This information was previously provided to BoS. OCAC failed to calculate these ratios accurately. Consistently providing false/inaccurate data is equivalent to wrongdoing – false/inaccurate is not right. Therefore, appropriately characterized as wrongdoing. Changing process to provide accurate data that was previously not accurate is admission of not doing things right, which is wrongdoing.

Saskia Boisot, MD Claim Fact Check Counter Fact Check Claims to have supplied countless examples of staff’s incompetence at OCAC in accurately ascertaining animal behavior.

While the No Kill Shelter Alliance (NKSA) has

made numerous statements demanding the

removal of Dr. Hawkins and shelter staff, they

have not reported any substantiated instances

of employee misconduct in determining animal behavior.

Incorrect Multiple Grand Jury Reports substantiate these claims. Shelter staff continue to hose down kennels with dogs in them. Kennel staff continue to label dogs as aggressive that are not aggressive as has been proven multiple times. Shelter staff have not provided any substantiated documents to support their labeling of aggressive dogs. Public Records Request fail to provide adequate documentation to substantiate aggressive behavior.

Dr. Boisot has presented several specific examples of dogs that were scheduled to be killed by OCAC due to “behavior issues”. These dogs were rescued and proved to not have behavior issues. Bartlett’s staff even helped move at least one of these dogs to another shelter!

California Rabies Compendium states, “The

biting dog or cat must be either

a) Observed daily for signs of rabies for ten

(10) days following the exposure date, regardless of the animal's vaccination

status, or

b) Euthanized immediately and tested for rabies in a public health laboratory.” Records indicate that euthanasia is consistent

with law and Logan settlement. Ms. Logan could have requested the record for this animal and received this information.

The state of California does not follow the one bite rule, and neither does it follow any rules regarding automatically euthanizing vicious dogs after a certain number of attacks or bites. Instead, the court carefully evaluates a dog’s conduct and then determines whether a dog should be quarantined or euthanized based on the dog’s previous history

of violence and the severity of the attack.

Reflection of incompetence of OCAC staff and consistent inaccurate record keeping. This is a bad excuse, but this is not a legitimate reason. OCAC employees are responsible for accurate record keeping and reporting at all times. The assertion that this consistent faulty record keeping is acceptable is false and a gross waste of taxpayer dollars for personnel who are truly not capable of performing their job duties accurately. OCAC records as provided via Sharon Logan Settlement indicate that the dog was 18 months old. This is either incompetence or falsifying documents – neither of which is acceptable. FURTHER EXAMPLES OF INATTENTION TO DETAIL AND INCOMPETENCE IS THAT OCAC STAFF CANNOT EVEN SPELL THE DOG BREED “GERMAN SHEPHERD” CORRECTLY! (or run spell check)

Save More Kill Less advocates for OCAC to comply with Grand Jury recommendations, previous JVR Recommendations, and Performance Audit recommendations to improve outcomes, save lives, and improve shelter environment. OCAC staff frequently labels dogs as aggressive that are not aggressive, limiting public view and chance of adoption. OCAC staff are not qualified to make assessments on animal behavior. Save More Kill Less advocates for increased outreach efforts by increasing foster programs and more flexibility in working with Adoption Partners.

Claim Fact Check Counter Fact Check Claimed the October 2015 report from OC Animal care erroneously reported

that in October OCAC euthanized 491 animals

False OCAC provided Sharon Logan with a list of

animal ID numbers for euthanized animals. The settlement allows her to request up to five (5) files a month for detailed review.

If a litter is euthanized, the entire litter is assigned one ID number because the records are contained in one file. The records will contain an accurate count of the number on animals in the litter.

Per settlement paragraph 4 – Periodic Review of Records, OCAC will provide documentation pertaining to animals euthanized during the prior month. Settlement stipulates that information should be sufficient to identify EACH euthanized animal. Grouping litters into one animal ID does not meet this requirement as evidenced by Nick Gerda receiving data for ALL animals versus all animal ID’s only. GOVT. CODE §§ 6250 - 6276.48 California Public Records act does not place a limit on the number of records that can be requested. This is not in compliance with settlement to provide sufficient information to identify EACH euthanized animal. This also provides false number of animals euthanized. Are these litters counted as one or actual number in euthanasia statistics? This is a deceptive attempt to skew data.

Request for 5 cases per month is in addition to the information to identify each euthanized animal. OCAC failed to provide an accurate number of animals euthanized pursuant to the settlement. Dear Paul and Gary,

Greetings to you both, and I hope you are having an enjoyable holiday season. I just wanted to drop you both an email to introduce you to one

another, since you have both expressed a keen interest in connecting regarding the Orange County Animal Shelter. Paul, Gary is the head of San

Diego Humane Society and SPCA, and has been largely credited with moving San Diego towards "No Kill", and is extremely well versed with

engaging the community when it comes not just to animal sheltering, but also to spay/neuter, recruiting volunteers and fosters, and raising large

amounts of funding support. Gary was previously in Washington DC, which was one of the examples we had used in our presentation where

progressive life-saving programs have been implemented on a large scale. He has A LOT of experience with making these changes, and given this,

coupled with his close physical proximity, I think he could really provide us with a lot of assistance and guidance, not to mention the fact that he has

indicated a willingness and enthusiasm for doing this.

As you are both aware of at this point, I am currently in Europe, but will be back next Tuesday (December 29th). It would be great if the two of you

could connect, at least over the phone, so that we might move towards a moratorium on so called "empty cage killing" as soon as possible. Despite

being out of the country, I am still available by phone, should either one of you need to reach me (XXX-XXX-XXXX), and am checking my email

multiple times a day. Once I return, I would be happy to come and meet with either/both of you in person at your convenience (except Mondays,

which I cannot do because of work conflicts).

In the meantime, I hope you both have a very enjoyable holiday week, and look forward to hearing of your progress in this regard.
