1. INTRODUCTION

The “The Rual Energy Project – Additional Financing – Phase 4 , Ha Tinh Province”

is among the subproject (hereinafter alternatively referred to as project) to be implemented in

round 4 of the Second Rual Energy Project (RE2) by Electricity of Vietnam and funded by

the World Bank (WB). This project shall be implemented in 61 communes/towns of 12

districts/cities in Ha Tinh province.

The project components include:

+ New construction of 44.286 km medium voltage transmission line

+ New construction of 223.849 km low voltage transmission line

+ New construction of 74 substations at 35, 22, and 10/0.4 kV

This project may result in negative impacts on the local environment and residents

during the preparation, construction and operation phases.

To ensure such potential impacts are properly identified and mitigated during the

implementation of the project and ensure compliance with the Environmental Impact

Assessment Policy of the WB - (OP/BP 4.01), an Environmental Management Program

(EMP) for this project has been prepared in accordance with the guidance given in the

Environmental Management Framework (EMF) prepared under the RE2. This EMP is

comprised of the following sections: project description, policy framework, applicable

environmental standards and regulations, potential negative environmental impacts, proposed

mitigation measures to be taken during preparation, construction and operation phase, and

implementation organization. The EMP shall also include environmental Codes of practices

(ECOP) which are to be incorporated into bidding and contracting documentation attached to

environmental monitoring.

According to applicable environmental protection regulations of Vietnam, the project

is subject to the establishment of an Environmental Protection Commitment (EPC). This EPC

has been approved by Huong Khe district people’s committee in its Letter No. 61/TB-UBND

dated 11/7/2012 and attached as an annex to this EMP.

2. LEGAL FRAMEWORK

2.1. Regulations of Vietnam government.

- Environmental protection law No.52/2005/QH11 adopted by the National Assembly

of Vietnam on 29/11/2005, providing responsibilities of individuals and organizations

in environmental protection;

- Forest development and protection law No.29/2004/QH11;

- Cultural heritage law No.28/2001/QH10;

- Water resources law No.08/1998/QH10 dated 20/05/1998;

- Government decree No.80/2006/NĐ-CP dated providing details and guidance on the

implementation of some articles of the environmental protection law;

- Government decree No.21/2008/NĐ-CP dated 28/2/2008 amending and

supplementing some articles of the government decree No.80/2006/NĐ-CP dated

9/8/2006 which provides details and guidance on the implementation of some articles

of the environmental protection law;

- Government decree No.29/2011/NĐ-CP dated 18/04/2011 providing details on

strategic environmental assessment, environmental impact assessment and

environmental protection commitment;

- Circular No.26/2011/TT-BTNMT dated 18/07/2011 by the Ministry of Natural

Resources and Environment providing details and guidance on the implementation of

some articles of the government decree No. 29/2011/NĐ-CP dated 18/04/2011 on

strategic environmental assessment, environmental impact assessment and

environmental protection commitment;

- Government decree No.106/2005/NĐ-CP dated 17/09/2005 providing details and

guidance on the implementation of some articles of the Electricity Law and with

regards to safety requirements for high voltage grid;

- Government decree No.81/2009/NĐ-CP dated 12/10/2009 amending and

supplementing some articles of the government decree No.106/2005/NĐ-CP dated

17/09/2005 which provides details and guidance on the implementation of some articles

of the Electricity Law and safety requirements for high voltage grid;

- Circular No.12/2011/TT-BTNMT dated 14/04/2011 on the management of hazardous

substances;

- National technical regulation: QCVN08:2008/BTNMT – national regulations on

surface water quality; QCVN05:2009/BTNMT- air quality, standards on ambient air

quality; QCVN26:2010/BTNMT- National technical regulations on noise;

QCVN27:2010 - National technical regulations on vibration.

- EVN guidelines No.2623/CV-EVN-KHCN&MT dated 28/05/2009 on the

management and prevention of pollution and PCBs excessive exposure.

2.2. Safety policies applicable with the project:

Environmental screening based on the criteria set out RE2 EMF found that the project

is subject to the application of Environmental Assessment Policy (OP 4.01), forced

resettlement policy (OP 4.12) and disclosure policies of the WB.

3. PROJECT OBJECTIVE AND SCOPE OF WORK

3.1. Project objective

The project “The Rual Energy Project – Additional Financing – Phase 4 , Ha Tinh

Province ” shall have the following objectives:

- To improve and upgrade the existing medium and low voltage transmission lines in

order to reduce power loss, stabilize power supply for the region and living and

production activities in the rural areas

- To ensure good power supply and power quality for the project site;

- To prevent overload for the local grid and enhance local power grid safety

- To contribute to poverty reduction program in rural area through infrastructure

improvement, that is power transmission lines;

3.4. Project description

3.4.1. Medium voltage transmission lines supplying power for new substations.

- The medium voltage transmission lines shall supply power for new substations

located in 54 communes (Thach Hung, Thach Ha, Cam Huy, Cam Vinh, Thien Cam, Cam

Loc, Trung Le, Yen Ho,Bui Xa, Thai Yen, Duc Thuy, Duc Thinh, Xuan Giang, Xuan Hai,

Can Loc,My Loc, Duc Huong, Phu Gia, Phuc Dong, Huong Long, Huong Tra, Phuong Dien,

Huong Binh, Huong Giang, Son Bang, Son Hoa, Son Quang, Son Ha, Son Long, Son Tien,

Son Linh, Son Hong, Ky Xuan, Ky Lam, Ky Nam, Ky Tay, Ky Thuong, Ky Hop, Ky Trung,

Ky Son, Ho Do, Mai Phu, Thach My, Trung Luong, Dau Lieu, Thuan Loc, Duc Thuan,

Thach Ha, Thach Vinh, Viet Xuyen, Thach Long, Thach Kenh, Ngoc Son and Thach Son) of

12 districts with the total length of 44.286 km.

All the project communes are located near district or town centers with traffic access

convenience, therefore the field surveys were conducted with a great ease. The lines shall

primarily run over rice fields, tea plantations and other type of casual crops. The region has

category III terrain conditions.

3.4.2. Substations

- Substations shall be located in places with convenient access to main roads and near

district or town centers, functioning to share the current load with existing substations.

3.5.2. Transportation

Material and equipment supply

Material and equipment supply shall be determined in detail in later phase, depending

on the state budget disbursement and project bidding mechanism. Two sources are expected:

- Material and equipment supply by the project owner.

- Material and equipment supply by the contractor.

Long distance transportation

For material and equipment supplied by the project owner:

+ Long distance transportation of such material and equipment shall be

undertaken using specialized trucks. Such trucks shall be selected in accordance with the

requirements in packing provided in the contract.

+ Long distance transportation from the project owner warehouse to the site shall

be undertaken using 5 7.5 ton trucks and loading and unloading shall be done using 5

ton cranes.

For material and equipment supplied by the contractor:

+ Electric poles shall be transported using Kawaz trucks, using 5 ton cranes for

loading and unloading.

+ Supporting frames and accessories shall be transported using 5 ton trucks with

manual loading and unloading.

+ Cement and steel shall be transported using 5 ton trucks with manual loading

and unloading.

+ Stone and sand shall be transported using 5 ton dump trucks.

Intermediate transportation

- Material and equipment stored at the site such as cables, insulators, accessories, breakers,

capacitors, power meters, meter boxes and cement shall be transported to the construction

sites using non-motorized vehicles and manual handling.

Manual handling

All material and equipment shall be transported to the construction site manually. The

distance shall be determined case by case.

4. SUMMARY OF PROJECT SITE NATURAL & ENVIRONMETNAL

CONDITIONS

4.1. Geography and geology

4.1.1. Geography:

Ha Tinh Province in the central strip with geographical coordinates from 17o53 'to

18o45' north latitude, 105o05 'to 106o30' East. Ha Tinh province is located in the southern

coastal area of the old four borders:

+ North of Nghe An province

+ South of Quang Binh province

+ West Democratic People's Republic of Laos.

+ East Sea

- Natural area is 6054 km2.

- Population estimated in 2008 to 1,314,252 people, a population density of 217 people /

km2 but the population is unevenly distributed in the coastal plain and density 578 ng /

km2 in the midlands and mountainous 55 ng / km2.

- The administration of Ha Tinh: 10 districts and 1 city, 1 town consists of 262 communes,

wards.

- Administrative center of culture and economy of the province of Ha Tinh City

(The data of this deducted from Statistical Yearbook of Ha Tinh province in 2010)

4.1.2. Terrain and land form:

The total area of 605,345 ha of natural land that is agricultural land area of 121,500 ha.

The terrain slopes tilted toward Southeast Northwest, rivers and streams for land division

creating rich in variety, complexity of the nature of Ha Tinh set includes 2 main groups:

Water into distribution groups in the coastal plain is mainly in line remote land suitable for

rice cultivation and cash crops. Of a distribution group in the Midlands Uplands.

4.1.3. Soil

Land used for agriculture is 96 805 ha of arable land which is 1641 ha annual pasture

61 ha, 937 ha of ponds, 17,275 hectares of garden land. Average of Ha Tinh agricultural

land is 757 m2 / person.

4.1.4. Climate

Ha Tinh is one of two southern provinces of Central Vietnam has a tropical climate

harsh. Hot season from April to October the average temperature (26 - 37oC) is the

absolute temperature 42oC, the cold season from January to April next year, the average

temperature below 20 degrees Celsius, low absolute temperature 1 ° C . Relative humidity

(71-91)%, minimum peaks in July and January 2, 3 and September. Average rainfall

(1800-2000) mm / year. Complex mode storm affected by two types of wind, wind

northeast from October to April brought a cold climate, summer is influenced by the hot

dry southwest wind, the terrain is relatively flat so months 7.8, 9 affected by the

devastating storms that great. So the agricultural production of Ha Tinh often difficult and

depends on natural disasters.

4.2. Natural resources

4.2.1. Land:

Ha Tinh province has 605,574 hectares of natural land. In particular, the agricultural

land area is 98,171 ha, accounting for 16.24% of land area is forested 240,529 hectares,

accounting for 39.72% of land area is used exclusively 45,672 ha, accounting for 7.54%;

residential area is 6799 ha, representing 1.12% of unused land and river ice is 214,402 ha,

accounting for 35.40%.

In agricultural land, crop land area is 76,234 ha annually, accounting for 77.67%, but the

rice land is 65,159 ha, accounting for 85.47% of the annual crop; land for perennial crops

is 2964 ha, accounting for 3.01%.

The area of barren hills greened need is 160,187 ha, accretion can use is 22 564 ha, the

total surface area is 6576 ha of which are exploited and used as 947 ha, not exploitation is

5629 ha.

4.2.2. Forestry:

As of 2002, the province has 244,453 ha of forest land. Among them are 194,754 ha of

natural forests, planted forests is 49,699 ha.

The natural protected areas: Area Vu Quang Nature Reserve covers an area of 61,283 ha.

Area Ke Go Nature Reserve area: 35,000 ha.

4.2.3. Marine resources

The province has 137 km of coastline from Nghi Xuan district in Ky Anh district,

including the major estuaries: The Cua Hoi - Nghi Xuan, Cua Sot - Thach Ha, Cua

Nhuong - Cam Xuyen, Cua Khau - Ky Anh. This is a marine fisheries are more precious

and rare with high volume such as lobster, oysters ... only be exploited from 10 to 15%.

Ha Tinh can develop a comprehensive economic sea fishing, aquaculture and seafood

processing industries for export.

4.2.4. Mineral resources

Ha Tinh has great potential for mineral investment, but has not been effectively

exploited are:

- In Thach Khe Iron Ore (Thach Ha) with reserves of about 500 million tons.

- Tin mine in Son Kim (Huong Son), and gold in Hoa Hai (Huong Khe) and Ky Tay, Ky

Hop (Ky Anh). ILMINITE ore in Thach Ha and Cam Xuyen average catches:

100.000tan/nam. Zircon mining output per capita: 7.000tan/nam. RUTSIN average

catches: 3.000tan/nam.

- Titanium oxide reserve of 3-5 million tonnes of run along the coast are likely to venture

abroad.

4.3. Population, culture and social characteristics

Population - Ethnic groups: According to a survey on 04/01/1999, Ha Tinh province with

1,268,968 people. The number of working age people in the province is 645,555 society,

accounting for 46.95% of the population. On the whole province has 5 main ethnic groups,

the largest ethnic majority Kinh making up nearly 99%. The ethnic minorities, including 594

ethnic Lao people; have 403 Muong ethnicity, nationality Chut is 127 people.

Educational level: By the end of 2002, universal primary education for 11/11 districts with

260 communes. Number of pupils academic year 2001 - 2002 is 363,235 students. Of which:

Primary is 183,251 students, secondary schools is 134,864 students, high school students is

45,120. Number of teachers 1999-2000 school year is 13,169 people. Where: 3339 is the

Primary, secondary education is 5280 people, high school is 1,550 people. Number of health

workers in 2000 was 2376 people. Of which: Doctor is 433 people, medical doctors and

technicians are 967 people, 669 people are nurses and midwives is 307 people. The average

medical doctor on a thousand people was 10.2 people.

In the project area: the project area without ethnic minorities, there are no differences in

perception, but many cultural issues, society has always been interested in local government,

all people are using water clean lighting. The project will contribute directly and indirectly

improve the lives of local people by providing electricity for production, local economic

development, lighting of public works ...

The project is not located in areas of historic, cultural facilities - as well as social security and

defense.

4.4. Traffic condition:

The main traffic facilities in Ha Tinh are by roads. There are currently 3 national

roads running through Ha Tinh (national road No.1A, national road No.8A, Ho Chi Minh

road) with the total length of 228 km. In addition, there are also provincial roads, inter

commune roads that lead to border gates and have been improved progressively. Together

with traffic infrastructure development, transportation vehicles in the provinces also meet the

requirements of transportation and the needs of local residents within the province.

The project region has good traffic access since it runs along main roads and it is not

necessary to construct any new service roads.

5. IDENTIFICATION OF PROJECT POTENTIAL IMPACTS

The project shall play an important role in the electrification program and poverty

reduction policy in 61 communes of 12 districts. It will also speed up the national

modernization and industrialization which is a step towards promoting rural development and

poverty reduction.

When the transmission lines are constructed, the local residents shall tend to move to

live close to electricity access. The local authorities shall need to plan for this by opening

new roads, new residential areas and industrial and agriculture development. All the project

districts and the city shall have to work in this direction.

The project shall bring about significant socioeconomic benefit. This has been

documented in detail in the description of feasibility report. A part from such benefits, the

project may also result in environmental and socioeconomic impacts which are adverse to the

local conditions. Surveys have been conducted on this and potential project impacts are

summarized in the below table.

6. ENVIRONMETNAL MANAGEMENT PLAN

6.1. The management of the social impact of the project:

• Program information and communication:

Basic information includes the following information

- Number, type and area of agricultural land lost

• Mechanisms of compensation claims All complaints and inquiries related to any aspect of RP, including the determination of

unit prices and number of missing property will be settled according to the following steps:

Step 1: If any person claims that an issue of the resettlement program and restore life, that

person can direct presentation or written complaint to the competent authorities of the

commune . The CPC will address these questions within 15 days after receipt of the

complaint.

Step 2: If the complainant disagrees with the decision in step 1, the person may complain to

the DPC or the Committee on District clearance within 15 days of receipt of the decision in

step 1. DPC clearance or the district will issue a decision within 15 days after receiving the

complaint.

Step 3: If the complainant is not satisfied with the decision of the district government, that

person may appeal to the PPC or the Commission resettlement of the province within 15

days after receiving the decision of the DPC or district board clearance. Within 15 days

PPC or Provincial Resettlement Committee will make a decision on this complaint.

Step 4: If PAP still not satisfied with the decision of the provincial government, they would

apply to the district court within 15 days of receipt of the decision of the PPC or Provincial

Resettlement Committee

The relocation should be exempt from all administrative fees and legal.

• System monitoring and evaluation The PMU and Power Company affiliated closely with the DPC / commune in the

respective management units and independent monitoring unit conducting regular

monitoring implementation of the compensation plan and re- residents. The findings will be

recorded in quarterly reports for submission to the VND, the Electricity Corporation and the

other life made in accordance with the provisions of the policy framework and RP

equivalent.

- Monitor that the RP has been implemented as designed and approved

- Check that the funds to make the declaration and RP for the PMU, respectively, at the

local level (provincial / district) in a timely manner and in sufficient quantities to ensure the

implementation of goals, and capital PMUs are used respectively in accordance with the

stated purpose of the RP.

- Keep all complaints and answer questions and ensure complaints are resolved as specified

time.

Monitoring by independent organizations or independent units or independent

consultant hired by the Electric Power under VND will conduct periodic monitoring and

external evaluation RP implementation. The independent organization may be scholars or

research institutions, non-governmental organizations (NGO) or independent consulting

firm, with a staff of professional and reference conditions approved recognized by the

World Bank.

To check the information provided to monitor and report on internal management of the

Electricity respectively, then the agency may hire external monitor will visit the sample

about 20% of affected households in the province involved in every 6 months after RP was

conducted to:

- Identify procedures for the participation of affected persons, the compensation and the

right to restore new life to be made in accordance with the policy framework or not, and

- Assess whether the target of the policy framework for improving or at least ensure that

living standards and incomes of the people affected have been met or not.

- Get the quality criteria of the social and economic impacts when the project to affected

people.

- Giving opinions modified in the deployment process in cases of RP may be to achieve the

principles and objectives of the policy framework.

6.2. Mitigation measures

- Keep track of the community concerns and

information required such as project progress;

- Respond to community concerns via telephones and

documents in a timely manner;

- Notify local residents of construction schedule, work

schedule, potential interruptions to services and

detour roads and temporary buses, any destruction or

mine explosion schedule;

- Provide technical data and drawings for community,

particularly a scheme on construction sites and EMP;

- Provide notice boards at all sites to provide

information about the site manager, environmental

officer, medical and safety officer, with concrete

contact details and other information so that affected

people will be able to raise their voice and concerns.

14. Procedure for

addressing any

cultural and

historical site

found

During construction phase if the contractor finds any

cultural and historical sites, including commentary or

tombs, the contractor shall:

- Stop construction activities in the particular area;

- Protect the area from any damage or loss to the sites.

In case the historical objects can be removed or

sensitive objects assign a person to protect it until

local authorities come to confirm and take over the

issue;

- Notify the construction supervising consultant, who

will be responsible for informing local authorities or

the state agencies of such cultural or historical sites

(within 24 hours or less);

- Local authorities or state agencies shall be

responsible for protecting and isolating such area

before any further processing.

- Decide how to process such issues is the

responsibility of the local authorities, including

change, (in case a cultural or historical site is found

and cannot be removed), reservation, isolation,

rehabilitation and rescue;

- If the cultural or historical site are of high value and

the reservation is recommended by relevant agencies

the project owner shall have to change project design

accordingly for the component in that particular area;

7. IMPLEMENTATION ORGANIZATION FOR THE ENVIRONMENTAL

MANAGEMENT PROGRAM AND CAPACITY BUILDING

7.1. Responsibilities in implementing the Environmental Management Program

(EMP)

7.1.1. During detailed design and bidding invitation preparation

During the detailed design and bidding invitation preparation, the project management

unit shall be responsible for incorporate the EMP (mitigation measures, responsibilities of the

contractor) into the attached annexes in the bidding invitation and contract signed with the

contractor. Engineers taking charge of the detailed design shall also refer to findings in the

EIA and EMP to ensure environmental issues shall be looked at in the final design.

During the bidding invitation preparation and the contract, it is necessary to ensure the

contractor is fully informed of its responsibilities in implementing environmental mitigation

measures and its commitment to compliance.

7.1.2. During construction phase

The project management unit shall assign the construction supervising consultant

and/or field engineers to supervise daily progress of safety measure application by the

contractor. The terms of references are documented in Annex 1 (TOR for the construction

supervising consultant and/or field engineers shall cover the followings duties:

- Prior to construction, confirm compensation for affected people has been completed.

- During construction phase, strictly supervise the implementation of mitigation measures

throughout the construction phase.

- Confirm the compliance with the EMP and check out for and damage caused by the

contractor. If necessary, prepare a minute and ask the contractor to compensate or

rehabilitate as provisions of the contract. Environmental safety implementation by the

contractor shall be included in the project progress reports.

8. CONSULTATION AND INFORMATION PUBLICATION

During preparation phase (2011), 05 tasks shall be implemented:

Task 1: Conduct field surveys and work with local authorities to agree on transmission

line routes and substation locations.

Task 2: Conduct field surveys and prepare EIA report and EMP.

Task 3: Organize stakeholder consultation for the project.

From 09/3/2011 to 22/5/2011 meeting with local residents shall be organized in 61

subproject communes and conduct consultation about the EMP, with the participant of the

project owner representatives:

- Subproject description, transmission line routes, substation location and the necessity of

the project;

- Potential environmental impacts;

- Environmental impact mitigation measures.

Participants: Representatives from commune people’s committee, farmers association,

women’s association and other mass organizations, village leaders and representative of

affected households and the consultant.

Summary of comments by participants:

- In general, the majority concerns of the participants were their support for the project due

to the project benefits. Environmental impacts were insignificant and would be within a

small scope.

- Local authorities supported those proposed locations for substations.

- Compensation has been implemented satisfactorily. The construction of the project shall

result in minimum impacts.

- During the construction, mitigation measures shall be taken to minimize impacts on

trees, crops and existing public facilities in the project region.

- During the construction phase, a large number of workers working in the region but the

contractor shall have to manage their workers and work with local authorities to ensure

social security.

- Once the construction is completed, the contractor shall rehabilitate the site and return

the original landscape.

The summary of meeting with local residents, minute of stakeholder consultation

meeting and some photos about the meeting attached in Annex 6.

All relevant issues as well as comments by the local residents have been taken into

account by the supervising consultant and the project owner and shall include them in the

design of the project and EMP implementation.

Task 4: Review and adjust the EMP as per comments from the stakeholder

consultation. Further receive comments from other stakeholders and affected households.

Task 5: Popularize the EMP to the public population

Only after the design of the project is adjusted to best suit with the local conditions

and environmental performance, it shall be approved and given investment license.

According to the information popularization requirements of OP 4.01, the consultant shall:

Provide copies of the EMP, RP, and summary of project to Ha Tinh provincial

people’s committee and project commune and district people’s committees;

Make announcements many times on the mass media within 60 days. Such

announcements shall indicate that during working hours, anyone can provide his comments

on the EMP, RAP and summary of project design within 2 months at the following locations:

1) Project district commune people’s committee venues; and 2) Project commune

people’s committee venues.

Both Vietnamese and English copies of the EMP shall also be submitted to the

Vietnam Development Information Center (VDIC) at 63 Ly Thai To street, Hanoi in order to

provide access to NGOs and the general public.

The English copies of the EMP shall also submitted to the WB for disclosed at the InfoShop.
