NBSTC does not take any responsibility for the delay caused due to non-availability of

Internet connection, Internet traffic jam etc. for the online bids.

The hard copy of the earnest money (mentioned in NIT NO. NBSTC/17/CSP- ET/COB/2017-18 dated 04.08.2017) must be submitted by the L1 Bidder into the office of the Managing Director, North Bengal State Transport Corporation, Paribahan Bhaban, P.O.+ Dt. Coochbehar, Pin-736101 in the form of Demand Draft / Bank Guarantee issued from any Nationalised Bank / Scheduled Bank payable at Coochbehar drawn in favour of ‘North Bengal State Transport Corporation’, only. The bidders are required to e-file / upload the scan copy of the DD /Bank Guarantee towards Earnest Money Deposit (EMD) in the e procurement portal. Only the L1 Bidder should physically submit the DD / Bank Guarantee in original before issuance of Work Order / Purchase Order at the address mentioned above.

The L1 bidder shall submit the hard copy of the EMD/Bid security to the tender inviting

authority with his acceptance letter of the LOI. Failure to submit the hard copy with the

acceptance letter within the time period prescribed for the purpose, may be construed as

an attempt to disturb the tendering process and dealt with accordingly legally including

blacklisting of the bidder.

The pre-qualification (Technical Bids) documents alone will be opened on 24.08.2017 at 14:00

hours by the authority of NBSTC in presence of bidders.

. Name of Technically qualified bidders will be displayed in the portal on 25.08.2016 at 14:00

hours, subject to completion of verification and technical evaluation.

The Financial bid document of the technically qualified bidders will be opened for evaluation and selection of qualified bidders on 28.08.2017 for scrutiny at 13:00 hours and the bid documents of non-qualified bidders will remain unopened. No separate intimation will be given for this, unless the above date is changed. In case of change of date, intimation will be given online. No individual intimation will be given.

The tender inviting authority reserves the right to reject or cancel any or all pre-qualification documents and financial bid document without assigning any reason whatsoever.

The EMD of successful bidders will be released after submission of security deposit.

All the related documents are to be produced IN ORIGINAL to this office as and when asked for.

Intending Tenderers are requested to download the Tender Document from the

website: www.wbtenders.gov.in within the stipulated time.

Any concealment of fact will be seriously viewed and all tender papers submitted by the agency will be treated as informal and his/her earnest money will be forfeited.

Opening of Tender:

1. The Tenders, so received upto 14:00 hours on 22.08.2017 only, Technical Bid will be opened

on 24.08.2017 at 14:00 hours by the authority of N.B.S.T.C in presence of the available Tenderers or their authorized representatives.

2. All participating Tenderers are requested to remain present at the time of opening of Technical Bid. Objections in this regard will not be entertained by any participant who will not be present during opening of tenders.

Terms & Conditions:

1. This Notice Inviting Tender will be treated as part of the Tender Document.

2. In case of any day meant for this tender (only Bid Opening) appears to be an

unscheduled holiday, the next working day will be treated as scheduled / prescribed day for the same purpose.

3. No preconditioned tender will be accepted.

4. The successful Tenderer, will have to execute an agreement on a Non-Judicial Stamp

Paper as per rules duly signed and submit to this office.

5. The authority reserves the right to accept or reject any or any time in the BOQ

(Bill of Quantity) Quantity or Rate.

TECHNICAL BID

(I) ELIGIBILITY CRITERIA FOR THE BIDDER

Copies of the following documents are to be enclosed with the technical bid

1. Bidder should have a minimum of 5 years experience in manufacturing and supplying Tyres to the North Bengal State Transport Corporation or Other State Undertakings/Departments or reputed companies.

2. Audited Profit and Loss Account, Balance Sheet for last three years to be furnished.

(II) GENERAL TERMS & CONDITIONS FOR THE BIDDER

1. Tenders should be in the prescribed format obtained online from the e-tender portal www.wbtenders.gov.in and it should be submitted as per the instructions given in para (IV) of this tender document.

2. NBSTC does not take any responsibility for the delay caused due to non- availability of Internet connection, Internet traffic jam etc. for the online bids.

3. NBSTC reserves the right either to accept or reject any or all the tenders at any time prior to award of contract.

4. NBSTC reserves the right to choose any material and change the quantity required.

5.The Technical Bid must be accompanied by an Earnest Money Deposit as soft copy (scanned copies of the originals) @ 2% of Total Value by crossed Demand Draft/ Bank Guarantee on any Nationalised Banks/Scheduled Banks payable at COOCHBEHAR. The Demand Draft/ Bank Guarantee should be drawn in favour of “NORTH BENGAL STATE TRANSPORT CORPORATION ”. No other form of Earnest Money Deposit will be accepted. Tenders received without Earnest Money Deposit will be summarily rejected.

6. Earnest Money Deposit of the successful bidder shall be forfeited in the event of withdrawal of his bid before the bid validity period or in the event of the failure of successful bidder to furnish the Bid Security or to execute the agreement within the specified period. In addition to the forfeiture of Earnest

Money Deposit, steps will be taken to ban the business dealings with the bidder in future.

7.For the successful bidder Earnest Money Deposit will be refunded after first delivery of the tyres in good condition and acceptance as per the specifications.The amount deposited as Earnest Money Deposit will not carry any interest. 8. BOTH TECHNICAL & FINANCIAL BIDS to be submitted in Online format. Hard copies of the supporting documents should be submitted to the address of communication as mentioned above.

9.The successful bidder shall be intimated of his selection for the award of contract. Hence no enquiry in this regard will be encouraged.

10. The successful bidder should furnish Bid Security equivalent to 10% of value of the Work Order/Supply Order, either by Demand Draft or by Bank Guarantee from a Nationalised Bank/Scheduled Bank valid for one year, within one week from the date of receipt of award of contract from the NBSTC. The successful bidder shall also execute the agreement in the proforma prescribed by the NBSTC along with the Bid security. The amount deposited as Security Deposit will not carry any interest.

11. The rates quoted in the Financial Bid shall be inclusive of taxes if any that may be levied by the appropriate authorities, Insurance, Transportation, loading & unloading charges and other charges, up to delivery point.

12. The rate quoted in the Financial Bid shall be valid for 120 days from the date of opening of Financial Bid.

13. If it is found that the supplied materials are not as per specifications, the supply made will be rejected and the business dealings with the supplier

will be banned along with forfeiture of Bid Security.

14. Each New Bias Tyre should run at least 40,000 Kms. and in case of Radial Tyre this should be at least 60,000 Kms.

15. Defects if any found in the supplied Tyres during the guarantee period / assured Kilometrage shall be replaced immediately by the supplier at his own cost, within 10 days from the date of receipt of intimation. 16.The supplier shall be solely responsible for the payment of taxes, if any levied by the Government and other local bodies.

17.In exceptional circumstances, NBSTC may solicit the bidders consent to an extension of the period of validity. The request and the responses thereto shall be made in writing (or by e-mail or fax).

18.Online Bids must be submitted not later than the specified time & date.

19. The NBSTC may, at its discretion, extend the deadline for submission of bids by amending the bid documents.

20. During evaluation of Technical bids, NBSTC may, at its discretion, ask the bidder for clarification of his bid.

21. NBSTC will scrutinize the bids to determine whether they are complete, whether any computational errors have been made, whether required sureties have been furnished, whether the documents have been properly signed, and whether the bids are generally in order.

22. NBSTC reserves the right at the time of award of contract to increase or decrease the quantity of goods and services originally specified in the schedule of requirements without any change in unit price or other terms and conditions.

23. The Managing Director, NBSTC; will act as the Arbitrator in case of any disputes. The Jurisdiction will be at Coochbehar.

24. Delivery Schedule:-

Delivery of materials should be completed within 15 days from the date of issue of Purchase Order.

25. Acceptance of materials received after the expiry of Delivery Period

Contractor is required to complete supplies within stipulated delivery period. In

case Contractor fails to complete the entire/ part quantity of supplies within

stipulated delivery period, the Authority shall, without prejudice to other remedies

under the contract, levy/deduct pre-estimated liquidated damages as Specified of

the total value of the unsupplied tyres exclusive of duties & taxes which the

Contractor has failed to deliver within the period fixed for delivery upto @0.25%

for delay of each week or part thereof.

The amount of pre estimated liquidated damages to be charged under the contract shall not exceed 5% of the Tender value of the undelivered tyres.

Authority, at its discretion, may grant extension in delivery period for unsupplied quantity.

26. Payment Terms:- 100% payment against delivery.

27. The taxes and duties will be applicable as prevailing at the time of

delivery within the delivery schedule.

28. Delivery point will be at Coochbehar.

(IV) METHOD OF SUBMISSION OF BOTH TECHNICAL & FINANCIAL BIDS

1. TECHNICAL BID should contain the following covers. (i) One Sealed cover containing the documents required to prove the eligibility criteria mentioned in the tender document along with the letter accepting the terms and conditions of the tender.

(ii) Separate sealed cover containing technical specifications of all types of

Tyre. All the copies should be self attested by the bidder.

All these covers should be placed in a single cover and covering letter and sealed properly and superscribed as “TECHNICAL BID FOR SUPPLY OF NEW TYRES (BIAS AND RADIAL)”. 2. BOTH TECHNICAL & FINANCIAL BIDS to be submitted in Online format on or before 22.08.2017 at 14:00 hrs. Physical copies of the supporting documents mentioned above should be submitted to “The Managing Director, NBSTC, Paribahan Bhavan, Sagar Dighi , P.O.& Dt. Coochbehar “ by 24.08.2017 till 14:00 hrs. 1. This Deed of Guarantee made this day of dd/mm/yyyy (Authority to specify) between Bank

of(hereinafter called the “Bank”) on the one part, and ------(name of the

Authority”) of the other part.

Contractor).

3. AND WHEREAS the Contractor is bound by the said Contract to submit to the Authority a

irrevocably undertake to pay to the Authority an amount not exceeding Rs.(Rupees

only)without any demur, merely on a demand in writing from the Authority stating that the

Bank shall be conclusive as regards the amount due and payable by the Bank under this

Guarantee. We, the Bank, further undertake to pay to the Authority any money so

demanded notwithstanding any dispute raised by the Contractor in any manner

whatsoever and our liability under these presents is absolute, unconditional, unequivocal

and irrevocable.

5. We, the Bank, further agree that the Guarantee herein contained shall remain in full

force and effect during the period that would be taken for the performance of the said

agreement.

6. This Guarantee is valid for a period of ________ (Duration in calendar months

in figures and words) from the date of signing. (The initial period for which this

Guarantee shall be valid must be for at least _______ months/years longer than the

anticipated expiry date as stated in the Contract. We undertake not to revoke this

guarantee during its currency without the written consent of the Authority.

7. At any time during the period in which this Guarantee is still valid, if the Authority agrees

to grant a time extension to the Contractor or if the Contractor fails to complete the

works within the time of completion as stated in the Contract, or fails to discharge itself

of the liability or damages or debts as stated under Para 5, above, it is understood that the

Bank shall extend this Guarantee under the same conditions for the required time on

demand by the Authority and at the cost of the Contractor.

8. The Guarantee hereinbefore contained shall not be affected by any change in the

Constitution of the Bank or of the Contractor.

9. The neglect or forbearance of the Authority in enforcement of payment of any moneys, the

payment whereof is intended to be hereby secured or the giving of time by the Authority for

the payment hereof shall in no way relieve the Bank of their liability under this deed.

10. We, the Bank, undertake not to revoke this Guarantee except with the previous

consent of the Authority in writing. This Guarantee shall be valid up to and

we undertake to renew/extend this Guarantee from time to time till the completion

of performance by the Contractor of its obligations under the Contract and/or as

demanded by the Authority.

11. The expressions “the Authority”, “the Bank” and “the Contractor” hereinbefore

used shall include their respective successors and assignees.

In witness whereof I/We of the Bank have signed and sealed this guarantee on the dd
