As per the Concessionaire the details of Execution of Escrow Agreement has been submitted to NHAI.

4. DETAILS OF ALL THE APPLICABLE PERMITS SPECIFIED IN SCHEDULE OF CONCESSION AGREEMENT The status of the Concessionaire’s submission of the details of Applicable Permits is incomplete and needs to be complied before the appointed date.

5. PERMISSION OF STATE GOVERNMENT FOR CUTTING OF TREES IN NH 84 Approval of the proposal Submitted by NHAI to MoEF for diversion of forest land is awaited. Stage 1 clearance is obtained. Final clearance for MoEF is yet to be done.

6. DETAIL OF SAFETY PROVISION MADE BY CONCESSIONAIRE DURING PRE-CONSTRUCTION AND CONCESSION PERIOD Concessionaire has observed the 24’Th Road Safety week starting from 1’St Jan 2013 by displaying the Safety Banners and awareness program at various stretches in the Project Highway.

7. DETAIL CONSTRUCTION DESIGNS, CONSTRUCTION METHODOLOGIES, QUALITY ASSURANCE PROCEDURES IN ACCORDANCE WITH COMPLETION SCHEDULE Q OF CONCESSION AGREEMENTThe Concessionaire has submitted the Pavement Design Report which has been reviewed and returned with observations.The Concessionaire has submitted the Quality Assurance Procedure vide letter no. PBHL/PATNA/TECH/NHAI-PIU/2013/16 dated: 21-02-2013, which has been reviewed and returned vide letter no. Bloom/Bi/Pat-Bux/2013/03/141 dated: 04-03-2013.The Concessionaire has submitted the Construction Methodology Manual vide letter no. PBHL/PATNA/TECH/BLOOM/2013/40 dated 02-03-2013 and the same has been reviewed and returned vide letter no Bloom/Bi/Pat-Bux/2013/03/145 dated 13-03-2013.The Concessionaire has submitted the Plan and Profile drawings for i) Design CH Km 72.8 to Km 74.2, Km 76.1 to Km77.1, Km 85.1 to Km88.5 and Km 90.4 to Km100.0 vide letter no PBHL/PATNA/TECH/NHAI-PIU/2013/62 dtd 24-05-2013 and ii) Design CH. Km 100.0 to Km 104.4, Km 106.3 to Km 107.0 and Km 109.9 to Km 121.0 vide letter no PBHL/PATNA/TECH/NHAI-PIU/2013/63 dtd 28-05-2013. The same has been reviewed and returned by the IE. The Concessionaire has submitted the GAD of bridges across rivers, Sone and Ganga vide letter no. PBHL/PATNA/TECH/IE/2013/065 dated 06.06.2013. The same has been returned with observations by IE.More submissions of Design and drawings of 1 major and 3 minor Bridges were made by the Concessionaire vide letter no. PBHL/PATNA/TECH/IE/2013/79 dated

05-07-2013, which has been reviewed by IE with some observations vide letter no. Bloom/Bi/Pat-Bux/2013/07/221 dated 19-07-2013.

No progress in design submissions during the month.

8. STAKING OUT OF PROPOSED CENTRE LINE Concessionaire has started the Staking out of proposed centerline from design CH KM 36.00 to KM 125.00. There was no activity at site by the Concessionaire’s team.

9. ESTABLISHMENT OF TEMPORARY BENCH MARKS AND FIXING OF ROW PILLARS.Concessionaire had started the establishment of Temporary Bench Marks, fixing of ROW pillars, traverse survey etc, but not fully completed. No activities reported at site during the month.

10. IDENTIFICATION OF QUARRY AND PLANT SITEConcessionaire’s has identified the plant site and some Quarry sites. Testing of Borrow area materials started and stopped. No activities carried out during the month.

11. ESTABLISHMENT OF LABORATORY AT PLANT SITESConcessionaire’s Central Laboratory and Camp site at Bihiya, Km.70 + 500 was temporarily functional from 5th May’13.Another camp site at Km 103, near Dumraon has also been finalized to establish second laboratory.The Site Laboratory at Ganga River (Buxar) and at Koilwar (near Ara) has also been identified and construction was in advanced stage. The erection of Concrete Batching& Mixing plant was in progress at Koilver site.Installation of some major plants at Central yard was being carried out. However, no intimation of the establishment of laboratory has been given by the Concessionaire to IE. No activities in the camp site & at laboratory at Koilver Bridge and central camp during the month. Demobilization of some machinery has been noticed at Central Camp site.

12. MOBILIZATION OF MACHINERIESFinalization of EPC contract has been done and details have been submitted to NHAI. Some Machinery for concrete works has arrived at Koilver site. No intimation of mobilization of machineries given by the Concessionaire. Demobilization of some machinery has been reported at site during the month.

Deployment of EPC staff is under progress at Bihiya Camp and Koilver site, but details of staff have not yet been submitted to IE. Demobilization of the staff has been noticed from Koilver Camp sites.

14. CONSTRUCTION ACTIVITIESSome pre-construction activities including ROW pillar fixing, centre line marking and establishing of TBM have commenced from Buxar end and near Koilver site. There is no progress at all in the Pre-Construction activities including the maintenance work during the month.

2.3 FINANCIAL PROGRESS:

Not applicable at this Stage of the Project.

SECTION – IIIGENERAL PROJECT INFORMATION AND ORGANIZATION STRUCTURE

3.1 GENERAL:The National Highway Authority of India (NHAI) on behalf of Ministry of Shipping, Road Transport and Highway (MoRTH), Government of India have taken up the development of various National Highway corridors where the intensity of Traffic has increased significantly and there is requirement of augmentation of capacity for safe and efficient movement of Traffic. The development of these corridors has been planned for implementation under Four Lanning of NHDP Phase-III Program. The Project Road namely the Patna-Buxar section is

connecting Patna (The Capital city of the State of Bihar) and Buxar town (on Bihar/Uttar Pradesh Border) and is implemented on DBFOT basis. The Project Corridor between Patna and Buxar passes through the plain terrain in the State of Bihar through three District viz. Patna, Bhojpur and Buxar. The Project Road starts from Saristabad, Patna and ends at Junction of NH-84 near Bharoli Golamber (KM 75.0) with NH-19 (KM 46.500). The Road Section from Patna to Ara is a part of NH-30 and from Ara to Bharoli Golamber is a part of NH-84.An Index Map showing the location of the Project Road is attached in Figure 1.The Project Highway comprises of NH-30 & 84 from Km. 0.000 to Km. 124.850 (approx. 125.443 Km. in Length).For the realization of the above-mentioned Project, a Concession Agreement between the NHAI and Patna-Buxar Highway Project Limited was made. Bloom Companies, LLC, USA has been appointed as the Independent Engineer for the said Highway Project.

3.2 SCOPE OF WORKS:

The DBFOT Project basically Constitute Up-Gradation involving Construction of Four Lane Highway including Bridges; Widening and Rehabilitation of Bridges and Culvert; Construction of Embankment/Elevated Structures/ROBs wayside Amenities etc. along the existing Highway including provision of Realignment and By Passes. The proposed Construction works will involve use of Modern Equipment and Construction Practices/Techniques. The scope of works shall include the following Project Facilities:

Toll Plaza(s); Roadside Furniture; Street Lighting; Pedestrian Facilities; Landscaping and Tree Plantation. Truck Lay-Byes; Bus-Bays and Bus Shelters; Traffic Aid Posts; Medical Aid Posts; Vehicle Rescue Posts; Telecom System;

3.3 INDEPENDENT ENGINEER:

The Concession Agreement envisages the appointment of an Independent Engineer (IE) by the National Highway Authority of India. The Consultant has given in-depth consideration to ensuring they have the right team combination to undertake the Project Works. From its extensive experience on similar Projects in India and in other developing countries, the Consultant has provided a work organization and management system to ensure that the Project Works run smoothly, quality product is received and to the complete satisfaction of the NHAI. The Consultant’s Team Leader/Consultant’s Representative shall be responsible for the overall direction of the Project and is responsible for the quality of services provided and shall regularly inspect the Project and direct policy in achieving Quality Project Management. The Team Leader/Consultant’s Representative shall liaise with the Employer, in

policy matters concerning the Project and the performance of supervisory staff on site. IE would be responsible for the Construction Supervision Team. IE would ensure that the review of the designs/drawings/specifications for the entire Project is undertaken to a high degree of precision. IE would also manage the Construction supervision team.

The IE has mobilized required staff on the project since April 02, 2012.Based on the directions from the Project Director, NHAI. The Independent Engineer has started mobilizing required staff for the Buxar Office which included the Professional, Sub-Professional and Office Staffs directed by Project Director NHAI.

SECTION – VIMOBILIZATION OF STAFF AND RESOURCES

6.1 INDEPENDENT ENGINEER ESTABLISHMENT

6.1.1 STAFF/PERSONNELThe following Staff of the Independent Engineer has been mobilized. The joining of all the staff was informed to NHAI in writing from time to time. The Sub-Professional staff interview was conducted by PD and approval obtained from NHAI for mobilization. The Independent Engineer submitted invoices to NAHI PIU for payment of the services right from inception. The pending payment of the services of the manpower deployed at the project was released by NHAI during the month of Dec’13. NHAI and IE agreed mutually that no more manpower shall be deployed until the appointed date of the Project is fixed by NHAI. Further reduction in Manpower was made as the Concessionaire wasn’t showing any interest in taking the Project Work.

IE deployed the Survey Team and conducted the detailed survey of the new alignment as directed by NHAI. IE has submitted the report of the Survey vide letter nos. l) Bloom/Bi/Pat-Bux/2012/10/083 dtd 22/10/2012 ll) Bloom/Bi/Pat-Bux/2012/10/087 dtd 30/10/2012 and lll) Bloom/Bi/ Pat-Bux/2012/12/111 dtd 31/12/2012 to NHAI for further necessary action. The final Reconnaissance Survey of the alternative alignment has been submitted to NHAI vide letter no. Bloom/Bi/Pat-Bux/2013/01/114 dated 15-01-2013.The detailed survey of new alignment is not the scope of work of IE as per the contract however; IE has performed the same as professional gesture.The Independent Engineer had been asked by CGM, NHAI to prepare a Google earth drawing showing the realignment from “Danapur Bhusala to Parev” to understand the position of one of the realignment of the DPR. Accordingly, IE had prepared the drawing showing both the alignments.

2) The maintenance of road which was taken up by Concessionaire and the same was billed under the maintenance estimates. As the Concessionaire was not carrying out the maintenance work, NHAI had asked the PWD, Arra to estimate the balance Quantities and carry out the road maintenance. Accordingly, the work was going on and the measurements have been taken by IE and submitted to NHAI for payment.

3) The representation given by existing IOC petrol pump at Bihta had been given to the IE for comment. The same was examined and our comments given along with distance details from various junctions on existing road and with proposed 4 lane road.

4) Recently, NHAI HQ had approved an estimate for Rs 9.86 crores for the maintenance of Patna – Buxar road in the absence of concessionaire’s appointed date. Now, the contractor is doing maintenance work and the same is being supervised by the IE.

7.3.5 APPENDIX A memorandum for the preparation of the Appendix to be signed prior to the Appointed date is in progress and jointly surveyed by the Concessionaire’s staff and IE‘s team.The Concessionaire has further refused to sign the Memorandum containing an inventory of the Patna-Buxer Site and has refused to acknowledge the land handed over to the Concessionaire for fixing up the appointed date of the Project.

7.4 TRAFFIC STUDIESConducted near Bihiya Camp KM 70.500 from 9th May’13 to 12 May’13.

7.5 MAINTENANCE OF EXISTING ROADThe details and condition of existing road have been surveyed and reported to NHAI Vide Letter No. Bloom/Bi/Pat-Bux/2013/05/177 dated 21-05-2013.Maintenance work on Shoulders and major pot holes have been taken up to make the existing road traffic worthy during the monsoon period.The general estimate for maintenance of the existing road was submitted to NHAI after survey vide letter no Bloom/Bi/Pat-Bux/2013/09/249 dated 10-09-2013. Another survey was conducted on the existing highway after the receding of the flood waters from Ganga and an estimate was submitted to NHAI vide letter no Bloom/Bi/Pat-Bux/TL/2013/09/253 dated 14-09-2013. Again as per the instructions of NHAI, for the visit of the Honorable President of India to Ara town further survey was conducted and estimate prepared for the road surfacing with BC and other safety measures and sent to the Authority vide letter Bloom/Bi/Pat-Bux/TL/2013/09/265 dated 26-09-2013.The concessionaire is not doing maintenance on regular basis and doing it occasionally under the approved estimate of NHAI for maintenance of existing road. The Concessionaire has stopped all Maintenance activities since the month of October 2013 in the project. The balance emergency repair and maintenance works are being carried out thereafter through the Road Construction Division, Bihar from March 2014.The existing road condition was reviewed by IE and reported to the authority vide letter no. Bloom/Bi/Pat-Bux/BE/2014/01/330 dated10-01-2014. Since the finger type expansion joints have been badly damaged in the existing Ganga Bridge at Buxar, an estimate was prepared by IE for emergency repairs and submitted to PIU, NHAI.The Maintenance of the existing Project Highway has been started on 27-06-2014.

7.6 SAFETY MEASURESConcessionaire has observed the 24’ThRoad Safety week starting from 1’St Jan 2013 by displaying the Safety Banners and awareness programme at various stretches in the Project Highway.

Accident Data of 11nos. Police Stations falling between Patna- Buxar Highway for the month of May 2014 has been submitted to NHAI vide letter no. Bloom/Bi/Pat-Bux/2014/07/404 dated 09-07-2014. Details are attached in Table I below.

Due to the extended development period in the Project and lack of routine maintenance in the Project Highway the general condition of the existing project highway has deteriorated. The maintenance works which is a top priority is planned to be completed through a contactor selected by the NHAI, before the ensuing monsoon period. Moreover, the Concessionaire has stopped all activities in the Project and has requested the Authority for a mutual exit from the Project.

The Independent Engineer has written to the Authority for the Safety Measures and Maintenance Work to be taken up in the Project prior to the approaching Monsoon rains vide letter no. Bloom/Bi/Pat-Bux/BE/2014/05/387 dated 24-05-2014.
