AGENDA ITEM NO. 272.2
Subject: To take decision about existing taxi stands and amendments in Terms & Condition for allotment Taxi Stands.
This case pertains to the Taxi Stands running in the Chandigarh. The
brief history of the same is as under:
Presently, there are 61 number taxi stands running under control of
Municipal Corproaiton, Chandigarh. Initially, they were 62 in number, but, one
taxi stand i.e. Taxi Stand, Sector 17, Chandigarh is not running from its allotted
site due to Construction of Multi-level parking in Sector 17, Chandigarh.
The detail of these 61 taxi stands is as under:

The Worthy Commissioner, Municipal Corporation,
Chandigarh vide order dated 06.12.2012 cancelled 24 Taxi Stands out of 37 taxi
stands which were allotted by the Chandigarh Administration due to non-
fulfillment of eligibility criteria as per clause 3(a) and clause 12 of the Terms &
conditions (Annexure „A‟).
An agenda was placed before the F & CC in its meeting held
on 17.8.2012 regarding re-allotment of 37 Taxi Stands to the existing licensees.
But 24 licensees did not fulfil the prescribed conditions. Therefore, the F&CC
decided that the Taxi Stands of Sr. No. 1 to 13 be re-allotted for further period of

3 Years extendable up to 5 years in total and Taxi Stands from Sr. No. 14 to 37
be cancelled and re auctioned and fresh applications be invited. (Annexure „B‟).
The licensees of the said 24 cancelled Taxi Stands approached the
Hon’ble High Court through 12 CWPs demanding cancellation of the above said
orders of the Commissioner. Municipal Corporation, Chandigarh.
The Worthy Commissioner, Municipal Corporation filed an affidavit in
Hon’ble High Court submitting all the facts. (Annexure „C‟).
The Hon’ble High Court passed order dated 15.7.2013 which is reproduced below:
“The other averments taken in the affidavit coupled with the
statement made by the learned counsel for the parties, these writ petitions
are allowed. Impugned orders separately passed in each case are ordered
to be set aside. However, liberty is granted to the Municipal Corporation,
Chandigarh, to pass fresh orders, in accordance with law. It is further
made clear that till the appropriate fresh order is passed by the Competent
Authority, status quo as it exists today shall continue.
During the course of hearing, learned counsel for the petitioner
has fairly stated that the petitioner shall pay the ground rent within a
period of week from today. It shall be accepted by the Competent
Authority, however, without prejudice to the rights of the respondents.”
(Annexure „D‟).
As per the decision of the Hon’ble High Court, the matter was placed
228thbefore F&CC in its meeting held on 26.3.2013. The decision of the F&CC
is reproduced below:-
“The Committee considered & resolved that a Committee consisting of Councillors and officers be formed to consider this issue and
hear the defaulter Taxi stand licensees also. The Committee should submit
its recommendations within one month. Till then status quo be
maintained.” (Annexure „E‟).

As per above decision a Committee consisting of the Councillors and
Officers was constituted under the Chairmanship of Sh. Satish kumar Kainth,
Councillor, which gave its recommendation in its meeting held on 29.1.14.
(Annexure „F‟)
The recommendations of the said Committee were put up before the
F&CC in its meeting held on 29.5.2014 and the F&CC passed the following
resolution:-
“The Committee considered & resolved that all the occupiers of Taxi stands who have completed full term of 5 years be given time up to
31.3.2015 as a onetime measure, subject to clearance of all their
outstanding dues without any interest.
The Committee further resolved that detailed agenda be prepared
mentioning therein the next course of action be taken after 31.3.2015.” (Annexure‟G‟).
Again, a Committee consisting of Councilors and Officers was
constituted by the Mayor to give recommendation regarding Taxi Stand and to
finalizing the Terms & Conditions of Taxi Stands operating in city, held on
28.01.2015. The said Committee submitted its recommendations at (Annexure
„H‟) which were placed before the F&CC in its meeting held on 23.4.15. F&CC
considered the recommendations and passed the following resolution:-
“The Committee resolved to reject the recommendations given by
the Committee constituted by the Mayor for suggesting terms & conditions
for taxi stands.
It was further decided that a fresh Committee be constituted by
the Mayor to look into these issues afresh. The office was asked to frame
the terms & conditions for consideration of the Committee, so that the
Committee can discuss and resolve the matter in a fixed manner. In the
meanwhile, the F&CC considered and granted extension for three months
for existing taxi stands.’ (i.e. upto 30.6.2015.) (Annexure‟I‟).

As approved by F&CC the Worthy Mayor constituted a Committee to
finalise the Term & Conditions of taxi Stand, consisting of joint/Addl.
Commissioner, MC, Chd, SE(B&R), CAO, L.O., Supdt (parking), M.C., Chd.
The said Committee has discussed the matter in its meeting held on
03.09.2015 at 4.00 P.M. and recommended the amendments to be included in
the Terms and Conditions of Taxi Stands, which are placed below at
(Annexure‟J‟)

Minutes of the meeting of the Committee constituted for finalizing the
terms & conditions of Taxi Stands operating in City, held on 03.9.2015 at
4:00 P.M.
Following members were present:-

1. The Committee members recommended that in future the Taxi Stands
Should be auctioned to maintain transparency. The Committee further
recommended that 24 Taxi Stands whose period expired on 30.6.2015 and
other Taxi Stands whose term is going to expire very shortly should be
allowed to continue till the auction process is finalised. . The Committee
further recommended that this matter be got approved from F&CC and there
after from the House, if the House approved the same a speaking order is
to be passed by the Commissioner as per decision of the Hon’ble High
Court and after that the Taxi Stands would be auctioned.
2. The Committee is of the view that the taxis in the name of dependent (s) i.e.
family members like Father, mother, Wife, Son(s) and unmarried daughter(s)
should also be considered under Clause 3 (b) (i) of the terms and conditions
of Taxi Stands.

3. In case of partnership there shall be no Adda Incharge and name of all the
partners shall be mentioned in the allotment letter.
4. The Committee decided that only bonafide residents or entities
registered/existing or persons carrying out trades or business in Chandigarh
shall be eligible to apply along with proof of residence/operation. The said
proof of successful bidder may be got verified by mean as felt necessary in
case of doubt. If any information is found false, the allotment shall be
cancelled immediately and the entire amount deposited shall be forfeited.
5. The licensee shall supply a list of Taxis alongwith their registration number.
Only those taxis should be parked in the taxi stands which have been duly
registered as taxis with State Transport Authority, Chandigarh by the licensee
in his name or in the name of his/her dependent (s)
6. The Committee further recommended that penalty may be imposed
separately for violation of each clause of terms and conditions of Taxi Stands
and recommended the following penalties:-

7. Committee recommended that the maximum limit of the area of the taxi
stand should be 3500 Sq. Ft.
8. The Committee recommended that above recommendation should be
included in the existing Terms & Conditions. i.e. 22.3.2012.
Beside, the terms and conditions of taxi stands, the committee also
discussed and recommended that the following matters may also be taken
before the F&CC:-
1. The committee also consider the matter related to the Taxi Stand of Sector
48, Chandigarh and recommended that the terms of the said taxi stands
has not been extended after completion of three years for the last two
years, as the licensee of the said taxi stands does not fulfill the clause 3 (b)
(i), wherein he owned only 3 taxis in his name and the fourth taxi is in the
name of his wife. Therefore the matter may be placed before the F&CC to
take decision whether to extend the terms for another two years or the
same cancelled .
2. The matter w.r.t. taxi stand of Sector 18, Chandigarh was considered by the
previous Committee and it was recommended that the office should make
a request to the District Magistrate to de-notify the taxi Stand of Sector 18-
D, V-4 Road, Chandigarh and notified the same at Sector 18-A, V-4 Road,
Chandigarh and for the time being allowed the licensee to operate his taxis
from the same place and clear his all dues (i.e. ground rent and service
charges) regularly as the place where the taxi stand of Sector 18,
Chandigarh is running not notified by the District Magistrate, UT,
Chandigarh.
3. Committee has also recommended to make a request to the District
Magistrate to de-notify the taxi Stand of Sector 15, Chandigarh with the
request to notify the same at some other suitable place, as there is no
sufficient place for parking of public vehicle (s), and this issue was raised by
the area Councillor in the meeting of previous Committee.
The F&CC in its meeting held on 23.4.2015 had granted extension to the
licensees upto 30.6.2015. Now, the Committee has further recommended that
-
the existing licensees of the Taxi Stands and whose license period going to
expire very shortly should be allowed to continue till the auction process is
finalized.
A detailed agenda along with recommendation of the Committee was
placed before the F & C.C. in its meeting held on 21.12.2015. After discussing
the agenda in short the Committee deferred the agenda. (Annexure „K‟).
An Agenda was again placed before the F & C.C. in its meeting held on
16.06.2016 to take decision about existing taxi stands and amendments in
Terms and Conditions for allotment of Taxi Stand but no decision was taken and
the committee deferred the agenda. (Annexure „L‟)
Now, the matter is again placed before the F & C.C. for taking following
decisions:-
1. Whether the Taxi Stands whose term has expired or going to be expired in
Oct. 2017 be auctioned as recommended by the Committee Constituted by
the Mayor.
2. Whether the recommendation of the Committee be included in the present
Terms and Condition for auction of Taxi Stands.
3. Whether the existing Taxi Stand operators may be allowed to run Taxi
Stands till the finalization of auction process as recommended by the
Committee.
4. A decision regarding 24 Taxi Stands which were cancelled in 2012 by the,
then Commissioner, Municipal Corporation, Chandigarh has to be taken
and fresh orders are to be passed by the Commissioner, as directed by the
Hon`ble High Court in its orders dated 15.7.2013 and it has also been
directed to maintain status quo till then.
Accordingly, an Agenda is again placed before the F&CC for its
consideration and decision in the matter.

Subject:- Allotment of Idle Truck Parking, Sector 26, Chandigarh .
The F&CC in its 260th meeting held on 22.04.2016 passed the following
resolution (Annexure A):-
“ The Committee considered & decided that 50% of last bid of the parking lots would be the reserve price for auction and the term of the contract be six months or less, extendable upto one year with the existing terms & conditions.”
Accordingly, Idle Truck Parking, Sector 26, Chandigarh was auctioned for a
period of six months extendable upto one year vide this office memo no. 881 dt 08.06.2016 and
physical possession of the same was handed over to him on 15.06.2016. The terms of one year is
going to expire on 14.06.2017.
It is also pertinent to mention here that this parking is situated in the
transport area of Sector 26, Chandigarh and is meant for parking of trucks only. Presently, Sh.
Lalit Joshi is running the said paid parking at a license fee of Rs. 59.00 lacs. The said paid parking
is also not in the list of parkings which Municipal Corporation, Chandigarh is going to allot
through e-tender process, in a single lot.
The matter is placed before the F&CC to decide as to whether this parking
should be allotted through open auction or e-tendering and also decide the reserve price for the
same.
It is also proposed that present licensee may be allowed to run the said
parking till the allotment of license to the new successful bidder in case allotment is delayed
beyond 14.06.2017.

Subject: - Condemnation of 3 number enforcement trucks and fixation of reserve
price thereof.
The Finance & Contract Committee in its 270th meeting held on 16-3-2017 has
unanimously approved the purchase of 03 nos. Tata LPT 909 EX 2/38 chassis with cabin
PTOP BS-IV on DGS&D R/C. Accordingly purchase order was placed to the agency.
Simultaneously the case for condemnation of the old out dated trucks was processed and the
following trucks were placed before the Condemnation Board of Chandigarh Administration
vide this office memo No. SDE(M)/HO/(Mech. Section) 2017/2166 dated 24.03.2017 for
condemnation and fixing reserve price:-

Now the Condemnation Board of Chandigarh Administration has declared the
above said trucks condemned and fixed the reserve price of Rs.1,30,000/- (Rs. One Lac Thirty
Thousand only )for each truck (Annexure-1,2,3).
Agenda is placed before the Finance & Contract Committee for acceptance of
reserve price and approval to dispose off the above said trucks through public auction.

Subject: Rough Cost Estimate for Construction of Cement Concrete footpath inside
Green Belt in Sector 48-A,B,C&D, Chandigarh.
(Amount: Rs.28.33 lacs)
The rough cost estimate for Construction of Cement Concrete footpath inside
Green Belt in Sector 48-A,B,C&D, Chandigarh framed to facilitate for public convenience
besides beautifying the area as well the residents. The undersigned along with the SDE
inspected the site and found that cement concrete footpath is required because old existing
footpath has become undulatory and creating inconvenience in walking. The old paver blocks
footpath was constructed 9 to 10 years ago. The Area Councillor has also requested for this
work.
Accordingly, the rough cost estimate amounting to Rs. 28.33 lacs has been
prepared and submitted for arranging administrative approval and allotment of funds from the
competent authority of Municipal Corporation, Chandigarh. The scope of the work taken in the
estimate does not include in any earlier approved estimate.
1. Dismantling of existing kerbs

4. Refixing of old kerbs
5. Providing and fixing cobble stone of size 4”x4”x4”

Subject: - Rough cost estimate for purchase of 3 Nos Mazda Tippers for use in Roads Wing of
M.C., Chandigarh.
(Approx. Amount: - Rs.48.54 lacs)
The Secretary, State Transport Authority, U.T., Chandigarh vide letter
No.5672/STA/2016 dated 27.12.2016 ordered that no Transport Vehicles shall be allowed who are 15
years old as such there is urgent requirement of 3 Nos Mazda Tippers for use in the Road Wing of
Municipal Corporation, Chandigarh as the existing Mazda Tippers have crossed the prescribed time
limit of 15 years & cannot ply on the road further. There is a provision in the financial year 2017-18 to
purchase 3 Nos Mazda Tippers.
Accordingly a rough cost estimate amounting to Rs.48.54 lacs has been prepared for
arranging administrative approval and allotment of funds. The scope of the work entered in the
estimate has not been included in any earlier approved estimate.
The expenditure on this work shall be charged under Head “4217 (P) “Capital Head (Machinery
Equipment)”. The budget allocation cost of already approved estimate and expenditure incurred under this
head is as under:

Subject:- Regarding enhancement of fees of the Advocates in District Court, Labour
Court, Permanent Lok Adalat, Consumer Forum and Arbitration Cases etc.

The Municipal Corporation Chandigarh proposes to enhance the fee structure of
Advocates in the District Court, Labour Court, Permanent Lok Adalat, Consumer Forum and
Arbitration Cases of the MCC.
The some advocates who are on the panel of Municipal Corporation, Chandigarh
have requested to enhance the fee structure in the District Court, Labour Court, Permanent Lok Adalat,
Consumer Forum and Arbitration Cases.
In this connection, it is intimated that the departments like CITCO, Chandigarh
Housing Board or Chandigarh Administration has enhanced the fee structure of Advocates those are on
panel time to time, but the fee structure of the District Court, Labour Court, Permanent Lok Adalat,
Consumer Forum and Arbitration Cases has not been enhanced from the last 8 years by the Municipal
Corporation, Chandigarh. In Supreme Court/National Commission/National Green Tribunal at Delhi or
in High Court(s), the MCC follows the fee structure & panel of Advocates of the Chandigarh
Administration (Flag A) which has been enhanced/changed by the Chandigarh Administration time to
time.
The Municipal Corporation, Chandigarh is an autonomous body, therefore, our
advocates, those who are in the panel of Chandigarh Administration, are also engaged/appointed to
defend the cases in District Court, Labour Court, Permanent Lok Adalat, Consumer Forum and
Arbitration Cases etc and the fee structure is Rs. 2500/- & Rs. 3000/- per case (as per the order dated
24.08.2010 (Flag B) passed by the then Commissioner of Municipal Corporation Dr.Roshan Sunkaria,
IAS ) in the respective Court(s). In District Court, Labour Court, Permanent Lok Adalat, and
Consumer Forum, the public prosecutor or ADA are appeared to defend the cases on behalf of
Chandigarh Administration.

In view of above, the Finance and Contract Committee may be requested to adopt the

Chandigarh a common receipt centre (centralised collection point), bank extension
counter is required in the premises in the MC building so that all types of receipts is
received at a single point. The Engineering Wing, MCC has calculated rate of license fee
@ Rs.566/- per sft. Accordingly, it has been decided to allot a space of 125.27 Sq feet or
13.92 sq.yd = 11.64 sq. meter at Ground floor in the building of Municipal Corporation
Sector 17, Chandigarh for opening of OBC branch on the terms & conditions mentioned
in letter of intent for allotment of space for opening of OBC branch in the building of
Municipal Corporation Sector 17, Chandigarh on monthly licence fee basis as intimated
by the Chief Engineer, MCC.
The allotment of space has been allowed in principle by the CMC. The
letter of intent for allotment of space of bank counter (Annexure-A) has been issued to
the General Manager, Oriental Bank of Commerce, Sector-17, Bank Square, Chandigarh
on monthly rent/license fee @ Rs.70,872/- plus service tax etc. as calculated by the SDE,
Roads Sub Division No.1, Municipal Corporation, Chandigarh (Annexure-B).
The matter is placed before the Finance & Contract Committee for
consideration and ex-facto-approval.

235thw.e.f 06.04.2012 as per the decision of F& CC in its meeting held on

committee consisting of following officers:-

Subject:- Proposal for handing over of operation and maintenance of community toilets located at different locations in Chandigarh to local community/self
help groups under NULM.
There are 24 no. community toilet blocks located at different
locations in Chandigarh for the slum dwellers. The total no. of seats in all these
community toilets is 1323 no. The detailed list of community toilet blocks is
attached as Annexure-I. It has been proposed to handover the operation &
maintenance of these community toilet blocks by out sourcing preferably to the
members of local community residing in these slum areas/self help groups at a
grant of Rs.15,000/- per month per community toilet consisting of WC seats upto
20 nos. including the cost of required consumables by signing a MoU with the
Party. A copy of MoU duly vetted by the Law officer and checked by the Chief
Accounts officer is attached as Annexure-II. The total annual expenditure
involved will be Rs.121.00 Lacs. The expenditure will be charged to the A/mtc. of
toilets.
It has been duly allowed by the Competent Authority to place the
Agenda before the Finance & Contract Committee. Therefore, the Agenda is
placed before the Finance & Contract Committee for consideration and approval.

Subject: Estimate for B/I one no.12”x8” (304.80 x 203.20mm) i/d deep bore Tubewell (with reverse rig method or any method of latest technology) & other contingency
work in green belt, Sector 34-C, Chandigarh.
The existing T/well in Sector 34 is giving low discharge and not fulfilling the required demand of
drinking water supply in sector 34, Chandigarh. The residents of sector 34 are facing problem of shortage in
drinking water. The area councillor has requested vide his letter dated 02-05-2017 addressed to Chief Engineer,
M.C. Chandigarh for providing new tubewell to solve the problem of shortage or low pressure of water in
sector 34, Chandigarh. In view of the above, estimate has been prepared on the basis of field data submitted by
the SDE MCPH Sub Divn. No.9, Chandigarh for the generation of water. The water from the tubewell will be
used for filling the existing UGR and also to be connected with existing distribution network in Sector 34,
Chandigarh.
So it has been proposed to bore the Tubewell with suitable size screen, machinery, MS delivery
pipe & special and making connection with existing pipe line. Provision for providing and fixing of G.I. Sheet
shed and other civil work etc. has also been taken in the estimate The work shall be carried in the following
parts :-
Part – 1 : Tube well Drilling with stainless steel cage type wire wound screen.
Part – 2 : Pumping machinery of T/well & prov., fixing of G.I sheet shed & other civil work.
As such, an estimate amounting to Rs.42.25Lacs duly allowed by the competent authority is
placed before the Finance & Contracts Committee for its consideration and approval. The expenditure shall be

Subject: Installation of fountain in lieu of fountain to be dismantled in park in front of House No.162-65, Sector 27-A , Chandigarh.
A request has been received from Area Councillor (photocopy enclosed)
wherein it is brought out that the existing fountain is being used by the public for open
urination and causing inconvenience to the residents of the area and further requested to
shift the same within the garden area without toe wall so as to use the existing structure and
machinery . The site was got inspected by concerned SDE and found that the area in vicinity
is being misused due to existence of toe wall and even on removal of same, the
inconvenience to the residents will not be readdressed.
In view of above, it is further brought out that the fountain was installed in the
year 2012 including operation and maintenance but now due to request of the residents
through Area Councillor, it is proposed that the existing fountain be dismantled and new
fountain within the garden area using the existing machinery with tentative amount comes to
Rs.15.00Lakhs be provided.
Thus an agenda duly allotted by the competent authority is placed before
Finance & Contracts Committee for consideration and decision to approve in principal to
dismantle the existing fountain and provision of new fountain thereto in garden.

and observed that people are throwing waste in parks and stray cattle’s are also littering there
creating unhygienic condition and thus it is proposed that toe wall under existing railing around
various parks in Sector 34 should be constructed to safeguard these from stray cattle’s/dogs
and to keep the area neat and clean. The Area Councillor Smt. Ravinder Kaur Gujral has also
requested for this work.
Accordingly, the rough cost estimate amounting to Rs. 42.51 lacs has been
prepared and submitted for arranging administrative approval and allotment of funds from the
competent authority of Municipal Corporation, Chandigarh. The scope of the work taken in the
estimate does not include in any earlier approved estimate.
