1. General scope of work 1.1. Background The NAM Programme Office requires an office building container facility from a contractor by

providing cost effective construction services, which shall meet the technical requirements

defined in this SOW, in the design documentations and in accordance with the applicable law

and standards. The location and the detailed technical specification of the new proposed

container office building requirements are specified in attachments 1, 2 and 3. If applicable,

wherever in this SOW the parameters differ from the DCD, the DCD shall prevail.

2. Specified scope of construction services The Contractor shall complete the construction works in accordance with the detailed design provided

in the DCD related to the Container Office Building and included in the Bill of Quantity (Attachment 4).

The following as a minimum shall be completed:

o Provision of new containers (manufacturing date shall be later than 1 January

2020) as per the DCD.

o A container building to accommodate a max 30 PAX.

o Specified outdoor parking area for vehicles and bicycles with outdoor lighting.

o A designated outdoor smoking area.

o Connection of all the required utilities including rainwater drainage.

2.1 Building layout concept To provide a container facility as rapid and economic solution in order to provide the office

environment for the temporary deployed MOC Forces. All the detailed construction documents

and technical utility requirements in accordance to regulations is in the DCD - Attachment 1.

The container building will contain the following rooms below: List of rooms:

2.2 Facility utility connections and supplies.

2.2.1 Power supply

o Shall comply with the future projected IP telephone system (separate MoD

project) to avoid interference and be suitable for the installation and connection.

2.2.2 Wall sockets

o Every container room –shall have required inbuilt standard EU 230V wall sockets

as per the design documentation

2.2.3 Lighting

o Required indoor lighting: in the operation and computer room is 500 LUX,

otherwise 300 LUX with the following inbuilt accessories.

o 32 pcs 2x27W LED linear tube lamps (ops-, break-, computer-, server rooms,

kitchenette, changing rooms)

o 13 pcs 1x22W LED linear tube lamps (corridors, washing rooms, and the janitor).

o Required outdoor lighting: min. 15 LUX average lighting value.

o 5 pcs of outdoor 38 W LED road lantern lights for the parking lot and the entrance

road (switch off function from the Air Traffic Control Tower (ATCT) is required in case of

night flight operation) with min. of 15 LUX average lighting value. Installation of

road/street lanterns in poles.

o Type A or B low intensity obstacle lights (LED technology) on the top of the

container in accordance with the ICAO ANNEX 14 regulations. The obstacle lights shall

be remote controlled from the ATCT (switch off function shall be integrated in to the

TeGe Watch System obstacle lights control in the ATCT to support night flight operation).

2.2.4 Heating/cooling and ventilation

o Inbuilt electrical equipment in each container unit in accordance with the

proposed floor layout. Controlling of the heating/cooling system with room thermostat

installations shall be provided. Individual zone temperature control in each zone of the

building (briefing, operation, break rooms and sanitary block) by room temperature

controllers, with outdoor temperature control unit. The set indoor temperature for winter

time is 22,0 ± 2,0 °C, for summer time 24,0 ± 2,0 °C.

2.2.5 Air-condition heating/cooling units are required in the following rooms:

• Break room

• Kitchenette

• Operation room

• Briefing room

• Server room (note: humidity control is not required)

2.2.6 Operational parameters for IT server closet.

o The temperature shall be controlled to provide continuous operating ranges between

20 °C to 25 °C.

o Antistatic floor is required.

2.2.7 Hot water supply

o Hot water shall be provided in 4 showers and 4 sinks.

o Hot water in the kitchenette for a double sink.

2.2.7 IT equipment

o Operation room electrical supply as follows.

o 16 pcs standalone computers (16x450W).

o 1 pcs A3 size printer/scanner/copy machine station (800 W) connected to

network.

o Briefing room electrical supply as follows:

• 8 x E-box turn: 2x220V socket for laptops; 2xIT/COM socket

• 1 pcs LED TV (180 W).

• 1 pcs projector (300 W).

• Server room.

o IT network Cat-6 UTP active elements (routers, switches,) contains the

necessary active items, servers and server rack cabinets.

o IT network Cat-6 UTP without active elements.

o Wifi network is not required in the building.

o Break room electrical supply as follows:

• 8 x E-box turn: 2x220V socket for laptops; four pieces of 2xIT/COM

sockets.

• 1 pcs LED TV (180 W).

2.2.8 Kitchenette

o Microwave.

o 15 bar coffee machine.

o Teakettle water boiler.

o 210 L two-door refrigerator. Energy Standard A+++

o 12 place setting.

2.2.9 Water supply

o Men rest room and shower: 2 toilettes, 2 urinals, 2 showers, 4 sinks.

o Women rest room and shower: 2 toilettes, 2 showers, 4 sinks.

o Kitchenette: 1 tap (double sink) and 1 dishwasher machine. Energy Standard A+++

Note: The PAB existing water distribution line has been renovated and replaced by new pipelines. The layout of the detailed construction design is in the DCD - Attachment 1 (MOC_KIV_KOZ_01). 2.2.10 Sewerage

o A new sewerage lifting station to pump sewerage to an existing manhole as per

the DCD.

Sanitary block

o Sewage channels (DN110 sewage pipe).

o Boiler condense waste water drainage.

Kitchenette

o Sewage connection (1 x DN110 sewage pipe): double sink and dishwasher

machine.

Chilled rooms (briefing, operation, break and server rooms and kitchenette)

o Split air conditioners condense wastewater drainage.

2.2.11 Indoor low voltage engineering

o Construction of the Information Technology Network (fiber optics, switches,

outlets) to the workplaces (operation room, briefing room) based on the Structural design

in accordance with the Hungarian Military Regulations for Intranet.

o IT network Cat-6 UTP cable network with active elements (routers, switches,

WIFI Aps,) contain the necessary active items, servers and server rack cabinets, network

printer/scanner/fax machine.

o IT sockets (IT/ COM sockets) in briefing (E-box: 8x; wall socket 1x, ceiling socket

1x), operation room (16 wall sockets), break room (E-box: 4, wall socket 4x) in

accordance with the planned layout.

For example: Prodax, Schrack, Schneider, Legrand or approved equivalent make in

same form – fit-function.

o IP Telephone system and sockets (IT/COM sockets) in briefing (2), operation

room (15) in accordance with the planned layout.

For example: Prodax, Schrack, Schneider, Legrand or approved equivalent make in

same form – fit-function.

o Wireless Projector set with active IT device (trough bluetooth connection, with a

remote controlling smart device) for supporting the presentation in briefing room as per

layout.

Fire detection and alarm system connected to the Fire Station fire center

o Fire detection system shall consist of smoke and heat detection where

applicable, however optical smoke detectors are required in every container.

o Fire alarm system of the building complying with the relevant Hungarian fire

safety standards and requirements, including the emergency protocol and provide exit

lights for the escape route. Licensing plans and authority handover.

o Fire alarm center near the entrance which shall be connected to the fire fighter

building’s alarm system in Bldg. 102 in order to give warning in case of fire in a timely

manner.

Security access control to the container building (OPTIONAL)

o Building access control, intrusion detection and alarm system shall be connected

to the Air Base Guard Operation Center (Building 103).

o Automatic opening of the entrance doors by card reader system located at the

entrance doors is required.

o Continuous monitoring possibility of the access control is required by Air Base,

therefore this system shall be connected to the HUN MoD Security Server.

o Intrusion detection system shall consist of windows opening detection where

applicable.

2.3 Demolition and preparation works

All demolition work shall be conducted safely and in accordance to regulations. Any damage

caused to existing structures or services shall be rectified by the contractor. All preparity work

can be conducted on the lay- down area highlighted on the existing site plan at attachment 3.

2.4 Protection of the existing utilities

All existing utilities (Attachment 2) shall have adequate protection to prevent damage during any

phase of the construction works. If any damage is caused during the construction services then

it is to be rectified by the contractor, at own costs, to the original state.

2.5 Protection of the existing structures during construction

Adequate protection shall be provided to all exisiting structures to ensure they are not damaged

during any phase of the construct works. Any damage caused as a result shalled be rectified by

the contractor, at own costs, to the orginal state.

2.6 General construction considerations:

o Equipment and materials specified in several sections in the Attachments and

the planned reference drawings provides an illustration to the Contractor about the

minimum acceptable quality and quantity requirements and/or standards of materials

necessary as well as the minimum technical requirements needed to fulfil this SOW.

o All dimensions shall be checked and verified, and prior construction confirmed

against the design documentation and drawings.

2.7 Design document considerations and design review The Container Office Building Project has been designed by EPTI Ltd. and meet the Hungarian

legislative regulations and applicable standards as detailed in the CPD and DCD documents.

The design documentation is NATO UNCLASSIFIED. The full design package in electronic

format (PDF) is issued to bidders attending the mandatory bidders conference/site visit (e-file

sharing on NSPA e-Portal).

The Ministry of Defence of Hungary, Magisterial Bureau, Military Construction Authority has

issued the construction permit decision under 10657-6/2020h registration number (effective on

21 September 2020) as per Attachment 5.

Important note: The Contractor must fully comply with the requirements set out in the construction permit.

The Contractor shall complete the detailed design review and inspection in accordance with the

Act V of 2013 on the Civil Code Book Six, Section 6:252 related to the Chapter “Construction

contract” (3).

NSPA request written confirmation of the detailed construction design review and inspection

provided by the bidder along the proposal in Exhibit III. The confirmation requested to be

provided by the bidder is a pre-requisite of the contract award.

2.8 Applicable standards and regulations for design work

All design and engineering work shall comply with the following. Applicable NATO, Hungarian

and European Union (EU) laws, regulations and standards to include, but not limited to:

o NATO 85-5 Criteria & Standards for Airfields.

o Nemzetközi Polgári Légiközlekedési Szervezet Egyezmény 14. Melléklet / The

Convention on International Civil Aviation Organization (ICAO) ANNEX 14.

o 40/2002. (III. 21.) Govt. Decree on the regulations for building authority approval

procedures of the specific type of defense and military structures / 40/2002. (III. 21.)

Korm. Rendelet a sajátos építményfajták körébe tartozó honvédelmi és katonai célú

építményekre vonatkozó építésügyi hatósági engedélyezési eljárások szabályairól.

In case of conflict between the above mentioned standards, the most restrictive standard

requirements shall be utilized.

2.9 Supporting documentation The following documentation is attached to this SOW for consideration in the preparation of the

proposal:

3 Roles and responsibilities

3.1 NATO Support and Procurement Agency (NSPA) and Airlift Management Program (NAMP)

NSPA is the contract management authority and is the service integrator on behalf of the

customer (HUN MOD). All matters concerning application and administration of the contract

shall be dealt with by the appointed NSPA Contracting Officer (CO) and appointed Technical

Officer (TO) who shall provide contract oversight.

The NSPA Contracting Officer is delegated authority to administer and implement changes to

the Contract within established limits and in accordance with NSPA procurement regulations.

Administrative matters concerning application, interpretation and administration of the Contract

shall be dealt with by the CO.

The assigned NAMP Technical Officer is responsible for the technical management of the

contract and serves as the technical authority for contract matters. The TO will coordinate the

construction activities with the end users and with the Contractor and communicate

recommended changes in scope or deliverables to the appropriate CO for contractual

modification if required. The Technical Officer is responsible of verification and acceptance of

the services provided by the Contractor.

3.2 Prime Construction Contractor The Construction Contractor that is responsible for the overall implementation of the project in

compliance with the detailed design, standards and regulations identified within the contract.

o Provision of As-built Documentation

• As-built documentation shall be provided by the Construction Contractor taking

into account any changes/deviations from the original design as well as the Designer

Support during the Construction works.

• Delivery schedule of As-built documentation - Upon successful completion of the

construction works, prior to conduct the Technical Handover Takeover of the Project,

the Construction Contractor will provide the as-built documentation in 3 hard copies,

and soft copies on CD/DVD in electronic pdf and CAD format.

3.3 Design Contractor (EPTI Ltd)

The Design Author delivered the design of the works and is accountable to the NSPA

Contracting Officer and NAM PO Technical Officer on all design related issues as detailed in

the design phase descriptions. The Contractor in the framework of the supervision by author of

the design as a secondary QA is responsible to NAMP for on-site implementation of the

construction plan, preventing unauthorized deviations by construction participants from the

accepted construction plan, as well as violations of binding regulatory enactments and

standards during construction work.

The designer shall work in close liaison with NSPA TO and the Construction contractor,

performing activities of supervision, highlighting technical non-compliances, advising on design

changes, attending technical and QC meetings, reporting to NAMP.

o Contractor Support during Implementation Works - Upon request through

NAMP TO the construction contractor can request support from the designer to assist

with construction works. This may be in the form of supplementary documentations,

technical clarification or on-site engineering guidance. The construction contractor can

also request through NAMP TO updated documentations as a result of design

modifications or site variations which will alter the original documentations. Construction

Support Services will be provided by the Design Contractor for the entire duration of the

construction works until the project is formally confirmed for use by the handover-

takeover committee.

3.4 Construction Technical Controller (CEH Ltd)

NSPA contracted and engaged an independent engineering firm to provide services of technical

inspection and to monitor the quality of the works during the execution.

The technical controller shall work in close liaison with NSPA TO, performing activities of

supervision, recording material approvals, attending and supervising tests, highlighting technical

non compliances, advising on design changes, monitoring on-site work safety, attending

technical and QC meetings, reporting to NAMP.

The construction technical controller’s main responsibilities include:

o Services of Quality Assurance: advice for materials approval, technical

inspections, attendance of tests for acceptance.

o Record of submittals and tests.

o Technical reporting to NAMP.

o Attendance to weekly meeting as per request with NAMP and Contractor’s

representatives for quality and progress monitoring.

o Record of non-conformities, advices for solution, record of solutions adopted by

the Contractor.

The technical controller may take advantage of a team of expert qualified to supervise specific

works of the project.

In combination with NAMP Project Officer, the technical controller shall be liable and sign the

forms for inspections, approval of materials and quality related documents during the execution

of the works.

3.5 End Users The End Users of this project are not budget holders, therefore all changes to the project are

mandatory for prior approval by the NAMP Technical Officer and contractual agreement by

NSPA Contracting Officer for subsequent implementation. The Contractor is not authorized to

communicate directly with the end users, to receive guidance or to implement design or services

changes.

4 Objective of the construction services NSPA intends to engage one (prime) Contractor to execute the construction works in order to fulfill the

requirement of this SOW and as described in detail in the DCD set of documents. The Prime Contractor

may employ subcontractors to fulfill the required workload in accordance with the subcontracting plan

presented in the proposal. Level of Subcontracting shall not exceed 60 percent.

The main objective of the construction contract is to provide all necessary material, equipment,

resources and services required to install and commission the above listed infrastructure works in line

with the notional project implementation schedule in Table 1.

The contract with the Contractor shall be in effect for the duration of the Container Building Facility

project until completion of the construction, plus as long as the termination of the warranty period and

until satisfactorily completion of all warranties. Key milestones of each project phase are clearly stated

in the work schedule depicted in Table 1. The construction services shall be completed no later than

4.1 List of deliverables

o Submission of the announcement form for commencement of the construction

works to the Military Construction Authority. The application form is at Attachment 6.

o Provision of construction services with the required inbuilt equipment for the

Container Building Facility Project in accordance with this document and the DCD

documents.

o Removal of construction and demolition waste and disposal outside of the Air

Base and place in an official dump place.

o Conduct and administer the record of the Handover of the Site.

o Opening and administering the construction log in accordance with the relevant

191/2009. (IX. 15.) Govt. Decree.

o Conduct and administer the record of the construction coordination weekly

meetings by NSPA and the weekly reports specified later in this SOW.

removal instructions and special care) is required. Duration of training shall be

adequate to thoroughly train O&M procedures specified by the manufacturers.

• Certifications of used materials; test result certificates; warranty

documents; operation and maintenance manuals; and the minutes of training

held for the users and operators.

• Operation & Maintenance (O&M) Documentation. The Contractor shall

provide O&M documentation for the delivered works. The O&M Manual shall

include descriptions of the operation and maintenance of the delivered

structures, systems and equipment. All documentation shall be in English and

Hungarian.

• Testing of the mechanical, electrical equipment/accessories as well as

the provided utility systems. Records of the testing and commissioning of utilities,

mechanical, electrical systems and equipment in accordance with the relevant

regulations and best practice available on the market.

Based on the Pre-Final Inspection statements provision of the of snag list correction of the of

snag list NLT the deadline set in the Pre-Final Inspection record.

o Organize and conduct Technical Handover-Takeover (HOTO), provision of the

Complete Technical Handover-Takeover Documentation according to the relevant

regulations, including:

• Record of the handover-takeover,

• Record of the coordination of the public utility with NSPA and PAB (if

applicable),

• Keys, inbuilt equipment’s accessories (thermo control units, BMS units )

and security system manual update relating to the new modifications, completed.

o Upon successful handover-takeover process:

• Coordination with the Military Construction Authority and submission of

the announcement form for the commencement of the occupation permit

procedure. The application form is at Attachment 7.

• Coordination with the Jász-Nagykun-Szolnok County Disaster

Management Directorate (Water Protection Authority) and submission of the

announcement form for the commencement of the water right operation permit

procedure. Authority procedural fee (in accordance with the 13/2015. Decree of

Ministry of Interior) shall be paid by the Contractor on behalf of the NSPA.

• The Contractor shall be the responsible for obtaining the necessary

permits on behalf of the NSPA.

o Deliverables requiring certification from a professionally qualified individual are

identified below:

• Quality Management Plan.

• Health and Safety Plan.

• Prefabricated structures shop drawings and documentation.

• Sampling and Qualification Plan.

4.2 Administration services for the activation of the container building facility and the utilities

Submission of the activation announcement to the Military Construction Authority, the

transfer of ownership of the change. In accordance with the 59/2010. (HK 5.) HM IÜ-HM KPÜ

common regulation Annex 4, submission of the activation documents (Certificate for building, facility fileing) to the MoD Defence Economic Bureau, including the required annexes,

corresponding to the substantive and formal requirements prescribed by law for further

administration in the property management database.

4.3 Bill of Quantities (BoQ) The design documentation consist the designer bill of quantities in Attachment 4. The

Contractor may check all quantities on site before the submission of the proposal. The

Contractor is authorized to augment the BoQ with the works which deemed to be necessary to

complete the Container Building Facility. These items are subject for approval by the TO.

5 Technical and Commercial Requirements Technical equipment and materials specified in the DCD are replaceable by other compatible

equivalent, but must be certified to conform standards defined in the DCD and this SOW.

In case of deviation from the planned materials determined in the DCD, the manufacturer`s performance

certificates of materials and detailed specifications have to be provided with the offer for control and

acceptance by NSPA TO. Considerations to constructability, durability and sustainability have to be

followed when selecting materials.

Materials to be used for the execution works shall require approval by NSPA TO before being placed

or installed. After contract award the contractor has to submit the manufacturers` performance

certificates of the applied construction materials, accompanied by a material approval form. NSPA

reserves the right to control and mark the materials upon delivery to the construction site - only approved

materials can be built in by the contractor.

The proposed deviations (make and type) accompanied with specifications or manufacturers’ performance datasheets/certificates have to be submitted with the bid if different than the designed products are offered.

The detailed shop drawings of prefabricated steel structures, including specifications and installation

method statement shall be developed by the contractor after the contract award. However, the provision

of the offer manufacturer`s basic data, references and quality management system certificates - ISO

9001 certificate is mandatory.

This document complements the requirements for construction and shall be handled together with the

DCD and specifications. The drawings in the design package are standard with proper dimension signs

and are provided in PDF format.

A detailed construction schedule and an illustration of how Contractor’s personnel and equipment shall

be deployed in the designated work area (work organization layout) must be presented as part of the

proposal.

Standard working hours of Papa Air Base as well as the SAC HAC compound: Monday to Thursday:

7:00-17:00, Friday: 7:00-14:00.

Contractor shall request permission minimum ten (10) working days in advance from Papa Air Base

Commander, and coordinate with NAMP INFRA and NAMP Security Office to work overtime outside

standard working hours and/or during weekend.

The contractor is responsible to coordinate visitor request with Papa Air Base Ops at

([email protected]).

6 Required Project Organization

During the period of performance, the Contractor is responsible for providing qualified personnel at all

stages of the project and shall ensure that the personnel are adequately qualified and experienced to

fulfill the task detailed in this SOW and in the design documentations.

A preliminary Organization Chart shall be provided as part of the proposal, indicating those individuals,

in addition to the Project Manager, having primary responsibility for key project activities such as site

management, engineering (staff of the technical office), quality management, documentation

management, quality control, testing and laboratory management, surveys. The organization chart shall

also identify all major subcontractors and suppliers and their primary points of contact. The Contractor

shall also include in his proposal brief curriculum vitae (CVs) of all the key personnel. The

Organizational Chart shall be updated and provided to NSPA whenever key personnel changes or

additions are made.

The Project Manager who shall be responsible to the NSPA for the coordination of the entire project

shall be a qualified Engineer, with at least eight (08) years of relevant professional experience and

project management experience in at least three (03) contracts of similar nature/magnitude to this

project.

The designated full time Site Manager shall represent the Contractor in all matters related to technical,

organizational and administrative issues arising from the day-to-day activities of the works. The site

manager shall have a proven level of qualifications and experience in the management of work of similar

type and extent, enabling him to resolve technical and administrative problems that may arise in the

course of the ordinary activities of the works, and controlling the subcontractors without having to defer

to higher authorities for all decisions. He or she shall be a qualified Civil Engineer specialized for

construction with at least eight (08) years of relevant professional experience and site management

experience in at least three (03) projects of similar nature/magnitude to this project.

For the key staff deployed on site fluency in English (written and spoken) is a mandatory requirement;

in order to communicate with construction and other authorities fluency in Hungarian (written and

spoken) is also required.

6.1 Personnel Requirements as per Exhibit III (Technical Compliance Form-TCF)

In terms of the requirement for the key personnel required for this project such as Project

Manager, Site Manager, QA/QC Manager and H&S Manager detailed information is provided in

the Technical Proposal Form, which shall be part of the tender documentation.

The Site manager must be a registered engineer as the Responsible Technical Supervisor and this must be recorded on the TCF by submitting the registration certificate. Minimum team composition of involved engineers and experts for the following construction

works disciplines is required (all senior engineers registered in the relevant chamber of

engineers):

o Architect or Civil Engineer.

o Mechanical engineer/Supervisor expert.

o Electrical engineer/Supervisor expert.

o Health and safety expert/QA/QC manager.

During the period of performance, the Contractor is responsible for providing qualified and

skilled personnel at all stages of the project and shall ensure that the personnel are adequately

qualified and experienced to fulfill the task highlighted in this SOW.

The Contractor shall ensure that its personnel are adequately insured, physically capable and

in good health medical condition, and professionally skilled, to fulfill their duties under this SOW.

The Contractor’s personnel shall be in possession of citizenship of a NATO Member Nation.

In case of the replacement of the Site Manager, a new person shall comply with all qualification

criteria set in the Technical Proposal Form. NSPA shall be informed prior to the change. The

Contractor shall submit the CV within ten (10) working days to the NSPA for review and

acceptance.

Were NSPA Contracting Officer, based upon prior information provided by and consultation with

NAM Technical Officer, to judge as inadequate the qualification or performance of the Site

Manager, the Contractor shall replace him / her at his own cost and without delay and no later

within ten (10) working days. Contractor request for replacement of the Site Manager shall be

provided to the Contractor by the CO.

6.2 Cross-border provision of services

Non-Hungarian companies shall be registered by the Hungarian Chamber of Commerce and

Industry as authorized building contractors in accordance with the governing Act 76 of 2009 on

the General Rules for the Initiation and the Resumption of Service Activities 12. § (1) and the

Act LXXVIII of 1997 on the Formation and Protection of the Built Environment Section 39. §.

Directive 2006/123/EC of the European Parliament and of the Council of 12 December 2006

on services in the internal market, refers.

7 Quality Management of the Contractor

The Contractor shall have an in-house quality control system in accordance with the applicable ISO

9001:2015 or NATO AQAP 2110 (Quality Assurance Requirements for Design, Development and

Production) standards. The contractor shall develop and submit the Quality Management Plan.

The Contractor shall institute a quality assurance system to demonstrate compliance with the

requirements of the Contract. NSPA shall be entitled to audit any aspect of the system.

The Contractor shall perform and document all quality control throughout duration of construction,

installation, testing and commissioning. The Contractor shall employ a qualified Quality Manager to

support the project quality assurance.

The QM plan shall be followed and amended as required by the Quality Manager and the final version

of the QM plan and its annexes must contain the full package of test results and measurements.

Details of all construction procedures and compliance documents shall be submitted to NSPA for

approval before execution stage is commenced. When any document of a technical nature is issued to

the above, evidence of the prior approval by the Contractor himself shall be apparent on the document

itself. The updates of the QM plan have to be summarized monthly and included in the monthly

summary report.

The contractor shall make available equipment and supplies to the NAMP Project Officer and or NAMP

designated construction supervisors in order to carry out their duties associated with measuring and

validating works performed.

Approval stages shall be defined based on the final schedule after contract award. After finalization of

the current stage the contractor is obliged to ask NAMP Technical Officer`s approval before proceeding

with the following work stage. The Contracting Officer’s Technical Representative assigned and

responsible for surveillance and oversight of the Contractor’s efforts to perform the work requirements

described herein is the NSPA Technical Officer.

7.1 Quality Control, Inspection and Acceptance

For the purpose of performing Quality Control Inspection of the works, NSPA delegates this

function and associated authority to the TO who has the overall authority conferred to him by

this Contract as concerning Inspection and Control of the quality of materials, equipment

acceptance and workmanship used in performance of the works delivered. “Additionally, his

responsibility includes validation of quantities of items of work for partial invoicing.

All specified requirements included in this Statement of Work are subject to Quality

Control/Quality Assurance to the satisfaction of the TO, unless specifically directed otherwise

by NSPA. The TO shall have all necessary access to perform the required QC/QA activities.

Technical acceptance will be performed by the NSPA TO.

7.2 Approvals of Materials and Equipment All construction materials and equipment shall require prior approval by the NSPA TO prior to

its order, delivery and installation at the Site. The Contractor shall provide material / equipment

submittals in written form stating brand, type, make, major characteristics, compliance with SoW

and specifications. Original documentation from producer shall be attached to the submittal.

All submittals shall be signed or declined in writing by the NSPA TO within five (5) working days.

Material submittal form shall be presented as per Attachment 8 Documented

Contractor failure to provide submittal in sufficient advanced time or in accordance with

specifications shall not waive project delivery timelines or quality of works required. The

Contractor shall put forth all effort to prevent late submittals to happen.

The declaration of performance of all construction materials and equipment shall conform to the

275/2013. (VII. 16.) Gov. Decree on the detailed rules for the design and installation of a

construction, and the required certification of performance.

7.3 Pre-Final Inspection For the facilities which will be delivered prior to the Final Inspection and Acceptance, a partial

acceptance shall be conducted by the TO (in coordination with the end user). Title for said items

work shall be transferred to NSPA and owner at that juncture. Title to remaining works shall

pass to NSPA upon final acceptance of the entire project.

Near the completion stage of all work or increments thereof, the QC Manager, the Technical

Controller and the TO shall perform a pre-final inspection and develop a “snag list” of all

deficiencies detected-if any. This list shall be formally documented and signed along with the

estimated date by which all the deficiencies shall be corrected. If upon inspection, any

construction work is determined by NSPA to be unsatisfactory, re-inspection shall be performed

after correction of the noted deficiencies.

The QC Manager shall perform follow-up inspections to assure that all deficiencies have been

corrected before notifying the TO to arrange for the Final Inspection and Acceptance.

The formal of test reports and commencement of commissioning procedures pertaining to

certain mechanical and electrical systems, such as those to be performed by manufacturer’s

representatives shall be furnished by the Contractor to the NSPA TO for review and comment

prior to the preparatory inspection.

7.4 Final Inspection and Technical Acceptance The QC Manager shall notify the TO within ten (10) working days prior to the date to perform

the Joint Final Inspection. The Joint Final Inspection shall be organized by the Contractor and

a call for attendance shall be sent to officials of NSPA, PAB Authorities, HUN MoD, Technical

Inspection Service Provider, and Responsible Designer.

Record of the statements made by the parties shall be included in the record of the final

inspection, as well as the recognition and approval/disapproval of the completed works and the

declaration of the satisfactory performance of the Contractor in accordance with the SOW

requirements.

Technical acceptance on behalf of NSPA shall be performed by the TO who shall sign the NSPA

Final Inspection and Acceptance certifying that the services performed are in accordance with

the contractual requirements. However, claims based on latent defects, fraud, gross negligence,

or such gross mistakes as amount to fraud shall not be prejudiced thereby, nor shall the

guarantees applicable to the items or services furnished by the Contractor be affected by such

acceptance.

8 Mobilization and Lay-down Yard The first ten (10) working days after the handover of the site shall be designated as mobilization period,

after which the Contractor shall have all essential equipment and personnel in place to commence

execution of the requirements of this contract. The Contractor is free to finish the mobilization earlier

and may start the preparatory works at an earlier stage, however not prior to the site hand-over.

In order to establish site office and facilities at Papa Air Base inside the perimeters based on the relevant

design chapters the Contractor is required to submit a Mobilization plan not later than ten working days

after Notification of Contract Award or signature of Contract. Supply route on the Air Base in principle

is from Gate No 2 or potentially Gate 3 (TBC), which shall be coordinated with PAB officials.

NSPA will not provide any furnished property, accommodation, logistic support and / or security

measures to sustain the activities of the Contractor in performance of this contract. Accordingly, the

price quoted by the Contractor shall include the mobilization of all equipment, human and material

resources needed to accommodate his personnel, including catering, sanitary, rest facilities, all in

addition to required plants and machinery, energy, fuel and water supply, storage, power and

communications.

The Contractor can connect to the existing utility lines (power and water supplies) within the base

against payment, noting that provision and installation of instruments for measuring the consumption

must be provided by the Contractor and approved by the PAB administration. Alternatively the use of

utilities can be paid in a lump sum to MoD based on separate agreement representing 0,1% of the

contract value per each utility used. The connection to the specific utilities will be confirmed during the

site visit but all connection fittings shall be provided by the Contractor. The designated lay-down area

assigned to the Contractor for the project ancillary works (office containers and mobile WC) will be

confirmed on the site visit.The Contractor will then be responsible for the site and its lay down area

installation, its maintenance and cleanliness and restoration to PAB/NSPA. Note that sewage and water

network is not available on the lay-down yard.

Designated material storage will be the same as the lay down area.

The Contractor shall restore the lay down to the construction to its original state as part of its

demobilization according to the state before the construction.

8.1 Flight Driving Training Standards It is mandatory for drivers to adhere to flight driving standards if required to drive in specfic flight

areas. All drivers are to receive the necessary training if required before construction

commences.

8.2 Interruption of Public Services

NSPA will not be liable for interruption of utility services (power, IT, water, sewer.) caused by

the Contractor in performance of this Contract and shall not be liable for Contractor’s delays,

damages, or increased cost occasioned by such interruption of services.

All temporary outages in any utility services of PAB Buildings required for the performance of

work shall be scheduled with PAB POC (Maj Attila ORBAN/Maj Zoltan MONEK), no less than

five (5) working days in advance of such outages and shall be coordinated in writing.

8.3 Working environment

The construction sites inside PAB and internal roads shall be maintained in a neat/clean and

Quality manner in accordance with sound industrial practice and H&S plan in force for this

project. If requested by PAB, the Contractor must provide cleaning machinery and cleaning

procedure to keep the affected roads and pavements, as well as the adjacent roads (main traffic

corridors, storage sites) in good and clean condition (e.g. the traffic roads shall be cleaned from

soil, dirt, bituminous material).

The access roads of the construction site shall be cleaned at minimum at the end of each

working day by no later 06.00 p/m if applicable. NSPA/PAB reserves the right to order ad-hoc

cleaning (e.g.: hazard to safety or environmental issues) activity if it is required on the site.

The Airbase normal daily operation interruption and disturbance shall be avoided, or at least

minimize as much as possible. Therefore, the Contractor is responsible to take every effort to

protect noise, vibration, litter, dirt and dust contamination of the PAB/NAMP/HAW/Boeing

facilities and working environment.

The Contractor shall store all supplies and equipment on Site in the designated Lay-down Yard,

so as to preclude theft or damage.

The demolished construction waste and material wrapping shall be stored in closed containers

at all times on the Site until final disposal out of the Base in order to prevent pollution of the

Airbase territory. The Contractor shall make every effort to prevent such incident.

The Contractor shall have in their compound personal safety equipment, in kit form, composed

of minimum safety helmet and visibility vest, to distribute to visitors to the site or persons

designated by the TO. Minimum five (5) safety kits for visitors shall be made available at all

times during construction.

The Contractor shall maintain the construction site and lay-down yard in line with environmental

protection standards. As a minimum measure, the Contractor shall:

o Establish an Environmental Plan.

o Store all toxic materials and chemicals in weather and third party protected

shelter with controlled access.

o Petroleum, oils, & lubricants (POL) shall be kept in secure container preventing

contamination to the area.

Prevent disposal of toxic materials and POL into the camp drainage and sewer system.

All the materials shall be disposed properly in accordance with European / Hungarian

environment protection regulations.

o Provide a de-contamination kit to treat POL leaks. The construction site shall be

equipped with minimum one kit containing: shovel, sand, treatment chemicals, plastic

barrels for contaminated soil.

9 Regular Reports & Meetings

9.1 Reports

The Contractor shall prepare and provide to NSPA reports on at minimum weekly basis as per

the template at Attachment 9.

The reports shall be forwarded to the TO at minimum one working day prior to the weekly

construction meetings.

The weekly reports shall include (but not to be limited to): o Work progress for the reported period.

o Scheduled works for upcoming week.

o Update of the implementation plan / project implementation schedule (if

applicable).

o Health & Safety issues (if applicable).

o General issues (if applicable) that can impact completion time, cost or quality.

This can be for example weather conditions, security arrangements, supplier problems,

o Technical issues (if applicable) that can impact completion time, cost or quality.

o Pictures of works carried out in the reported period.

9.2 Weekly meeting

There shall be weekly construction meetings organized by the Contractor. The meetings shall

be chaired by TO and attended by NSPA/PAB/MOD HU officials and the Site Manager. If

required, the meeting can be attended by third party (sub-contractor, designer, technical

inspection service provider, and construction authorities). The main purpose of the meeting is

to discuss the weekly report, project progress, any issues and coordination with base authorities.

The meetings shall be recorded in the site diary, and as per request by NSPA TO, minutes of

the meeting shall be prepared by the Contractor and submitted to NSPA TO within five working

days after the meeting. A Template of coordination meeting minutes is provided in Attachment

10.

9.3 Other Meetings NSPA reserves the right to request other meetings on an ”ad hoc” or as determined necessary

meetings with at minimum 24 hours prior notice to the contractor. It is the responsibility of the

contractor to record and issue minutes of all meetings held relating to the project.

9.4 Photos-Mobile Device Recording-Prohibited

It is prohibited to take photos and/or to conduct recording by mobile devise of the airport flight

line area.

10 Testing and Commissioning

10.1 Testing and Acceptance Schedule

The Contractor shall prepare Testing and Acceptance Schedule and submit it to the TO for

approval not later than five (5) working days before planned testing as per approved project

schedule.

10.2 Testing Arrangements

The Contractor shall submit to the TO description of testing methodology for respective

materials, structures, equipment or utilities prior to commencement of tests. The testing

methodology shall describe testing process, testing tools (machinery) and values required by

applicable standards. The Contractor is responsible for application of relevant testing methods.

Submission of testing methodology to the TO, does not waive Contractor’s liability.

The Contractor shall record and document all tests. Test results shall be recorded on testing

protocols.

The Contractor shall submit draft of testing protocol for each system, equipment or materials to

the TO prior to first testing. The protocol shall include (but not be limited to):

o Subject of testing.

o Testing method.

o Place and time of the test.

o Place and time of sample recovery (if applicable).

o Results.

o Standard values (as required by applicable standards).

o Comparison of test results to standard value.

o Recommendations.

At the discretion of NSPA, the testing may be witnessed by a NSPA representative or a qualified

third party to be nominated by NSPA.

All test sheets when completed shall be signed off by the Contractor’s qualified representative

prior to inclusion in hard and soft format, provided to NSPA as part of the technical

documentation.

The Contractor shall provide the TO with one hard copy of all testing protocols. Minimum one

hard copy of testing protocols shall be filed by the Contractor in the Site office.

The Contractor may request earlier testing of selected areas. This initial (earlier) testing shall be

approved by the TO in writing.

Testing of materials, structures and surfaces shall be executed as requested in applicable

standards and technical specifications. The testing shall be executed by the Contractor’s

personnel using identical technical documentation to that provided as sample.

All test equipment shall be calibrated and current valid calibration certificates shall be made

available for NSPA inspection.

11 Construction Documentation Submittals in the Proposal (Technical Compliance Form)

11.1 Method of Statement

The Contractor shall provide the Method of Statement in the proposal, which shall describe the

technological order of the construction works and shall include (but not limited to):

o Basic engineering data (name of the structure, procedure).

o Construction materials (type, quantity, quality).

o Proposed machinery (type, capacity, quantity, reserve).

o Different work phases in chronologic order and their requirements.

o Quality control (in accordance with the Sampling and Qualification Plan).

11.2 Outline Quality Management Plan

The Contractor shall provide the Outline Quality Management Plan in the proposal, which shall

include (but not limited to):

o Project organization & duties of personnel in Quality Control (QC) process.

o Responsibilities of leading personnel.

o Description of basic construction methods with stress to QC for all parts of the

project.

o Weekly reports on QC issues (to be added during construction period).

11.3 Project Implementation Schedule The Contractor shall provide the Project Implementation Schedule (PIS) in the proposal. The

PIS shall maintain the working schedule during the project that consists of establishing,

developing, reviewing and updating the project Work Breakdown Structure (WBS) and

schedules for the Project in MS Project format.

11.4 Construction Liability Insurance The Contractor shall have appropriate construction liability insurance valid for this type of

activities and the insurance must cover initially the value of the bid and later modified to cover

the value of the contracted services (supplemental agreements inclusive). The liability insurance

contract shall be issued by an insurance company located in one of the NATO Member Nations

and shall remain valid until End of Warranty period – To be Determined).

Insurance requirements are applicable as specified in the Terms and Conditions of the

Contract and General Provisions hereto.

12 Construction Documentation Submittals prior to the handover of the site

12.1 Detailed Construction Work Organization Plan (DCWOP)

The Contractor shall prepare Detailed Construction Work Organization Plan (DCWOP) for the

construction works to present the feasibility of the construction works of the designed facilities

in line with the Project Implementation Schedule.

In DCWOP the organization of construction works in space and time shall be presented with the

designation of:

o Storage areas for construction materials;

o Access roads to the construction sites for heavy vehicles used to transport

construction materials, or used to support the construction.

o The Contractor shall not block (e.g. provides at least half-lane traffic flow) the

SAC HAC roads in order to provide uninterrupted operations of SAC Community for the

aircraft operation support equipment.

o Location for temporary rest/office containers for construction personnel;

o Estimation of utility demands of construction works, planning of supply of

construction works with required utilities.

o Areas which need to be limited in use during construction works in line with safety

regulations

12.2 Sampling and Qualification Plan The Contractor shall provide a Sampling and Qualification Plan in the relevant detailed

construction design. The plan shall include (but not limited to):

o Name of the examined element.

o Test protocols according the relevant regulations.

o Frequency of the test.

o Result of the test.

o Name of the accredited testing institution.

13 Health and Safety The Contractor shall comply with the DCD’s Health, and Safety Plan, which shall take into consideration

the safety regulations of Papa Air Base (Attachment 11).

The Contractor’s personnel before start working in PAB/SAC HAC premises shall attend a Security Health and Safety briefing/training organized by the Air Base and the training record shall be attached

to the Construction Log.

13.1 Security The Contractor shall comply with all the security and safety regulations of Papa Air Base during

the performing of its service in the Air Base. Latter requires formal acceptance by the Contractor

prior the commencement of the services.

The project as a whole does not have requirements for security clearances. All personnel

involved in the project shall obey the security instructions. If during the life of the contract security

issues should arise, the Contractor will be notified accordingly.

14 Reserved 15 Defects If there are controversies over the cause and/or responsibility of a non-critical defect it shall be

determined and resolved by the client consulting with NAM TO whom in turn will consult with NSPA

Contracting Officer. The Contracting Officer within 10 working days shall request and chair meeting at

PAB with a) client, b) NAM TO and c) Contractor and to come to a decision.

15.1 Critical defects Immediate notification will be made to the Contractor in written format by the designated

representative of the client on defects of critical nature, defects that affect operations, life safety

critical defects. The notification shall require that the Contractor provide within two (2) working

days written response with the proper diligence and according to the contractual terms and

conditions.

15.2 Non critical defects A list of noncritical defects will be maintained by the designated representative of the client and

presented at the yearly warranty inspections. Defects that are found to be user abuse or

improper operation or maintenance and operation are the responsibility of the HUN MoD.

15.3 Procedures During the Defect Notification period it shall be the responsibility of the HN to contact the

contractor to fix any defects.

Repair of defects should be executed as soon as possible according to a schedule provided by

the Contractor and agreed to by PAB.

Warranty repairs that cannot be completed within the validity of the warranty claim period shall

be satisfactorily resolved within a reasonable period of time after the expiration of that warranty

period. Reasonable period of time shall be acceptable to PAB by commencing repair services

with no later ten (10) working days after notification of the warranty and completion by no later

twenty (20) working days after commencing the repair services.

In all of the cases the NAMP Contracting Officer requires to be kept apprised of critical warranty

actions, so as to take the lead in coordination with PAB to correct the identified deficiencies by

the most expedient means possible, especially with regard to the resolution of possible

disagreement and coordination of using performance and warranty bonds.

15.4 Period of services The contract with the Contractor will be in effect for the duration of the Project until completion

of the construction and the three (3) year warranty. Each project phase shall be clearly stated

in the proposed PIS work schedule provided by the contractor, however, the later or earlier than

planned start for similar duration of required QA services shall not cause any additional claim

within three months project tolerances.

15.5 Language of work and training NAMP`s primary working language in this project is English. Therefore, the language of all

meetings, emails, and any submittal documentation will be in English. The language of all

submittals and of communication on the project site with NAMP Technical Officer in case the

end users be present will be in English, otherwise as prior agreed by NSPA in Hungarian. The

Contractor designated team shall provide support to the NAMP Technical Officer to translate

requests from construction authorities and or related correspondence.

The Design Documentation is a bilingual English - Hungarian documentation with bilingual

drawings.

The official language of submittals of permits and general communication with local authorities

is Hungarian. Documentation required by Hungarian General Construction Regulations shall be

Hungarian for example construction journal, health and safety plan kept on site

Should the commercial manuals for operation and maintenance exist only in English, the prime

contractor for construction shall provide a Hungarian translation. Training on maintenance and

operation for the assigned personnel of the end user is Hungarian.

16 Access to the site The Contractor shall send the Request for Temporary Visitors Pass to the Base authorities as described

in the form (Attachment 12) no later than ten (10) working days before the first scheduled working day.

Employers who carry out construction or similar types of activities, subcontractors of those, employees

of those – including temporary ones – who do not hold Hungarian citizenship can only enter military

establishments if they hold a valid EEA registration card or a residency card. Employees who are third

country citizens must hold a valid work permit.

• COVID-Access to PAB – as of 26.01.2021:

“Companies are advised to consult with the Embassy / Consulate representing their Country in

Hungary as it relates to the restrictions published by the Government of Hungary on entering

into Hungary.

Persons, which are permitted to entering Hungary for service purposes of NATO or Hungarian

Defense Forces (HDF) , their entry to Papa Air base (PAB) is permitted only by the

Commander of HDF and with taking into account the epidemiological provisions in force.

Authorization and endorsement must be initiated within a minimum of fourteen (14) days prior

to travel) AND Person(s) entering Hungary must go into a ten (10) day quarantine.

This quarantine can be shortened if person(s) can credibly provide two (2) negative CORONA

Virus (PCR) tests which are 48 hours apart within 72 hours timeframe.

The PCR test(s) result(s) must be in either Hungarian or English language version(s).

EEA and EU citizens, as well as citizens of Iceland, Lichtenstein, and Norway are granted freedom of

movement within EEA member states.

In any future contracts, Hungarian Defense Forces must demand that the condition of entry for non-

Hungarian citizens into HDF establishments is an EEA registration card, a residency card, or a valid

work permit as per 2007/I. law about entry and residency of people who have the right to freedom of

movement and residency; and 2007/II. law about the entry and residency of a third-country citizen.
