Memorandum by the Chairmanof th e Conference of National Armaments Directors
On 7th March, 1962 ['I, the Council approved the ImplementingProcedures for the "NATO Agreement for the mutual safeguarding
of secrecy.of inventions relating to defence and for which applica-tions for patents have been made", submitted by the Armaments
Committee in document C-M(62)16.
2. After examining these procedures as required by paragraph F of
the Annex to G M ( 6 2 )16, the Working Gmup on Industrial Propertyproposed a number of drafting amendments to paragraphs A(4), A(5),
E and F of the Implementing Procedures, amendments which affectedneither the substance nor the spirit of the original texts. .
3. A t its first meeting of 13th to 15th February, 1967, the Con-
ference of National Armaments Directors approved the proposed

APPLICATIONS FOR PA TENT S HAVE BEEN M ADE - FIRST
REVISION LN ACCORDANCE WITH PARAGRAPH F HERE-
!1. The following procedures have been formulated in accordance
with the undertaking in Article 1 of the NATO Agreement for the
mutual safeguarding of secrecy of inventions relating to defence and
for which applications for patents have been made, signed in Paris
on 21st September, 1960, hereinafter referred to as the NATO Agree-
I ment and in conformity with NATO security requirements.IG 2. The procedures can be implemented only i f :

I (a) the government of the country of origin and the governmentof the receiving country each has legal authority to impose secrecy
within its own jurisdiction on inventions, disclosure of which mightprejudice its national security and to prohibit any such disclosure;
(b) the legal authority to which reference is made in sub-para-
graph (a) above (including any enabling and enforcement means)
and the arrangements for physical security are adequate and suEcient
to safeguard all aspects of the security of the subject matter of the
inventions concerned, to a standard not inferior to NATO security
requirements from the time when the subject matter of the inventions
is received officially by the government of the receiving country
until ib release from secrecy by the government of the country of

(c) adequate measures are available to the government of thecountry of origin to prohibit the unauthorised filing abroad of appli-cations for patents in respect of inventions, disclosure of which mightprejudice national security, and to authorise within its discretion thefiling abroad of applications for patents in respect of inventionssubject to secrecy restrictions.
Procedures
A. GENERAL CONDITIONS AND REQUIREMENTS
Applications for patents received in one NATO country from anotherwith a request that they be placud in secrecy under the provisionsof the NATO Agreement shall be placed in secrecy in the receivingcountry and shall be accorded a degree of security classification at
least equal to the degree of security classXcation given to them bythe country of origin, provided that:
(1) the request for secrecy of the pa tent application is receivedfrom or on behalf of a Defence Agency of the governmentof the originating country or from the Applicant accompaniedby a permit from or on behalf of the Defence Agency;
(2) a certificate is furnished by or on behalf of a Defence Agencyof the government of the country of origin that the invention,.the subject of the patent application, has been placed in secrecyfor defence purposes and specifying the security classificationwsigned by that country;
( 3 ) all documents, papers and correspondence relevant to thefiling of the patent application Are received in the PatentM c e 'I of the receiving country solely through oBciallyrecognised adequately secure communication channels.
(a) A Defence Agency of the government of the country oforigin shall ensure that all documents relevant to theapplication are transmitted to that government's Em-
bassy in the receiving country, through diplomaticchannels.
(b) If the Applicant wishes to be represented or must berepresented by a Patent Agent, Attorney or otherrepresentative the Embassy will ascertain from theappropriate Agency of the receiving country whethersuch Patent Agent, Attorney or other representative isduly suthorised :
(1) to have access to classified subject matter and
Wherever it appears in these procedures "Patent Office" means the officialnational agency in each country, provided for in Article 12 of the UnionConvention of Psria, dated 20th March, 1883 [TS 379; 25 Stat. 13723, or theprotection of industrial property, which accepts and proceases applications forpatents for inventions in accordance with the national laws and regulations ofthe country concerned.

government in accordance with Article I11 of th e NATOAgreem ent, a waiver in writing of any claim to compensa-tion for loss or dam age du e solely to t he imposition of secrecyon the invention b y the receiving government when imposedunder provisions of the NATO Agreement.
B. CORRESPONDENCE RELATING TO THE APPLICATION
All correspondence relating to the application under these pro-cedures shall pass only through the same secure channels BS specifiedfor the original patent application, excepting correspondence ex-
clusively relating to paym enta of taxes an d fees provided t h at suchcorrespondence contains n o information pertaining to the invention,th e subje ct of t he application . O th er unclassified formal notification(such as extension of time limits or similar notices) may be sent by
the foreign Pat ent OB ce a t i ts discre t ion direc t ly ~A the Applicantor his authorised representative without any special securityarrangements.
C. REMOVAL OF SECRECY
T h e noti ce of th e gove rnm ent of t he cou ntr y of origin of its inten-tion to rem ove ite own measu res of secrecy in accordance with Article4 of the NATO Agreement shall be addressed to the appropriateDefence Agency of th e gov ernm ents of the receiving countries. Ifafter the six weeks period provided for in the above agreement thegovern ment of the c ou ntr y of origin removes secrecy i t will imme-diatel y so inform t he ap prop riate Defence Agency of the governmentsof the receiving countries, which gov ernmen ts will then removesecrecy measures. T h e titlea an d addresses of th e national agencies
of th e receiving cou ntries to which th e anno uncem ent concerningth e remov al of secrecy should be forwarded are listed in Appendix
D. NATIONAL PARTICULARS
Any national rules of procedure which may be formulated in
amplification of t he procedures contain ed herein mus t be compatiblewith these procedures.

All governments will notify the other governments and the Inter-national Staff of NATO promptly of any change in their laws andregulations on which the foregoing procedures are based pointing outthe effect of the changes on these procedures and any changes in thetitles and addresses in Appendix 2.

When a government par ty to the NATO Agreement is abIe toimplement the procedures and intends to apply them, it will soinform the Secretary General of NATO who wiI1 notify immedi~telyall other government parties. These procedures shall be applicable ntthe da te of this notification between this government an d a ny ofthe other governments for which the Secretary General has alreadygiven such notification. ['I
F. R E V I S I O N S
These procedures shall be examined by the relevan t Working G ro upof the No rth A tlantic T re aty Organization for possible revisions onceevery two years from the date of approval by the North AtlanticCouncil or whenever specifically requested by one of the participatinggovernments.
G. APPROVAL
These procedures were approved by the North Atlantic Councilon 7th Ma.rch, 1962, in the E nglish and French languages, both texts
being equally authentic.

2. Ces procedures ne sont applicables que si;
(a) le gouvernement du pays d'origine e t le gouvernement dupays destinataire ont, chacun sur son territoire, 1s pouvoir de prendre
dm mesures de secret B 1'6gard des inventions dont la divulgation
pourrait compromettre la sk ur it 6 de la dBfense, ainsi que le pouvoir
d'in terdire m e elle divulgation ;
(b) le pouvoir de prendre les mesures dont il est question Bl'alinBa (a) ci-dessus (dont toutes dispositions d'habilitation et d'appli-
cation) et les mesures mat&ides de sQurit6 prises, conviennent et
suffisent pour assurer B tous 6gards la s6curitB des inventions en
cause du moins autant a ue l'exkent les dis~os itionsOTAN en matiere

Prockdures
A. CONDITIONS E T REGLES GENERALES
Les demandes de brevets regues d'un pays OTAN dans un autrepays OTAN, avec demande de mise au secret en vertu de17Accord
OTAN, seront mises au secret dans le pays destinataire et celui-ci
leur assignera une classification de skuri tB d'un niveau au moins

ses propres mesurea de sdcurit6. Si, apr& la pkriode de six semaines,
prkvue audit accord, le Gouvernement du pays d'origine lhve lesecret, il en informera imm6diatement les services cornp6t.ents de ladbfense des pays destinataires, et ces gouvernements lhveront alorsles mesues de secret. h ists des noms et dresses des Services
nationaux dm pays destinataires auxquels les demandes de levee du
secret devraient Btre adresskes se trouve en Appendice 2(c).
D. DISPOSITION8 NATIONALES
Lea regles nationales d'application qui seraient BaborBes B la suite
de la mise en vigueur des proc6dures contenues dans le prbent docu-
ment devront &tre ompatibles avec ces procklures.

E. ENTREE EN APPLICATION
Lorsqu'un gouvernement partie 3b l'Accord OTAN est en mesure de
mettre en oeuvre les procedures d'application et entend
les appliquer, il en avise le Secretaire GBn6ra.l de 1'OTAN qui lenotifie imm6diatement B tous les autres gouvernements parties BllAccord. Ces procedures seront applicables A la date de cette notifica-
tion entre ce gouvernement et tout autre gouvemement pour lequel
une telle notification a d6jB 6tB adress6e par le Secr6taire Gheral .
F. REVISIONS DE LA PROCEDURE
La revision kventude des procedures fera l'objet d'un examen au
Groupe de travail competent de lJOrganisation du Trai t6 de 1'Atlan-
tique Nord tous les deux ans B partir de la data dJapprobation duComeil de 1'Atlantique Nord ou chaque fois quJune d e revision sereexpressbent demandbe par l'un des gouvernements participants.
