    Notes

    1. The status of an approval may change. An approval may be "current". In addition, an approval is no longer in force if it has "expired", been "surrendered", suspended or "cancelled".

    2. During periods of severe water shortages, the Approval Holder must comply with any notification issued by the Minister under section 60 of the Water Management Act 2000.

    NOTICE OF CHANGE OF HOLDER OR CONTACT

    1. The NSW Office of Water is to be advised of any change of Approval Holder. This will occur whenever there is a change of ownership of works shown in this Approval. The advice should be accompanied by evidence of transfer of ownership of the works.

    2. If the Approval Holder wishes to nominate a new contact person a written statement signed by the holder should be submitted to the NSW Office of Water.

    3. The contact person should advise the NSW Office of Water of any change of mailing address as soon as possible.

    SCHEDULE 1 CONDITIONS INTRODUCTION Under section 100 (1)(a) of the Water Management Act 2000 (WMA 2000) this Approval is subject to such conditions as are, from time to time, required to be imposed on the Approval by the Water Sharing Plan for the New South Wales Murray and Lower Murray Regulated River Water Sources. Under section 102 (1) of the Water Management Act 2000 this Approval is subject to such other conditions as the Minister may impose on the Approval after it has been granted, including conditions relating to the protection of the environment. AUTHORISED WATER SUPPLY WORKS Authorised Water Supply Works

    1. The Approval Holder is authorised to construct and use the water supply works listed detailed in Schedule 1 to extract and convey water for use(s) described in Schedule 2, and other purposes as required or authorised by the Minister, subject to the conditions of this Approval. Note: Under section 90 (2) of the Water Management Act 2000 the term construct is defined to include install, maintain, repair, alter or extend the work.

    2. Unless approved in writing by the Minister, a water supply work referred to in Condition

    1 must not be modified such that the existing design extraction capacity or location of the work is altered.

    Taking of Water

    3. The Approval Holder must not take water using a work authorised by this Approval unless in compliance with the conditions of the access licence under which water is being taken.

    4. The Approval Holder must not take water using works authorised by this Approval under

    a regulated river access licence unless it is in accordance with a water supply order approved by the State Water Corporation not less than 4 days prior to when the water is to be taken, except when taking water that is accounted as a supplementary water allocation or such number of days as may be otherwise agreed with the State Water Corporation from time to time.

    Measuring and Reporting the Volume of Water Extracted

    5. The Approval Holder must install, maintain and operate devices for measuring the volume of water extracted in compliance with the New South Wales Interim Water Meter Standards as may be updated or replaced from time to time or in accordance with any written direction from the Minister.

    6. The Approval Holder must provide a statement issued by a certified person validating

    that the maximum error of devices used for measuring the volume of water extracted is within the limits advised in the NSW Interim Water Meter Standards as may be updated

    or replaced from time to time, or in accordance with any written direction from the Minister or the State Water Corporation.

    7. The Approval Holder, on becoming aware that an extraction measuring device ceases to

    accurately record the extraction through the approved work, must immediately notify State Water Corporation and comply with the State Water Corporations requirements given with respect to extracting water, providing data from which extraction may be estimated, and restoring the measuring device to meet the required accuracy.

    8. The Approval Holder must provide the Minister, with the details of

    a) the quantity of water extracted through the authorised work, b) the water management infrastructure used to convey the water extracted, and c) cropping details held by the Approval Holder, when requested and in the form and according to the procedures established by the Minister.

    Construction or Modification of a Work for the Discharge of Water

    9. The Approval Holder must not, without the prior written approval of the Minister, modify an existing work or construct a new work, if the modification or construction has the potential to cause or permit a discharge of water from any part of the Area of Operations to any land or water adjacent to the Area of Operations. Note: Where the Minister provides written approval in accordance with this condition, the terms and conditions of this Approval will be amended accordingly.

    Operation of Works to Allow the Passage of Flood Water across Water Supply Channels

    10. The Approval Holder may construct and operate the works listed and detailed in Attachment 3to allow the passage of flood water across water supply channels, in accordance with procedures established by the Approval Holder in consultation with the State Water Corporation and the relevant Local Government authority, provided that the Approval Holder has received and implements the written procedures from State Water Corporation for the notification, reporting and measurement for the proposed operation at each site, and any other necessary procedures to enable State Water Corporation to reconcile the relevant water account.

    REPORTING AND NOTIFICATION REQUIREMENTS Notification and Reporting of Events

    11. The Approval Holder must notify the Ministers nominated contact officer of any significant events, planned or otherwise, which prevented, or are likely to prevent, the Approval Holder from meeting any of the requirements of this Approval. Such notification must be made in writing as soon as practicable, but no later than 14 days, after becoming aware of the event.

    Submission of an Annual Compliance Report

    12. The Approval Holder must, by the 31st of October each year, submit to the Minister a hard copy and an electronic copy of an Annual Compliance Report for the preceding water year (from 1 July to 30 June).

    13. The Approval Holders Annual Compliance Report must present, but need not be limited

    Plans of the Area of Operations, Authorised Works, Monitoring Sites and Water Management Infrastructure

    13.1 A plan of the Area of Operations, as existing at 30 June of the year of reporting, showing, to the Ministers satisfaction, the boundary of all included land and including any amendments made by the inclusion and exclusion of lands in accordance with sections 131 and 135 of the WMA 2000, and showing the boundary of any other land listed in Schedule 2 that are not included in the Area of Operations;

    13.2 A plan (or plans) showing, to the Ministers satisfaction, the current location of

    the authorised works listed in Schedule 1 and all monitoring sites listed in Attachments 1 and 2, as
