintenance The supplier has provided following schedule of maintenance required to carry out and the number of manpower & hours required to carry out each maintenance task.

(a) routine servicing and maintenance in accordance with the manufacturer's published recommendations, including changing oils, oil filters and air filters; lubrication, changing identified consumable or wear parts and

B.7.3 Duration of Warranty/Guarantee: B.7.3.1 This Warranty / Guarantee shall become effective on the day on which the Mobile Maintenance Service Van is commissioned at the Site. Commissioning shall be evidenced by the issue of the Purchaser's Acceptance Certificate.

B.7.3.2 The Guarantee shall remain effective for warranty period and thereafter for twenty four (24) months from the date of issue of acceptance certificate ; irrespective of the hours worked by the Mobile Maintenance Service Van during the period of guarantee.

B.8 Composite Warranty / Guarantee: The Supplier shall warrant that the equipments of Mobile Maintenance Service Van supplied under this contract is : a) In accordance with the contract specifications. b) The equipments shall have no defects arising out of design, material or workmanship &

the complete equipment shall be warranted for 12 months from the accepted date of commissioning. Any defect arising observed on this account will have to be attended immediately. Any failed assembly/ sub assembly / parts due to design, manufacturing or workmanship defect during this warranty period of 12 months shall be supplied by the supplier free of cost and shall not be drawn from the spares purchased by NCL.

The warranty shall cover for total equipments including chassis of Mobile Maintenance Service Van so that ultimate/comprehensive responsibility lies only with the Mobile Maintenance Service Van supplier although components may be supplied by different suppliers to the Bidder. However, in the case of chassis of service van, the criteria of chassis manufacturer shall be considered.

B.9 Quality Assurance B.9.1 Detailed quality assurance plan for various stages of manufacture as per ANNEXURE – I. The Quality Assurance plan shall comply with an internationally recognized quality assurance standard such as ISO 9001 -2008 or latest.

B.9.2 The Supplier shall provide facilities to Purchaser or their authorized representatives for progress inspection during manufacture at their works and furnish all test data available in this regard for quality control, both for bought out items and their own manufactured items.

B.9.3 The Purchaser or their agent, when so required by them, shall also be provided with samples of “bought-out” materials for the purposes of undertaking independent tests, which shall be at the expense of the Purchaser.

C.1 Air Compressor ( IR Make / IR2545 Model ) – Qty. - 01 No. Base mounted, two stage, two cylinder, air cooled, electrically started , having a Piston displacement of minimum 500 Ltrs/Min at 175 Psi working pressure and with all standard accessories like non return valve, air delivery valve, pilot valve, air cooler pipe etc. Air Receiver of not less than 250 Ltrs. capacity, vertically fitted with standard accessories like safety valve, pressure gauge, drain valve inspection manhole etc. and tested as per safety norms as per ANNEXURE – J.

C.2 Air operated Grease Pump - Qty . 01 Set : It shall be suitable for mounting on standard 200 Kg (approximately) barrel with follower plate and drum cover. The pump shall deliver minimum 400 gms of grease per minute. The working ratio shall be 50:1 with built in air regulator to control air pressure. The unit shall be completed with 1 mtr Inter connecting grease hose and 1 mtrs inter-connecting air hose. The unit shall be capable of delivery a block pressure of 425 Kg /cm² - as per ANNEXURE – K.

C.3 Air operated low-pressure oil pumps - Qty. 02 Sets : GROZ Make / OP/T3/51B/BSP Model - Air operated oil pumps with suitable positive displacement flow meters, mounting suitable for standard oil barrel of 200 ltrs. (approximately) capacity. The capacity of the oil pump shall be 18 ltrs. / min at a working pressure 750 psi with 1mtr long inter connecting oil & air hose. The working ratio should be 5:1. The pump should also have built in Air Regulator to control the input of Air pressure for safeguarding the pump working. A compensating vessel is to be provided at the outlet of the unit to reduce any oil fluctuations as per ANNEXURE – L.

C.4 Air Operated Oil Transfer Pump - Qty. 01 No. : GROZ Make / OPK/T3/11B/BSP Model air operated oil pump having a working ratio 1:1, transferring oil from one barrel to any other container. The capacity of the oil pump is up to 40 LPM with 10 mtr long hose as per ANNEXURE – M.

C.5 Wall mounted Digital Tyre inflator – Qty. 01 No. : PCL SUMO Make Automatic Digital Tyre Inflator, set pressure and tyre pressure can check 0-140Psi , visual display from outside the van shall be enabled, provided with 10 Metre long hose with inflator adaptor - as per ANNEXURE – N.

The service van shall be provided with all the lighting devices like head light, stop and tail light, turn signal lights (left & right) on the both front and rear, fog lamps. The rear body shall have metal top canopy, platform, side metal doors, butterfly doors at the rear with proper ventilation for loading and unloading of grease barrels etc. Painting inside and outside the body will be done as per standard procedure .Anticorrosive process will be carried out before painting.

C.18 Welding Generator Set - Welding generator set having Welding current range 50-500Amps, Open Circuit Voltage-70V, air-cooled, step less current variation, Protection for overheating of electrode or sticking in case of short circuit and protection for over load & Safety of personnel along with all standard items & accessories as per ANNEXURE – Y.

shall remain in full force and effect, during the period that would be taken

for the performance of the said contract and it shall continue to be

enforceable till all the dues of the purchaser under or by virtue of the said

contract have been fully paid and its claims satisfied or purchaser certifies

that the terms and conditions of the said contract have been fully and

properly carried out by the said seller and accordingly discharges the

guarantee. Unless a demand or claim under this guarantee is made on us in

writing on or before the ________ (date to be given) __________ and

unless the guarantee is renewed or a claim is preferred against the Bank

within ________ (months from the date of the Bank Guarantee) we shall be

discharged from all liability under this guarantee thereafter.

4. We, ___________________________ Bank Limited, further agree with the

purchaser, that the purchaser, shall have the fullest liberty, without our

consent and without affecting in any manner out obligations hereunder to

vary any of the terms and conditions of the said contract or to extend the

time of performance of the said contract from time to time or to postpone

for any time or from time to time any of the powers exercisable by the

purchaser against the seller and to forbear on enforce any of the terms and

conditions relating to the said contract and we shall not be relieved from our

liability by reason of any such variation or extension being granted to the

said seller or for any forbearance, act or omission on the part of the

purchaser, or any forbearance, act or omission on the part of the purchaser,

or any indulgence by the purchaser, to the seller or by any such matter or

thing whatsoever which under the law relating to sureties would but for this

provision have effect of so relieving us.

The Bank further agrees that in case this guarantee is required for a longer

period and it is not extended by the Bank beyond then period specified

above, the Bank shall pay to the purchaser the said sum of Rs.

________________ (specify the amount) or such lesser sum as may then be

due to the purchaser and as the purchaser may demand.

5. We, _________________________ Bank Limited, lastly undertake not to

revoke this guarantee during its currency except with the previous consent

of the purchaser, in writing.

6. The bank has under its constitution, power to give this guarantee and Mr.

______________________ Manager, who has signed it on behalf of the

Bank has authority to do so.

This Bank Guarantee will not be discharged due to the change in the

constitution of the Bank or the contractor.
