ACCREDITED PROVIDER STATUS - New YorkCounty Lawyers’ Association has been certified bythe New York State Continuing Legal EducationBoard as an Accredited Provider of continuing legaleducation in the State of New York from March 8,2004 through March 7, 2007.

REFUNDS /TRANSFERS - Written notice of can-cellation or transfer must be received by NYCLA nolater than one hour prior to the start of the program.A $35 processing fee per course will be deductedfrom the refund for cancellations received less thanfive calendar days prior to the course date. Norefunds will be issued after the program start time;program materials will be shipped within two weeksafter completion of the program to registrants whohave not notified the Institute of cancellation in atimely manner. Every year lawyers make thousands of civil and criminal applications for permission to appealto the New York Court of Appeals from rulings of the intermediate appellate courts. Yet, only a small percentage of these requests are granted. Getting leave toappeal to the Court of Appeals requires more than just having the “right” case.

The advocate must also master the Court's rules regarding leave applications, as well as devel-op a strategic knowledge of how to “pitch” the case to the judges of the Court. This course willprovide the nuts-and-bolts procedures, Court Rules and strategic considerations involved in getting leave to appeal to New York’s highest court, forboth civil and criminal cases.

Attendees will learn: (1) When an appeal becomes ripe for Court of Appeals review; (2) theprocess and format for the leave application; (3) the Court Rules governing leave applicationpapers; (4) the strategies of “packaging” the issue to maximize the chances of appealing to thejudges of the Court, including overcoming the problems of reviewability and appealability; and(5) learning what judges look for in deciding whether a case is leaveworthy.

The widespread use of electronic mail has created some new security challenges to keeping client's confidences private or from inadvertent disclosures. A panel of experts will discuss and review the evolution of the attorney-client privilege and proactive security measures to protect confidential information when transmitted via the World Wide Web.

Session 1: This interactive program uses hypotheticals to explore unique issues involving lawyers' use of electronic communications and documents, including: the ethical limits on using new communication technologies; the ethics implications of working with service providers and discarding electronic files; the rules governing communications with adversaries (including ex parte contacts, sending “unscrubbed” documents, handling inadvertently transmitted communications from adversaries and limits on deceptive conduct); the ethics ramifications of litigation issues (including outsourcing of privilege review work, the duty to retain electronic documents when anticipating litigation, the crime-fraud exception as applied toelectronic document spoliation and preparing privilege logs for electronic communications).

Session 2: will also discuss the need for confidentiality, privacy issues, encruption and electronic communication and security vs. productivity. Possible security measure solutions available on the market will be discussed as well.

Session 3: will discuss corporate policies that may be implemented to put employees on notice of the use of e-mails and the internet at work.

The program will explore the ramifications of the Supreme Court's decision in Kelo v. City of New London, where the Court ruled that the use of eminent domain to revitalize a city's economy was a proper exercise of its governmental authority. This case is extremely significant given the fact that the Court approved the condemnation action even though it involved the taking of privately-owned property from one private person and giving it to another private person, who happened to be a developer. This panel of experts, which includes the attorney who argued the Kelo case on behalfof the City of New London before the Supreme Court, as well as the attorney who represented the plantiffs, will discuss such issues as: the scope of the public use clause of the Fifth Amendment to the Constitution; the literal vs. broader interpretationof what constitutes sufficient public use; and the future of eminent domain after Kelo.

Attorneys involved in real estate, city planning and public interest law cannot afford to miss the discussion of these vital issues.

Many attorneys consider it a “win” when an entry of judgment is entered in favor of their plaintiff/client, or a dismissal is granted in favor of their defendant/client. Yet, many times enforcement of that judgment is not only a critical step in the litigation process, but also the step that determines whether the entire litigation process was worth the effort. Enforcement of judgments is often the beginning, and not the end, of a hotly contested adversarial process since very sophisticated techniques are used by debtors, including judgment debtors, to conceal assets that they beneficially own. The increased sophistication of legitimate financial transactions and the reluctance of bankers and other professionals in various jurisdictions to inquire into the clients’financials affairs have contributed to the ease and speed with which substantial funds can be transferred by a debtor from jurisdiction to jurisdiction and from country to country. In so doing, the source and identity of those funds, who controls them and who are the beneficiaries of the transactions are often concealed.
