Minutes of the sitting held in the NCST, Lok Nayak Bhawan, New Delhi on 26/09/2018 at 4:00 P.M.under the chairmanship of Ms. Anusuiya Uikey, NCST in the case of Shri Nabor Ekka, President,Indian Confederation of Indigenous and Tribal People, Cia C, W.W.S., Plot No. 1, West KidwaiNagar, New Delhi regarding non filling the vacant posts of Staff Nurse under post code 20/13 forscheduled tribe category in Govt. of NeT of Delhi.

Representation dated 15112/2015 received from Shri Nabor Ekka, President, Indian Confederation of

Indigenous and Tribal People, Clo C, W.W.S., Plot No. I, West Kidwai Nagar, New Delhi regarding non

filling the vacant posts of Staff Nurse under post code 20113 for scheduled tribe category in Govt. ofNCT of

Delhi.

This case was discussed in the sitting(s) convened by the Commission on 29/08/2016, 13110/20 17,

13/03/2018, 04/05/2018 and 11/06/2018 with the Officers of Health & Family Welfare Department, GNCT

Delhi, Services Department, GNCT Delhi and the Delhi Subordinate Services Selection Board (DSSSI3) and

the petitioner(s).

During discussion in the sitting held on 11/06/2018, it was observed that the Health & Family

Welfare Department pointed out 28 dossiers returned to DSSSB but now the Health & Family Welfare

Department vide letter dated 21105/2018 has informed only 13 dossiers returned to the DSSSB which is

contradictory. The posts reserved for STs were 18 (Staff Nurse). The Health & Family Welfare Department

is taking this issue very carelessly and giving wrong information to the Constitutional Body. The

Commission advised that the Department of Health & Family Welfare should submit the following

information within fortnight from the receipt of the minutes of the sitting. After receipt of the information,

this issue will be discussed with the Chief Secretary, Govt. ofNCT of Delhi and Principal Secretary, Health

& Family Welfare Department, Govt. ofNCT of Delhi.

(i) Number of total candidates and ST candidates (for post of Staff Nurses) advertised in the

2013 vide post code no. 20/2013, out of which how many ST candidates have been appointed

in the Hospital I Medical Institution so far.

(ii) Statement showing the name of candidates, letter and date of nomination of candidates

recommended for appointment in the Hospital I Medical Institution by the Health & Family

Welfare Department and appointment letter issued by the concerned Hospital I Medical

(iii) Total Number of Nursing posts in the Health & Family Welfare Department, Govt. of NCT

of Delhi and posts reserved for Scheduled Tribes.

The Health & Family Welfare Department, Govt. of NCT of Delhi to the NCST has not submitted

the satisfactory action taken report. The NCST fixed the sitting on 29/08/2018 to discuss the issue but due to

non- appearance of Secretary, Health & family Welfare Department, GNCTD, the sitting was postponed and

fixed for 26/09/2018 at 4:00 P.M.

In the sitting, the petitioners informed that the posts advertised under code no. 20/2013 reserved for

Scheduled Tribes has not been filled so far and demanded to give the chance to the candidates (24 in

numbers) mentioned in the panel 1 waitlist prepared by the DSSSB vide Order No. 513 dated 26/07/2016.

Further, DSSSB, vide advertisement no. 02/2018 dated 05/07/2018 had invited the applications for Nursing

Officer against the post code no. 03/2018, where 51 posts reserved for STs against total 684 posts. Whereas

the 24 ST candidates panelled 1 waitlisted by DSSSB in 2013 have not been given chance to join the post.

The Hon'ble Vice-chairperson asked the Secretary, Health & Family Welfare (H&FW) to inform the

position and suggest the possibility to invite the candidates mentioned in the panel 1 waitlist.

The Secretary, H&FW, GNCTD informed that H&FW, GNCTD has invited the candidates who have

been referred by the DSSSB against the reserved posts for STs against the posts advertised under code No.

20/2013. Action taken by the H&FW, GNCTD was slow, hence, the ST candidates had not joined the posts

in time. The Department is ready to appoint all ST candidates mentioned in waitlist 1 panel. But he is not

empowered to take a decision to relax the norms for inviting the candidates mentioned in the panel 1 waitlist.

Hon'ble Lieutenant Governor, Delhi is empowered to relax the norms 1 revive the panel 1 waitlist of the ST

candidates prepared by the DSSSB against the post code number 20/2013. The representative of DSSSB also

endorsed the suggestions of Health & Family Welfare Department, GNCTD.

After detailed discussion, Commission has observed that H&FW Department has not taken action in

time to invite the ST candidates recommended by the DSSSB against the post code No. 20/2013. It was

decided by the Commission that matter should be taken up with the Hon 'ble Lt. Governor of Delhi to revive

the panel! waitl ist prepared by DSSSB vide Order No. 513 dated 26/07/2016 for the post code No. 20/2013

by NCST.

Commission suggestedl recommended that the Health & family Welfare Department, GNCTD,

should also take up the matter with the Hon 'ble Lt. Governor of Delhi to revive the panel! waitlist of ST

candidates prepared by DSSSB against the post eode No. 20/20 I 3. The action takenl to be taken should be

submitted by H&FW GNCTD to the Commission within a month from receipt of the proceedings of the

sitting.~~
