Hello and I hope everyone had a very busy fall

with winter rapidly approaching . All the

feedback I get from other contractors around

the Garden State has been very positive with more than

enough work – thank God! With winter approaching, please remember that our vehicle maintenance needs change dramatically from tires to air brake systems to defrosters – not to mention maintaining our tenders to remain useful during the colder months .

LOCATION, LOCATION, LOCATION: Our next membership meeting location will now be at O’Connors American Bar & Grille, located at: 1383 Monmouth Road, Eastampton NJ 08060 (phone: 609-261-7577) . It is located about 15-20 minutes south of our previous locations . The board met there for their quarterly meeting and found it to be better suited than previous locations – hopefully we have a new home to settle in . We have been attempting to find a location that meets our cost limitations but also has the size we need . I will keep this notice here for the near future to catch anyone that may have missed a meeting or newsletter announcement .

rules being published . The comments numbered over one hundred to the NJ DEP which was incredibly helpful to keep the rules moving toward approval . We have not yet gotten a final date on when we can expect to get the rules finalized, it is still in motion with hopes to have signed by the Governor

2018 CHRISTMAS PARTY: We have great news for our upcoming 2018 NJGWA Christmas Party scheduled for Saturday, January 13, 2018: we have negotiated room rates down by $10 .00 (now $119.00), party rates down by $25 .00pp (now $125.00pp), and free parking for all attendees! We hope that helps you make a quicker decision to come to the party this year – the Ernie White Band will be returning which was a huge success last year! And we will be raffling off a room upgrade to a suite ($500 .00 value) at our next membership meeting!

The NJGWA Adam Rinbrand College Scholarship program is funded by our Silent Auction at the Christmas Party – please consider donating an item for auction – in just the past two years, we have given $6,000 .00 out to six young men and women to assist with their educational needs . We could not have done it without the donations from our sponsors and members!

NGWA Ground Water Week 2017 will be held in Nashville, Tennessee, taking place December 5th – 7th, 2017 . If you are an NGWA member and have registered for the expo, please let me know (email, call, text, or see me at the next membership meeting) so I can sign you up as a delegate .

The next NJ DEP Well Advisory Board will meet on November 21st which will be the same day as our next membership meeting . You want to make the next membership meeting to hear from Art Becker about the latest news, especially on enforcement .

MEETINGS: Our last membership meeting was “huge”… .we had 54 people in attendance and the numbers have been steadily increasing which is what we are hoping for – making our association more and more valuable to our members .

We hope to see you at our next membership meeting on November 21st at O’Connors . The meeting topic will be presented by Seth Kellogg, PG, of Roux Associates, on the latest emerging contaminant which affects us all, whether you are a water well or environmental drilling contractor . Seth will present on the new NGWA document “Groundwater and PFAS (Per- and Polyfluoroalkyl Substances): State of Knowledge and Practice .” The discussion will include an introduction to the chemical and physical characteristics, human health and ecological impacts, legal and regulatory framework, field sampling and analysis, fate and transport, and remediation and treatment options .

NGWA Voices Opposition to ELD Mandate at Press Conference

On September 27, NGWA joined more than 30 organizations at the National Press Club in Washington, D .C ., speaking out against the electronic logging device (ELD) mandate . The mandate is slated to take effect on December 18, 2017 . NGWA has been working with allies and Congress to delay the mandate by two years .The press conference served to draw national attention to the issue “beyond the beltway” and featured speakers from trucking and agriculture groups, in addition to NGWA government affairs director Lauren Schapker .Members of NGWA are also asked to take action on this issue and send a letter to their member of Congress, asking him or her to co-sponsor H.R. 3282, the ELD Extension Act of 2017 . This legislation would extend the deadline to comply with the mandate by two years .NGWA impact: With pressure on Congress to act on delaying the mandate, the press conference served as a way to also engage national media on the issue . The mandate could increase the cost of business for those NGWA members operating fleets of vehicles .

NJGWA impact: As NJGWA President and Chair of the NGWA Transportation and Infrastructure Subcommittee, I sent an email blast to our membership in October to ask for your support by getting in touch with your Congressman/woman here in New Jersey to ask them to support this bill . Thus far, participation has been very low from around the country – and we have not demonstrated our commitment but still can – it takes a moment for you to help out .

GOP Releases Tax Reform Framework;

Contains NGWA PrioritiesRepublicans released an outline of their tax reform plan, which includes several provisions advocated by NGWA members during the 2017 Groundwater Fly-In earlier this year . The plan would provide several tax breaks targeting small businesses—repeal of the estate tax, capping small business taxes at 25 percent, and immediate expensing for five years .

However, the plan did not include ways to pay for the tax breaks, which will be critical in the viability of the plan moving forward . In addition, the investment tax credit for installation of geothermal heat pumps was not included in the framework .NGWA impact: Comprehensive tax reform would likely include several provisions that would improve the business climate for NGWA’s small business members .

NJGWA impact: Naturally, it will improve our ability to do business, too – what is proposed on a national scale with this tax reform would have major implications for us to hire, buy new equipment, and pass on our businesses from family member to family member, generation to generation without the burden of the so-called ‘death tax’ .

New Jersey Official Nominated to Lead FMCSA

On September 25, Raymond Martinez, chairman and chief administrator of the New Jersey Motor Vehicle Commission, was nominated to lead the Federal Motor Carrier Safety Administration . His role at the Motor Vehicle Commission involves licensing, titles, and inspecting New Jersey’s 4 .9 million vehicles .Martinez was nominated by Governor Chris Christie and has served as chief administrator since 2010 . He also previously directed the New York State Commission of Motor Vehicles, and served in the White House for Presidents Ronald Reagan, George H .W . Bush, and George W . Bush .Martinez’s nomination received praise from an array of transportation organizations, and he is expected to be confirmed by the Senate .With the forthcoming ELD mandate, having a new administrator in place will give NGWA an opportunity to urge reconsideration of the regulation .NGWA impact: Nominating a head of FMCSA will likely expedite activity at the agency . In addition, a fresh look at the pending ELD mandate could bring relief to NGWA members .

NJGWA impact: I was asked if I knew or had any contact with Mr . Martinez but I haven’t – if anyone has, please let us know and perhaps we can get him to attend one (or more) of our membership meetings .

Fish and Wildlife Service (FWS) Determinations May Affect

Groundwater UseOn September 20, the FWS designated as endangered the Pearl Darter living in Mississippi’s Pascagoula River basin where the species’ small population size, scattered locations, and low genetic diversity increase its vulnerability to catastrophic events .Water quality decline from point and nonpoint source pollution impacts the species’ habitat . Activities affecting Pascagoula River basin water quality include: more than 100 water injection disposal wells and enhanced oil recovery wells; hydraulic fracturing wastes stored in open pits; and releases from retention basin failure or overflow with risk to surface water and groundwater .On October 4, FWS proposed listing the Trispot Darter, freshwater fish of Alabama, Georgia, and Tennessee, as a threatened species due to excessive pumping and PCBs in groundwater affecting its habitat . Comments on the latter proposal are due by December 4, 2017 .In a separate action on September 29, FWS withdrew its proposal that the Kenk’s amphipod is endangered . FWS determined threats to Kenk’s amphipod are not as significant and the species is more widely distributed than previously determined . The organism lives in groundwater and groundwater-related habitats (caves, seeps, small springs, wells, interstices, and rarely deep ground water lakes) of Maryland, Virginia, and the District of Columbia .NGWA impact: Endangered species designations affecting groundwater and groundwater discharge areas can influence demand for water development, groundwater modeling, and environmental assessment services .

NJGWA impact: This policy can eventually migrate to the Garden State if there is a threat to a similar species that service in our groundwater and/or groundwater-related habitat .

EPA Nominees Face Confirmation Hearing in Senate

Several of President Donald Trump’s nominees for positions at the Environmental Protection Agency faced the Senate Environment and Public Works Committee members during their confirmation hearings .These included David Ross, nominated to lead EPA’s Office of Water, who took questions on his nomination to lead the office, and Michael Dourson, who took questions on his nomination to lead the Office of Chemical Safety and Pollution Prevention .Most pointed questions were directed at Dourson throughout the hearing, including his experience in studying PFAS and perchlorate . However, Ross received questions about his views on federalism and the role the federal government should play in state-specific environmental issues .NGWA impact: The lack of controversy around David Ross’ nomination indicates he is likely to be confirmed . The comments surrounding PFAS at the hearing represent an opportunity to provide the forthcoming NGWA best practices document as a resource to the Senate and EPA .NJGWA impact: Our next membership meeting will be focused on this particular item so our timing could not be better to inform/educate our membership on this important up-and-coming subject .

Live Music Makes the Party Last year for the first time we had live music at the Christmas Party . It was a big hit, people danced, sang along and really enjoyed it . The overwhelming feedback was that the band made the party .This year we are having the Ernie White Band return to do their magic . They play a variety of familiar Rock and Pop songs . The music is upbeat, great for dancing or just fun to listen to .Ernie White is from the Trenton, NJ area and is a local celebrity . He started playing guitar at the age of ten and has made a career out of music . He has written for television, movies, collaborated with Richie Sambora from Bon Jovi, toured the country professionally and produces his own

Cd’s . He has a recording studio and gives guitar lessons from beginner to advanced . Ernie is an expert on guitar in the Jazz, Rock and Blues genres . For many years Ernie has put on a Christmas Show featuring live local talent . The songs can range

As chair of the transportation subcommittee of the National Ground Water Association’s Government Affairs Committee, I’m appealing to you to encourage the members of your state association to take action with their people in Congress .As of December 18, 2017, the Federal Motor Carrier Safety Administration will require motor carriers to install electronic logging devices in their commercial motor vehicles . The mandate was put in place via the passage of MAP-21 legislation, signed into law in 2012 . Estimates of the cost for ongoing tech support and upkeep run from the hundreds to thousands of dollars for each piece of equipment . Significant uncertainty about the readiness of the technology and enforcement capabilities exists with just a few months to go before the mandate takes effect . In an effort to help our industry deal with this uncertainty, Congressman Brian Babin (R-AL) introduced H .R . 3282, the Electronic Logging Device Extension Act, which would extend the deadline for implementation by two years . In doing so, FMCSA and ELD manufacturers would have more time to ensure implementation is done appropriately . We need to come together as a community to help support this legislation, and we need to encourage our fellow contractors to stand up and help all of us .While most water well system professionals may be operating under the current and proposed exemptions, we don’t know if this will be an opening to even more regulation . The issues I see down the road are when the rules change and new taxes or more restrictions are placed on the trucking industry . Somehow the water well industry always gets caught up in trucking regulations, and things like enhanced tracking, additional use taxes, and rigid application of hours of service rules could impose more costs and burden on our industry . Our industry has always relied on strong grass roots support to make sure our voice is heard . A while ago, a coworker asked me to write about weird job site instances that have happened during my more than 40 years of drilling . It threw me through a loop, because as those of you who have drilled for any length of time know– finding something normal during drilling is the weird thing!

I drilled through a 6 inch gas main once with a 4” bit, never breaking the sidewalls– it was so perfect! Have you ever seen rocks and dirt go flying over a 40 foot boom?! We shut down and evacuated 3 highrises, a daycare, a small store, and shut down Conrail . It was a mismarked gas main! They had a new plastic main laid near the old steel main, and I guess the meter picked up the steel over the plastic line . We called 911 and the whole squad came out: fire trucks, cops, first responders, ambulances and the gas company . The first responder secured the site, and as I was watching, I saw a train approaching . I asked the first responder if he was going to stop the train . He asked why, and I explained that I live near a railroad . Trains throw a lot of sparks from their wheels . He said, “Oh, %&*%$!” and got on his radio . The train came to a screeching halt . Good times!

We had 2 mud rotaries drilling about 100 feet apart on a job . We both started the hole at the same time, and we were both down to about five feet when the rigs started bogging down . Apparently, we’d both drilled through the same fishing net buried underground . It took awhile to get that off!

I was drilling in a landfill and drilled through a large bale of stainless steel wire . I couldn’t get the roller bit back up through the mud pan . It was about 2 feet across on top of the 8 inch bit . We ended up having to block the rig about 4 feet off

the ground and pick up the mud pan with cables to get to the sst wire to burn it off the kelly bar and bit . Not a good idea in a landfill, but we were out of options . We covered the hole, and kept it filled with water . Did you ever run augers through a steel shopping cart buried underground? Not fun!

Once we went met the client on site to drill 6 monitoring wells . He had a print showing the well locations . We went to the first location: there was already a well . Same on the second and third . He said to me, “Hmmmm . I wondered why I found a print with locations marked right where I want to put new wells!” Really??!!!

We came up to a site, and the inspector was already looking around . I went out to see what he was doing, and he looked confused . He couldn’t figure out the map . I took a look, flipped it right-side-up, and helped him locate the holes . You can’t make this stuff up!

Another time we were drilling on the side of a road . We had the pick-up parked beside the rig . We were taking a break in the pick-up when the ground started to shake . Here we were, parked on top of a manhole with the concrete under it so rotted from the stuff running through it that the concrete shattered, and the truck went down– with us in it! It bottomed out on the frame, and we were forced to pull it out with the tender . Then we called the sewerage company . They fixed it and never said a word .

You may remember that quite a few years ago, we had a large earthquake in South Jersey . We had just finished an 18 inch by 100 foot hole . We’d just gotten the bit to the surface when it hit . We all took off running, sure that

the hole was collapsing and the rig was going down! We did end up losing some of the hole .

We drilled and grouted a house well once . We typically did monitoring wells and grouted with cement, so that’s what we did here as well . Later, we received a call from the county inspector saying that he had failed the well because he couldn’t check the grout due to cement in the borehole! We did another house well and the county wanted to watch us grout . We finished the installation and called them up . They told us they couldn’t come out for a couple of days, so we couldn’t grout . What could we do? Lose the well?! So I grouted the hole and we had to wait to regrout it . The inspector showed up in a county van with his bunch of flunkies, looked at the grout and asked, “Why is your grout so thick?” After that we just stuck with environmental wells and borings, and stayed away from house wells .

I drilled an environmental mud boring in a chemical plant, got down about 4 feet, and hit concrete . I asked the inspector and he assured me that it had been checked and there was nothing there but fill . So I drilled about 3 inches, and the bit dropped exactly 60 inches and hit more concrete . I told the inspector, and he reiterated, “There’s nothing there . Keep drilling .” “F*^&$# you!” I told him . It ended up being a 60 inch force main that thankfully was off . I played softball back then, and dropped a ball in the boring right to the concrete pipe and filled the hole up with cement . We got a call about 2 years later . The forcemain kicked on and shot the cement plug and softball out of the hole! Good times! I could go on, but it’s really just normal stuff for a well driller! Good times! Typical days for a well-driller!
