DEFINITIONS• Electrical and Communications Association, Queensland Industrial Organisation of Employers ABN 40 669 256 (MEA).• The Advertiser is the company / agency whose name and address appear at Item 1 of this agreement.• The MEA website is masterelectricians.com.au and is owned by MEA.• The Master Electrician magazine is the quarterly magazine published by MEA.
PRIVACYInformation collected by MEA is protected by the Privacy Amendment (Private Sector) Act 2000 (Cth). Information collected by this form is for the purpose of obtaining details to assist in providing goods and services and will not be disclosed to a third party, except where prior written permission is obtained from the individual who supplied the information and to whom the information refers.
By advertising with MEA, you agree to the terms of our Privacy Policy, available at masterelectricians.com.au.
Clause 1: The Advertiser agrees to advertise in the issues stated at Item 3 of this agreement.
Clause 2: The Advertiser will provide to MEA artwork for the advertisement in accordance with the deadlines and specifications as outlined in this document. MEA is under no obligation in relation to material or information received after relevant deadlines or not in accordance with the relevant specifications.
Clause 3: MEA owes no duty to the Advertiser to review or amend any advertisement and no review or amendment by MEA will affect Advertiser’s responsibility for the content of the advertisement.
Clause 4: The positioning and placement of an advertisement is at the discretion of MEA except where expressly agreed in writing by MEA.
Clause 5: MEA will invoice Advertiser the amount shown at Item 3, to secure the booking prior to publication.
Clause 6: Payment is due within seven days, after the invoice issue date. The invoice is payable via BPAY, credit card (excluding American Express or Diners) or cheques made payable to MEA.
Clause 7: MEA reserves the right to withhold publication of the Advertiser’s advertisement until the Advertiser has paid any outstanding amounts and may terminate the agreement by written notice, effective immediately.
Clause 8: The Advertiser may cancel a booking by providing to MEA notice in writing, of its desire to do so, not less than eight weeks prior to the material deadline of the issue it seeks to cancel advertising from. However, in the event that the Advertiser has received a discount for advertising in multiple editions or publications, including packages, the Advertiser shall remain liable to pay for the booking for all advertising.
Clause 9: Failure to provide material as and in the manner specified in this document will result in the Advertiser being charged additional fees for any work undertaken by MEA in attending to having the material included in the forthcoming publication at a rate of $110 per hour, in addition to any other charges already payable.
Clause 10: All content for advertisements must be approved by MEA prior to publishing and MEA reserves the right to refuse advertising requests without explanation. MEA also reserves the right not to publish any further material from the Advertiser for any reason, at its absolute discretion. In the event that it does so, no further charges will be payable with respect to further bookings.
Clause 11: MEA reserves the right to insert the word ‘advertisement’ when an advertisement resembles editorial material, at its absolute discretion.
Clause 12: The Advertiser represents and warrants to MEA that the advertising material provided by it is not false and/or misleading, does not contain any untrue, defamatory, harmful, abusive or obscene materials, is in compliance with relevant laws, does not infringe upon the rights of any other party and will not give rise to any claims against or liabilities of MEA, its directors, employees or Members.
Clause 13.1: Nothing in these terms and conditions excludes or varies any rights or remedies under the Australian Consumer Law in the Competition and Consumer Act (2010). To the fullest extent possible and subject to MEA’s liabilities and obligations under the Australian Consumer Law, the remaining provisions of this clause shall apply, subject to Clause 13.1.
Clause 13.2: MEA makes no representation or warranty of any kind including to: the continued production of any publication in print or digital form; final placement, positioning of an advertisement or date of publication or distribution; to the number of visitors to its website; or exclusivity.
Clause 13.3: The Advertiser acknowledges that distribution of a relevant publication may be suspended or ceased at any time for any reason.
Clause 13.4: MEA is not liable for any direct or Indirect Loss of any nature it incurs as a consequence of publishing material supplied by the Advertiser, including where arising from the failure of MEA, to publish an Advertisement in the form prescribed or a lack of distribution / publishing of the relevant advertisement.
Clause 13.5: Where any of the circumstances set out in Clause 13.4 arise: a. The advertiser shall incur no cost where the Advertisement has not been published at all due to the negligence of MEA or any of its employees; andb. in all other circumstances, and subject to the other applicable terms, the agreed rateshall be reduced according to circumstances. In no circumstances will MEA’s liability be greater than the republication of the relevant advertisement.Clause 14: If a party is unable, wholly or in part, by Force Majeure to carry out an obligation under this agreement it must give the other party prompt written notice of the Force Majeure and the extent which it will be unable to perform or be delayed whereupon the relevant obligation, so far as it is affected by the Force Majeure, is to be suspended during the period that the Force Majeure prevails.
Clause 15: This Agreement constitutes the entire agreement of the parties and supersedes all prior discussions, undertakings and agreements.
Clause 16: This Agreement will be governed in accordance with the law in force in Queensland. By entering into this Agreement, the parties are deemed to have submitted to this non-exclusive jurisdiction of the courts.
