Standard vs. Technical Regulations

Standards and Technical Regulations have different implicationsfor international trade.If an imported product does not fulfil the requirements of atechnical regulation, it will not be allowed to be put on sale.Whereas, in case of standards, non‐complying products will beallowed on the market, but their market share may be affectedby consumer’s preference to standard product.
Conformity with standards is generally voluntary, butTechnical Regulations are by nature mandatory.

Some of the important Technical Regulations of TEC are:
Implemented through provisions of license EMF emission norms from Mobile BTS Cellular service roll‐out obligations for different
technologies. Technical Requirements for the FSS satellite network
operation under the CUG‐VSAT license. Implemented through executive orders. SAR limits for mobile handsets of 1.6 W/kg averaged
over 1 gm of tissue.

• Lack of enforceable legislative powers led toineffective implementation of few regulatoryprovisions, which necessitated amendment in theIndian Telegraph Rules, 1951.
• Section 7 of Indian Telegraph Act 1885 empowers theGovernment to frame rules for the conduct ofTelegraph.

7. Power to make rules for the conduct of telegraphs—• (1) The Central Government may, from time to time, by notification in theOfficial Gazette, make rules consistent with this Act for the conduct of all orany telegraphs established, maintained or worked by the Government or bypersons licensed under this Act.• (2) Rules under this section may provide for all or any of the followingamong other matters, that is to say:•xxx xxx• (e) the conditions and restrictions subject to which any telegraph line,appliance of apparatus for telegraphic communication shall be established,maintained, worked, repaired, transferred, shifted, withdrawn ordisconnected;•xxx xxx• (k) any other matter for which provision is necessary
for the proper and efficient conduct of all or anytelegraphs under this Act.

Indian Telegraph (Amendment) Rules, 2017 were notified on 6thSeptember 2017. Rule 528 to 537 were added by G.S.R. 1131 (E).Amendment in Rules will be effective from 1st October, 2018.
Part XI : TESTING AND CERTIFICATION OF TELEGRAPH 528 : Definition of OEM 529. Mandatory Testing- Any telegraph which is used or capable of beingused with any telegraph established, maintained or worked under thelicence granted by the Central Government in accordance with theprovisions of section 4 of the Indian Telegraph Act, 1885 (hereinafterreferred to as the said Act), shall have to undergo prior mandatorytesting and certification in respect of parameters as determined by thetelegraph authority from time to time

530. Authority for testing- (1) The testing shall becarried out by the telegraph authority or any otheragency designated by the telegraph authority.
Indigenous products - OEM to be responsible.(R.531)

Certification necessary for all telecom equipment, priorto sale/ import/ use
Exemptions with prior permission allowed for R&D/Demonstration/ sample for mandatory testing, forlimited numbers of equipment
Equipment, not prohibited in India, personallyaccompanied on inward foreign travel to India forpersonal use, are also exempted on self‐declaration.

Certification required only once for one model ofequipment, and is applicable for any quantity of the samemodel of the equipment.
Certificate is normally valid for 5 years, it can be renewedwithout re‐testing, if Essential Requirements (ERs) remainssame.
Quality and reliability of equipment is not in purview ofthis procedure

Essential Requirements (ERs)

Technical Regulations enforced under theMTCTE framework will be in the form ofEssential Requirements (ERs) comprising of :• EMI/EMC Requirements;• Safety Requirements;• Technical Requirements;• Other Requirements viz. SAR, Panic Button, IndianLanguages, RoHS, IPV6 etc. as applicable;
• Security Requirements.
ERs will be broadly based on relevant International standards and global regulatory best practices.

• Web based, end to end online process• Inputs from stakeholders for ER formulation.• Work‐shops, Seminars, awareness programmes etc.for information dissemination.
