The City of Milwaukee (“City”) hereby gives notice by publication as a class 1 notice under Wis.
Stat. Ch. 985 and by 1st class mail to all owners, owner's agents, and interested parties at their
last-known address of the City’s intent to file an application for the appointment of a receiver
under Wis. Stat. § 823.23(2)(a). The appointment of a receiver may be requested by the City
unless action is taken to abate the nuisance described herein within sixty (60) days after receipt
of this notice.
The addresses, tax keys, and legal descriptions that identify the 176 residential properties that are
subject to this notice are attached and marked Exhibit B (collectively hereinafter, the
“Properties,” and separately hereinafter, a “Property”). The individuals, limited liability
companies, and corporations that own the Properties shall be referred to hereinafter as the
“Owners.”
The anticipated application for receivership will address a business enterprise created and
controlled by Elijah Mohammad Rashaed (“Rashaed”). Based upon information and belief,
Rashaed has accumulated a portfolio of real estate in the City of Milwaukee by using multiple
limited liability companies (“LLCs”) and distributing ownership interests in real estate among
multiple individuals. The anticipated application will allege that the distribution of ownership
interest among the Owners was done by Rashaed with the intent to maintain a public nuisance
and avoid legal duties such as 1) complying with building code requirements, 2) adequately
managing residential rental property, 3) paying debts and judgments, and 4) complying with
administrative regulations regarding residential rental practices.

The conditions of the Properties that constitute a nuisance are as follows:
1. Building code violations. Since 2001, the City’s Department of Neighborhood Services
(“DNS”) has issued to the Owners approximately 3,500 orders identifying approximately
15,000 violations of the municipal code observed at the Properties (these figures do not
include any violations observed at 6 nonresidential parcels currently owned by an entity
controlled by Rashaed or 52 parcels that an entity controlled by Rashaed formerly
owned). The number of orders issued and violations observed for each Property are
identified on Exhibit A alongside the address of the correlating Property. Approximately
309 orders to correct 1,195 code violations remain unabated and are identified on Exhibit
A alongside the address of the correlating Property.
TO ABATE: Correct any and all code violations existing at the Properties.
2. Dilapidated building at 2405 West National Avenue
TO ABATE: Complete the restoration of the building in accordance with the
stipulation and court order in Milwaukee County Circuit Court Case No. 15-
CV-3720.
3. Dilapidated building at 2710 West Juneau Avenue
TO ABATE: Raze and remove all structures located at 2710 West Juneau
Avenue and return the property to a dust-free, erosion-free condition in
accordance with the stipulation and court order in Milwaukee County Circuit
Court Case No. 15-CV-7228. If the City of Milwaukee has razed the building
and structures, reimburse the City of Milwaukee for the cost thereof.
4. Dilapidated building at 519 North 28th
Street
TO ABATE: Raze and remove all structures located at 519 North 28th
Street
and return the property to a dust-free, erosion-free condition pursuant to the
Raze Order recorded in the office of the Milwaukee County Register of Deeds
as Document # 10606874. If the City of Milwaukee has razed the building and
structures, reimburse the City of Milwaukee for the cost thereof.
5. Dilapidated building at 2359-65 North 45th
Street
TO ABATE: Complete the restoration of the building located at 2359-65 North
45th
Street or raze and remove all structures thereon and return the property to a
dust-free, erosion-free condition pursuant to the Raze Order recorded in the
office of the Milwaukee County Register of Deeds as Document # 10498359. If
the City of Milwaukee has razed the building and structures, reimburse the City
of Milwaukee for the cost thereof.
6. Dilapidated building at 3351 North 25th
Street
TO ABATE: Raze and remove all structures located at 3351 North 25th
Street
and return the property to a dust-free, erosion-free condition pursuant to the
Raze Order recorded in the office of the Milwaukee County Register of Deeds
as Document # 10308487. If the City of Milwaukee has razed the building and
structures, reimburse the City of Milwaukee for the cost thereof.

7. Mismanagement of rental property. Based on information and belief, the policies and
practices established by Rashaed’s management of the Properties cause a public nuisance
because:
a. The business practice of reactive maintenance and repairs requires the Department
of Neighborhood Services (“DNS”) to perform property management services for
the Owners at the expense of taxpayers.
TO ABATE: Proactively inspect units and correct any code violations without
waiting until DNS issues orders.
TO ABATE: Designate a responsive person for tenants to contact with repair or
maintenance requests before reporting issues to the City.
b. The business practice of insufficiently capitalizing Owners causes them to defer
maintenance and accrue unpaid debt. The accrual of debt and deterioration of
property value incentivizes the business to abandon buildings that negatively
impacts adjacent properties and surrounding neighborhoods.
TO ABATE: Create separate records and bank accounts for and sufficiently
capitalize each Owner so that it may function separately from any bank
accounts related to Horizon Mgt. & Construction LLC.
TO ABATE: Pay and/or satisfy all unsatisfied judgments against Owners,
including 90 unsatisfied judgments in favor of the City totaling $289,962.93 of
debt against 16 different LLCs.
c. The rental practices of the business have resulted in 2,467 eviction actions against
2,044 different individuals since 2001. Over 90% of the total eviction actions
were filed since 2009. Rate of eviction was below 15% of units in 2008 and prior,
but increased rapidly in 2009 and peaked at 71% of units in 2016. The Owners
filed more eviction actions in 2016 than any prior year, averaging almost 1 new
eviction filing per day.
TO ABATE: Correct management practices that have resulted in rapid increase
in eviction rate.
d. The business practice of accepting emergency assistance provided under Wis.
Stat. § 49.138 from a prospective tenant without disclosing the total rent amount
and non-rent charges, and then refusing to rent to the prospective tenant due to the
unpaid balance while retaining the emergency assistance payment has caused state
taxpayers to unjustly enrich the business without receiving the benefit
contemplated by such payment.
TO ABATE: Return to state taxpayers all emergency assistance payments
retained by the business under circumstances in which the business did not
simultaneously provide housing for the beneficiary of such payments.
e. The business practice of repeatedly violating state administrative code prohibiting
unfair residential rental practices constitutes a public nuisance per se.
TO ABATE: Comply with all residential rental practices described in Wis.
Adm. Code Ch. ATCP 134.

The conditions that resulted in the decision to apply for a receiver are as follows:
1. Nuisance Activity. Based on information and belief:
a. The chronic violations of building code requirements, policy of allowing buildings to
deteriorate and cause blight, and the mismanagement of rental property creates a
public nuisance that has negatively impacted tenants, neighbors of the Properties, and
the rights of the community as a whole.
2. Improper and/or Unlawful Use of Limited Liability Companies. Based on information
and belief:
a. Rashaed has acted in a manner that constitutes a willful failure to deal fairly with the
members’ LLCs in connection with a matter in which they have a material conflict of
interest in violation of Wis. Stat. § 183.0402(1)(a).
b. Rashaed has acted in a manner that constitutes a violation of criminal law in violation
of Wis. Stat. § 183.0402(1)(b).
c. Rashaed has acted in a manner that constitutes a transaction from which the members
derived an improper personal profit in violation of Wis. Stat. § 183.0402(1)(c).
d. Rashaed has acted in a manner that constitutes willful misconduct in violation of Wis.
Stat. § 183.0402(1)(d).
e. Rashaed acquired debt using DW3 LLC and 4252 North Teutonia Property, LLC for
his own benefit while he and the Owners were subject to millions of dollars in
unsatisfied judgments.
i. Through DW3 LLC, Rashaed took control in 2016 of $869,397.24 in debt against
Owners by acquiring the notes and mortgages in the possession of Seaway Bank
& Trust Co. and subject to foreclosure judgment in Milwaukee County Case Nos.:
14-CV-5144 ($25,038.55), 14-CV-5380 ($606,383.74), 14-CV-5349
($27,937.17), and 14-CV-5146 ($210,037.78). Seaway Bank & Trust Co.
acquired the mortgages after the original issuer, Legacy Bank, was closed by
federal regulators on March 11, 2011. Seaway Bank & Trust Co. was later closed
by federal regulators on January 27, 2017.
ii. Through DW3 LLC, Rashaed acquired the balance of a $640,000 mortgage from
Ridgestone Bank. Ridgestone Bank was later renamed Byline Bank.
iii. Through 4252 North Teutonia Property, LLC, Rashaed took control in 2016 of the
balance of a $350,000 mortgage by acquiring the note and mortgage in the
possession of AnchorBank and subject to foreclosure judgment in Milwaukee
County Case No.: 14-CV-2978.
f. On at least ninety-seven (97) occasions, parcels have been conveyed from one entity
controlled by Rashaed to a different entity controlled by Rashaed.
g. Rashaed makes no effective distinction between the Owners, and they are operated as
an alter ego of Rashaed for the purpose of avoiding legal duties.
3. Fraud Against a Financial Institution. Based on information and belief:
a. On April 4, 2013, a Consent Order between North Milwaukee State Bank (“NMSB”),
Federal Deposit Insurance Corporation (“FDIC”), and Wisconsin Department of
Financial Institutions (“WDFI”) required NMSB to tighten lending standards

b. In May 2013, Rashaed’s business partner, Randolph Myricks (“Myricks”), was named
president of NMSB.
c. On July 30, 2013, First Property Development LLC obtained a 12-month loan from
NMSB for $474,420.33. As collateral, it mortgaged 4 parcels of real estate that it
acquired for $57,300, approximately an 828% loan-to-value mortgage. On said date,
First Property Development LLC had 11 unsatisfied judgments totaling $30,000.
d. On July 30, 2013, Second Property Development LLC obtained a 12-month loan from
NMSB for $475,664.79. As collateral, it mortgaged 4 parcels of real estate that it
acquired for about $50,000 and First Property Development LLC mortgaged 2 parcels
of real estate that it acquired for $17,000, approximately a 710% loan-to-value
mortgage. On said date, Second Property Development LLC had 8 unsatisfied
judgments totaling $20,000 and First Property Development LLC had 11 unsatisfied
judgments totaling $30,000.
e. On October 10, 2013, the mortgages for the July 30 loans totaling over $950,000 were
signed by Myricks, as president of NMSB, and Rashaed.
f. On October 16, 2013, Myricks was directed by NMSB’s board of directors to enter
into an agreement with the Federal Reserve Bank of Chicago to shore up lending
practices
g. On December 9, 2013, the mortgages for loans totaling over $950,000 were recorded
in the office of the Milwaukee County Register of Deeds.
h. Although the loans called for repayment in full by July 30, 2014, no satisfaction was
ever recorded.
i. NMSB lost $680,000 in 2013, suffered a $2.1 million loss in 2015 (a greater loss than
any other Wisconsin bank), and was closed by federal regulators on March 11, 2016.
j. There is probable cause to believe that the loan transactions described above constitute
loan fraud in violation of Wis. Stat. § 943.83, fraud against a financial institution in
violation of Wis. Stat. § 943.82(1), and/or bribery involving a financial institution in
violation of Wis. Stat. § 943.85.
4. Unfair Residential Rental Practices. Based on information and belief:
a. Rashaed has failed to identify to tenants or prospective tenants in writing the owner of
the real estate in violation of Wis. Adm. Code § ATCP 134.04(1).
b. Rashaed has failed to disclose to prospective tenants any known, uncorrected building
code or housing code violation that presents a significant threat to the prospective
tenant’s health or safety in violation of Wis. Adm. Code § ATCP 134.04(2)(a).
c. Rashaed has failed to disclose to prospective tenants certain conditions affecting
habitability in violation of Wis. Adm. Code § ATCP 134.04(2)(b).
d. Rashaed has failed or refused to deliver to tenants the full amount of any security
deposit, less any amounts that may be withheld, within 21 days after the tenant
lawfully vacates the premises in violation of Wis. Adm. Code § ATCP 134.06(2).
e. Rashaed has rented or advertised for rent premises that have been placarded and
condemned for human habitation in violation of Wis. Adm. Code § ATCP 134.09(1).
f. Rashaed has terminated a tenancy or gave notice preventing the automatic renewal of a
lease, or constructively evicted a tenant by any means including the termination or
substantial reduction of heat, water or electricity to the dwelling unit, in retaliation
against a tenant because the tenant reported a violation of this chapter or a building or

housing code to any governmental authority, filed suit alleging such violation, or
attempted to assert any right specifically accorded to tenants under state or local law in
violation of Wis. Adm. Code § ATCP 134.09(5).
g. Rashaed has excluded, forcibly evicted or constructively evicted a tenant from a
dwelling unit, other than by an eviction procedure specified by law in violation of Wis.
Adm. Code § ATCP 134.09(7).
h. Rashaed has misrepresented the location, characteristics, or equivalency of dwelling
units owned or offered by the landlord in violation of Wis. Adm. Code § ATCP
134.09(9)(a)1.
i. Rashaed has failed to disclose, in connection with any representation of rent amount,
the existence of any non-rent charges that will increase the total amount payable by the
tenant during tenancy in violation of Wis. Adm. Code § ATCP 134.09(9)(a)3.
j. Rashaed has misrepresented to any person, as part of a plan or scheme to rent a
dwelling unit to that person, that the person is being considered as a prospective tenant
for a different dwelling unit in violation of Wis. Adm. Code § ATCP 134.09(9)(b).
